AUTHORIZATION FOR THE PURCHASE OF CELLEBRITE INC. MOBILE DEVICE FORENSIC

EXTRACTION SOLUTION WITH CARAHSOFT TECHNOLOGY CORPORATION DEPARTMENT: POLICE DEPARTMENT
PRESENTED BY: SCOTT STAFFORD, LIEUTENANT
CONTACT INFORMATION: SCOTT STAFFORD, (714) 754-5675
RECOMMENDATION:

Staff recommends the City Council:

1. Authorize the use of OMNIA Partners’ Cooperative Agreement No. R191902 with Carahsoft Technology Corporation for the purchase of Cellebrite Inc. mobile device forensic extraction solution.

2. Authorize the purchase of Cellebrite Inc. mobile device forensic extraction solution under the awarded Organized Retail Theft Prevention (ORT) Grant through OMNIA Partners’Cooperative Agreement No. R191902 with Carahsoft Technology Corporation in the amount of $128,760.27.

BACKGROUND:

The Costa Mesa Police Department (CMPD) seeks to appropriate funds from the State of California Board of State and Community Corrections (BSCC) from the Organized Retail Theft Prevention (ORT) Grant for the purchase of Cellebrite Inc. mobile device forensic extraction solution.

Cellebrite Inc. provides a universal forensic extraction device (UFED) solution for extracting, decoding, and analyzing data from mobile devices (i.e., smartphones, cell phones, tablets, GPS units, SIM cards, memory cards, drones, and USB devices), including live and deleted data, contacts, phone numbers, call logs, text messages, SMS messages, app data (social network and other), location data, pictures, videos, and voice messages. UFED technology provides digital forensic investigators with the capability to collect, protect, and act decisively on mobile device data for criminal investigations.

ANALYSIS:

The proposed purchase through the Omnia Partners’ Cooperative Agreement No. R191902 with Carahsoft Technology Corporation is necessary to comply with reporting requirements set forth under the awarded $3.5 million ORT Grant. The purchase of Cellebrite Inc. mobile device forensic extraction solution through the ORT Grant will allow the CMPD to focus its efforts on prevention, apprehension, collaboration, and enhanced law enforcement efforts. Cellebrite Inc. offers significant

apprehension, collaboration, and enhanced law enforcement efforts. Cellebrite Inc. offers significant functionality in investigative resources and crime analytics.

The cooperative agreement meets all requirements set forth by the City of Costa Mesa’sMunicipal Code and all the requirements set forth by the State of California regarding regional, state, and national cooperative purchasing agreements. Omnia Partners has established an approved vendor list following a nationwide competitive bid process which includes Carahsoft Technology Corporation.

This process confirms the City still receives the lowest available pricing and meets the competitive bid process requirements.

Cellebrite Inc. has articulated its commitment and enthusiasm to work with the CMPD to ensure we are equipped and trained to forensically download and analyze electronic mobile device data. The CMPD will be able to use this technology to reduce crime and address community issues.

ALTERNATIVES:

The City Council may elect not to move forward with the purchase through OMNIA Partners Cooperative Agreement with Carahsoft Technology Corporation; however, this alternative is not recommended as the primary goal of the awarded ORT Grant is to increase directed enforcement and investigative capabilities to reduce retail theft in the community.

FISCAL REVIEW:

There are sufficient appropriations for technology under the awarded $3.5 million ORT Grant to fund this purchase over a three-year period. This purchase will not impact the General Fund.

LEGAL REVIEW:

The City Attorney’s Office has reviewed this agenda report and approved it as to form.

CITY COUNCIL GOALS AND PRIORITIES:

This item supports the following City Council Goal:
· Strengthen the public’s safety and improve the quality of life.

CONCLUSION:

Staff recommends the City Council:

1. Authorize the use of OMNIA Partners’ Cooperative Agreement No. R191902 with Carahsoft Technology Corporation for the purchase of Cellebrite Inc. mobile device forensic extraction solution.

2. Authorize the purchase of Cellebrite Inc. mobile device forensic extraction solution under the awarded Organized Retail Theft Prevention (ORT Grant through OMNIA Partners’Cooperative Agreement No. R191902 with Carahsoft Technology Corporation in the amount of $128,760.27.

DEPARTMENT: INFORMATION TECHNOLOGY
PRESENTED BY: STEVE ELY, DIRECTOR
CONTACT INFORMATION: STEVE ELY, DIRECTOR, (714) 754-4891 RECOMMENDATION:

Staff recommends the City Council:

1. Authorize the City Manager and City Clerk to execute a Professional Services Agreement (PSA) for cable and camera installation to NetXperts, LLC, 1777 Botelho Drive, Suite 102, Walnut Creek, CA 94596, in the amount of $794,014.

2. Authorize a five percent (5%) contingency in the amount of $39,701 for unforeseen costs.

3. Authorize the City Manager or designee to execute the agreement and future amendments to the agreement.

BACKGROUND:

At the March 3, 2020, City Council Meeting, City Council approved the Information Technology Strategic Plan. The Strategic Plan, Year Four, included upgrading the outdated telephone system to a Voice Over Internet Protocol (VoIP) system. In early 2023, the Information Technology Department began researching the project. It was determined the current Category 5 cabling throughout City Hall and all remote sites was outdated and 20 years old. It would need to be upgraded to Category 6A specifications (CAT6A) in order to support VoIP and other modern technology. Given all the other investments in technology, the City needs greater capacity - 1 gig to 10 gigs.

The Police Department’snew camera system also requires CAT6A cabling. The new camera system consists of seventy (70) cameras in and around the police station and the communications building.

This project includes installation of a complete end-to-end certified system for transmission of voice, data, and video signals. The system will be designed, installed, and tested to the proposed CAT6A specifications. It also includes replacing obsolete CAT5 infrastructure, establishing new and enhancing existing cable pathways, installation and termination of cabling at identified drop locations, labeling map, certification testing, and removal and demolition of pre-existing network cable and patch panels post-migration. A written commitment to warranty of work for a 10-year minimum was

patch panels post-migration. A written commitment to warranty of work for a 10-year minimum was required, and the contractor is to be on-site for continuous days until work is completed.

ANALYSIS:

On October 12, 2023, Purchasing issued Request for Proposal #24-03 (Attachment 1) on the City’s bid portal. A mandatory pre-proposal conference was held on October 19, 2023, and the bid was closed on November 3, 2023. The submittals were reviewed by the IT Manager and IT Staff. Staff recommends NetXperts.

NetXperts, LLC submitted a bid proposal in the amount of $794,014. The licenses and references of NetXperts have been checked and staff has found them to be in good standing.

Upon City Council award of the Professional Services Agreement (PSA), NetXperts will furnish the necessary bonds and insurance, which will be approved as to form by Risk Management. The PSA will be drafted by the City Attorney’soffice after City Council award and executed thereafter. Upon the award and subsequent execution of the agreement, a “Notice to Proceed” will be issued.

City Council authorization for a contingency in the amount of $39,701 for unforeseen costs is also requested. The vendor submittal is included (Attachment 2).

In addition, this award will be written so the City can continue to use the RFP vendor selected for the next three years, with two one-year extensions for all Verkada camera installations and new cabling needs.

The following locations will receive new CAT6A cabling:

4. Evaluation of Proposals and Selection Process: In accordance with its Municipal Code, the City will adhere to the following procedures in evaluating Proposals. An Evaluation Committee, which may include members of the City's staff and possibly one or more outside experts, will screen and review all Proposals according to the weighted criteria set forth above.

While price is one basic factor for award, it is not the sole consideration.

A. Responsiveness Screening : Proposals will first be screened to ensure responsiveness to the RFP. The City may reject as non-responsive any Proposal that does not include the documents required to be submitted by this RFP. At any time during the evaluation process, the City reserves the right to request clarifications or additional information from any or all Proposers regarding their Proposals.

