I agree that my submission(s) and their contents will automatically become the property of the City of Cotati (“City”) and I consent to its public display in the City’s Cotati Utility Box Expression Program (“Program”). I further understand and agree that:
1. There is a $100 stipend per box to cover the cost of supplies for the participation in the Program.
2. I am required to use a primer which must be applied before the artwork and anti-graffiti coating which must be applied twice after the artwork is complete.
3. I am required to use high-quality exterior acrylic paint only on the utility box.
4. Artwork will not prevent access to the box or cover any stickers, warning labels, access panels or locks.
5. My artwork is an original work and I hereby warrant that I am the sole owner of the artwork, and that I have no contractual or other arrangement which would interfere with or prevent me from providing my consent.
6. My artwork work may be publicly displayed at various forums, locations, and on various media, which may include without limitation, decorative wrap on electrical or traffic signal boxes/equipment.
7. While on public display, my artwork may be photographed, videotaped or otherwise represented as part of the Program and otherwise used for the City’s public information purposes (e.g., newspapers, newsletter, television, radio, internet, etc.).
8. While the City will take reasonable care of my artwork while displayed, the City and its contractors and personnel are not responsible for any damage or loss to the Artwork.
9. My participation in the Program, including any additional use or disclosure permitted herein is voluntary.
10. My name and/or photograph, video, etc., identifying me as the artist, may be disclosed and/or used in any form or manner described above.
11. The City will consider locations proposed by artist but retains the right to locate any artwork at any potential locations in the City of Cotati.
12. Changes to the artwork design may be required to accommodate site-specific requirements. Any changes must be approved by a City representative.
13. In the event that the artwork becomes damaged to such an extent that repair is not reasonably feasible, or if City determines, in its sole judgement, for any reason that the artwork should no longer be retained, City may cause the removal of the artwork.
14. I agree to waive my rights of attribution out in the Visual Artists Rights Act, 17 U.S.C §§106A and 113(d) ("VARA"), the California Art Preservation Act, Cal. Civil Code §§ 987 and 989 ("CAPA").
DISCLAIMER I have read the information contained within this form and agree to the rules and regulations stated herein. I agree to indemnify and hold harmless, the City of Cotati, its City Council, Officers, Agents, associated Organizations and Foundations, Employees, Contractors, and volunteers, for any loss or liability which results or is alleged to have resulted from my participation in this program, including any claim arising out of the applicants entry, acts, or omissions in said program or any accident, injury or damage involved therein, including but not limited to attorney fees and court costs. I have read and fully understand these policies. All statements contained within this form are true and complete to the best of my knowledge and belief and my signature is below.
