This is a response to the many inaccuracies put forth by the Harbor Soaring Society (HSS) in their May 2, 2023 written comments submitted to City Council and comments referencing it by president of the harbor soaring society, Mr. Mat Garcia.
HSS first paragraph says that the HSS “recommends implementation of the actions City Council approved at the September 21, 2021 meeting” and “Absent any new substantive, empirical data or analyses from regulatory agencies or independent, authoritative sources, we believe it is appropriate to proceed with the City Council’s approved actions. No such information has been provided in the latest staff report.” FICTION
FACT: California Department of Wildlife (CDFW) provided their recommendation to city staff in an email dated March 20, 2023 from their Senior Environmental Specialist Supervisor stating their “SUPPORT FOR FULL CLOSURE OF THE FLYING FIELD DUE TO IMPACTS TO SENSITIVE BIOLOGICAL RESOURCES.” . This email came two years after the September 21, 2021 city council motion and is new substantive information from an authoritative source.
HSS says that model glider flyer is “recognized in the Public Use Objectives of the current Fairview Park Master Plan and indeed is included in the third defined objective of the plan:
Provide for continuation of the organized uses that have historically occurred on the site, including model railroading, model airplane, and model glider flying.(Pg. 27) The plan presents a park for passive uses, including walking, jogging, biking and quiet contemplation, and includes a model railroad, glider and kite flying, and group picnicking all offered without compromising the overall passive nature of the plan. (Pg. 28) FICTION FACT: HSS failed to provide the entire paragraph leading up to ‘Public Use Objectives’ (FPMP p. 28) Which says,”The natural setting will dominate and provide the opportunity for walking, jogging, biking, and quiet contemplation.” There are many uses proposed in the Fairview Park Master Plan that DO NOT align with this goal and the FPMP recognizes that with each successive update, proposed uses will be taken out due to their incompatibility with the natural resources. “The plans involved a range of activities gradually moving to more passive uses in each successive plan.” (FPMP p.8) Under 5. Design Objectives in the FPMP it says,” The overwhelming consensus is to continue a park for passive uses by individuals and small groups and to enhance the natural environment of the park for those uses and as a habitat preserve.” (FPMP p.25) The many uses that have been deleted in FPMP updates include a play area, dog park, botanical garden, bus turnaround, parking lot, group picnic site, and more.
HSS claims on page 2 of their comments, “The flying of glider aircraft is specifically noted as an activity “compatible with the natural habitat restoration and archaeological preservation to occur in the major portion of the site” within the Fairview Park Master Plan on several occasions. FICTION
FACT: What HSS claims is simply not there in the FPMP and that is probably why they don’t put any page numbers to reference their false information.
What is in the FPMP is,
“However, the overall policy direction for passive, natural preservation and restoration is to guide all detail development actions.” (FPMP p.28)
HSS continues in their comments to compare their flying to the model railroad use but what HSS fails to recognize is that the model railroad is providing the public with an opportunity to get close to the natural resources in Fairview Park without trampling or negatively impacting them. The railroad can only go where the tracks have been laid. The glider planes are unpredictable. There are numerous accounts of glider planes going in vernal pools, crashing and burning in sensitive habitat, threatening public safety, injuring residents, threatening police helicopters, using weed killer in sensitive areas, actually hitting birds, and much more.
Through all this, HSS likes that the city has been “lenient”. (see attached HSS Newletters zip file) HSS poses a conflict unlike the model railroad does.
HSS continues on pg. 3 of their comments to talk about Measure AA and says, “Clearly, closing the flying field is an alteration that reduces benefits to the public and changes the ‘As Built’ condition of the park. An option that includes modifications to the use, and/or movement of the field will have consequences from Measure AA, potentially including the requirement of a full vote of the public to be implemented.” FICTION
FACT: There is no ‘fly field’ in the FPMP so there is no modification or alteration to Measure AA by keeping the ‘fly field’ closed. It is a vernal pool watershed. HSS seems to know this because proposing a vote of the public wouldn’t be talked about unless HSS knew that there was no ‘fly field’ in the FPMP in the first place.
HSS comments continue to say that all recommendations by CDFW as well as the comprehensive evaluation that city staff spent over a year and a half doing should be disregarded. The verbal attacks on CDFW, and city staff not showing ‘good faith’ is not based on any evidence. HSS saying the city contracted biologist cannot be listened to because he works for the city is unreasonable and unwarranted. The community feels that city council should listen to environmental experts, city staff, city committee, and the community and NOT a small group of flyers who push for their degrading hobby and are not environmentalist experts?
The HSS president, Mr. Garcia, told city council at the May 2, 2023 city council meeting, that city staff was the only ones against flying in Fairview Park. FICTION FACT: That is simply not true and there is much evidence to support that it is not true. The city committee, the Fairview Park Steering Committee, of which Mr. Garcia is a member of, also voted against any flying in Fairview Park because not only of the environmental degradation it would cause but also because of the public safety and enforcement issues. Wouldn’t Mr.
Garcia know what the committee voted on since he is a part of it? Why would he say that only city staff was against flying in Fairview Park? Does he not have a memory? Is he intentionally spreading misinformation? What other reason could there be? The community once again feels like it has to fight to save Fairview Park since city council is disregarding reason, experts, and the community.

Dear Lori and Carol,
This post is being blasted to everyone and is so inappropriate. Would the city really want these type of bullies who put down other people who own small businesses and their accomplishments, with phrases like “shit show” and rallying individuals to show up tomorrow to the City Council Meeting to put them down verbally. If Top Seed/Ball Brothers are unhappy with the City’s decision there is a much different, mature, business approach that could have been taken.
This blast says it all on how the CM Tennis Center has been run the last 15 months. Bullying and deceit. Isn’t pickelball one of the request for the new contractor to put in place? Why is that bad? Of course fees will go up just like everything else in the world, bread and butter. No one who currently works at the Tennis Center is a Costa Mesa resident.
I just wanted to make you aware of how Top Seed and Ball Family are reacting to what I am sure has been a fair process done by the both of you and your staff. Maybe showing them a side by side on how you made your decision would be helpful.
I appreciate your time and thank you,

I have learned that the Costa Mesa City Council is considering replacing Top Seed Tennis, run by the Ball family, with Agape Tennis. Further than several of the tennis courts would be replaced with pickleball courts and the facility would
be run by Agape with a skeleton crew. This would be a travesty to the residents of Costa Mesa and to all the tennis players that use this wonderful facility. The Ball family have dramatically improved operations, quality and instruction and the aesthetics of the facility. I am also a member of the Newport Beach Tennis Club and yet I believe Costa Mesa Tennis Center is more professionally managed and more attentive to their customers (or members). The quality of the instruction both individually and in groups is second to none.
I strongly endorse making permanent the choose to retain and make permanent Top Seed Tennis and the Ball family as the high qualify management team for the Costa Mesa Tennis Center.
Respectfully,
Tony Mathews

I am writing today to express my opposition to the city handing over the operation of the tennis center to Agape tennis. I used to play tennis at Fountain valley and Costa Mesa on a regular basis, but once Agape took over Fountain valley we were unable to reserve the courts at the time and days we previously had with the city. I no longer play there nor does anyone from my group. We need someone who will be there for the players and try to accommodate our needs. Agape is not a friendly organization and if you want to reserve more than one court they charge you more. Please don’t make Costa Mesa Tennis Center another corporate nightmare. Also the whole process of picking who will run it has been very secret and we deserve the right to know why the city is making its decision and what factors it considered in that process.
Thank you for your time,
A Costa Mesa player and fan.

The Balls have created a great, inclusive environment that has been great for me from not only a physical health perspective but also a great place to connect with the community.
Awarding the contract to large, impersonal management company is a win for big business and another loss for small family run business that contribute to the community in immeasurable ways
Thank You for your consideration!

