Subject: FY23/24 SB 1 List of Projects as required by the Road Repair and Accountability Act of 2017
Date: June 13, 2023
Written by: Craig Scott, Director of Public Works/City Engineer Recommendation
It is recommended the City Council of the City of Cotati adopt a resolution approving a list of projects for Fiscal Year 2023-24 funded by SB 1: the Road Repair and Accountability Act of 2017
Background
In August 2017, the California Transportation Commission (CTC) adopted the final FY 2017-18 Road Repair and Accountability Act of 2017 (SB1). The passage of SB1 established a Road Maintenance and Rehabilitation Account (RMRA) that requires local agencies to demonstrate that a project, funded by SB1, has been approved and described in adequate detail in a City resolution by July 1st. The RMRA funds have been provided to cities monthly starting January 2018.
Analysis/Discussion
To be eligible for funding, the City must provide a City resolution to the CTC by July 1, 2023, of a list of projects planned to be funded with RMRA funds. This is an ongoing annual requirement for the City to remain eligible for the funds. The approved project list must include four statutorily required elements for each project:
1. Location
2. Description
3. Estimated useful life
4. Anticipated construction date.
The City’s 2022 Pavement Management Plan (PMP) lists all City streets with their condition and generally associated pavement rehabilitation method. The PMP guides the City’s street preservation efforts and informed the 2024 Street Improvements Project (Project). The pavement condition has been determined for this area and recommended treatment methods provided to the City. The total Project is to pave two centerline miles of streets (10,560 feet). The FY 23/24 estimated SB 1 funding of $158,193 can provide pavement treatments for approximately 3,998 centerline feet. A subset of the total streets to be paved was selected to match, or closely match the estimated RMRA available funds. These streets are all to be slurry sealed and consist of the following:
Street From To Length, CL feet Cost Estimate
DORFMAN
DRIVE
CLOTHIER 147’ N/O HONOR

GRAVENSTEIN

HONOR PLACE CUL DE SAC SW 850 ‘ NE OF
DORFMANN

Total 3,998 $161,689*
* Without dividing the street segments provided in the StreetSaver model, this estimated cost is approximately equivalent to the estimated RMRA funding of $158,193.
These treatments have a useful life of approximately 6 years. Project construction is anticipated to begin in September 2023 and extend through Spring of 2024. This construction period overlaps with the eligible period of RMRA fund expenditures of July 1, 2023, to June 30, 2024, and is therefore eligible for the FY23/24 RMRA funding.
Financial Considerations
SB1 requires that RMRA funds not replace local funding sources, including General Fund, gas tax, and Measure M, and the City must maintain a “Maintenance of Effort” (in other words a certain level of funding to repair local roads) as if SB1 funds were not available. The Maintenance of Effort is defined by SB1 and is derived from the annual State Controller’s Report.
The California Transportation Commission (CTC) has prepared guidelines for agencies to follow in meeting the SB1 requirements. The guidelines establish May 1, of each year as the deadline for agencies to submit the project resolutions. Due to Covid 19, the deadline has been extended to July 1, for 2022 and 2023. The estimated SB1 amount for the City of Cotati for FY23/24 is $158,193, which is in the City’s adopted FY 23/24 budget and accounted for separately from other local funds being used for street preservation projects.
The City’s budget for FY 2023/24 pre-assigned the RMRA funding to the Redwood Drive and Cypress Street Project which is a partially grant funded project. Upon further evaluation, the uncertain time frame related to the project start, because of the Grant, would unduly complicate required State reporting for the RMRA funding. Therefore, Staff is requesting authorization to reallocate the FY 23/24 RMRA funds to the Capital Projects funded 2024 Street Improvements Project.
Environmental Issues
This action is exempt from the California Environmental Quality Act (CEQA) because this action is not a project which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, pursuant to CEQA Guideline section 15378. The appropriate CEQA analysis will be conducted as part of the design development for the named project.
