RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COTATI AUTHORIZING
THE CITY MANAGER TO EXECUTE AN AGREEMENT FOR INSTALLATION OF A
NEW PUBLIC RESTROOM AT KOTATE PARK
WHEREAS, after public review and approval of the Parks Capital Plan, in 2020 the City of Cotati selected Kotate Park to begin the City-wide park upgrades and improvements; and WHEREAS, after additional public workshops to refine the concept design for Kotate Park, the City completed the design of the construction drawings for the Kotate Park Revitalization Project, including the addition of a new public restroom; and WHEREAS, the City put the restroom out to bid separately from the general park improvements and received bids from the Public Restroom Company and Romtec; and WHEREAS, it is advantageous to the City to separately bid and award the restroom, to ensure greater control of the final product, expedite this long lead time item to coincide with general park improvements and avoid associated general contractor markups.
WHEREAS, City Staff has reviewed the bids by Public Restroom Company and Romtech, and finds that the bid by Public Restroom Company is the lowest responsive bid; and WHEREAS, the City’s adopted Fiscal Year 22/23 Budget includes $2,210,000 for the Kotatei Park Revitalization Project which includes the restroom as well as the general park improvements; and
WHEREAS, the bid by the Public Restroom Company totals $268,858 and providing a 10% contingency for unexpected manufacturing details or site conditions during installation, the total recommended authorized budget for the restroom is $295,744; and WHEREAS, associated design and construction management support will be included in the general project budget, which will be awarded with the general park improvements award in the near future; and
WHEREAS, this Project is Categorically Exempt in accordance with the California Environmental Quality Act Guidelines Section 15301 Existing Facilities as the Kotate Park Revitalization Project is a minor alteration of an existing facility, therefore, no further environmental review is required.
NOW THEREFORE BE IT RESOLVED THAT the City of Cotati City Council hereby finds that:
1. The construction agreement is awarded to Public Restroom Company for an amount of $268,858, and
2. The amount of the restroom budget to be allocated to the Kotate Park Revitalization Project shall be $295,744, and
3. The City Manager is authorized to execute the heretofore mentioned construction agreement, and any needed change orders to this and other restroom project related agreements up to the authorized budget for the restroom.