Petition to Grant Ownership of the Costa Mesa Tennis Center to the Ball Family Mayor Stephens
Costa Mesa City Council

Costa Mesa, CA
Dear Mayor Stephen’s and Members of the Costa Mesa City Council,
I am writing to strongly support granting ownership of the Costa Mesa Tennis Center to the Ball family.
With over 30 years of professional tennis experience, the Ball family brings invaluable expertise and a commitment to the sport
and the community.
The Ball family has been outstanding stewards of the tennis center, offering high‐quality lessons at accessible rates and preserving the center's integrity. Their leadership and dedication have fostered a sense of unity among tennis enthusiasts, benefiting numerous residents.
2 Replacing the Ball family with the Agape group jeopardizes the tennis center's reputation and its ability to serve the community effectively. Therefore, I urge the council to consider the Ball family's proven track record and expertise, making them the most suitable custodians for the Costa Mesa Tennis Center.
Please seriously consider
this petition and support the ownership transfer to the Ball family, ensuring the continued growth and success of tennis in our community.
Thank you for your attention to this matter.
Yours sincerely,

Subject: CM Tennis - No Agape, Please
Hello,
I have been a Fountain Valley resident for over 40 years. Having played and experienced various tennis programs around the OC region for the past 25, namely, Fountain Valley, HunƟngton Beach, Fullerton, Anaheim, Mission Viejo/Laguna Niguel, and Costa Mesa. I have gone even as far as Long Beach and Seal Beach.
Based on what I have experienced, the coaches and folks managing CM is probably the “best‐balanced”, meaning meeƟng the city’s needs as well as the community’s (players). It is not far‐fetched to say that CM, formerly run by Hank Lloyd and now with Top Seed,
conƟnues to be the most popular tennis courts of choice by the players/patrons. I have seen the downfall of the H.B. program (now by Tennis Anyone), and I used to play at Mile Square Park under the prior management there UNTIL Agape took over.
Now I do not go to Mile Square to play tennis because the courts are filthy, crawling with ants, and visible of constant debris on the courts. The reservaƟon system is a joke as no one ever answers the phone and reservaƟons are difficult to make. I was willing to drive 20 minutes farther to play at CMTC with Hank, the Ball family, Eduardo, Patrick because they know how to treat their customers.
The group of players who play at CMTC come from not just C.M. or the surrounding ciƟes within O.C. – we have players coming from as far as Rancho Cucamonga and Riverside on a weekly basis – and everyone gets along – this is a culture that no single outside operator can replicate, especially if the players start to leave because the coaches leave due to management change.
I am a lost as to why would any city government would risk losing these coaches or the players – since players FOLLOW coaches, not city or outside ownership – just because the city THINKS someone will offer a beƩer deal?
Is it about the money? Is CM City Council ready to bear the consequence of another poor decision like H.B. and F.V. just
to make a few extra bucks without considering the negaƟve impacts of losing coaches or unhappy players just to please a select few for the trendy pickleball wave? Has anyone seen how “successful” the tennis program is at H.B. and F.V. recently? Please conduct research and simply ask the players before you vote, even if you have never touched a tennis racquet.
Please keep the current management team. Lastly, there is always room for pickleball (with tape on the courts) without having to permanently convert the courts, and ulƟmately losing the loyalty and the support of your community. Feel free to contact me.
Thanks
James

Subject: Concerns Over Awarding Bid for Costa Mesa Tennis Center Management Dear Costa Mesa City Council Members,
I hope this letter finds you well. I am writing to express my deep concern over the recent awarding of the management contract for the Costa Mesa Tennis Center (CMTC) to Agape Tennis Group. This is my SECOND letter because more information has come out regarding the details surrounding the decision to award the contract which was was made exclusively by City Manager, Lori Ann Farrell, raising questions about transparency and fairness in the process.
Several talking points have been brought to light that I believe warrant serious consideration:
1. The decision appears to
have been made without adequate input from the Council, as conversations with some sitting Council members suggest that they are allowing Ms. Farrell to choose her "favorite" without providing any explanations.
2. There have been statements indicating a lack of interest in reviewing the proposals from other bidders, as the City Manager's judgment was deemed sufficient. This raises concerns about the integrity of the decision‐making process.
3. Allegations of biased comments from Ms. Farrell, such as dismissing the opinions of certain groups, are troubling and raise questions about her ethical conduct.
4. It is important to note that CMTC
currently serves a diverse population, and I worry that the decision to award the bid based on a desire for a specific cultural representation could disregard the existing inclusive atmosphere.
5. While Agape Tennis Group's marketing emphasizes creating safe spaces for all, it is essential to recognize that such claims should
not imply discrimination on the part of other contenders.
6. The decision‐making process should not devolve into a popularity contest; it must prioritize merit, qualifications, and alignment with the community's needs.
7. Claims that Agape will introduce pickleball to CMTC while implying that the McAvoy/Ball team will not, need to be
carefully assessed for accuracy. Ensuring fair representation of facts is vital in such matters.
8. I urge you, as dedicated Council members, to closely examine the decision‐making process and ensure that personal preferences do not supersede the best interests of the community. Replacing a legacy with another entity solely based
on personal preference could undermine the stability and progress of CMTC.
In conclusion, I implore you to thoroughly investigate the circumstances surrounding the awarding of the management contract and to uphold the principles of transparency, fairness, and inclusivity that our community values. By doing so, we can ensure
that CMTC continues to thrive and serve the needs of all residents.
Thank you for your time and attention to this matter.
Sincerely,
Laurie Martin

However, I do want to confirm that Agape Tennis Academy is an amazing organization and academy, and despite me living all the way in Lakewood, I have consistently gone down 2‐3 times every week to attend their clinics and classes. I definitely have tennis centers closer to me, but the community that Agape successfully builds and the care they implement at their facilities is top‐notch, and if it is pulling me 30‐50 minutes commute just to play tennis (even if there are courts 5 minutes away from me), they are clearly doing something right!
Since I do not
have personal experience with the way that Top Seed runs the tennis center, I will not touch too much on that; however, I have been to the Costa Mesa tennis center a few times and talked to people who go to both Fountain Valley and Costa Mesa, and one thing is constant, the sense of building a community through clinics, coaching, and facilities seems to bring more players back to FV than it has at Costa Mesa.
Ideally, I think every city deserves an academy like this, and I can only base any of my claims on things I have experienced,
but my local tennis academies and tennis centers are subpar from what Agape has done with Fountain Valley, and I am confident that they can do the same thing for Costa Mesa that they've done at Fountain Valley.
Again, I am a way out over in Lakewood and simply frequent the areas of Irvine and Costa Mesa quite often and really
only stop by Fountain Valley for tennis, so I believe I am unbiased in terms of cities/location, I just hope that amazing tennis centers continue to exist and am showing my support for Agape based on what I've experienced first‐hand.
Best,
Hayden Nguyen

Subject: Ball family tennis
I’m writing this email in regards to the Ball family running the Costa Mesa Tennis center:
I have been playing tennis at the center with Syd and Cameron Ball since January 2020. I had never played tennis but
wanted to try something new where I could be active and social. Over the years I’ve grown to love tennis and felt like I belonged to not only a new community of friends but a family.
The Balls have been wonderful examples of great teachers and the most genuine people I’ve ever worked with. The community center has never been run as smooth, welcoming, clean and busy as it has been since they took over.
They are always looking at new ways to bring people to the center. New tournament's, colleges and high schools practicing there, leagues, and clinics running all morning and afternoon. I have seen the Ball family work overtime to make the center a place people want to be, working 80‐100hr weeks. You will never find a more dedicated people who love what they do.
They have truly blessed me as well as the Costa Mesa community. It would be a complete shame to have them not involved in the center. So many of us would no longer have the tennis home we all love. Please do not take the Balls away from this community!

