Re: Jane Cotati - Timeline Extension Request due to PG&E Complications Mr. O'Bid and Mr. Housh,
This letter is to request an additional time extension on the completion and opening of the Jane Cotati Dispensary location at 8145 Gravenstein Highway.

In a previous extension letter, we requested the additional 90 days that was allowed for in Resolution 2021-57. Unfortunately, due to circumstances outside our control, we are requesting an additional 30 days of time to open the doors of the dispensary.

The primary driver of this request for additional time is the lack of permanent power from PG&E.

As previously stated, we have been wading through the PG&E process to have a new electrical service for the property delivered. We finally have a construction date from PG&E, but it is for September 6th and September gth ', 2022. The scope of PG&E's construction is to set a new power pole on the property, mount a new pole mounted transformer on the newly erected power pole and then run conductor to the switchgear on the property. All sub structures, the switchgear and the primary power panel for the property have been inspected & signed off and are ready for the permanent power to be connected.

Even though we have a construction date for September 6th and 8th, there is still a chance that PG&E might have to shift the dates of our permanent power establishment due to PG&E logistics and process. This is something that is entirely outside our control, and we are completely dependent upon PG&E for this task.

Once we do have permanent power, we will require approximately two weeks for our contractor to fully commission the HVAC, power and security systems in the building. These tasks cannot be completed without permanent power being established. If there are any systems that have difficulty, we will need time to identify the problem and locate any replacement parts necessary to ensure a proper working system.

The TCO (Temporary Certificate of Occupancy) from the building department will require us to have our permanent power and will have to be issued once we have all our building systems operational and functioning within parameters. We will not be able to obtain the TCO from the building department until we have had time to ensure all systems are functioning.

After we have our TCO, we will need some time to coordinate with the Planning and Police department through the facility for our final sign off on the security plan and other operational elements that need to be reviewed by those departments of the City. Upon all departments giving us the "green light" to proceed with operations, we assume that the final Certificate of Occupancy (CO) will be issued.

Upon receipt of our CO to operate from the Building, Planning Fire and Police Departments, we will need approximately 2 weeks of operational start up and training before we can open to the public.

Another potential delay to the opening of the project is the issuance of our CalTrans permit for work needed to be performed where Alder Avenue meets Highway 116. We have been told by CalTrans that they are ready to issue the permit and all fees have been submitted to CalTrans. We are awaiting the final permit form CalTrans in order to complete the Alder Avenue resurfacing of the asphalt and complete the off-site improvements required of us by the City. This item is right on the finish line and will be completed as soon as possible after the issuance of the CalTrans Permit, but the exact timeline of when the permit is issued and when we can have our off-site contractor complete the work is dependent upon the permit issuance. All other offsite work is complete.

Given the variables in this above stated series of events that need to happen in order to open to the public, we believe that 30 days should be sufficient to get us to the finish line, but as with everything in the current construction and logistics world, we cannot predict this timeline exactly.

We would like to request that the City Council grant City Staff the power to regulate the final opening hurdles of this project. We are highly financially incentivized to open this business as soon as possible and are pushing on all fronts to open our doors as quickly as we can.

Unfortunately, several of these final issues are dependent upon the finalization of permanent power and the necessary construction and approval timelines after that power is established. We are fully committed to opening this business as quickly as possible.

We can gladly report that the State License for the dispensary has been issued. A copy of that document is attached to this letter. The remainder of the sitework including paving, landscaping, fencing, irrigation, and the trash enclosure, have been completed. The exteriors of the buildings are complete and looking terrific. The signage for the dispensary has been mounted and overall, the project looks fabulous in our opinion. Our interior finishes and buildout are currently scheduled to be completed by the September 8*h completion date that we currently have been Indythree, LLC - "Jane Cotati"

granted by the city. We are very excited about this project and are eager to become productive members of the Cotati Business Community.

Our goal is to push through the remaining completion hurdles and open the dispensary as quickly as we can.

Thank you very much for your consideration and your time.

Best Regards,
