CITY COUNCIL STAFF REPORT
February 18, 2025 {{section.number}}{{item.number}}
CONSIDERATION OF A PROFESSIONAL SERVICES AGREEMENT WITH NV5, INC. FOR

ENVIRONMENTAL COMPLIANCE SUPPORT
RECOMMENDATION:

Authorize the City Manager to execute a five-year professional services agreement with NV5, Inc. for Environmental Regulatory Compliance Support Services in an amount not to exceed $125,000 per year.

BACKGROUND:

The Public Services and Engineering Department (PS&E) operates several facilities and equipment subject to Federal, State, and County environmental regulations. These include the Public Services Yard, Permanent Household Hazardous Waste Collection Facility (PHHWCF), fuel storage and dispensing facilities, the Aquatic Center, the Marina, stationary and portable emergency generators, and off-road diesel vehicles (ORD). Compliance with these regulations is overseen by multiple agencies, including the California Air Resources Board (CARB), the San Diego Air Pollution Control District (SD APCD), and the San Diego County Department of Environmental Health & Quality (DEHQ), which serves as the region’s California Unified Program Agency (CUPA).

Since November 1, 2020, the City has utilized consultants to provide specialized environmental compliance expertise and increase staff capacity. This approach has enhanced the City’s ability to meet evolving regulatory requirements efficiently and effectively.

ANALYSIS:

To continue proactive and effective compliance with the CARB, SD APCD, and CUPA regulations, PS&E issued a Request for Qualifications/Proposals (RFQ/P) for Environmental Regulatory Compliance Support Services. The submission period closed on August 12, 2024, with two responsive proposals received.

Following evaluation of the proposals and an interview of the top-rated firm, NV5, Inc. was selected as the firm best able to meet the City’s requirements based upon the scoring methodology outlined in the solicitation. The scope of work under this contract includes one-time costs for the development of a Comprehensive Compliance Plan and Quality Assurance Program, as well as ongoing support for compliance inspections, regulatory reporting, and program management.

City staff recommends awarding a five-year contract to NV5, Inc. to ensure continuity in regulatory compliance efforts and proactive management of environmental requirements.

FISCAL IMPACT:

This professional services agreement will be funded through the Solid Waste budget unit 13030000-80030. A mid-year adjustment was requested and approved to cover anticipated contract expenses through June 30, 2025. In subsequent years, the annual costs up to $125,000, will be incorporated in the City’s annual budget planning process to ensure continued funding.

ALTERNATIVE:

City Council may choose to not award the contract and provide additional direction to staff.

CALIFORNIA ENVIRONMENTAL QUALITY ACT:

Not Applicable.
