AGENDA ITEM REPORT
ITEM NO. CC 15
Meeting: October 15, 2024
Title: Badillo Street and Azusa Avenue Water Main Replacement Project – Project No. W2402 – Final Acceptance and Filing Notice of Completion
Presented by: Rafael M. Fajardo, Interim Director of Public Works/City Engineer Recommendation: 1. Accept the work performed by GRBCON, Inc;

2. Authorize the City Clerk to file a Notice of Completion for the Badillo Street and Azusa Avenue Water Main Replacement Project – Project No. W2402; and

3. Approve Resolution CC 2024-98 appropriating $89,426.63 from Water CIP Fund – Fund Balance for use towards completion of this project.

EXECUTIVE SUMMARY/BACKGROUND:

On September 5, 2023, the City Council approved a contract with GRBCON, Inc in the amount of $814,045 for the installation of approximately 500 linear feet of 12-inch water main, 65 linear feet of 8-inch water main, water services and fire hydrant(s) at the intersection of Badillo Street and Azusa Avenue. Project construction has been completed and City staff recommends acceptance of the work performed by GRBCON, Inc and authorization for the City Clerk to file a Notice of Completion (Attachment A) for the Badillo Street and Azusa Avenue Water Main Replacement Project – Project No. W2402.

DISCUSSION:

The water main at the intersection of Badillo Street and Azusa Avenue was installed circa 1952. It has seen an increase in leak activity during the last few years and has reached the end of its useful life. The Badillo Street and Azusa Avenue Water Main Replacement Project will help sustain increased demands within the Zone 1 service area and will enhance fire protection by upsizing the water main up to 12” in diameter, while adding additional fire hydrants.

During construction, the need for additional work not included in the original scope of work was identified by the City. As a result, the City Engineer reviewed and approved the following change orders, increasing the overall contract amount by $87,396.20 as follows:
 Change Order No. 1 – Increased the overall contract amount by $79,680.20 for costs associated with new requirements from the Metropolitan Water District (MWD) including conflict prevention in the future.
 Change Order No. 2 – Increased the over contract amount by $7,716.00 for quantity adjustments.

FISCAL IMPACT:

AGENDA ITEM REPORT
ITEM NO. CC 16
Meeting: October 15, 2024
Title: Request to Reorganize the Existing Staffing Structure of the Department of Public Works, Parks Maintenance Division
Presented by: Rafael M. Fajardo, Interim Director of Public Works/City Engineer Recommendation: That the City Council approve a proposed amendment to the current staffing organization of the Department of Public Works’ Parks Maintenance Division.

EXECUTIVE SUMMARY/BACKGROUND:

Within the past two months, the Department of Public Works’ Parks Maintenance Division has borne the retirement of two (2) employees, resulting in the vacancy of two (2) part-time Park Maintenance Assistant positions. In combination with an existing part-time Park Maintenance Assistant vacancy, the Division is now understaffed by three (3) essential part-time personnel. This deficit in staffing leaves a strain on the Division, making it difficult to maintain current efforts to perform daily functions, assist with City-sponsored events, and respond to after-hour needs. As such, in an effort to enhance the functionality and better meet the current needs of the Division, staff recommends the consolidation of two (2) vacant part-time Park Maintenance Assistants into one (1) full-time Park Worker.

DISCUSSION:

Currently, the Department’s Parks Maintenance Division is comprised of four (4) full-time positions and three (3) part-time positions. Within the next few months, all three part-time positions will be vacant, leaving the Division significantly understaffed particularly as the number of facilities has increased. Within the past five (5) years, the Department of Public Works has opened the new Banna Park, a walking/bike trail at Covina Park, a Pickleball Court at Hollenbeck Park, a new Skate Park, new playground equipment at Covina Park and many more recreational amenities that require continued maintenance/repairs. Furthermore, the number of park facilities to maintain will continue to increase with upcoming projects including a walking/bike trail at Hollenbeck Park and, most impactfully, the Covina Recreation Village. In addition to routine maintenance of these facilities, Parks Maintenance staff also assists the Parks & Recreation Division with special events and responds to afterhour callouts across the City.

To meet the current needs and in anticipation of the additional responsibilities of the Parks Maintenance Division, City staff is requesting the consolidation of two (2) vacant part-time Park Maintenance Assistants into one (1) full-time Park Worker. This will reorganize the existing personnel structure to increase full-time positions from four (4) to five (5), and reduce part-time positions by two (2).

