WHEREAS, on January 23, 2024, the Cotati City Council adopted Resolution No. 2024- 04, approving Preliminary Design Review, a Tree Removal Permit, a Hillside Development Permit, and a Vesting Tentative Map to allow development of Flahavan Estates, a 35-lot singlefamily home subdivision located at 8841 Old Redwood Highway; and WHEREAS, pursuant to the City of Cotati’s Affordable Housing Ordinance in effect at the time of project entitlement approval, 15% of the housing units in a residential development with more than nine units must be designated as affordable, based on Area Median Income (AMI) for a period of 55 years, and that one-third of the affordable units must be reserved for very low-income households, one-third for low-income households, and one-third for moderateincome households; and WHEREAS, the applicant, Pink Viking ORH LLC, has accepted the obligation to execute an Affordable Housing Regulatory Agreement and Declaration of Restricted Covenants (Affordable Housing Agreement) with the City that will restrict five units in the development to rents that are considered affordable based on AMI, and includes two units reserved for qualifying moderate-income households, two units for qualifying low-income households, and one unit for qualifying very low-income households; and
WHEREAS, this project supports the City of Cotati’s 2023-2031 Housing Element’s goal to promote affordable housing development by providing affordable housing units at no public cost and contributes to the City’s Regional Housing Needs Allocation; and WHEREAS, approval of the Affordable Housing Agreement is not a “project” subject to the California Environmental Quality Act (CEQA) because it will result in no direct physical effects on the environment and is therefore exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines.