The Committee may also contact Proposer's references. Proposals that receive the highest evaluation scores may be invited to the next stage of the evaluation process. The City may reject any Proposal in which a Proposer’s approach, qualifications, or price is not considered acceptable by the City. An unacceptable Proposal is one that would have to be substantially rewritten to make it acceptable. The City may conclude the evaluation process at this point and recommend award to the lowest responsible bidder. Alternatively, the City may elect to negotiate directly with one or more Proposers to obtain the best result for the City prior to making a recommendation or selection.

C. Interviews, Reference Checks, Revised Proposals, Discussions: Following the initial screening and review of Proposals, the Proposers included in this stage of the evaluation process may be invited to participate in an oral interview. Interviews, if held, are tentatively scheduled for the week of November 15-17 2023 and will be conducted at City of Costa Mesa City Hall, 77 Fair Drive, Costa Mesa, CA 92628. This date is subject to change. The individual(s) from Proposer's organization that will be directly responsible for carrying out the contract, if awarded, should be present at the oral interview. The oral interview may, but is not required to, use a written question/answer format for the purpose of clarifying the intent of any portions of the Proposal.

In addition to conducting an oral interview, the City may during this stage of the evaluation process also contact and evaluate the Proposer’s references, contact any Proposer to clarify any response or request revised or additional informat ion, contact any current users of a Proposer’s services, solicit information from any available source concerning any aspect of a Proposal, and seek and review any other information deemed pertinent to the evaluation process.

Following conclusion of this stage of the evaluation process, the Committee will again rank all Proposers according to the evaluation criteria set forth above. The Committee may conclude the evaluation process at this point, and make a recommendation for award, or it may request Best and Final Offers from Proposers. The City may accept the Proposal or negotiate the terms and conditions of the agreement with the highest ranked organization. The City may recommend award without Best and Final Offers, so Proposers should include their best Proposal with their initial submission. 165

Page 10 of 45 ends

5 Background & Project Summary

NETXPERTS
Understanding of the City’s Requirements
NetXperts understands that the City of Costa Mesa seeks to upgrade its current network infrastructure to a robust and scalable solution. Our approach is to replace the obsolete CAT5 with advanced CAT6A Infrastructure across all sites, ensuring high-speed, reliable data, voice, and video signal transmission. We recognize the importance of minimizing disruptions to City operations, hence we will adhere strictly to the specified work hours and make efficient use of time to complete the project expediently.

Work to be Done
Our work will encompass the installation of a complete end-to-end certified system, including 24 or 48-port Category-6A TrendNet patch panels, TrendNet Keystone Jack systems, and CommScope equivalent cabling solutions. We will also install PoE cameras and Samsung TV monitors, requiring direct RJ45 connections. Our team is ready to establish new and enhance existing pathways for cabling, ensuring a clean, organized, and serviceable infrastructure.

Objectives to be Accomplished
The primary objectives include:
● Ensuring all cabling is Category-6A, plenum -rated, and tested to ANSI/TIA/EIA- 568-B.1 standards with a Fluke Networks DTX-1800 tester or better. ● Maintaining compliance with the maximum pulling tensions and proper cable bend radii.
● Delivering detailed CAD and PDF as-built floor plans with accurate drop locations upon completion.
● Providing a comprehensive labeling system for all network drops, ensuring easy identification and maintenance.
● Securing the installation with a 10-year minimum warranty covering components and labor.

NetXperts will provide all necessary patch cables, manage cable support systems, and adhere to all cabling guidelines and installation best practices. We will not only meet the technical specifications laid out but also aim to exceed expectations in service delivery and system performance. We appreciate the opportunity to serve the City of Costa Mesa and look forward to discussing our proposal in further detail.

6 Method of Approach

NETXPERTS

Implementation Plan:
● Project Management Controls: NetXperts will use a phased approach, dividing the project into manageable stages, each with its own controls and review points. We'll employ project management software to monitor progress, resources, and budget in real-time.

Controls will include risk management plans, regular status reporting, and quality assurance checks, which will be conducted to review progress against the schedule, budget tracking, risk management, and change control processes. ■ A Project Steering Committee will be formed, including key NetXperts and City staff, to oversee project progress and make critical decisions. ● Stakeholder Engagement: Our methodology includes initial stakeholder meetings to understand all requirements and expectations thoroughly. Regular updates and review sessions will be scheduled to gather feedback and ensure alignment. We'll use surveys, interviews, focus groups, and workshops to document the views of both internal and external stakeholders.
● Implementation Strategies: NetXperts will implement agile project management techniques, allowing for flexibility and iterative progress based on stakeholder feedback.

We will employ Lean methodologies to optimize efficiency and reduce waste throughout the project lifecycle.
■ Agile principles will be incorporated to allow flexibility in project execution and to adapt to changing requirements or unexpected challenges. ■ Quality management will involve regular peer reviews and audits to ensure adherence to industry best practices and RFP requirements.

Client Satisfaction and Scope of Work Compliance:
● NetXperts commits to regular client engagement through a dedicated project manager who will be the point of contact for the City. We will conduct a thorough initial site assessment to understand the existing infrastructure and align with the City's vision, walkthroughs, progress reviews, and system testing to ensure client satisfaction. Our efforts include adherence to the specified components, rigorous testing, cabling guidelines, and detailed documentation of all installations, ensuring all installations are to the highest quality standards.
■ Your dedicated Project Manager to serve as the City's primary contact will be Zach Baldry.
■ Client satisfaction will be measured through regular check-ins and a formal review process at project milestones.

Project Schedule:
● We will provide a Gantt chart detailing all tasks, such as site assessment, procurement, installation, testing, documentation, and handover. Each task will be assigned a duration 207

7 and resources, with milestones for major deliverables. The overall timeline will be established in agreement with the City to ensure timely completion without compromising the daily operations of the City.
■ The project will be broken down into phases: Planning, Design, Procurement, Installation, Testing, Documentation, and Closure.
■ Each phase will have clearly defined tasks, durations, and responsible parties. ● For example, the Installation phase will include specific tasks such as "Install CAT6A cables in City Hall" with a duration of 10 days. ■ Please reference the Plan of Execution on page 8.

City Staff Collaboration:
● Specific tasks from City staff will include providing existing infrastructure information, facilitating access to sites, and participating in validation of the installation. City staff will also be involved in the approval process of the as-built documentation. NetXperts staff will be responsible for the execution of the project, with City staff providing oversight and feedback.
■ City staff will be integral during the planning phase to provide insights into the current challenges and future needs.

Innovative and Creative Approaches:
● NetXperts proposes the use of advanced cable management systems that not only organize cables but also simplify future maintenance. We will explore the use of environmentally friendly materials and processes. Innovative labeling solutions such as RFID tags could be employed for easy identification and management of the network infrastructure.
■ NetXperts proposes the use of biodegradable materials for all non-permanent installations to support environmental sustainability.

Recruitment and Retention of Former City Employees:
● If selected, NetXperts will reach out to displaced former employees of the City for potential recruitment. Our human resources policies will include proactive recruitment strategies, fair hiring practices, and competitive benefits to retain such individuals. We will also offer training and development programs to ensure that these employees can thrive in their new roles with NetXperts.

NetXperts is committed to delivering a high-quality project that meets all the City's requirements while ensuring efficiency, safety, and superior performance. We look forward to the possibility of working with the City of Costa Mesa and contributing to its technological advancement.

8 Plan of Execution

NETXPERTS

It is our plan to conduct this installation with a total of (4) installers and (1) site Foreman. It will be the role of installers to install all Cat6A cable to specified locations, Pathway, rack build out of patch panels and wire managers, along with testing, termination, and labeling of all locations. The role of the site foreman will be to coordinate work areas with the customer and crew of installers to ensure as minor impact as possible during business hours. Site foreman will also be responsible for documenting all new Pathway and existing pathway used to bring cable from IDF/MDF to its final location. Site foreman will coordinate with customers for staging of material as well as inventory of material to site to ensure all material is available that is needed for each day. The Site Foreman will be responsible for documenting and communicating all progress or delays onsite and troubleshooting any issues that may occur during installation. Site foreman will be on site daily with crew to ensure all aspects of install are to schematic and execution of timeline is adhered to. Crew and foreman will be onsite each day at expected start time and will work a full 8-hour day onsite. Site foreman will complete a daily site report at the end of each day to document progress of each day. Work will be started and completed in a uniform manner starting and completing each work location before moving on to the next with the exception of being relocated by the customer.

Execution of work is as follows:

City Hall: City Hall will be executed in a total of 50 workdays 10 days per floor. File #: 24-067 Meeting Date: 3/5/2024
TITLE:

RESOLUTION AUTHORIZING STREET CLOSURES FOR THE 2024 ORANGE COUNTY

MARATHON RUNNING FESTIVAL
DEPARTMENT: PUBLIC WORKS DEPARTMENT / TRANSPORTATION SERVICES DIVISION PRESENTED BY: RAJA SETHURAMAN, PUBLIC WORKS DIRECTOR
CONTACT INFORMATION: JENNIFER ROSALES, TRANSPORTATION SERVICES MANAGER (714) 754-5343
RECOMMENDATION:

Staff recommends the City Council:

Adopt Resolution No. 2024-xx (Attachment 1), designating event routes for the 2024 Orange County (OC) Marathon Running Festival and approving the temporary street closures for May 4, 2024 and May 5, 2024, as requested for the 2024 OC Marathon Running Festival.

BACKGROUND:

A Special Event Permit application was submitted to the City on December 12, 2023, requesting permission to close certain streets to conduct the 2024 OC Marathon Running Festival. The application is currently under review by the City’s Special Event Committee, which consists of representatives from various City departments.

This is the fifteenth year the City of Costa Mesa will participate in the OC Marathon, which has been an annual event in the Orange County area since 2004. Similar to the previous marathons, the proposed route for the 2024 OC Marathon Running Festival begins at Fashion Island in the City of Newport Beach and finishes at the Orange County Fair and Event Center in Costa Mesa. This year’s OC Marathon Running Festival consists of four (4) sub-events:

1. Full Marathon (26.2 miles) on Sunday, May 5, 2024

2. Half Marathon (13.1 miles) on Sunday, May 5, 2024

3. 5K Fun Run/Walk (3.1 miles) on Saturday, May 4, 2024

4. Kids Run the OC (1 mile) on Saturday, May 4, 2024
The routes within Costa Mesa for the 2024 full and half-marathon events are shown on Attachments 3 and 4, respectively. A map depicting the route for the 2024 5K Fun Run/Walk is shown on Attachment 5. The route for the Kids Run is entirely within the OC Fair & Event Center and is shown on Attachment 6. There are no changes to the proposed routes on public streets for the above events

from the 2023 OC Marathon Running Festival.

Within Costa Mesa, the streets affected by the Full Marathon include portions of Santa Ana Avenue, Bristol Street, Red Hill Avenue, Main Street, Sunflower Avenue, Anton Boulevard, Avenue of the Arts, Bear Street, Gisler Avenue, Country Club Drive, Mesa Verde Drive West, Adams Avenue, Placentia Avenue, Oriole Drive, Canary Drive, Tanager Drive, Golf Course Drive, Harbor Boulevard, Merrimac Way, and Fairview Road. The streets affected by the Half Marathon include portions of Santa Ana Avenue, Mesa Drive, and Newport Boulevard Southbound Frontage Road. The affected streets for the 5K Fun Run/Walk are Arlington Drive, Fairview Road, and Merrimac Way.

The Half Marathon event is proposed to start in the City of Newport Beach at 6:30 a.m. For the Half Marathon event, street closures in Costa Mesa begin at 5:00 a.m. and the last affected road segments reopen no later than 10:00 a.m.

The 5K Fun Run/Walk event will begin and end at the Orange County Fair and Event Center. For the 5K Fun Run/Walk, street closures will begin at 4:30 p.m. on Saturday and the last affected road segment will reopen no later than 6:30 p.m.

The 1 mile Kids Run is entirely within the OC Fair & Event Center, and no street closures are required for the Kids Run event.

Since the proposed routes for the Full Marathon, Half-Marathon, and 5K Fun Run/Walk events are not among the pre-designated routes for street closures for Special Event areas as approved in City Council Resolution No. 04-38 (Attachment 7), City Council approval is required for these street closures.

ANALYSIS:

Prior years’marathon events have enjoyed success due to the efforts of organizers, as well as City staff. Similar to prior Marathon events, the organizers will be required to conduct an extensive outreach to churches and businesses that are open during the time of the street closures and detours. In addition, residential areas affected by closures will be notified in advance.

On the weekend of the 2023 OC Marathon, police management personnel, sworn officers, civilian officers, and explorers (from Costa Mesa and other agencies) provided support for the events. The Fire Department had personnel stationed at the Emergency Medical Services (EMS) tent for the event. As a result of the close coordination between various City departments and event organizers, and the implementation of traffic control, impacts on many residential and commercial areas as well as arterial streets have been minimized.

Street Closures:

A number of minor and major arterial streets will require full closure, while some other streets will require either half-closure (one direction), or partial closure (only the closure of one or two lanes in one direction). In order to minimize impacts to the public, the closure of streets will be phased to occur as the fastest runners approach, and will be reopened as the last of the runners and the official sweep vehicle passes by. The fastest marathon runners are expected to finish in approximately two (2) hours and 20 minutes. The overall length of time for the slowest runners of the marathon with traffic control will be limited to a maximum of seven (7) hours. The marathon begins at 5:30 a.m., therefore, the last runner permitted on the course with traffic control would finish no later than 12:30 p.m. A sweep vehicle will circulate through the course in time with the slowest paced runner to

Page 2 of 5 ends

235
File #: 24-067 Meeting Date: 3/5/2024
p.m. A sweep vehicle will circulate through the course in time with the slowest paced runner to ensure the course is clear and that streets can be reopened as soon as possible.

Attachment 8 presents a brief summary of the arterials affected by the proposed Full Marathon, Half- Marathon, and 5K Fun Run/Walk routes through Costa Mesa. The Mesa Verde Community, Inc.

Board and the Mesa Verde Country Club will be notified of the event and the street closures.

Additional information to assist the patrons of the Mesa Verde Country Club and navigate the proposed closures will be provided to the Mesa Verde Country Club as the event date approaches.

Impacts to traffic flow will occur at various intersections as marathon participants move along the route, beginning as early as 6:30 a.m. and ending at approximately 1:00 p.m. Attachment 9 identifies the major intersections where traffic detours are necessary to provide for the safety of runners while crossing intersections. As shown in the attachment, traffic control on Harbor Boulevard and Fairview Road will be conducted as “soft closures,” whereby vehicles will be allowed through as gaps in runners permit. Adams Avenue will be subject to full closure for approximately two (2) hours followed by soft closures for up to four (4) hours. Advance warning signs will be positioned to advise drivers of possible delays during this time. Traffic control will be actively managed by Costa Mesa Police Officers, allowing traffic to pass through the closed area as much as possible. With the proposed closure of the Adams Avenue at Placentia Avenue/Mesa Verde Drive West intersection, there will be coordination with City of Huntington Beach staff for the placement of advance warning signs within their City limits to minimize congestion and delays.

Staff has also reviewed planned street improvement projects within the City for any conflicts with the 2024 (Full Marathon) and 2024 (Half Marathon & 5K) OC Marathon Running Festivals and confirms that no projects are scheduled on streets that would impact the proposed route for this event. Close monitoring of project schedules will continue as the date of the marathon approaches.

Traffic Control:

The OC Marathon Running Festival representatives estimate up to 12,000 participants and approximately 1,000 spectators along the 26-mile route. Due to the large scale of the event and magnitude of street closures, lane closures, and detours, the Transportation Services Division will require that the applicant be responsible for the preparation and submittal of detailed traffic control plans prepared by a Registered Traffic Engineer. Additionally, the applicant will be responsible for furnishing all traffic control devices such as cones, signs, and barricades required for the event. The overall traffic control at intersections and driveways will be directed by Costa Mesa Police Department Officers and Explorers.

