AGENDA ITEM REPORT
ITEM NO. CC 7
Meeting: November 4, 2025
Title: Declaring Real Property Owned by the City as Exempt Surplus Property that is no Longer Necessary for the City’s Use; Authorization to Proceed with the Sale of the Property, and Finding that this Action Exempt from the Provisions of CEQA Presented by: Brian K. Lee, Deputy City Manager/Director of Community Development Rafael M. Fajardo, Director of Public Works/City Engineer Recommendation: That the City Council:
1. Adopt Resolution CC 2025-114, declaring City-owned real property at the southwest corner of Grand Avenue and Hurst Avenue (APN #8429-004-900) as surplus and finding that it is exempt from the Surplus Land Act;
2. Authorize the City Attorney to make minor revisions, if necessary, to the Resolution prior to submittal to the California Department of Housing and Community Development;
3. Find that this action is exempt from the provisions of CEQA; and
4. Authorize the City Manager, or designee to initiate an appraisal and advertisement of the real property for sale.
EXECUTIVE SUMMARY:
Pursuant to the California Surplus Land Act (“Act”), the City Council must declare property as either “surplus land” or “exempt surplus land” before the City can dispose of it. “Exempt surplus land” is real property owned in fee simple that is not necessary for the City’s use and that falls within one of the exemptions specified in the Surplus Land Act. If the City Council declares the property as “exempt surplus land,” the City may sell the property without conducting the Notice of Availability Process through the California Department of Housing and Community Development.
Accordingly, it has been determined that City-owned property located at the southwest corner of Hurst Street and Grand Avenue (APN #8429-004-900) meets the definition of “exempt surplus land” that is described in the Act.
This property was previously utilized as a water well/pumping facility before being decommissioned on February 8, 2022. Since its decommissioning, the property has sat vacant and the City has determined that it has no other use for the real property. As such, it is recommended that the City Council consider adopting Resolution CC 2025-114, declaring the property as exempt from the Surplus Land Act and authorizing the appraisal and advertisement process for the property’s sale.
DISCUSSION:
The City owns real property (“Water Property”) at the southwest corner of Grand Avenue and Hurst Street that has historically been utilized as a water well/pumping facility. Over time, the operation of this well site became inefficient due to the City’s limited number of prescriptive pumping rights in the main San Gabriel Basin, which provides roughly 383 acre-feet (roughly 7.5%) of the total 5,177 acre-feet of water needed to supply the City’s service territory. Additionally, in order to operate this well site, costly modifications would be needed to treat the groundwater sources and make them suitable for consumer use. Because of this, it was determined that the operation and modification of this well/pumping facility would not be economically feasible. As such, the water well/pumping facility was decommissioned in 2022 and the property has sat vacant since this time.
The Water Property is 7,010 square feet in size and is located directly adjacent to a detached single-family residential neighborhood within the jurisdiction of Los Angeles County. Further, the development pattern of the adjoining neighborhood is single-family residential, and the reuse of the subject property as a single-family residence would be the most practical. Thus, for the aforementioned reasons, the relationship of the surplus Water Property limits the most practical potential reuse of the property to a single-family residential use.
Subject Property
The California Government Code Section 54221(f)(1)(B) defines “exempt surplus land” to mean surplus land that is less than one-half (1/2) acre in size, not contiguous to land owned by a State or local agency that is utilized for open-space or low and moderate-income housing. Based on this definition, it has been determined that the subject real property is not necessary for the City’s use and qualifies as exempt surplus land.
FISCAL IMPACT:
There is no fiscal impact at this time. There may costs to the City relative to the sale of the property, including real estate commissions and appraisals. Any future disposition of the property will be subject to consideration by the City Council.
CEQA (CALIFORNIA ENVIRONMENTAL QUALITY ACT):
The recommended action by the City Council to declare the property on the SWC of Hurst Street and Grand Avenue as Exempt Surplus Land and to authorize the sale of the property qualifies for a Class 12 (15312) Categorical Exemption of the California Environmental Quality Act (CEQA) in that the sale of exempt surplus land by the City of Covina in that the land is not located in an area of statewide, regional, or areawide concern.

