RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COTATI APPROVING
ANNEXATION OF CERTAIN PROPERTY TO COMMUNITY FACILITIES DISTRICT NO. 2017-01 (PUBLIC SERVICES); APPROVING ANNEXATION MAP RELATED THERETO AND AUTHORIZING AND DIRECTING RECORDING THEREOF; AND
AUTHORIZING AND DIRECTING THE PREPARATION AND RECORDING OF AN
AMENDED NOTICE OF SPECIAL TAX LIEN RELATING THERETO
WHEREAS, the City Council (the “City Council”) of the City of Cotati (the “City”) has previously formed City of Cotati Community Facilities District No. 2017-01 (Public Services) (“CFD No. 2017-01”) pursuant to the Mello-Roos Community Facilities Act of 1982, as amended (the “Act”), to provide for the levy of a special tax (the “Special Tax”) on all taxable property within the boundary of CFD No. 2017-01 for the purpose of financing certain authorized public services (the “Public Services”); and WHEREAS, acting pursuant to the Act, the City Council also authorized by the adoption of Resolution No. 2017-62 the annexation in the future of territory to CFD No. 2017-01 (the “Future Annexation Area”); and
WHEREAS, in accordance with the provisions of Sections 53339 through 53339.9, inclusive, of the Act (the “Annexation Provisions”), pertaining to annexation of property to a community facilities district, Cotati Commons Marketplace, LLC, the sole owner of the parcels to be annexed (the “Landowner”), has submitted to the City Manager of the City an executed form entitled “Voter and Unanimous Approval for Annexation and Landowner-Voter Ballot” (the “Unanimous Approval Form”), requesting the annexation of a parcel owned by Landowner to CFD No. 2017-01 (the “Subject Property”) and voting in favor of authorizing the levy of the Special Tax on the Subject Property; and
WHEREAS, a copy of the Resolution of Intention, incorporating a description and map of the proposed boundaries of the territory to be annexed to CFD No. 2017-01 and stating the services to be provided and the rate and method of apportionment of the special tax to be levied within CFD No. 2017-01, is on file with the City Clerk and the provisions thereof (the “Resolution of Intention”) are fully incorporated herein by this reference as if fully set forth herein; and
WHEREAS, on the date hereof, the City Council held a noticed public hearing as required by the Act and the Resolution of Intention relative to the proposed annexation of the Subject Property to CFD No. 2017-01; and
WHEREAS, at said hearing all interested persons desiring to be heard on all matters pertaining to the annexation of territory to CFD No. 2017-01 and the levy of said Special Tax within the Subject Property were heard and a full and fair hearing was held; and WHEREAS, no written protests were made at any time prior to the close of the public hearing; and
WHEREAS, a map showing the Subject Property and designated as Annexation No. 2025-02 (the “Annexation Map”), a copy of which is attached as Exhibit A hereto and incorporated herein by this reference, has been submitted to this legislative body; and WHEREAS, all prior proceedings taken by the City Council with respect to CFD No. 2017-01 and the proposed annexation of territory thereto have been duly considered and are hereby determined to be valid and in conformity with the Act, and CFD No. 2017-01 has been validly established pursuant to the Act.
NOW, THEREFORE, BE IT RESOLVED that the City Council, acting as the legislative body of Community Facilities District No. 2017-01 (Public Services), hereby finds, determines and resolves as follows:
Section 1. The foregoing recitals are true and correct and the City Council hereby expressly so finds and determines.
Section 2. The City Council hereby approves the Annexation Map and authorizes and directs the Deputy City Clerk to cause the recordation thereof in the official records of the County Recorder in accordance with the provisions of Section 3113 of the California Streets and Highways Code.
Section 4. In accordance with the request set forth in the Unanimous Approval Form, the City Council hereby authorizes and directs the Deputy City Clerk as soon as practicable following the recordation of the Annexation Map to cause the preparation and recordation of an Amended Notice of Special Tax Lien (the “Amended Notice”) in the official records of the County Recorder in accordance with the provisions of Section 53339.8. Upon recordation of the Amended Notice, the Subject Property shall be subject to the levy of the Special Tax in accordance with the rate and method of apportionment of special tax for CFD No. 2017-01.
IT IS HEREBY CERTIFIED that the foregoing resolution was duly adopted at a regular meeting of the City Council of the City of Cotati held on the 13th day of January, 2026, by the following vote, to wit:
