RESOLUTION NO. (XX)
AWARD OF A CONSTRUCTION CONTRACT FOR THE 2026/2027 PAVEMENT
PRESERVATION PROJECT
WHEREAS, the City of Cotati performs annual pavement maintenance projects throughout the City using various pavement preservation methods to maintain safe and serviceable roadways; and
WHEREAS, the location and scope of each annual project are determined through the City's Pavement Management Program (PMP), and the 2026/2027 Pavement Preservation Project (Project) includes improvements to streets commonly known as the "L Section"; and WHEREAS, the City Council awarded the design contract to Harris & Associates to prepare the Project design and bid documents, and following completion of the design, the Project was advertised for construction bids, which were opened on September 1, 2026; and WHEREAS, three construction bids were received, with Graham Contractors, Inc. submitting the lowest responsive bid of $328,736, which is 13% below the engineer's estimate of $377,679; and
WHEREAS, in August 2024, the City competitively selected Green Valley Consulting Engineers for construction management services based on demonstrated competence and professional qualifications consistent with Government Code § 4526 and the City's Procurement Policy, and based on the firm's continued qualifications and performance for the City, staff recommends amending its existing Professional Services Agreement to include Construction Management and Inspection services for the Project in an amount not to exceed $77,598; and WHEREAS, the city staff requested, and Green Valley Consulting Engineer’s provided, a proposal for Construction Management and Inspection services for the Project in an amount not to exceed $77,598, and City staff has reviewed the proposal and finds it to be fair and reasonable and recommends it for approval; and
WHEREAS, expenditures associated with the prior 2025/26 Street Project carried forward into Fiscal Year 2026/27, reducing available current-year appropriations, and a budget amendment of $50,000 utilizing remaining budget available from the prior fiscal year is necessary to provide sufficient budget authority for the Project; and WHEREAS, this action is found to qualify for a Class 2 Categorical Exemption under CEQA Section 15302 in that the project consists of replacement or reconstruction of existing structures and facilities where the new structure/facility will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced
NOW THEREFORE BE IT RESOLVED, the City Council of the City of Cotati determines the following:
1. The recitals above are true and correct, and
2. Awards the construction contract for the 2026/2027 Pavement Preservation Project to Graham Contractors, Inc. in the amount of $328,736; and
3. Approves an amendment to the existing Professional Services Agreement with Green Valley Consulting Engineers to incorporate Construction Management and Inspection services for the Project in an amount not to exceed $77,598; and
4. Approves a budget amendment of $50,000, as set forth in the budget amendment attached to the staff report, to provide sufficient Fiscal Year 2026/27 appropriations for the Project; and
5. Authorizes the City Manager to execute the construction contract, Professional Services Agreement amendment, and any necessary change orders or amendments within the approved Project budget; and
6. Authorize the budgetary return of unused appropriations back to the originating funds upon completion and closeout of the Project.