WHEREAS, the City of Covina (“City) is the owner in fee simple of that certain real property located at SWC Hurst Street & Grand Avenue (APN: 8429-004-900 & 8429-004-270) and further described in Exhibit “A,” attached hereto and made a part of hereof (“Property”); and WHEREAS, under Section 54221(b) of the Surplus Land Act, Government Code Sections 54220-54234 (“Act”), surplus land is land owned in fee simple by the City for which the City Council takes formal action in a regular public meeting declaring the land is surplus and not necessary for the City’s use. The land must be declared either surplus land or exempt surplus land; and
WHEREAS, under the Act, land is necessary for the City’s use if the land is being used, or is planned to be used pursuant to a written plan adopted by the City Council, for City work or operations; and
WHEREAS, the Property is approximately 7,010 square feet and is vacant; and WHEREAS, City staff has evaluated the Property for its potential to be used for City work and operations and has determined that the Property is not suitable for the City’s use; and WHEREAS, Government Code Section 54221(f)(1)(B) provides that “exempt surplus land” means surplus land that is less than one-half acre in size and not contiguous to land owned by a state or local agency that is used for open-space or low and moderate-income housing purposes; and
WHEREAS, the Property is less than one-half acre in size, not contiguous to land owned by a state or local agency that is used for open-space or low and moderate-income housing.
Further, the Property does not meet any of the conditions described in paragraph (2) of Government Code Section 54221(f); and
WHEREAS, the City Council desires to declare that the Property is exempt surplus land and not necessary for the City’s use; and
WHEREAS, the Act provides that the City may dispose of property declared exempt surplus land without further regard to the requirements of the Act, except for the requirement to notify the California Department of Housing and Community Development (“HCD”) at least 30
days prior to disposition of the property; and
WHEREAS, the accompanying staff report provides supporting information upon which the declaration and findings set forth in this Resolution are based.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COVINA, CALIFORNIA, HEREBY RESOLVES AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are a substantive part of this Resolution.
SECTION 2. Pursuant to Government Code Sections 54221(b) and 54221(f)(1)(B), the City Council hereby declares that the Property is exempt surplus land and not necessary for the City’s use.
SECTION 3. This Resolution has been reviewed with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) (“CEQA”).
The City Council hereby finds that it can be seen with certainty that the declaration of exempt surplus land has no likelihood of causing a significant negative effect on the environment. This finding is premised on the fact that no project or physical changes are proposed for the Property and this declaration is merely an administrative procedure before the City may dispose of the Property. Based upon these findings, the City Council determines that this Resolution is exempt from the application of the California Environmental Quality Act, pursuant to Section 15061(b)(3) of the State CEQA Guidelines.
SECTION 4. The City Clerk is directed to file a Notice of Exemption pursuant to CEQA Guidelines Section 15062.
SECTION 5. Staff of the City are hereby authorized and directed to provide a copy of this Resolution to HCD in the form and manner required by HCD at least 30 days prior to the disposition of the Property.
SECTION 6. The officers and staff of the City are hereby authorized, jointly and severally, to do all things which they may deem necessary or proper to effectuate the purposes of this Resolution, and any such actions previously taken are hereby ratified and confirmed.
SECTION 7. The City Clerk shall certify the adoption of this Resolution.
APPROVED and PASSED this 4th day of November, 2025.

Waive full reading, read by title only, and introduce Ordinance 25-13 entitled “An Ordinance of the City Council of the City of Covina adopting by reference codes comprising the 2025 Edition of the California Building Standards Code (California Code Of Regulations, Title 24, Parts 1 - 12), including the 2025 Editions of the California Administrative Code, California Building Code Volumes 1 and 2 including Appendices A B, D, F, I, J, N, O and P, California Residential Code including Appendices AA, BB, BF, BG, BH, BI, BJ, BK, BL, BM, BN, BO, CI, and CJ, California Green Building Standards Code, California Mechanical Code, California Plumbing Code, California Electrical Code, California Fire Code, California Existing Building Code, California Energy Code, California Historical Building Code, California Referenced Standards Code, and the California Wildland-Urban Interface Code, together with certain additions, insertions, deletions and changes, amending Title 14 of the Covina Municipal Code, and approving a CEQA exemption determination”; and
2. Schedule a public hearing for December 2, 2025, to receive public input on the proposed adoption by reference of the aforementioned Codes.
EXECUTIVE SUMMARY:
The California Health and Safety Code Section mandates that the California Building Standards Commission adopt and publish the California Building Standards Code (Title 24, Parts 1 through 12, of the California Code of Regulations) every three years. The 2025 Edition of the California Building Standards Code becomes effective statewide on January 1, 2026. Local agencies may amend Codes comprising the California Building Standards Code, provided any amendments of building standards are supported by express findings.
