RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COTATI 1) ACCEPTING THE IMPROVEMENTS, 2) AUTHORIZING THE CITY CLERK TO FILE THE NOTICE OF COMPLETION, AND 3) AFTER 35 DAYS OF NO PROTESTS,
AUTHORIZING THE RELEASE OF RETENTION FOR THE COMMUNITY CENTER
WINDOW REPLACEMENT PROJECT
WHEREAS, the City’s Capital Plan includes efforts to upgrade and maintain the City’s buildings and facilities, and, recently, the City has completed replacing the roof on the Community Center and now has completed the replacement of the Community Center windows; and
WHEREAS, on November 8, 2022, City Council awarded the construction contract for the Community Center Window Replacement Project (Project) to August-Jaye Incorporated; and WHEREAS, Construction Management services were provided by Moe Engineering and architectural support services by Integrated Resources, and work consisted of partially removing all existing aluminum windows, preparing the openings for new PVC window systems, installing new PVC window systems, and modifying and repairing adjoining surfaces as required to match the existing building; and
WHEREAS, the work has been completed and, on June 28, 2023, the City Engineer conducted a final walkthrough and determined work has been completed in accordance with the Project plans and specifications and recommends it for City acceptance; and WHEREAS, the City has received a Maintenance Bond from the contractor for 10 percent of the contract price and is for any needed repairs due to faulty construction for a year after City Council acceptance of the Project improvements; and WHEREAS, following Council Acceptance, the City Clerk is to record the Notice of Acceptance with the County Recorder’s office, and after 35 days with no protests, the City is to release the retention to the contractor; and
WHEREAS, the total Project cost is $124,660, which is 20 percent below the authorized Project budget amount of $155,000; and
WHEREAS, the Project’s budget was included in the Civic Center Windows and Exterior Repairs Project which was included in the City’s Fiscal Year 2022/23 Budget; and WHEREAS, unspent funds in that project account will be returned to the unappropriated General Funds account, not carried over, for FY 23/24; and WHEREAS, the Project is Categorically Exempt in accordance with the California Environmental Quality Act Guidelines Section 15301 Existing Facilities as the Community Center Window Replacement Project is a minor alteration of an existing structure, and no further environmental review is required.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Cotati hereby takes the following actions:
1. Accepts the contract work performed on the Community Center Window Replacement Project; and
2. Directs the City Clerk to record the attached Notice of Completion for said contract work within 15 days of the date of resolution and provide a copy to the contractor (Cal. Civil Code §9204); and
3. Authorizes the City Manager to release any remaining contract retention to August-Jaye Incorporated thirty-five (35) days after the recordation of the Notice of Completion, provided that no liens or stop notices have been filed against the Project.
IT IS HEREBY CERTIFIED that the foregoing resolution was duly adopted at a regular meeting of the City Council of the City of Cotati held on the November 14th, 2023, by the following vote, to wit:
