Subject: CONSIDER AWARDING THE CONSTRUCTION CONTRACT
FOR THE CLASS 1 PATHWAY MAINTENANCE PROJECT
Date: April 14, 2026
Written by: Craig Scott, Director of Public Works/City Engineer Recommendation
It is recommended the City of Cotati City Council adopt a resolution awarding the Construction agreement for the Class 1 Pathway Maintenance Project and authorizing the City Manager to execute said agreement and any change orders or amendments to the Construction Management Agreement up to the authorized project budget amount.
Background
On November 26, 2024, City Council approved an Agreement with Moe Engineering to provide engineering design services for the maintenance and restoration to Cotati’s Laguna de Santa Rosa Class 1 Multi-Use Trail from Gravenstein Way to East Cotati Avenue which is approximately 2,200 feet and varies from 8 feet to 10 feet wide. Class 1 Multi-Use Paths are fully separated from bike and pedestrian paths from roadways and are typically parallel to a street, waterway, and/or other alignment through open space or undeveloped areas. Interactions with vehicles are limited to street crossings. Although they do not wear down as quickly as roadways, pathways do degrade over time, and their surfaces can get uneven creating a hazard for the bicyclists and pedestrians that use them. Therefore, similar to roadways, pathways periodically are in need of spot repairs or restoration. The City has created a capital improvement program to address this need. When the design agreement was approved, City Council directed staff to return with recommendations for the pathway material before finalizing design, with further direction to explore the feasibility of constructing a gravel pathway next to the existing asphalt pathway, and, on September 9, 2025, Staff presented the natural paving and the asphalt paving options and was directed to move forward with the natural paving option.
Analysis/Discussion
The Project design was completed and the Project advertised for bidding on February 27, 2026.
On March 27, 2026, eight bids were received and opened with the apparent low bid by AGD General Engineering Inc. for an amount of $148,800 which is 4.7 percent above the Engineer’s Estimate. The City Engineer has reviewed the bid from the low bidder and finds it to be complete and has determined it to be a responsive bid and recommends it for award.
The design agreement approved on November 26, 2024, with Moe Engineering, is scoped to include services through construction and project close-out and no changes to that contract are being requested at this time.
Following action by City Council, it is anticipated two weeks to execute the construction contract with work to begin within a couple weeks of that date. Once a Notice to Proceed has been issued, the Contractor has 20 working days to complete the work not counting any extra days granted for wet weather or material supply delays outside the Contractor’s control. Work, therefore, is anticipated to be substantially completed in early June. The trail will be closed to the public during construction.
Financial Considerations
This project was included in the City’s FY 2025/26 Budget with a total budget of $150,000.
Design, bidding, and construction management services are not to exceed $45,057, and additional misc. services including public noticing, site inspections and blueprinting has been $1,041, leaving $103,902 for the construction contract.
Accounting for the actual construction contract amount of $148,800, and a contingency of $15,000, the revised total Project amount is $210,000 which exceeds the prior authorized Project budget of $150,000 by $60,000. Staff are requesting approval of a budget transfer from the unappropriated General Fund balance to make up this difference. This budget amendment has been provided to the agenda item.
Environmental Issues
This action is found to qualify for a Class 1 Categorical Exemption under CEQA Section 15301 in that the project consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of the existing or former use.