DISCUSSION:
The California Health and Safety Code Section mandates that the California Building Standards Commission adopt and publish the California Building Standards Code (Title 24, Parts 1 through 12, of the California Code of Regulations) every three years. The 2025 Edition of the California Building Standards Code becomes effective statewide on January 1, 2026. Local agencies may amend Codes comprising the California Building Standards Code, provided any amendments of building standards are supported by express findings.
The list below identifies the specific Codes proposed for adoption, as well as the model codes upon which the 2022 Title 24 regulations are based:
California Building Standards Code Reference Model Code 2025 California Administrative Code
2025 California Building Code 2024 International Building Code 2025 California Residential Code 2024 International Residential Code
2025 California Electrical Code 2023 National Electrical Code 2025 California Mechanical Code 2024 Uniform Mechanical Code 2025 California Plumbing Code 2024 Uniform Plumbing Code 2025 California Energy Code
2025 California Wildland-Interface Code
2025 California Historical Building Code
2025 California Existing Building Code 2024 International Exist. Bldg. Code 2025 California Green Building Standards Code
2025 California Referenced Standards Code
2025 California Fire Code 2024 International Fire Code
2023 Los Angeles County Fire Code
2024 International Property Maintenance Code (not
part of Title 24)
As described above, local agencies are allowed to amend the California Building Standards Code and other uniform Codes. However, to maintain a uniform minimum level of regulation throughout the state, any amendments to building standards must be justified by express findings reflecting specific conditions unique to the local jurisdiction. The amendments being proposed by staff are limited to administrative or procedural clarifications of the various Codes and concern themselves with subjects that either are not covered by the Codes or are reasonably necessary to effectively implement the Codes. Excepting for modifications to the 2025 California Residential Code, none of the proposed amendments make changes to the building standards set forth in the Codes and, therefore, express findings of unique local conditions are not required.
FISCAL IMPACT:
As the Ordinance addresses only regulations and not fee schedules, the proposed action will entail addition review, oversight, and staff training.
CEQA (CALIFORNIA ENVIRONMENTAL QUALITY ACT):
The adoption of this Ordinance is exempt from CEQA pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378), of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3.
Respectfully submitted,

Submittal documents and other data submitted for review may thereafter be destroyed as required by the City’s records retention schedule.
The building official may extend the time for action by the applicant for a period not exceeding 180 days on written request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. An application shall not be extended more than once.
An application shall not be extended if this code, or other pertinent laws or ordinances, have been amended after the date of application. In order to renew action on an application after expiration, the applicant shall resubmit submittal documents and pay a new plan review fee.
14.04.060 Section 105 – Permits – Amended – Expiration.
Subsection 105.5 is hereby amended to read as follows:
105.5 Expiration. Except as set forth in subsection 105.5.1, every permit issued for property within the City shall expire by limitation and become null and void as follows:
1. If work authorized by such permit is not commenced within 365 days from the issuance date of such permit.
2. If work authorized by such permit is commenced within 365 days from the issuance date of such permit, such permit shall expire by limitation and become null and void if the work authorized by such permit is suspended or abandoned. For
purposes of this subsection, ‘suspended or abandoned’ shall mean that the permittee has, for a period of 180 days or longer after commencing the work authorized by such permit, failed to make substantial progress toward completion of the work, as determined by the Building Official after inspection. The building official may, in his or her discretion, grant, in writing, one or more extensions of time, for periods of not more than 180 days each. The extension shall be requested in writing and justifiable cause demonstrated.
3. In the event of permit expiration, before work authorized pursuant by the expired permit can be commenced or recommenced, a new permit shall first be obtained (hereafter, a ‘renewal permit’). To obtain a renewal permit, the applicant may be required to resubmit plans and specifications, if deemed necessary by the building official and/or chief planning official. The applicant must pay all applicable fees, including, but not limited to, a plan check fee and building permit fees, in the amount then established by resolution of the city council. If renewal permits are applied for, a mandatory site inspection shall be performed by the Building and Safety Department to determine compliance of existing conditions and materials with this code. All work to be performed under a renewal permit must be performed in accordance with all applicable technical codes, regulations, laws, and ordinances in effect on the date of issuance of the renewal permit. Renewal permits are subject to expiration as set forth in paragraph 2 above.
4. In the event of permit expiration, any work performed under that permit is ‘unpermitted’ as defined in Section 114.1 of this code, and is subject to the legalization provisions of Section 114.5 of this code.
105.5.1 Expiration – Unpermitted structures or grading. Notwithstanding any provision of Section 105.5, if a building permit was issued in order to bring an unpermitted structure or unpermitted grading (as defined in Sections 114.1.1 and 114.1.2 of this code) or other unlawful, substandard, or hazardous condition into compliance with any applicable law, ordinance, rule, or regulation, such permit shall expire by limitation and become null and void 60 days after the date on which the permit was issued. The building official may, in his or her sole discretion, extend the validity of the permit for a period not exceeding 180 days beyond the initial 60 day limit upon written request by the applicant filed with the building official prior to the expiration date of the original permit, if the building official determines that substantial progress has been made toward completing the work authorized by the permit.
14.04.070 Section 107 – Submittal Documents – Amended – General Subsection 107.1 is hereby amended to read as follows:
107.1 General. Submittal documents consisting of construction documents, statement of special inspections, geotechnical report and other data shall be submitted in two or more sets with each permit application. The construction documents shall be prepared by a registered design professional where required by the statutes of the jurisdiction in which the project is to be constructed. Where special conditions exist, the building official is authorized to require additional construction documents to be prepared by a registered design professional.
Exception: The building official is authorized to waive the submission of construction documents and other data not required to be prepared by a registered design professional if it is found that the nature of the work applied for is such that review of construction documents is not necessary to obtain compliance with this code. Further, except for plans of a common interest development as defined in Section 4100 of the California Civil Code, plans need not be filed for:
1. Single or multiple dwellings not more than two stories and basement in height.
2. Garages and other structures appurtenant to buildings described under paragraph 1 above.

107.5 Retention of construction documents. The building official shall maintain an official copy, which may be on microfilm, electronic media, or other type of photographic copy, of approved construction documents for every building for a period not less than 180 days from date of completion of the permitted work, or as required by the City’s records retention requirements.
14.04.090 Section 109 – Fees – Amended – Payment of fees.

SECTION 17. All inconsistencies between the Building Code, Residential Code, Electrical Code, Mechanical Code, and Plumbing Code as adopted by this Ordinance and Parts 2,
2.5, 3, 4, and 5, respectively, of Title 24 of the California Code of Regulations are changes, modifications, amendments, additions or deletions thereto authorized by California Health and Safety Code Sections 17958 and 17958.7.
SECTION 18. The numbering of the most recent editions of the California Building Standards Code has been completely revised from earlier editions. All references to the uniform codes in the Covina Municipal Code that are not amended by this Ordinance or a subsequently enacted ordinance shall refer instead to the successor section or sections contained in the 2025 Edition of the California Building Standards Code, Parts 1, 2, 2.5, 3, 4, 5, 6, 7, 8, 9, 10, 11, and 12 of Title 24 of the California Code of Regulations, as adopted and amended by the City.
SECTION 19. The City Council hereby finds that the proposed amendments to the 2025 Editions of the California Building Code, California Electrical Code, California Mechanical Code, and California Plumbing Code, and the majority of the amendments to the 2025 Edition of the California Residential Code, that have been enacted by this Ordinance are merely a continuation of similar changes and modifications made to earlier editions of such uniform codes, and all of such changes and modifications, whether previously enacted or enacted in this Ordinance, are necessary for administrative clarification, do not modify a building standard pursuant to California Health and Safety Code Sections 17958, 17985.7, and/or 18941.5, and therefore do not require findings pertaining to local climatic, geological, or topographical conditions to justify such modifications. These amendments establish administrative standards for the effective enforcement of the building standards in the City of Covina.
SECTION 20. The City Council hereby finds that certain changes and modifications to the 2025 Edition of the California Residential Code, incorporated into Part 2.5 of the California Code of Regulations, that have been enacted by this Ordinance are merely a continuation of similar changes and modifications made to earlier editions of such uniform codes, and all of such changes and modifications, whether previously enacted or enacted in this Ordinance, are reasonably necessary because of local climatic, geologic, and topographic conditions.
SECTION 21. Prior Ordinances Repealed. Upon the operative date of this Ordinance, all former ordinances or parts thereof conflicting or inconsistent with the provisions of this Ordinance and the codes herein adopted by reference, including, without limitation, Ordinance No. 19-10 22-19, and any other ordinance or portions thereof in conflict herewith are hereby repealed and declared to be of no further force and effect.
SECTION 22. Severability. If any section, subsection, subdivision, paragraph, sentence, clause, or phrase of this Ordinance, or any part thereof, is for any reason held to be unconstitutional or void, such decision shall not affect the validity of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional or void.
SECTION 23. This ordinance shall become operative the later of thirty (30) days after adoption, or January 1, 2026.
