RESOLUTION NO. (XX)
ACCEPTING THE GATEWAY SIGN IMPROVEMENT PROJECT, AUTHORIZING
THE CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE
COUNTY RECORDER AND RELEASE THE CONSTRUCTION CONTRACT
RETENTION
WHEREAS, in 2021, a design concept for new gateway signs, integrated into a holistic sign design program, was approved by the City Council; and WHEREAS, the thirteen new two post gateway signs were to replace aging and faded existing single post entrance signs; and
WHEREAS, on February 27, 2024, City Council awarded the construction agreement for the Gateway Sign Project to Bay Area Sign DBA Aloha Electric Sign Company for $68,900; and WHEREAS, field work began on the installation on June 10, 2024, and a final inspection was conducted on June 28, 2024, and the City Engineer has determined the work has been completed in accordance to the project documents and recommends acceptance by the City; and WHEREAS, Construction Management for the Project has been conducted by Moe Engineering, and the work has been completed on schedule and within budget with no change orders; and
WHEREAS, the construction contract had no change orders (a total of ($68,900) and the Construction Management Professional Services Agreement is estimated to leave $10,000 unspent; and
WHEREAS, remaining unspent funds of $26,100 will be returned to the unappropriated General Fund balance; and
WHEREAS, following City Council action, a Notice of Completion is to be filed with the County Recorder and after thirty-five days, provided there are no protests, the City is to release the retention to the Contractor; and
WHEREAS, the action of accepting improvements is found to qualify for a Class 2 Categorical Exemption under CEQA Section 15302 in that the project consists of replacement or reconstruction of existing structures and facilities where the new structure/facility will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Cotati hereby takes the following actions:
1. Accepts the contract work performed on the Gateway Sign Project; and
2. Directs the City Clerk to record the attached Notice of Completion for said contract work within 15 days of the date of resolution and provide a copy to the contractor (Cal. Civil Code §9204); and
3. Authorizes the City Manager to release any remaining contract retention to Bay Area Sign DBA Aloha Electric Sign Company thirty-five (35) days after the recordation of the Notice of Completion, provided that no liens or stop notices have been filed against the Project.
IT IS HEREBY CERTIFIED that the foregoing resolution was duly adopted at a regular meeting of the City Council of the City of Cotati held on August 13, 2024, by the following vote, to wit:
