RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COTATI APPROVING TO
A ONE YEAR LICENSE AGREEMENT FOR USE OF THE COTATI VETERANS
BUILDING FACILITIES, AND AUTHORIZING THE CITY MANAGER TO EXECUTE
SAID AGREEMENT
WHEREAS, the City of Cotati (City) has a desire to bring more opportunities for community programs, classes, events, and accessible rental spaces to Cotati; and WHEREAS, the County of Sonoma owns the Cotati Veterans Building, located at 8505 Park Avenue in Cotati; and
WHEREAS, the County of Sonoma desires to partner with the City to efficiently operate the Cotati Veterans Building; and
WHEREAS, the City has the necessary skills and resources to effectively manage and operate the Cotati Veterans Building in a manner that benefits the community; and WHEREAS, funding for the license agreement deposit and staff time is included in the adopted Fiscal Year 2023/24 budget; and
WHEREAS, the action of executing a license agreement for facility management and operations does not constitute a project as defined by California Environmental Quality Act Guidelines Section 15378; therefore, no further environmental review is required.
NOW THEREFORE BE IT RESOLVED THAT the City Council of the City of Cotati does hereby approve the attached License Agreement with the County of Sonoma and authorizes the City Manager to execute said agreement; and
BE IT FUTHER RESOLVED by the City Council of the City of Cotati as follows:
Section 1. Findings. The above recitals are declared to be true and correct and are incorporated herein as findings of the City Council.
Section 2. Effective Date of this Resolution. This Resolution shall become effective immediately.
Section 3. Severability. Each portion of this resolution is severable. Should any portion of this resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining resolution portions shall be and continue in full force and effect, except as to those resolution portions that have been adjudged invalid. The City Council of the City of Cotati hereby declares that it would have adopted this resolution and each section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that one or more section, subsection, clause, sentence, phrase or other portion may be held invalid or unconstitutional.
IT IS HEREBY CERTIFIED that the foregoing resolution was duly adopted at a regular meeting of the City Council of the City of Cotati held on the June 27th, 2023, by the following vote, to wit:
