Item type: CONSENT CALENDAR (ACTION)

Subject: ADOPTION OF A RESOLUTION APPROVING FISCAL YEAR 26/27 SENATE BILL 1 LIST OF PROJECTS AS REQUIRED BY
THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017
Date: June 9, 2026
Written by: Craig Scott, Director of Public Works/City Engineer Recommendation
It is recommended the City Council of the City of Cotati adopt a resolution approving a list of projects for Fiscal Year 2026-27 funded by SB 1: the Road Repair and Accountability Act of 2017.

Background
In 2017, the California legislature passed the Road Repair and Accountability Act of 2017 (SB1).

The passage of SB 1 established a Road Maintenance and Rehabilitation Account (RMRA) that requires local agencies to demonstrate that a project, funded by SB 1, has been approved and described in adequate detail in a City resolution by July 1st every year. The RMRA funds have been provided to cities monthly starting January 2018.

Analysis/Discussion
To be eligible for funding in Fiscal Year 2026/27, the City must provide a City resolution to the California Transportation Commission (“CTC”) by July 1, 2026, of a list of projects planned to be funded with RMRA funds. This is an ongoing annual requirement for the City to remain eligible for the funds. The approved project list must include four statutorily required elements for each project:

1. Location

2. Description

3. Estimated useful life

4. Anticipated construction date.

The City’s 2024 Pavement Management Plan (PMP) lists all City streets with their condition and generally associated pavement rehabilitation method. The PMP guides the City’s street preservation efforts and informed the 2027 Street Preservation Project (Project). The pavement condition has been determined for this area and recommended treatment methods provided to the City. With the 2026 Street Preservation Project currently wrapping up, the City is to continue with another preservation project later this calendar year with the Project. While we are still bringing old roads up to good condition, the goal is to do two projects per year, one for street preservation and one for street rehabilitation, subject to funding availability. In FY25/26, funding was used on other Capital Projects (mainly park improvements) and, therefore, the street preservation project was completed but no street rehabilitation project. As part of the funding for the street projects, the City has been utilizing RMRA funds to be able to maintain additional miles of roads each year.

The Project is to slurry seal the “L” section streets. These streets were reconstructed in 2018 with Full Depth Reclamation in 2018 and it is good practice to perform maintenance with slurry seal after 6-8 years. Specifically, the streets intended to be slurry sealed are Lincoln Avenue, Lakewood Ave, Loretto Avenue, Larch Avenue, Linden Avenue, Linden Court, and Larkspur Court.

The FY 26/27 estimated RMRA (SB 1) funding of $213,301 accounts for pavement maintenance for approximately 5,205 centerline feet (based on slurry paving) of the total Project. A subset of the total streets to be paved was selected to closely align with the estimated RMRA available funds. These streets consist of the following:

Street From To Length Cost Estimate
Lakewood Ave Lincoln Ave La Salle Ave 1,800 $70,513
Larch Ave Lincoln Ave La Salle Ave 1,425 $55,823
La Salle Ave E. Cotati Ave Larkspur Ct 1,000 $43,921
La Salle Ave Larkspur Ct Loretto Ave 980 $43,044
Total 5,205 $213,301
These treatments have a useful life of approximately 6 years. Project construction is anticipated to begin in September 2026 and extend through October 2026. This construction period overlaps with the eligible period of RMRA fund expenditures of July 1, 2026, to June 30, 2027, and is therefore eligible for the FY26/27 RMRA funding.

Financial Considerations
SB1 requires that RMRA funds not replace local funding sources, including General Fund, gas tax, and Go Sonoma, and the City must maintain a “Maintenance of Effort” (in other words a certain level of funding to repair local roads) as if SB 1 funds were not available. The Maintenance of Effort is defined by SB1 and is derived from the annual State Controller’s Report.

The CTC has prepared guidelines for agencies to follow in meeting the RMRA (SB 1) requirements. The guidelines establish July 1, of each year as the deadline for agencies to submit the project resolutions. The estimated SB 1 amount for the City of Cotati for FY26/27 is $213,301, included in the City’s adopted FY 26/27 budget for Fund 221 and accounted for separately from other local funds being used for street preservation projects. The remainder of the needed funding for the Project ($536,699) will come from other City sources, in accordance with the approved FY 26/27 City budget
Environmental Issues
The action of adopting a resolution to meet the State legislative requirements to remain eligible to use the SB 1 funding for routine street maintenance projects does not constitute a project as defined by California Environmental Quality Act Guidelines Section 15378; therefore, no further environmental review is required