In the forthcoming years, the fully burdened salary for the new full-time Park Worker will be included in the annual budget process, commencing with Fiscal Year 2025-2026.

COVINA HOUSING AUTHORITY
ANNUAL REPORT FY 23-24
Health and Safety Code Sections 34328 and 34328.1 require all housing authorities to file an annual report by October 1st with the City Clerk and the Department of Housing and Community Development. The requirements of the report follow.

A. Background
In FY 2010-2011, the Housing Authority was activated by the Covina City Council. City resolution No. 11-6926, adopted January 25, 2011, declared that there is a need for a housing authority, declared that all members of the City Council shall be the Commissioners of the Housing Authority and designated the mayor as the interim chairman of the housing authority.

On January 30, 2012, by Resolution 12-7045, the Covina City Council elected not to retain the housing assets and functions previously performed by the Covina Redevelopment Agency, which was dissolved pursuant to Part 1.85 of Division 24 of the California Health and Safety Code. All rights, powers, duties and obligations, including any encumbered amounts on deposit in the Agency’s Low-and Moderate Income Housing Fund, were transferred to the Covina Housing Authority.

On April 3, 2012, by Resolution 12-004, the Successor Agency to the Covina Redevelopment Agency recommended approval of the transfer of housing assets and properties of the former Agency to the Housing Authority by the Oversight Board.

On April 5, 2012, by Resolution 12-01, the Oversight Board directed the Successor Agency to transfer housing responsibilities and all rights, powers, duties and obligations associated with the housing activities of the Covina Redevelopment Agency along with the transfer of encumbered low-and moderate income housing funds designated for housing projects to the Covina Housing Authority pursuant to Health and Safety Code Sections 34176, 34177 and 34181. The Oversight Board approval was sent to the state Department of Finance for final approval. The transfer of the housing functions and duties were not questioned by the State Department of Finance, and so were approved.

Pursuant to Health and Safety Code section 34176 (a)(2) the Authority submitted a Housing Assets Transfer Form to the Department of Finance in July 2012. By letter dated August 30, 2012, the State Department of Finance approved the Housing Asset Transfer Form. The form was later amended, and the Amended Housing Asset Transfer Form was approved by the State Department of Finance by letter dated February 21, 2013.

The housing assets and functions assumed by the Housing Authority are as listed in Exhibit A to the Annual Report. In addition, the following rental properties will be monitored annually.

AGENDA ITEM REPORT
ITEM NO. CC 18
Meeting: October 15, 2024
Title: Use Classification Determination on “Physical Therapy” Uses as a “Medical Office/Clinic” Use
Presented by: Brian K. Lee, AICP, Director of Community Development Recommendation: City Council adoption of Resolution CC 2024-91, approving a Use Determination concluding that “Physical Therapy” uses are similar to “Medical Office and/or Clinic” uses and making a finding exemption under the California Environmental Quality Act (CEQA) guidelines.

EXECUTIVE SUMMARY:

On August 27, 2024, the Planning Commission conducted a meeting seeking clarification on defining and classifying “physical therapy” uses. The Planning Commission concurred with the staff’s analysis that “physical therapy” uses function and operates similarly to a “medical office and/or clinic” and that physical therapists are licensed healthcare professionals who evaluate a patient’s physical status, establish a plan of care, and administer treatments. The Planning Commission directed staff to prepare a resolution for the use determination for their review and approval consideration.

On September 24, 2024, the Planning Commission adopted Resolution No. 2024-017 PC by a 5-0-0 vote, recommending the City Council approve Resolution CC 2024-91, approving the Use Determination.

FISCAL IMPACT:

The consideration of the proposed Use Determination will not have a fiscal impact.

CEQA (CALIFORNIA ENVIRONMENTAL QUALITY ACT):

Under the California Environmental Quality Act (CEQA), City staff has determined that the proposed Use Determination would not result in, or have a potential for resulting in, either a direct or indirect physical change in the environment or a reasonably foreseeable indirect physical change in the environment and, accordingly, does not qualify as a “project” under the California Environmental Quality Act (“CEQA”) (Cal. Pub. Resources Code, Section 21000 et. seq.) and the CEQA Guidelines (Cal. Code Regs., tit. 14, Section 15000 et. seq.), as defined in CEQA Guidelines Section 15061

AGENDA ITEM REPORT
ITEM NO. CC 20
Meeting: October 15, 2024
Title: Update on Annexation Process of Unincorporated Islands within the City of Covina Presented by: Chris Marcarello, City Manager
Recommendation: Receive and file the status update.

