Hank Schreeder
<<Address>>
Dear Chief Schreeder,
I am pleased to extend this conditional offer of employment to you to work as a limited term retired annuitant in the position of Interim Chief of Police with the City of Cotati. The terms and conditions of your employment are set forth below.

Retired Annuitant
California state law permits individuals who retire and receive CalPERS retirement benefits to accept limited term post-retirement employment with a CalPERS-covered employer without reinstatement or penalty under certain conditions. The reason underlying this appointment is that an exigency currently exists in the Police Department with the retirement of the previous Chief of Police. You are not being appointed to fill a vacant position, but instead you are being appointed to a temporary, retired annuitant classification in this role.

Start Date
You will be required to complete all POST-required pre-employment steps, including the successful completion of a background investigation, fingerprinting, preemployment medical, drug screen and psychological evaluation. Additionally, you are required to maintain all POST requirements as a sworn peace officer while serving as Interim Police Chief. The effective start date of employment will be January 1, 2024. The City anticipates that it will terminate this Agreement upon the City finding a permanent replacement for the position of Chief of Police. You will report to Damien O’Bid, City Manager. Under no circumstances will your working hours exceed 960 hours during the fiscal year, including other hours worked as a retired annuitant in other CalPERS agencies in Fiscal Year 2023/24.

Employment Status/At-Will Status
The position of Interim Chief of Police requires specialized skills and expert professional services for a definite period of time. You will be expected to engage in City of Cotati

The Chief of Police is an "exempt" classification under the overtime provisions of the federal Fair Labor Standards Act (FLSA), meaning you will be compensated on a salary basis, in the amount specified below, and are not entitled to overtime as defined by FLSA.

California's Labor Code specifies that an employment relationship with no specified duration is presumed to be employment "at-will." This means that the employer or the employee may terminate the employment relationship at any time, with or without cause.

Indemnification
To the extent mandated by the California Government Code, the City will defend, hold harmless, and indemnify you against any tort, professional liability, claim or demand, or other legal action arising out of an alleged act or omission occurring in the performance of your services as the Interim Chief of Police. This indemnification and defense will not apply to any intentional tort or crime committed by you, to any action outside the course and scope of your employment, or any other intentional or malicious conduct or gross negligence committed by you.

Compensation
Your hourly rate will be $95.08 per hour, which isthe top step in the salary range for the Chief of Police.

Employee Benefits
Retired annuitants are ineligible for health benefits, holidays, sick leave, vacation or any other employee leave or benefit program. However, limited term retired annuitants may utilize the services of the City's Employee Assistance Plan (EAP).

Please contact HR if you have any questions on how to access.

Resignation/Termination
You may resign at any time; provided, however, you will reasonably provide the City Manager at least two (2) weeks advance written notice. Again, you are an "at-will" employee and serve at the pleasure of the City Manager. Notwithstanding the CalPERS 960 hour limit, you may be terminated at any time, with or without cause, by the City Manager. You are not entitled to any severance pay.
