RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COTATI APPROVING
THE AFFORDABLE HOUSING AGREEMENT FOR THE COTATI STATION
APARTMENTS PROJECT
WHEREAS, on June 14, 2022, Colvin Group LLC., a California limited liability company (“Developer”) was granted Design Review and Density Bonus approval by the Cotati City Council for the Cotati Station Apartments (“Project”), a 98-unit mixed use project consisting of 98-apartment homes (1, 2, and 3 bedroom units) and approximately 5,600 square feet of commercial space on three parcels totaling approximately 2.42 acres; and WHEREAS, the Developer intends to sell the Project, inclusive of 19 affordable, below market rate (“BMR”) housing units for very low, low and moderate income residents and families (each a “Unit,” and collectively with amenities and any associated public improvements, the “Development”); and
WHEREAS, the 19 BMR units are proposed to be restricted affordable for 55 years through an Affordable Housing Regulatory Agreement and Declaration of Restrictive Covenants (“Affordable Housing Agreement”), subject to the terms and conditions substantially as attached hereto as Exhibit A; and
WHEREAS, very low- and low- income units are particularly difficult to bring on-line, and while the City has exceeded the total housing allocation for the 5th Regional Housing Needs Assessment (RHNA), the City will not be able to meet the allocation of very low income units; and WHEREAS, in recognition of the shortage of lower income housing, the City desires to utilize the Affordable Housing Fund to lower the cost of construction for the very low- and lowincome units by granting funds to offset the estimated cost of the City’s impact fees attributable to the eleven (11) very low- and low- BMR units; and
WHEREAS, the action of approving an Affordable Housing Agreement does not constitute a project as defined by California Environmental Quality Act Guidelines Section 15378; therefore, no further environmental review is required.
NOW THEREFORE BE IT RESOLVED THAT the City Council of the City of Cotati hereby:
1. Approves the Affordable Housing Agreement and related documents, substantially in the form attached hereto as Exhibit A; and
2. Authorizes transfer of up to $275,000 from the Affordable Housing Fund to the applicable impact fee funds to reduce the impact fees on the eleven (11) low and very low units; and
3. Authorizes the City Manager to execute the Affordable Housing Agreement in substantially the form attached, subject to the approval of the City Attorney, and to sign all documents and take all actions necessary or appropriate to carry out and implement the intent of this Resolution.
