RESOLUTION TO APPROVE A CONTRACT FOR CODE ENFORCEMENT
SERVICES WITH WILLDAN ENGINEERING FOR UP TO $50,000 FOR FISCAL YEAR 2026/27 AND FOR UP TO TWO ADDITIONAL YEARS THEREAFTER WHEREAS, the Community Development Department is responsible for administering and enforcing provisions of the Cotati Municipal Code related to property maintenance, zoning compliance, public nuisances, and health and safety concerns; and WHEREAS, effective code enforcement helps preserve neighborhood quality, protect property values, promote public health and safety, and ensure compliance with applicable laws and regulations; and
WHEREAS, the City requires supplemental code enforcement services to address workload demands, provide specialized expertise, and maintain consistent levels of service to the community; and
WHEREAS, On May 7, 2026, the City of Cotati published a request for proposals to provide part time code enforcement services. The City received five responses and after reviewing all proposals, determined that Willdan Engineering was the best fit to meet the needs of the City.
WHEREAS, the proposed Professional Services Agreement was reviewed for compliance with Assembly Bill (AB) 339. Following a comparison of the proposed scope of services with the duties assigned to the City's recognized bargaining unit classifications, the City determined that the services are not currently performed by, nor available within, any existing bargaining unit classifications. Accordingly, the notification requirements of AB 339 are not applicable, and no notice to the City's recognized employee organizations was required; and WHEREAS, sufficient appropriations have been included in the Fiscal Year 2026–27 Operating Budget to fund the services provided under the proposed Professional Services Agreement; and
WHEREAS, the City Council finds that entering into an agreement with Willdan Engineering for code enforcement services is in the best interests of the City and its residents.
NOW THEREFORE BE IT RESOLVED, that the Council of the City of Cotati:
1. Approves an agreement with Willdan Engineering for contract code enforcement services in an amount not to exceed Fifty Thousand Dollars ($50,000).
2. Authorizes the City Manager to execute said agreement with Willdan Engineering and any non-substantive amendments necessary to provide code enforcement services on a part-time basis in an amount not to exceed $50,000 per year and to reauthorize this contract for up to two additional years after this fiscal year if the service needs of the city are being met in a professional and cost-effective manner.
3. This resolution shall take effect immediately upon its adoption.
