Community Facilities District No. 2017-01 (Public Services) Request and Unanimous Approval for Annexation
and Landowner-Voter Ballot
Recitals
By its Resolution No. 2017-62, adopted on September 12, 2017 (the "Resolution of Formation,") the City Council of the City of Cotati (the "City"):
a. established the City of Cotati Community Facilities District No. 2017-01 (Public Services) ("CFD No. 2017-01") pursuant to the Mello-Roos Community Facilities Act of 1982, as amended (the "Act"), with an initial boundary shown on the boundary map for CFD No. 2017-01 (the "Boundary Map"), which was recorded in the records of the Sonoma County Recorder (the "County Recorder") on July 27, 2017, under Document No. 2017058105, in Book 787, Pages 31 and 32, of Maps of Assessment and Community Facilities Districts; and b. designated all of the remaining real property within the corporate boundaries of the City as future annexation area (the "Future Annexation Area"), as further shown on the Boundary Map, to be annexed in segments to CFD No. 2017-01, upon satisfaction of conditions prescribed by the provisions of Chapter 3.5 of the Act.
Request
The undersigned: (the "Landowner"), as the sole owner of real properties identified as Assessor's Parcel No.s 046-286-017, 046-286-018, 246-286-019, and 046-286-020 (the "Subject Properties"), which is situated within the Future Annexation Area and is shown on Exhibit A (the "Annexation Map"), attached hereto and by this reference incorporated herein, hereby requests that the Subject Property be annexed to CFD No. 2017-01 as authorized by the Act and the Resolution of Formation.
Approval and Vote
1. The Landowner hereby provides its unanimous approval of the annexation of the Subject Property, identified on Exhibit A as "Annexation No. 2025-02," to CFD No. 2017-01, as prescribed and authorized by Section 53339.7 of the Act.
2. The Landowner, as the sole qualified elector for this annexation, hereby votes in favor of authorizing the City to levy the special taxes of CFD No. 2017-01 on the Subject Property in accordance with the rate and method of apportionment of special taxes for CFD No. 2017-01 (the "RMA"), a copy of which is attached hereto as Exhibit B and by this reference incorporated herein.
3. The Landowner hereby acknowledges the following:
a. Following a public hearing and assuming adoption of a resolution of the City Council of the City approving Annexation No. 2025-02, the City will cause the recordation in the official records of the County Recorder of (a) the Annexation Map and (b) an Amended Notice of Special Tax Lien, which will result in the establishment of a lien to secure payment of the special tax when levied upon all of the taxable property within CFD No. 2017-01; and
b. The City will levy a special tax upon the Subject Property in accordance with the provisions of the RMA.

DESCRIPTION OF SERVICES
The captioned Community Facilities District will finance, in whole or in part, the following Act of s in sing al end admirie cot, experts, and Come rey raci ter replacement of vehicles, equipment, and facilities:
Public Services
The Community Facilities District shall provide and finance certain types of public services, including but not limited to (i) the costs of contracting services, (i) maintenance or upkeep of related facilities, equipment, vehicles, apparatus, and supplies, (iii) the salaries and benefits of staff that directly provide public services, and (iv) overhead costs associated with providing such services within the CFD.
In addition, the following costs will also be financed by the special taxes levied within the CFD and be allocated to each category of service described above based upon their pro-rata share of needed administrative costs, operating reserves and capital reserves, and actual or estimated delinquencies.
1. Administrative Expenses including the costs incurred to determine, levy, and collect the special taxes, including compensation of City employees for administrative work performed in relation to the CFD, the fees of consultants and legal counsel, the costs of collecting installments of the special taxes upon the general tax rolls, preparation of required reports, and any other costs incurred in the administration of the CFD by the City;
2. Any amounts needed for operating reserves and capital reserves; and Any amounts needed to cure actual or estimated delinquencies in special taxes for the current or previous fiscal years.