EXECUTIVE SUMMARY:

At its September 17, 2024 regular meeting, the City Council requested an overview of the annexation process for Unincorporated Los Angeles territory within the City’s Sphere of Influence. The following report provides a brief update on the topic and annexation process with the County of Los Angeles (“County”) and the Local Agency Formation Commission (“LAFCO”).

DISCUSSION:

LAFCO provides a process that allows cities to incorporate areas into their communities and has identified unincorporated territory that could be annexed into the City of Covina. A brief summary of steps involved in this process includes:
 Meeting with representatives from LAFCO to discuss the application process and preparation of maps and boundary information needed to proceed.
 Meeting with representatives from the County of Los Angeles to discuss the process and timing related to a potential annexation of some or all of these unincorporated areas.  Coordination with LAFCO to prepare GIS maps of unincorporated areas.  Obtaining proposals for professional land surveyor services to develop legal descriptions for the unincorporated areas.
 Obtaining proposals from an economic consultant to assist in negotiations to ensure the sustainability of public services for unincorporated areas. This may include a financial analysis of existing property tax resources, infrastructure needs, public safety services and other public services that are currently provided by the County.

Following these steps, a full application package is prepared regarding the potential annexation of areas. This application consists of a resolution that includes the application, CEQA findings, pre-zoning ordinance, party disclosure form, LAFCO application form, maps/geographic description and related filing fees. Following the City Council’s consideration to proceed with an annexation application, the following steps would take place over roughly two to three years.
 LAFCO distributes the application proposal to impacted public agencies;  The County of Los Angeles distributes the proposal to County departments and service providers;  The County initiates a review of property tax revenues and property tax exchange for the unincorporated areas;
 City and County staff engages in negotiations related to property tax exchange amounts, needed infrastructure improvements and other public services; and  Public outreach to potential annexation areas.

Page 251 of 298 ends

Once deal points are agreed upon, LAFCO would proceed with noticing, public hearings and the processing of boundary changes.

FISCAL IMPACT:

There is no financial impact with receiving and filing this report. Should the Council decide to pursue further discussion on the topic, it would be appropriate to develop more detailed cost estimates and timelines for additional consideration.

ITEM NO. CC 21
Meeting: October 15, 2024
Title: Request to Amend the City’s Classification Plan for the Finance Department Presented by: Theresa Franke, Interim Finance Director
Joanna Espinosa, Senior Human Resources Analyst
Recommendation: Amend the Fiscal Year 2025 Budget to revise the approved budgeted fulltime position of Payroll Analyst in the Finance Department to that of Senior Payroll Analyst.

EXECUTIVE SUMMARY:

The current approved personnel budget for full-time regular positions in the Finance Department includes one Finance Director, one Senior Management Analyst, two Senior Accountants, one Accountant, four Account Clerk I/II, one Payroll Analyst, one Payroll Technician, and one Administrative Technician. With the pending retirement of the incumbent Administrative Services Director, duties have been redistributed throughout the department. As such, it is recommended that the position of Payroll Analyst be reclassified to Senior Payroll Analyst.

DISCUSSION:

On August 20, 2024, City Council approved the reorganization of the Administrative Services Department to reestablish a Finance Department and transition Human Resources functions to the City Manager’s Office.

In examining the functions of the Covina Finance Department, the incumbent Payroll Analyst has taken on additional responsibilities. This includes enhancing the use of Munis to streamline processes, supporting the citywide budget administration, and supervising staff in payroll functions to ensure that critical deadlines and city operations are met.

To strengthen succession planning and acknowledge the increased and anticipated responsibilities taken on by the current Payroll Analyst, staff recommends that the position be reclassified to Senior Payroll Analyst as an overall benefit to the organization.

FISCAL IMPACT:

Additional cost incurred will be offset by the savings from the pending retirement of the Administrative Services Director.

Title: Authorization to Prepare Construction Documents for Urban Greening Elements at Royal Oak Middle School in Accordance with CalFIRE Grant Requirements Presented by: Chris Marcarello, City Manager
Brian K. Lee, Director of Community Development
Daniella Andrade, Management Analyst
Recommendation: That the City Council:

1. Review/Approve the conceptual designs; and

2. Authorize the Superintendent and City Manager to integrate any design feedback into final design plans and prepare construction documents in accordance with CalFIRE grant requirements.

EXECUTIVE SUMMARY:

In late 2022, the City Council and Charter Oak Unified School District Board approved a memorandum of understanding between both agencies to partner in grant applications and share related costs in the design development for the future use of District fields/facilities located at Royal Oak Middle School (“ROMS”) property, at 303 S Glendora Avenue. The City/District was successful in its competitive grant application to the California Department of Forestry and Fire Protection’s (“CalFire”) Urban and Community Forestry Grant Program (“Grant Program”) for urban greening activities at the ROMS campus, receiving notice of intent to award from the granting agency in the Summer of 2023. In December 2023, the City entered into a Grant Agreement with CalFIRE allowing work to officially begin. The Grant Program provides $198,000 for the completion of public outreach/engagement activities and the preparation of landscaping/engineering designs at ROMS, with a focus on stormwater infiltration improvements, increasing tree canopies, and creating outdoor classroom areas in non-athletic field areas. The City and COUSD are also contributing to the project funding through a $50,000 local match requirement, split evenly.

Following this work, it is appropriate for the City Council and District Board to finalize design plans and authorize the completion of construction documents in accordance with CalFire grant requirements. It is important to note that this phase of work focuses on non-athletic field areas and that the City/District are pursuing other grant and/or funding opportunities for the renovation of the sports fields/facilities which are not eligible expenses under the CalFIRE grant award.

Civic Engagement Summary
Civic Engagement played an instrumental role in the development of the concept/design. Conceptual designs were drafted after the first round of civic engagement was completed and survey data/community feedback was assessed by the COUSD and City staff. Civic Engagement for the planning project was spearheaded by the local non-profit Active SGV which consisted of the following:
 Three (3) Pop-Up Events at ROMS
 Mailer notifications (3,300) mailers with links to an online survey  Social media outreach
 Survey in hardcopy and online (Spanish & English)
 Project fact sheet (Spanish & English)

Page 255 of 298 ends

 In-person canvassing within a .25-mile radius of ROMS (300 homes visited)  Text messages to over 20,000 residents within a .25-mile radius of ROMS) The intent of the first round of civic engagement strategies was to 1.) inform the public of the grant-funded project, and 2.) gather information regarding the ROMS surrounding community, the property’s uses, and where the community would like to see specific green elements added to the property. A draft concept was developed after careful consideration of the community survey and feedback and was recirculated to the community for further input at a follow-up pop-up event at the ROMS property. The feedback has been generally supportive of this planning project. The concept features several areas that are greyed out as ‘not in scope’ due to the high volume of feedback/comments relating to the preservation of an “open field” or “open grass area” for soccer and other sports facilities, which are not eligible expenses under this grant award.

Following these activities, Active SGV will conduct a final update to the community in the form of community mailers, an email notification to survey respondents who opted to be added to a “Friends of Royal Oak” mailing list, and a final community “pop up event” to communicate the results of the design.

FISCAL IMPACT:

The action does not result in a fiscal impact. The local match requirement had been authorized by the City Council in February 2024.

CEQA (CALIFORNIA ENVIRONMENTAL QUALITY ACT):

This action is exempt.

Recommendation: 1. City Council to open the public hearing and consider public testimony and close the public hearing; and

2. Adopt Resolution CC 2024-92, authorizing the annexation of territory to Community Facilities District No. 2007-1 (Annexation No. 34; 837 N. Sunflower Avenue, Covina) and authorizing the levy of a special tax and submitting the levy of tax to the qualified electors; and

3. Adopt Resolution CC 2024-93, calling a special election and submitting to the voters of Annexation No. 34 of City of Covina Community Facilities District No. 2007-1 (Public Services), propositions regarding the annual levy of special taxes within Annexation No. 34 to finance public services, and the establishment of an appropriations limit; and

4. Adopt Resolution CC 2024-94 making certain findings, certifying the results of an election and adding property to Community Facilities District No. 2007-1 (Public Services), Annexation No. 34.

EXECUTIVE SUMMARY:

At the August 20, 2024, City Council meeting, the Council adopted the boundary map showing territory proposed to be annexed as Annexation No. 34 and declared its intention to authorize the annexation of that territory to Community Facilities District (CFD) No. 2007-1 (Public Services).

The purpose of the CFD is to finance the public safety and park services that are provided to the territory within the District beyond that provided by the City generally. In Fiscal Year 2024-2025 it has been determined that the cost of these services, for each additional multi-family residential home, will be $861.05 per year. This program has been conceived with the intention that all future residential development, which results in a net increase of non-exempted residential units, would be required to annex to the CFD. The project at 837 N. Sunflower Avenue, Covina, has a total of one (1) new residential unit. The special tax will be applicable to the one (1) residential unit in Annexation No. 34.

DISCUSSION:

The purpose of the public hearing is to 1) authorize the annexation of territory to the CFD (Annexation No. 34); 2) call and hold an election of property owners within the CFD, and 3) authorize the levy of a special tax within Annexation No. 34 to the CFD. The related resolutions are hereby presented to the City Council, pursuant to the Conditions of Approval for one (1) single-family residence to be built at 837 N. Sunflower Avenue, Covina, California.

Pursuant to the Conditions of Approval for development of a new single-family development at 837 N. Sunflower Avenue, Covina, the applicant agreed to annex to the CFD, or to pay an in-lieu fee based on the financial impact on Police, Fire, Emergency, and Parks services. The builder opted to annex into the CFD. Under the proposed

Page 267 of 298 ends

CFD, in Fiscal Year 2024-2025, any newly constructed, non-exempted single-family residential units are charged $861.05 per year for the following services: police, fire protection and suppression, paramedic services, and park maintenance. This Special Tax appears on the annual Property Tax bill for each unit. The Special Tax authorized by the CFD shall be levied on all units for which building permits were issued on or before May 1 of the preceding fiscal year.

FISCAL IMPACT:

The “Special Tax” authorized by the proposed Community Facilities District (CFD) will generate $861.05 annually, based on one (1) single-family residential unit at the FY 2024-2025 tax rate of $861.05 per single-family home and will be deposited to Account No. 2740-4800-45800. The Special Tax shall be used to pay for the following additional services in the District: police, fire protection and suppression, paramedic services, and park maintenance. The Special Tax will increase annually by the greater of two percent (2.00%), or the percentage change in the Consumer Price Index.

CEQA (CALIFORNIA ENVIRONMENTAL QUALITY ACT):

Staff has determined that the annexation of the does not constitute a “project” under the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15378(b)(4) because such annexation involves the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment.

Respectfully submitted,

The special taxes shall be those as originally authorized through the formation of CFD No. 2007-1 and adopted by Ordinance of this legislative body, and no changes or modifications are proposed in the special taxes from those as originally set forth and made applicable to CFD No. 2007-1.

The City Clerk was the election official to conduct the election and provided each landowner in the territory to be annexed to CFD No. 2007-1, a ballot in the form of Exhibit “B”, which form is hereby approved. CC Regular Meeting

AGENDA ITEM REPORT
ITEM NO. PH 2
Meeting: October 15, 2024
Title: Public Hearing for the Expenditure of the 2024 Edward Byrne Memorial Justice Assistance Grant (JAG)
Presented by: David Povero, Chief of Police
Recommendation: Hold the public hearing and receive and file proposed program for expenditure of 2024 Edward Byrne Memorial Justice Assistance Grant (JAG).

EXECUTIVE SUMMARY:

Notification was received from the Department of Justice, Office of Justice Programs Bureau of Justice Assistance, that the Covina Police Department is eligible to receive $10,905 from the JAG 2024 program. This figure is based on population and crime statistics.

DISCUSSION:

Previous JAG allocations have been used to fund the part-time Community Services Officer (CSO) position assigned to manage the Youth Accountability Board (YAB). The 2023 JAG grant allocations are currently being used for this activity. Previous allocations of JAG grants have all been used to support this program and this newest appropriation of JAG 2024 ($10,905) will do the same but as part of a larger endeavor.

The tasks that the CSO performs include Preventive Juvenile Diversion, Victims advocacy, and neighborhood watch /Crime Prevention. This position will continue to work alongside educators and school resource officers to identify troubled students. The CSO will meet with the students, their family members, and school staff to provide resources, counseling, and assistance to deal with problems and divert students away from the criminal justice system.

Other tasks include:
• Aiding in the investigation to identify victims of domestic violence, sexual abuse, and other significant crimes. • Reach out to victims to inform them of resources and coordinate assistance. • Coordinate and communicate with neighborhood watch groups by scheduling meetings, connecting citizens with resources, and participating in community events.
• Maintain statistical data and records on the above programs.

FISCAL IMPACT:

Upon receipt of the final notification that the award has been awarded to the City, staff will bring back before the Council a resolution to increase the Police Department's revenue and expenditure budget under fund 2271 by $10,905 which is the award amount. There is no additional appropriation needed from the General Fund.