Dear City Counsel,
I am a resident of Costa Mesa. I am writing to tell you that my husband, son and myself take lessons at the Costa Mesa Tennis Center. I
am recovering from double knee replacement and I absolutely love the lessons I get from Cameron Ball. His experience is able to help me as I am getting myself back into shape after my surgeries. My son and husband also take lessons. We do because we LOVE the entire Ball family and what they offer at CMTD.
If the CMTD changes ownership we no longer take lessons there. They offer something special besides the expertise needed. They offer a community of people who come together, something the new owners will have a hard time replacing.
Thank you,
Kacey Gill

To Costa Mesa City Council and staff:
2 I have been a student and participant in the Agape Tennis & Pickleball Academy program at the Fountain Valley, CA location since the fountain Valley location opened years ago. I have nothing but positive experiences and good things to say about the Agape staff and the way they manage the program in fountain Valley (especially pickleball coach David Callihan, who moved all the way out from Georgia to teach pickleball here at Agape Fountain Valley). I have no doubt they will do a great job with the Costa Mesa location as well. I had not heard of the Fountain Valley tennis center before Agape began managing that program, as Agape did a great job of marketing their program and team and getting out the information about the courts, leagues and programs. I had not heard of the Costa Mesa tennis center until Agape announced that it was interested in managing this location as well. I believe Agape will continue to do a good job of informing the public about the Costa Mesa courts as well as the programs offered therein.
Thank you for your time,
Jeff Gillard

I have just been made aware that the City Manager of Costa Mesa, Lori Ann Farrell, is recommending Agape Tennis Center to take over the management of the Costa Mesa Tennis Center. As someone who has played at Fountain Valley
Tennis Center, I am absolutely stunned. There is nothing about the facility itself ‐ no vibrancy, no visible camaraderie ‐ that can help me understand why Ms. Farrell would opt to award the operations of our beloved Community tennis center to this national management team.
Curious, I’ve been searching online
for reasons this might have happened. I think I’ve found it: social media paints a very different picture of this Agape group. Online, they are the absolute beacon of diversity, inclusivity, love, camaraderie, leadership… I think I found every single buzzword from today’s current dictionary that exists on their account! The pictures are nice. There are lots of awards. They have a great marketing team.
In one of her posts she writes: “Only six months ago I didn’t even know Fountain Valley existed.” WHAT????
I wonder if she’s ever heard of Costa Mesa?
Here’s another good one: “Agape is creating
and maintaining a diverse, equitable, and inclusive workplace by eliminating the impact of racism and discrimination in all forms through our partnership and training. Organizations who become and remain leaders in our industry must have as a part of their business plan a central focus on managing 2 diversity through ‘Demographic Change’ that includes all people.” On this particular day, Agape was announcing that all of their staff completes “Diversity, Equity, and Inclusivity training with our friend and partner, J Lamont Harris."
Ok, so, are they being recommended because they have more checks in the DEI boxes than McAvoy/Ball Management? All I see when I’m playing at CMTC is an incredibly diverse population of players of all ages and economic backgrounds.
Would Ms. Farrell like them to complete a certification program as well? Is there one in particular that everybody’s using?
I am extremely angry. I’m really hoping that the City Council members will reject this rapacious, national tennis group in favor of the current management team of McAvoy/Ball to carry on the legacy of Hank Lloyd. They KNOW THEIR PATRONS.

Jake Halladay

Subject: Urgent Today: Costa Mesa Tennis Center
Dear Council Woman Hauser,
I am writing with concern about the future of the Costa Mesa Tennis Center. My children, and I have played tennis at CMTC for over 10 years. We have
enjoyed the family and community friendly atmosphere there.
We have come to rely on the Ball Family for advice, lessons, equipment service, scheduling, and support almost daily.
The Ball family and TopSeed Tennis have maintained and improved the Costa Mesa Tennis Center tremendously in the last 2 years. Their tireless efforts
to keep the courts clean, repaired, and even dry (after so many rainy days this past season) have made it possible for the tennis players of Costa Mesa to continue with our tennis pursuits/passion.
We have also loved the events that Top Seed and The Ball family have facilitated such as Pickleball tournaments, and
other tennis mixers with music which have drawn the community in. The location of the CMTC is a busy place where skateboarders and dog owners share the parking and park area. The presence of the Ball family and other employees at CMTC has been crucial to the safety and vigilance necessary to maintain a place where we can bring our families and feel secure.
I ask each of you to consider the value of continuing this type of hands‐on management. Top Seed Tennis and the Ball family have made the Costa Mesa Tennis Center a welcoming, beautiful place to play the tennis and pickleball we are so lucky to enjoy here in Costa Mesa.
2 With hope and prayers,
Angela Eyre

Subject: Meeting Agenda 7/18/2023 New Business: Agenda Item 1 To the members of the City Council,
I am writing to implore you NOT to follow the staff recommendation to award an operation agreement to Agape Tennis Academy for the management and operation of the Costa Mesa Tennis Center (CMTC). Please select the alternative of either awarding the operation agreement to interim operator Top Seed Tennis or starting the procurement process again.
I've been to the Fountain Valley tennis center in September of 2022 which is operated by Agape. The nets had huge holes that balls could sail through. There was no seating, no water, trash on the unswept courts including a nearly full Starbucks frappuccino that had been left there overnight, and an attendant who seemed bothered to have to do her job.
The entire place was filthy and depressing and there were people next to us playing three on three while their friends casually walked through our court with zero regard for tennis etiquette. If any vast improvements were made during the time that the FVTC was evaluated by your staff, it was only for show and will not continue.
By contrast, everyone at Top Seed (interim operator of CMTC) is friendly, helpful, and takes pride in their job.
Tennis is
the livelihood and passion of the Ball family who ARE Top Seed. They live and breathe tennis which is evident in their relationship with all their patrons and the way they have run CMTC. The courts and clubhouse are clean and well maintained. Top Seed has carried on the tradition from Hank Lloyd of making CMTC a community center where players of all ages from Costa Mesa and numerous surrounding cities gather to play tennis and nurture talents and friendships at an affordable price. In fact, CMTC charges less than FVTC but any patron of CMTC would gladly pay more. The fitness, fun, and camaraderie gained at CMTC is priceless. Has your staff actually visited both places and spoken to employees and patrons?
One story I will share is of how patrons go out of their way to help staff at Top Seed. There are many but one I know of is how a private college advisor who plays at CMTC is helping a Top Seed tennis pro's daughter, who is a tennis player, navigate the college application process as an athlete. This marrying of resources with those in need are made regularly within this very close community. My husband and I also hope to help young tennis players at CMTC whose parents are English language learners gain accessibility to college application resources.
Top Seed is willing to add four pickleball courts but adding a large number would infringe on surrounding neighborhoods with unbearable noise, increased traffic and parking issues, plus disruption to patrons of the dog and skate parks.
Pickleball is barely a sport. In the scheme of racquet sports and the athleticism required, I'd rank it at the very bottom with minimal exercise actually achieved in a match.
CMTC will lose almost all of its current tennis patrons as the consensus is to find other places to play tennis if Agape is awarded the operation agreement.
I've played at CMTC off and on for the past 15 years and am currently a tennis member of The Huntington Club. I much prefer the more relaxed and friendly environment of CMTC in its current state to even THC.
I would like to understand specifically why the staff is recommending Agape. Can the proposals be made available to the public? My husband has run procurement departments at Kaiser Permanente, Disney, Sony, and is currently at Adobe and would love to see the
details of the proposals, evaluations, and scores.
2 Additionally, a polished proposal, active social media accounts, and the promise of increased revenue (that will potentially harm the city and its citizens) are all smoke and mirrors. The CMTC is expertly managed with care and love by Top Seed Tennis as witnessed by their numerous and vocal supporters. The City Council goal of "Strengthen the Public’s Safety and Improve the Quality of Life" will not be met if Agape becomes the CMTC operator.

2 I highly recommend Agape Tennis and Pickleball academy to manage the pickleball program in the city of Costa Mesa.
They have done a great job at the Fountain Valley Tennis center, providing more courts for playing, starting leagues/lessons, hiring great staff members and expanding the pickleball program in the City of Fountain Valley. Most of the staff there play pickleball in different areas, and they know that there are many people in the communities who want to play and that we need more courts and programs in Orange County. In case you haven’t heard, Pickleball is the fastest growing sport in the US, and it can generate a lot of money for your city.
