RESOLUTION NO. (XX)
2026 COTATI CHAMBER OF COMMERCE OKTOBERFEST IN LA PLAZA PARK WHEREAS, the Cotati Chamber of Commerce submitted an application to the City for the Cotati Oktoberfest, 2026; and
WHEREAS, it will be necessary to conform to certain conditions as described in “Exhibit A,” attached hereto, to facilitate this event; and WHEREAS, the City Council finds that this event is part of a comprehensive economic development strategy by the Chamber of Commerce in that it increases visitation to the City, promotes the Cotati community and results in increased sales tax revenues; and WHEREAS, the City Council further finds that the health, safety, and welfare of the citizens of the City of Cotati will not be jeopardized by the approval of this event; and WHEREAS, the application for this event is attached as Exhibit B; and WHEREAS, in accordance with the City’s license agreement (License Agreement) with the Chamber of Commerce, the Chamber is entitled to rent La Plaza Park two times per year without a rental fee; and
WHEREAS, because the City is a partner in these events, it is recommended that the City fund the remaining fees to facilitate these events (estimated at $1,888); and WHEREAS, the action of approving an Oktoberfest event does not constitute a project as defined by California Environmental Quality Act Guidelines Section 15378; therefore, no further environmental review is required.
NOW THEREFORE BE IT RESOLVED, that
Section 1. Findings. The above recitals are declared to be true and correct and are incorporated herein as findings of the City Council.
Section 2. Approval of Conditions. The City Council hereby approves the conditions of approval for this event, attached as Exhibit A.
Section 3. Approval of Fee Waivers for Cotati Chamber of Commerce. The fee waiver for the park permit has been previously waived in accordance with the License Agreement. For this event, the estimated cost of City banner hanging, street closure, and restroom cleaning requires an additional City contribution from the City's General Fund of $1,888, as described in the accompanying Staff Report, is hereby approved to facilitate these events.
Section 4. Effective Date of this Resolution. This Resolution shall become effective immediately.
Section 5. Severability. Each portion of this resolution is severable. Should any portion of this resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining resolution portions shall be and continue in full force and effect, except as to those resolution portions that have been adjudged invalid. The City Council of the City of Cotati hereby declares that it would have adopted this resolution and each section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that one or more section, subsection, clause, sentence, phrase or other portion may be held invalid or unconstitutional.