SECTION 24. Certification. The City Clerk shall certify the passage of this Ordinance and shall cause the same to be entered in the book of original ordinances of said City; shall make a minute passage and adoption thereof in the records of the meeting at which time the same is passes and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published as required by law, in a local weekly newspaper of general circulation and which is designated for that purpose.

ATTACHMENT B
RESOLUTION CC 2025-115
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COVINA,
CALIFORNIA, SETTING FORTH REQUIRED FINDINGS FOR
AMENDMENTS TO THE 2025 CALIFORNIA BUILDING STANDARDS
CODE, THE 2025 CALIFORNIA RESIDENTIAL CODE, AND
ADOPTION OF CERTAIN APPENDICES IN BOTH CODES, BASED ON
LOCAL CLIMATIC, TOPOGRAPHICAL AND/OR GEOLOGICAL
CONDITIONS
A. RECITALS:
(i) Certain building standards and other related provisions contained in national model and uniform codes are adopted and amended by the State of California, and thereafter published as the California Building Standards Code (“CBSC”). The 2025 CBSC will become applicable in the City, subject to amendments made by the City pursuant to Health and Safety Code Sections 17958.5 and/or 18941.5.
(ii) Health and Safety Code Sections 17958.5 and 18941.5 authorize the City Council to make reasonably necessary modifications to the California Building Standards Code, based on certain local conditions.
(iii) Health and Safety Code Section 17958.7 requires that, before making any modifications to building standards contained in the CBSC, the City Council shall make an express finding that each such modification is reasonably necessary because of local climatic, geological, or topographical conditions.
(iv) The City has determined that modifications should be made to building standards and other provisions contained in the CBSC, and are reasonably necessary due to local conditions.
City has further determined that the remainder of such modifications are of an administrative or procedural nature, or concern themselves with subjects not covered by the CBSC or are reasonably necessary to safeguard life and property within the City of Covina.
B. RESOLUTION:
NOW, THEREFORE, be it is found, determined and resolved by the City Council of the City of Covina as follows:
SECTION 1. Amendments to building standards contained the 2025 Edition of the California Building Code, the 2025 Edition of the California Residential Code, including certain Appendices in both Codes, adopted by Ordinance 25-13 are hereby found to be reasonably necessary due to the to the following local conditions:
A. Climatic Conditions
Los Angeles County and the City of Covina are located in a semi-arid Mediterranean type climate which predisposes all fuels, including wood shingles, to rapid ignition and spread of
fire. Therefore, there exists a need for additional fire protection measures.
Hot, dry Santa Ana winds are common to all areas within the City of Covina and Los Angeles County in general. These winds, which can cause large and small trees along with small structures to fall and are a contributing factor to the high danger in the area, and create the need for an increased level of building oversight and protection. This added protection will supplement normal building codes and process to immediate protection for life and safety of multiple occupants during heavy wind and seismic occurrences.
B. Geological Conditions
The City of Covina is located in a highly active seismic area. There are earthquake faults that run along both the northeastern and southwestern boundaries of Orange & Los Angeles Counties. The Newport-Inglewood Fault Zone (NIFZ) which runs through Orange & Los Angeles Counties was the source of the destructive 1933 Long Beach earthquake (6.3 magnitude, hypocenter off Newport Beach coast), which took 120 lives, with areas damaged from Laguna Beach to Marina del Rey and inland to Whittier, and poses one of the greatest hazards to lives and property in the nation. Regional planning for reoccurrence is recommended by the State of California, Department of Conservation. There was also an earthquake in December 1989, with the epicenter located near the City of Irvine. The fault on which this quake occurred was unknown prior to this activity. The October 17, 1989, Santa Cruz earthquake resulted in only one major San Francisco fire in the Marina district, but when combined with the 34 other fires and over 500 responses, the department was taxed to its full capabilities. The Marina fire was difficult to contain because mains supplying water to the district burst during the earthquake. If more fires had been ignited by the earthquake, it would have been difficult for the fire department to contain them. Experts predict a major earthquake in our area within the next 30 years. This situation creates the need for both additional fire protection measures and automatic on-site fire protection for building occupants since a multitude of fires may result from breakage of gas and electric lines as a result of an earthquake.
Amendments to other than building standards set forth below are administrative in nature and are listed solely for reference.
Amendments to the 2025 California Building Standards Code, and adoption of, and additions and deletions to, are found reasonably necessary based on the climatic, topographical, and/or geological conditions cited in Section 1 of this Resolution and are listed as follows:
