RE: Sunflower Park Improvements Bid Protest
Dear Mr. Scott
M3 Integrated Services, Inc. (M3) takes exception to the bid protest filed by ERA Construction, Inc. on the subject project. The protest states that M3 failed to list subcontractors for certain portions of the work. M3 has both a General Engineering (class A) and General Building (class B) state contractor license. M3 typically self performs 60% to 80% of the work on a project and has the necessary trades in house to perform all such work.
M3 intends to self-perform the masonry work. In California, a Class "A" General Engineering Contractor license can perform masonry work if it's part of a larger project that falls under their purview, which involves fixed works requiring specialized engineering knowledge and skill, such as roads, airports, or other "fixed works". Parks are considered fixed works.
M3’s bid was responsive and did not violate any of the Public Contract Codes Sections cited by ERA Construction, Inc.
