RESOLUTION NO. (XX)
RESOLUTION OF THE CITY OF COTATI APPROVING AN AMENDED LICENSE
AGREEMENT WITH NOR CAL OAKS FOR THE USE OF PUTNAM AND CATOR
FIELDS AND APPROVING A RELATED BUDGET AMENDMENT
WHEREAS, on May 9, 2023, the City Council approved a license agreement with Nor Cal Oaks for the use, operation, and maintenance of the Putnam and Cator Fields, under which Nor Cal Oaks invested substantially more than the originally committed amount to rehabilitate and significantly improve the fields; and
WHEREAS, Nor Cal Oaks has requested amendments to the license agreement due to changes in its funding structure to maintain the viability of youth baseball and softball programming for the community; and
WHEREAS, the proposed amended license agreement maintains the original term and overall structure, clarifies operational responsibilities, and includes changes related to field access, signage, annual payment requirements, and the assumption of water costs by the City subject to usage limitations; and
WHEREAS, under the amended agreement, Nor Cal Oaks will continue to fully fund and perform specialized field maintenance and repairs, preserving a high level of field quality for public benefit at no cost to the City for maintenance services; and WHEREAS, approval of the amended license agreement requires a related budget amendment to the General Fund Parks budget to account for the City’s assumption of irrigation water costs.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Cotati that:
1. The City Council hereby approves the amended License Agreement with Nor Cal Oaks for the use, operation, and maintenance of Putnam and Cator Fields, substantially in the form presented, subject to minor administrative or non-substantive changes approved by the City Manager and City Attorney.
2. The City Manager is authorized and directed to execute the amended License Agreement on behalf of the City.
3. The City Council approves a budget amendment to the General Fund Parks budget to increase irrigation water expenditures to reflect the City’s assumption of water costs under the amended agreement.
4. This Resolution shall take effect immediately upon adoption.
