RESOLUTION NO. (XX)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COTATI
APPROVING A SIDE LETTER AGREEMENT BETWEEN THE CITY OF COTATI AND THE COTATI EMPLOYEES ASSOCIATION AMENDING THE 2026–2031
MEMORANDUM OF UNDERSTANDING
WHEREAS, the City of Cotati ("City") and the Cotati Employees Association (CEA) are parties to a Memorandum of Understanding (MOU) effective July 1, 2026, through June 30, 2031; and
WHEREAS, following adoption of the MOU, the City and the CEA determined that clarification was needed to ensure the language contained in Section 9.01(A), Public Employees' Retirement System (PERS), accurately reflects the parties' historical negotiated agreement regarding retirement benefits for Classic Members – Tier 1; and WHEREAS, although the provisions outlined have been consistently administered by the City since their adoption, they were inadvertently not incorporated into subsequent Memoranda of Understanding; and
WHEREAS, the City and the Cotati Employees Association desire to incorporate those existing provisions into the current 2026-2031 Memorandum of Understanding to ensure the agreement accurately reflects the parties' long-standing understanding and administration of the negotiated retirement benefits; and
WHEREAS, approval of the Side Letter Agreement does not create additional fiscal impacts beyond those previously negotiated and anticipated under the existing Memorandum of Understanding.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Cotati as follows:
1. The foregoing recitals are true and correct and are incorporated herein by this reference.
2. The City Council hereby approves the Side Letter Agreement between the City of Cotati and the Cotati Employees Association, attached hereto as Exhibit B and incorporated herein by this reference.
3. The City Manager is hereby authorized to execute the Side Letter Agreement on behalf of the City and to take all actions necessary to implement its provisions.
IT IS HEREBY CERTIFIED that the foregoing resolution was duly adopted at a regular meeting of the City Council of the City of Cotati held on July 28, 2026, by the following vote, to wit:
