WHEREAS, as part of the orderly development of the City, the City considers and approves subdivision plans then typically enters into Subdivision Improvement Agreements for the installation and eventual acceptance by the City of public improvements; and WHEREAS, this process is to ensure the development meets the City’s land use and infrastructure requirements presented in the General Plan, codified in the Municipal Code, and prescribed in guidance documents including the Engineering Design Standards, Standard Plans, and Construction Specification Manual and Building Permit forms and procedures; and WHEREAS, on November 9, 2021, the City Council accepted the recommendations of the Design Review Committee and Planning Commission, accepted the improvement plans, approved the Public Improvement Agreement, and approved the Real Property Documents (i.e. easements, dedications, and abandonments); and
WHEREAS, the Project has followed these procedures and the public improvements have been completed to the satisfaction of the City Engineer and the Professional Engineer on record for the Developer and the public improvements are recommended for City Council acceptance; and
WHEREAS, following City Council action, the City Clerk is to record the Notice of Completion, then, after the 35-day noticing period with no protests received, the City Clerk is to release any Public Improvement Agreement Securities; and WHEREAS, in accepting the public improvements, the City is taking responsibility for the long-term maintenance of the public improvements; and WHEREAS, the Developer has provided the City with a maintenance bond to be in effect for one year following City acceptance of the improvements; and WHEREAS, the property owner is responsible for maintaining the driveway and sidewalk; and
WHEREAS, as identified, the proposed development is purely the renovation of existing structures located on a previously developed parcel and site improvements, and keeps all development activities within the boundaries of previously disturbed areas of the property; and WHEREAS, Staff requested the project applicant provide input from a consulting biologist and traffic engineer to identify any potential impacts to biologic resources or traffic improvements needed to mitigate circulation impacts, and the results of these studies identified the project does not create any potentially significant impacts, and, given this, the Project qualifies for a Class 1 and Class 4 Categorical Exemption under Sections 15301 (Existing Facilities) and 15304 (Minor Alterations to Land) of the California Environmental Quality Act (CEQA); and
WHEREAS, specifically, it is found to qualify for these Exemptions given implementation of the approved project would renovate the existing previously constructed existing structures, all of which are located on a previously developed parcel; and that all work is limited to previously disturbed areas on this parcel.
