Cotati City Council
Agenda Staff Report
Item type: CONSENT CALENDAR (ACTION)
To: City Council
Subject: City Manager Agreement Revision
Date: August 23, 2022
Written by: Damien O'Bid, City Manager
Recommendation
It is recommended that the City Council adopt a resolution approving the second amended and restated agreement for the City Manager and adopt a resolution approving the corresponding updated salary schedule.

Background
The current City Manager, Damien O’Bid, became Acting City Manager on December 1, 2014, after which a full recruitment process commenced for a permanent City Manager. The current City Manager was ultimately selected and entered into a three-year employment agreement with the City, commencing on April 15, 2015. On April 10, 2018, the agreement was extended through July 9, 2018. On July 9, 2018, the agreement was again extended for 3 years through July 9, 2021. The agreement was extended again on August 24, 2021 through July 9, 2026, which was approved through an Amended and Restated Agreement.

Analysis/Discussion
The Second Amended and Restated Agreement revises the City Manager employment agreement to make the following changes:

1. Due to the extraordinary inflation this year, add a 1% cost of living allowance in FY 22- 23, effective on August 15, 2022 (the start of the current payroll period), to mirror all other employees.

2. Revise the longevity provision from 5% to 9% at 10 years of service, to mirror the cumulative longevity available to Department Heads

3. Increase the life insurance to from $100,000 to $150,000, in line with the life insurance available to all other employees, effective September 2022.

All other provisions remain unchanged. Additionally, an updated salary schedule is included as a separate resolution to document the corresponding salary change.

Financial Considerations
The adopted FY 22-23 budget is anticipated to have sufficient funding in the fiscal year due to current staffing levels. As such there are no requested budgetary amendments at this time.

Environmental Issues
This action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, pursuant to CEQA Guideline section 15378.
