RESOLUTION NO.
RESOLUTION OF THE CITY OF COTATI CITY COUNCIL AWARDING THE
CONSTRUCTION CONTRACT FOR THE COMMUNITY CENTER WINDOW
REPLACEMENT PROJECT TO AUGUST-JAYE CONSTRUCTION AND
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY CHANGE ORDERS OR
AMENDMENTS TO RELATED PROFESSIONAL SERVICES AGREEMENTS UP TO
THE APPROVED PROJECT BUDGET AMOUNT
WHEREAS, the City’s Capital Plan includes efforts to upgrade and maintain its buildings and facilities, and recently, the City has completed replacing the roof on the Community Center and has now completed the design and received bids to replace the Community Center windows; and
WHEREAS, the Community Center Window Replacement Project design was conducted over the past year and the Project was advertised for bidding last month, and, on October 18, 2022, seven bids were received and opened with the low bid in the amount of $87,613, and the high bid of $295,000; and
WHEREAS, work consists of partially removing all existing aluminum windows, prepare the openings for new PVC window systems, install new PVC window systems, and modify and/or repair adjoining surfaces as required to match the existing building; and WHEREAS, the low bid was reviewed, and Staff has determined it to be responsive and recommends it for award; and
WHEREAS, the City’s adopted Fiscal Year 2022/23 Budget includes $1,038,000 for the Civic Center Windows and Exterior Repairs Project which includes the City Hall Window Replacement (received prior Council award and budget authorization), Community Center Window Replacement Project as well as painting the Community Center; and WHEREAS, the prior authorized budget for the City Hall Window Replacement Project was $350,000 which leaves $688,000 for the Community Center Window Replacement Project, painting, and contingency; and
WHEREAS, the City Council approved under a prior action professional services agreements for Project Management, Design, and Construction Management services for the Project for a total of $36,734; and
WHEREAS, the construction contract totals $87,613, and with a contingency of $30,653, and the prior approved amounts for design, project management, and construction inspection, the total Project budget amount is $155,000, and is well below the $688,000, available budgeted amount; and
WHEREAS, the action of replacing windows does not constitute a project as defined by California Environmental Quality Act Guidelines Section 15378; therefore, no further environmental review is required.
NOW THEREFORE BE IT RESOLVED THAT it is recommended the City of Cotati City Council hereby:
1. Awards the Community Center Window Replacement Project construction contract to August-Jaye Construction for an amount of $87,613, and
2. Authorizes a project contingency of $30,653, and
3. Authorizes the City Manager to execute any required change orders to the construction contract and amendments to related professional services agreements, for a combined total not to exceed $118,266 (construction contract plus contingency).
