RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COTATI APPROVING THE 2023 THE LIME FOUNDATION BATTLE OF THE BANDS EVENT IN LA PLAZA PARK.
WHEREAS, The LIME Foundation submitted an application to the City for the Battle of the Bands talent show event on May 9, 2023; and
WHEREAS, California Vehicle Code Section 21101(e) authorizes temporary street closures if necessary for the safety and protection of persons who are to use that portion of the street during the temporary closing; and
WHEREAS, it will be necessary to temporarily close certain streets, as described in the Exhibits attached to facilitate these events; and
WHEREAS the City Council finds that the closure is necessary for the safety and protection of persons who are to use that portion or portions of the street(s) during the temporary closing; and
WHEREAS, the Chief of Police of the City of Cotati will arrange for temporary street closure and traffic re-routing, which would minimize the traffic hazard conditions and allow for orderly movement of traffic; and
WHEREAS, the Chief of Police will contact the Rancho Adobe Fire Protection District, ambulance service providers, bus service providers, and others who may need ingress, egress, or the ability to traverse the affected area and will reasonably provide for their needs; and WHEREAS, the event organizers have been conditioned to provide evidence of their ability to serve alcohol responsibly and in conformance with all rules and regulations of the California Department of Alcoholic Beverage Control and conditioned to return the park and streets to their prior condition of cleanliness and repair as set forth in Exhibit “A” attached hereto; and
WHEREAS, it will be necessary to conform to certain conditions as described in “Exhibit A,” attached hereto, to facilitate this event; and WHEREAS, the City Council finds that this event is part of a comprehensive economic development strategy by the City in that it will increase visitation to the City, promote the Cotati community and result in increased sales tax revenues; and WHEREAS, the City Council further finds that the health, safety, and welfare of the citizens of the City of Cotati will not be jeopardized by the approval of this event; and WHEREAS, the application for these events is attached as Exhibit B; and WHEREAS, the action of approving a Battle of the Bands talent show event does not constitute a project as defined by California Environmental Quality Act Guidelines Section 15378; therefore, no further environmental review is required.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Cotati as follows:
Section 1. Findings. The above recitals are declared to be true and correct and are incorporated herein as findings of the City Council.
Section 2. Approval of Conditions. The City Council hereby approves the conditions of approval for these events, attached as Exhibit A.
Section 3. Effective Date of this Resolution. This Resolution shall become effective immediately.
Section 4. Severability. Each portion of this resolution is severable. Should any portion of this resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining resolution portions shall be and continue in full force and effect, except as to those resolution portions that have been adjudged invalid. The City Council of the City of Cotati hereby declares that it would have adopted this resolution and each section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that one or more section, subsection, clause, sentence, phrase or other portion may be held invalid or unconstitutional.
IT IS HEREBY CERTIFIED that the foregoing resolution was duly adopted at a regular meeting of the City Council of the City of Cotati held on the June 13th, 2023, by the following vote, to wit:
