RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COTATI AWARDING
THE CONSTRUCTION CONTRACT FOR THE POCKET PARK AND LAGUNA TRAIL PATHWAYS IMPROVEMENTS PROJECT TO US ENGINEERING, INC. AND
AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONSTRUCTION
CONTRACT AND CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES
AGREEMENT, INCLUDING ANY NEEDED CHANGE ORDERS AND
AMENDMENTS, UP TO THE AUTHORIZED PROJECT BUDGET AMOUNT
WHEREAS, the City’s Fiscal Year 2021/22 Annual Budget includes projects to improvement Pocket Park and the existing pathways extending from McGinnis Court to Marsh Way and to the bridge across the Laguna De Santa Rosa; and WHEREAS, on November 9, 2021, the City Council approved design contracts for these projects and the designs have been completed and the projects advertised to bid; and WHEREAS, upon award of the construction contract, the improvements are to be constructed with completion expected in early August; and WHEREAS, on May 4th, 2022, the City received and opened four bids for the subject project and the low bid is from US Engineering, Inc for a not to exceed amount of $163,760 which is 3.5 percent below the engineer’s estimate; and
WHEREAS, the bid from US Engineering, Inc has been reviewed by City staff and has been determined to be responsive and is recommended for award; and WHEREAS, Moe Engineering has provided design services for these projects and has been requested to provide Construction Management and Inspection services during construction, and Moe Engineering has submitted a proposal for the requested services and City staff has reviewed it and determined it to be fair and reasonable; and WHEREAS, the City’s adopted Fiscal Year 21/22 Annual Budget includes $74,000 for design and construction of the Loretto and Marsh to McGinnis Pathway Resurfacing Project and $50,000 for the Pocket Park Improvements Project (subsequently combined and referred to as the “Pocket Park and Laguna Trail Pathways Improvements Project (Project)”); and WHEREAS, the total Project cost for both of these efforts, including design through construction plus contingency, is projected to be $216,300, therefore, a budget appropriation of unappropriated general funds for an amount of $92,300 is requested.
WHEREAS, the Project is categorically exempt under CEQA Section 15301 Existing Facilities, part (c) and Section 15303 because the Project is a minor alteration of a public street that involves negligible or no expansion of an existing use.
NOW THEREFORE LET IT BE RESOLVED by the Council of the City of Cotati that:
1. All of the above recitals are true and correct and incorporated herein by reference; and
2. The construction contract for the Pocket Park and Laguna Trail Pathways Improvements Project (Project) is awarded to US Engineering, Inc. for an amount not to exceed $163,760.00; and
3. The Construction Management and Inspection Agreement with Moe Engineering, Inc. is approved; and
4. A budget appropriation is approved in the amount of $92,300 for a total revised Project budget of $216,326; and
5. The City Manager (or designee) is authorized to execute the construction contract for the Project, the construction management and inspection agreement and any needed change orders, amendments and miscellaneous Project expenses up to the Project’s budgeted amount of $216,326.
IT IS HEREBY CERTIFIED that the foregoing resolution was duly adopted at a regular meeting of the City Council of the City of Cotati held on the May 24th, 2022, by the following vote, to wit:
