ORDINANCE NO.
INTRODUCTION OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COTATI AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE
CITY COUNCIL OF THE CITY OF COTATI AND THE BOARD OF
ADMINISTRATION OF THE CALIFORANIA PUBLIC EMPLOYEES’ RETIREMENT
SYSTEM TO REMOVE THE CONTRACT PROVISION EXCLUDING FROM
CALPERS MEMBERSHIP “PERSONS COMPENSATED ON AN HOURLY BASIS” PROSPECTIVELY, PURSUANT TO GOVERNMENT CODE SECTIONS 20305 AND 20503
WHEREAS, the action of revising a pension contract does not constitute a project as defined by California Environmental Quality Act Guidelines Section 15378; therefore, no further environmental review is required.
NOW THEREFORE THE CITY COUNCIL OF THE CITY OF COTATI DOES ORDAIN AS FOLLOWS:
SECTION 1. Recitals Made Findings. The above recitals are hereby declared to be true and correct findings of the City Council of the City of Cotati SECTION 2. That an amendment to the contract between the City Council of the City of Cotati and the Board of Administration, California Public Employees' Retirement System is hereby authorized, a copy of said amendment being attached hereto, marked Exhibit, and by such reference made a part hereof as though herein set out in full.
SECTION 3. The City Manager of the City of Cotati is hereby authorized, empowered, and directed to execute said amendment for and on behalf of said Agency.
SECTION 4. This Ordinance shall take effect and be in full force and effect from and after thirty (30) days from its final passage.
