Subject: FY22/23 SB 1 List of Projects as required by the Road Repair and Accountability Act of 2017
Date: May 24, 2022
Written by: Craig Scott, Director of Public Works/City Engineer Recommendation
It is recommended the City Council of the City of Cotati adopt a resolution adopting a list of projects for Fiscal Year 2022-23 funded by SB 1: the Road Repair and Accountability Act of 2017
Background
In August 2017, the California Transportation Commission (CTC) adopted the final FY 2017-18 Road Repair and Accountability Act of 2017 (SB1). The passage of SB1 established a Road Maintenance and Rehabilitation Account (RMRA) that requires local agencies to demonstrate that a project, funded by SB1, has been approved and described in adequate detail in a City resolution by July 1st. The RMRA funds have been provided to cities on a monthly basis starting January 2018.
Analysis/Discussion
To be eligible for funding, the City must provide a City resolution to the CTC by July 1, 2022, of a list of projects planned to be funded with RMRA funds. This is an ongoing annual requirement for the City to remain eligible for the funds. The approved project list must include four statutorilyrequired elements for each project:
1. Location
2. Description
3. Estimated useful life
4. Anticipated construction date.
The City’s 2021 Pavement Management Plan (PMP) lists all City streets with their condition and generally associated pavement rehabilitation method. The PMP guides the City’s street preservation efforts and informed the 2023 Street Preservation Project (Project). A figure showing the extents of the project is attached to the resolution. The pavement condition has been determined for this area and recommended treatment method(s)s provided to the City. The FY 22/23 estimated SB 1 funding can provide for pavement treatments for approximately 3,979 centerline feet of the following streets within the 2023 Street Preservation Project: McGinnis Circle, Ross Street, Park Avenue, Jorgensen Street, and Forno Way. The pavement preservation is to consist of dig outs, crack sealing and slurry seal. These treatments have a useful life of approximately 6 years. The 2023 Street Preservation Project is anticipated to begin in August 2022 and extend through October 2022.
Financial Considerations
SB1 requires that RMRA funds not replace local funding sources, including General Fund, gas tax, and Measure M, and the City must maintain a “Maintenance of Effort” (in other words a certain level of funding to repair local roads) as if SB1 funds were not available. The Maintenance of Effort is defined by SB1 and is derived from the annual State Controller’s Report.
The California Transportation Commission (CTC) has prepared guidelines for agencies to follow in meeting the SB1 requirements. The guidelines establish May 1, of each as the deadline for agencies to submit the project resolutions. Due to Covid 19, the deadline has been extended to July 1, for 2022. The estimated SB1 amount for the City of Cotati for FY22/23 is $135,000, which is being incorporated into the City’s draft FY 22/23 budget and accounted for separately from other local funds being used for street preservation projects.
Environmental Issues
This action is exempt from the California Environmental Quality Act (CEQA) because this action is not a project which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, pursuant to CEQA Guideline section 15378. The appropriate CEQA analysis will be conducted as part of the design development for the named project.
