RESOLUTION NO. (XX)
ACCEPTING THE 2025 STREET IMPROVEMENT PROJECT, AUTHORIZING THE
CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY
RECORDER AND RELEASE THE CONSTRUCTION CONTRACT RETENTION WHEREAS, the City’s Five-Year Capital Improvements Plan includes a list of street paving projects, and the paving projects are based on a Pavement Management Program (PMP), updated every 2 years, which guides the identification and prioritization of street pavement maintenance projects; and
WHEREAS, the PMP provides strategies to prioritize the annual roadway projects based on their condition and treatment costs, and pavement maintenance projects are significantly funded by, and made possible by Measure S, the City’s local revenue measure, grant matching funds, as well as the street financing issued in 2022; and WHEREAS, the City Council continues to prioritize street repair and maintenance to reduce long-term maintenance costs, and, since July 2020, the City has completed approximately $16 million in roadway improvements, increasing the Pavement Condition Index (PCI) to the mid-70’s, and these investments have made considerable progress in improving the condition of our roadways, making Cotati’s streets among the best in Sonoma County; and WHEREAS, on April 8, 2025, City Council awarded the construction agreement for the 2025 Street Improvement Project (Project) to American Asphalt Repair & Resurfacing Co, Inc., and the first page of the As-Builts is attached to provide a general idea of the scope of the Project; and
WHEREAS, field work began in mid-May and a final inspection was conducted on June 16, 2025, and the City Engineer has determined the work has been completed in accordance with the project documents; and
WHEREAS, Construction Management for the Project has been conducted by Green Valley Consulting Engineers, and the work has been completed within the contract allotted days and under budget; and
WHEREAS, on June 10, 2025, City Council approved a budget amendment to account for an underestimation of the crack sealing needed, to add speed cushions on Benson Lane and a three way stop at the intersection of Benson Lane and Loretto Avenue, and for additional striping on Water Road;
WHEREAS, following City Council action, a Notice of Completion is to be filed with the County Recorder and after thirty-five days, provided there are no protests, the City is to release the retention to the Contractor; and
WHEREAS, The City’s Fiscal Year 24/25 Budget has an amended annual project budget of $719,000 and total Project costs are $670,158 with an amount under budget of $48,841; and WHEREAS, this action is found to qualify for a Class 1 Categorical Exemption under CEQA Section 15301 in that the project consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of the existing or former use.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Cotati hereby takes the following actions:
1. Accepts the contract work performed on the 2025 Street Improvement Project; and
2. Directs the City Clerk to record the attached Notice of Completion for said contract work within 15 days of the date of resolution and provide a copy to the contractor (Cal. Civil Code §9204); and
3. Authorizes the City Manager to release any remaining contract retention to American Asphalt Repair & Resurfacing Co, Inc. thirty-five (35) days after the recordation of the Notice of Completion, provided that no liens or stop notices have been filed against the Project.
