Subject: ADOPTION OF A RESOLUTION APPROVING FISCAL YEAR 25/26 SB1 LIST OF PROJECTS AS REQUIRED BY THE ROAD
REPAIR AND ACCOUNTABILITY ACT OF 2017
Date: June 24, 2025
Written by: Craig Scott, Director of Public Works/City Engineer Recommendation
It is recommended the City Council of the City of Cotati adopt a resolution approving a list of projects for Fiscal Year 2025-26 funded by SB 1: the Road Repair and Accountability Act of 2017.

Background
In August 2017, the California Transportation Commission (CTC) adopted the final FY 2017-18 Road Repair and Accountability Act of 2017 (SB1). The passage of SB1 established a Road Maintenance and Rehabilitation Account (RMRA) that requires local agencies to demonstrate that a project, funded by SB1, has been approved and described in adequate detail in a City resolution by July 1st every year. The RMRA funds have been provided to cities monthly starting January 2018.

Analysis/Discussion
To be eligible for funding in Fiscal Year 2025/26, the City must provide a City resolution to the CTC by July 1, 2025, of a list of projects planned to be funded with RMRA funds. This is an ongoing annual requirement for the City to remain eligible for the funds. The approved project list must include four statutorily required elements for each project:

1. Location

2. Description

3. Estimated useful life

4. Anticipated construction date.

The City’s 2024 Pavement Management Plan (PMP) lists all City streets with their condition and generally associated pavement rehabilitation method. The PMP guides the City’s street preservation efforts and informed the 2026 Street Improvements Project (Project). The pavement condition has been determined for this area and recommended treatment methods provided to the City. With the 2025 Street Preservation Project currently wrapping up, the budgeted intention is to move to a rehabilitation project later this year with the Project. While we are still bringing old roads up to good condition, the goal is to do two projects per year, one for street preservation and one for street rehabilitation, subject to funding availability. As part of the funding for these projects, the City has been utilizing RMRA funds to be able to maintain additional miles of roads each year.

The Project is to do full-depth reclamation on Lund Hill Lane, between Valparaiso and Cypress Avenue, as well as Lasker Lane and potentially Oretsky Lane (as a bid alternate). The work also consists of dig outs, crack sealing and slurry seal on E. Cotati Avenue between Baytree Court and the City Limits.

The FY 25/26 estimated RMRA (SB 1) funding of $205,319 will allow us to include additional work in the Project, including pavement maintenance for approximately 2,265 centerline feet (based on digouts, crack sealing and slurry paving), with some matching City funding. A subset of the total streets to be paved was selected to closely align with the estimated RMRA available funds. These streets consist of the following:

Street From To Length, CL, Feet Cost Estimate
E. Cotati Ave Baytree Ct Beverly Dr 1,092 $122,541
E. Cotati Ave Beverly Dr RR Tracks 1,173 $131,631
Total 2,265 $254,172
These treatments have a useful life of approximately 6 years. Project construction is anticipated to begin in August 2025 and extend through October 2025. This construction period overlaps with the eligible period of RMRA fund expenditures of July 1, 2025, to June 30, 2026, and is therefore eligible for the FY25/26 RMRA funding.

Financial Considerations
SB1 requires that RMRA funds not replace local funding sources, including General Fund, gas tax, and Go Sonoma, and the City must maintain a “Maintenance of Effort” (in other words a certain level of funding to repair local roads) as if SB1 funds were not available. The Maintenance of Effort is defined by SB1 and is derived from the annual State Controller’s Report.

The California Transportation Commission (CTC) has prepared guidelines for agencies to follow in meeting the RMRA (SB-1) requirements. The guidelines establish May 1, of each year as the deadline for agencies to submit the project resolutions. Due to Covid 19, the deadline has been extended to July 1. The estimated SB1 amount for the City of Cotati for FY25/26 is $205,319 included in the City’s adopted FY 25/26 budget for Fund 221 and accounted for separately from other local funds being used for street preservation projects. The remainder of the needed funding for this roadway segment ($48,853) will come from other City sources, in accordance with the approved FY 25/26 City budget.

Environmental Issues
This action is found to qualify for a Class 1 Categorical Exemption under CEQA Section 15301 in that the project consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of the existing or former use.