The Police Department will staff this event similarly to prior years’events making any necessary adjustments based on actual field conditions. Since the OC Marathon is being held on a Sunday, it will not affect weekday peak rush-hour traffic. Therefore, during the hours in which the event occurs in Costa Mesa, it is expected to have a lesser impact on traffic flow. With traffic control at all locations monitored and managed by the City’s Police Department, emergency access to all properties is assured at all times. Fire Department personnel on the Special Event Committee are involved in reviewing the Special Event Permit application and will include any necessary conditions and implement appropriate measures to ensure emergency response is not adversely affected.

Page 3 of 5 ends

236
File #: 24-067 Meeting Date: 3/5/2024
Public Information:

The applicant will be conditioned to provide written notification prior to the event to all property owners and tenants affected by the street closures. Some samples of correspondence are included in the proposed 2024 OC Marathon Operations Plan (Attachment 2). The applicant is engaged in discussion with the Orange County Fair and Event Center, for approval to utilize the property for the event and based on those discussions, anticipates their approval.

Similar to prior years, staff will work with the applicant to identify and be certain that all properties directly affected by the event receive adequate notice of the time and period of closure, as well as proper detour information. Additionally, as part of the traffic control requirements, the Public Works Department staff will require the placement of changeable message signs at key locations in advance of the event to give adequate notice of the planned street closures.

OC Market Place:

In previous years, the traffic restrictions on Fairview Road, southbound Newport Boulevard Frontage Road, and Harbor Boulevard created long delays for visitors to the OC Market Place. The OC Fair and Event Center cancelled the OC Market Place on Sunday of the prior OC Marathon events. This eliminated a major traffic issue that was experienced by the OC Market Place vendors and visitors alike.

For the 2024 OC Marathon event also, the OC Market Place is expected to be closed for the entire weekend. The cancellation of the OC Market Place for the 2024 event will reduce the amount of traffic on those roadways and will result in significantly fewer impacts. Parking for the OC Marathon event will be improved due to the cancellation of the OC Market Place.

Areas of Improvement:

The following are some of the observations and areas for improvement identified for earlier OC Marathon events and continue to apply for the 2024 OC Marathon Running Festival:
· Event start times should be maintained as close to schedule as possible. · Field-review all water stations and band locations, particularly near residential areas. · No music or loud noises near residential areas before 8:00 a.m. · Address traffic issues related to vehicles exiting the Fairgrounds parking lot and on Fair Drive. · Improve course signage for all events.

ALTERNATIVES:

The City Council may elect not to approve the requested route as submitted and direct the applicant to revise the route to use other streets. This alternative, however, would not be preferred by the organization as it will have significant impacts on the planned event.

Another alternative would be to not approve the resolution and the requested street closures. This may result in the cancellation of the 2024 OC Marathon Running Festival.

Page 4 of 5 ends

237
File #: 24-067 Meeting Date: 3/5/2024
FISCAL REVIEW:

The applicant will reimburse the City for the cost of Police and Fire support during the event per the Special Event Permit application.

LEGAL REVIEW:

As part of the Special Event Permit application, the applicant will be required to provide the City with indemnity and insurance per the City’srequirements. The City Attorney’sOffice has reviewed this report and the proposed Resolution (Attachment 1) and approves them both as to form.

CITY COUNCIL GOALS AND PRIORITIES:

This item supports the following City Council Goal:
· Strengthen the Public’s Safety and Improve the Quality of Life CONCLUSION:

A Special Event Permit application has been submitted to the City requesting closure of certain streets on May 4, 2024 and May 5, 2024, to conduct the 2024 OC Marathon Running Festival. Staff requests City Council’s approval to close the identified streets for this event. In addition, staff requests adoption of the Resolution, designating the event routes in compliance with Costa Mesa Municipal Code, Section 9-208.9.
