Subject: Award of Construction Contract for the Kotate Park Revitalization Project to Oak Grove Construction
Date: November 22, 2022
Written by: Craig Scott, Director of Public Works/City Engineer Recommendation
It is recommended the City Council of the City of Cotati adopt a resolution awarding the construction contract for the Kotate Park Revitalization Project to Oak Grove Construction and authorizing the City Manager to execute said agreement, and any needed change orders and amendments, including to the design professional services agreement with Integra, up to the approved Project budget
Background
The City’s Parks Capital Plan identified the Kotate Park Revitalization Project as a near term priority project. Phase 1 of the park improvements have been designed and advertised for construction bids. The planned improvements at the park includes replacing the play equipment in the park, a restroom, ADA access to the park off of Linden Court, seating and landscaping in the area of the play structures, new lighting, and landscaping including revamping the turf areas and landscaped areas.

Analysis/Discussion
On March 22, 2020, City Council approved a design agreement with Integra to prepare construction documents and provide design assistance during construction for the Kotati Revitalization Project (Project). The construction documents were completed, and the project advertised for construction bids with bids opened on November 8, 2022. The City received three bids with the low bid from Oak Grove Construction for an amount of $1,938,713, which is 5 percent below the engineer’s cost estimate of $2,035,551.

City Staff has reviewed the bid proposal from Oak Grove Construction and has determined it to be complete and responsive and recommends it for award.

On February 25, 2020, City Council approved a professional services agreement with Integra Planning + Landscape Architecture (Integra) for the design of the Kotate Revitalization Project.

On November 9, 2021, City Council approved an amendment to the agreement for additional consulting services. The amended agreement includes design assistance during construction including reviewing submittals and preparing as-builts. It may be necessary to amend the agreement to provide Construction Management and Inspection services to ensure the proper installation of the improvements and to review the invoices. City staff is requesting City Council authorize the City Manager to execute any such amendments up to the approved Project budget.

Financial Considerations
The Kotate Park Improvement Project is included in the City’s adopted FY22/23 budget for an amount of $2,387,900 within Grants Fund Account 201-00-91100-PROP68. Funded is provided using a combination of General Funds, specifically Measure S, County Parks Measure M taxes, Prop 68 State Grants, Development “Bed Tax” Fees, and Park-In-Lieu Fees.

From the budget $320,258 is encumbered for existing contracts related to the restroom building and design agreements. The remaining available budget of $2,067,640 is deemed sufficient to meet the construction costs, however staff are requesting a fifteen percent construction contingency in the amount of $290,887 for a total contract not to exceed $2,229,600. Due to the budget deficiency, staff are requesting an additional appropriation of unencumbered of General Fund reserves in an amount of $161,960. With this adjustment the total project cost would be not to exceed $2,549,860.

Environmental Issues
This Project is Categorically Exempt in accordance with the California Environmental Quality Act Guidelines Section 15301 Existing Facilities as the Kotate Park Revitalization Project is a minor alteration of an existing facility, therefore, no further environmental review is required.
