SUBJECT: BUDGET-TO-ACTUAL FINANCIAL REPORTS FOR MARCH 2022 ______________________________________________________________________

RECOMMENDATION
• Receive and file monthly budget-to-actual financial reports of the City’s major operating funds for the month of March 2022

BACKGROUND
In order to provide timely information to the City Council and to the public, the City’s Finance Department has prepared the attached monthly budget-to-actual reports. These reports provide a summary as of March 31, 2022 of the fiscal year-to-date revenues and expenses of the City’s major operating funds: General Fund, Housing Authority Fund, Lighthouse Cove RV Park Fund, Sewer Fund and Water Fund.

The information in the attached report is a snapshot at this point in time and may change as additional information is entered into the accounting system and verified.

ITEM ANALYSIS
As of March 31, 2022, we are 75% of the way through the fiscal year, with 25% of the year remaining. If revenues were received and expenditures made evenly throughout the year, there should be approximately 25% of each budget line remaining. However, revenues and expenditures are not even throughout the year for many reasons. Many revenues are not received evenly throughout the year (particularly tax revenues and grant reimbursements), most expenses are not recorded until the invoice is received in the following month, and budgets may include large projects that have not yet been completed.

This report summarizes the actual revenues and expenditures for the year to date; additional information is provided in the budget-to-actual reports attached.

BUDGET TO ACTUAL REPORT – MARCH 2022
MAY 2, 2022
2 • General Fund
General Fund revenues show that 35% of the budgeted amount is yet to be received. This is dependent on the timing of when certain revenues are received.

For example, most taxes, third party billings, and grant reimbursements are recorded quarterly. Normally, the remaining revenue budget at this point is higher, indicating revenues are coming in higher than budgeted this year. General Fund actual expenditures show that 44% of the budgeted amount is yet to be expended. • Housing Authority Fund
The Housing Authority is funded by monthly disbursements from the federal government. At this point, actual revenues show 30% remaining to be received and actual expenditures have remaining amounts of 32%.
• Lighthouse Cove RV Park Fund
Revenues collected by the Lighthouse Cove Recreational Vehicle Park (RV Park) show 6% remaining to be collected. RV Park revenues are highly seasonal, and most rental revenues are typically received in the summer months. Actual expenses in the RV Park show 52% of the budget left to be expended. • Sewer Fund
The Sewer Fund earns revenue primarily from charges to the users of its services.

Actual revenues show 28% of the total revenue budget remaining to be collected.

Operational expenses (not including debt service or capital improvements) show 45% of the budget remaining to be expended.
• Water Fund
The Water Fund earns revenue primarily from charges for service. Actual revenues show 21% of the budget remaining to be collected and 34% of budgeted operational expenses (not including debt service or capital improvements) remaining to be expended.
• Summary
The following table summarizes the actual revenues and expenses for the City’s five major operating funds, not including encumbrances:

3 • Long-term Liabilities
The City’s long-term liability balances are included in the table below. Net Pension Liability, Net OPEB Liability, and Compensated Absences are updated annually during the audit process. These amounts below are from the most recent audit (June 30, 2021). The Sewer Fund and Water Fund loan balances are updated when payments are made (in July for the Sewer Fund loan, and in December and June for the Water Fund loan). These do not include interfund balances (amounts owed from one City fund to another).

CITY COUNCIL AGENDA REPORT
TO: MAYOR GREENOUGH AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: JON OLSON, PUBLIC WORKS DIRECTOR

ANDREW LEIGHTON, ENGINEERING PROJECT MANAGER
DATE: MAY 2, 2022
SUBJECT: RANNEY COLLECTOR VARIABLE FREQUENCY DRIVE

REPLACEMENT CONTRACT WITH NORTHRIDGE ELECTRIC
______________________________________________________________________

RECOMMENDATION
• Ratify the City Manager’s signature on the Small Public Works Agreement with Northridge Electric to replace the Variable Frequency Drive of one pump at the Ranney Collector.
• Approve and Adopt Resolution No. 2022-28, A Resolution of the City of Crescent City Amending the Fiscal Year 2021-2222 Budget of the City of Crescent City

BACKGROUND
The City’s current water system was originally developed in 1958. The Ranney Collector removes water from the Smith River aquifer and is the sole source of potable water to the City of Crescent City.

There are three vertical turbine pumps that are utilized to pump water to meet all City water demands and ensure that there is sufficient supply for fire suppression throughout the community. Variable Frequency Drive (VFD) motors were installed in 2011 as an energy efficiency project to replace the single speed motors previously used. VFD electronics are like any other piece of equipment that require ongoing maintenance and eventual replacement. Unlike pumps their failure is not proceeded by any warning signs.

ITEM ANALYSIS
One of the VFG drives has failed. The loss of one VFD means that the city is currently operating with the two remaining pumps. Recent changes to the operating strategy have shifted tank filling to off-peak capacity times which enables the third Ranney pump to function as a load sharing and back-up pump. Replacement of the VFD should be done

RANNEY VFD REPLACEMENT
MAY 2, 2022
2 with some urgency, though it is not an emergency situation. The contractor has already ordered the replacement parts which are expected to be delivered in late July with installation to follow. Upon Council approval, funds will be transferred in the current fiscal year for the parts to be ordered, and the budget will be carried over to the next fiscal year to complete the project.

FISCAL ANALYSIS
The proposed project is not currently budgeted in the Capital Improvement Program (CIP). Staff recommends funding this project from Water Fund reserves.

Unused funds from prior CIP project $16,442
Water reserve funding to be transferred to CIP $13,558
Total funding $30,000
Contract amount with NRE $24,459
Contingency $ 5,541
The Water Fund is currently budgeted to have working capital of $2,048,316 at the end of the current fiscal year.

STRATEGIC PLAN ASSESSMENT
GOAL 1: Support quality services, community safety, and health to enhance the quality of life and experience of our residents and visitors.

D. Provide and maintain an efficient, adequate infrastructure to provide for both current and future community needs

CITY COUNCIL AGENDA REPORT
TO: MAYOR GREENOUGH AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: LINDA LEAVER, FINANCE DIRECTOR
DATE: MAY 2, 2022
SUBJECT: QUARTERLY CASH AND INVESTMENTS REPORT AS OF MARCH 31, 2022
______________________________________________________________________

RECOMMENDATION
• Receive and file quarterly cash and investments report as of March 31, 2022

BACKGROUND
California Government Code Section 53600 requires timely reporting of local agency investment transactions and portfolio to the agency’s legislative body. The Government Finance Officers Association’s (GFOA) best practice recommendation is for local agencies to periodically report cash and investments to the governing body.

ITEM ANALYSIS
Below is a summary of the City’s cash and investments as of March 31, 2022 (general ledger balances). These totals do not include fiduciary funds that are held by other entities (e.g. trust account held by PARS for the City’s OPEB liability).

Quarterly Cash and Investments Report March 2022
May 2, 2022
2 • Cash
o Petty Cash
The City maintains petty cash in various departments for change drawers and incidental purchases.
o Bank Accounts
Amounts listed are general ledger amounts and reflect activity through December 31, 2021. These amounts include checks that have been written but not yet presented to the bank (outstanding checks) and deposits that have been made but not yet recorded by the bank (deposits in transit). The general ledger balance reflects the City’s balances more accurately than the bank statements of the same date. Transactions are recorded by finance staff during various reconciliation processes which may not all be complete as of the writing of this report. Any final updates are not anticipated to be significant.
▪ US Bank Main – This is the City’s checking account. All cash receipts and accounts payable are processed through this account. Balances fluctuate based on activity and cash flow needs. When funds accumulate that are not immediately
needed for cash flow, they are transferred to LAIF. When Account Balance

3 additional funds are required to meet immediate needs, they are transferred from LAIF into the main checking account.
▪ US Bank Payroll – This is a Zero Balance Account (ZBA). When payroll expenditures (direct deposits, checks, and wire transfers) are presented to the bank, the amount of the expenditure is automatically transferred from the main checking account into the payroll account.
▪ US Bank Savings (CDBG Program Income) – The California Department of Housing and Community Development (HCD),
which administers our Community Development Block Grant (CDBG) strongly suggests using a separate, interest-bearing bank account for Program Income. Interest earned on Program Income is also qualified as Program Income.
▪ US Bank Housing Authority – This account is used to receive funding from the Federal Department of Housing and Urban Development (HUD). Housing Assistance Payments are made from this account. The amount allowed by HUD for
administrative costs is periodically transferred into the City’s main checking account and allocated for costs within the Housing Authority Fund.
▪ US Bank Sewer Fund Capital Reserve – This account was required under the terms of the State Revolving Fund loan. Over a period of 10 years, the City was required to set aside $2,187,700 as a capital reserve. The balance in this account represents the first three years’ contributions plus interest. In October 2017, the City successfully negotiated a contract amendment to the SRF loan, removing the Capital Reserve Requirement. The majority of funds previously held in this account were transferred to the Sewer Fund for an authorized project. The remaining balance is held until needed for a project. ▪ US Bank Water Fund Debt Service Reserve – This account is required under the terms of the Safe Drinking Water loan. The funds will only be available to make the debt service payment should the Water Fund be unable to make payments from its operating account. The debt service reserve will be held in this account until the loan is paid off in 2024. The balance in this account is one year’s debt service plus interest.
o Pooled Cash
With the exception of restricted bank accounts (US Bank Savings, US Bank Housing Authority, US Bank Sewer Fund Capital Reserve, and US Quarterly Cash and Investments Report March 2022
May 2, 2022
4 Bank Water Fund Debt Service Reserve), the City’s cash and investment resources are pooled. The pooling of cash and investments provides several advantages, including better physical custody and control, enhanced investment opportunities, and ease of operations. It also simplifies custody, collection, and disbursements.

It is important to note that the City’s pooled resources include fiduciary, grant, and capital project funds as well as the City’s major operating funds.

The cash and investment totals represent balances as of a specific date and do not necessarily represent amounts available for future appropriations.

The use of pooled cash allows the City to cover negative cash balances in certain funds internally, rather than borrowing from an external source.

Certain funds – particularly when grant-funded – experience a negative cash balance due to the timing of expenditures and the delay in reimbursement. Instead of using external borrowing to cover these timing issues, the City’s pooled cash covers the negative fund(s) until reimbursed. Typically, the General Fund covers the negative funds.

However, when the negative funds are for very large amounts (for example, large CIP projects), the General Fund alone may not have sufficient cash flow to cover the entire negative balance. Per the City’s Debt Policy, short-term cash flow needs may be covered by one of the enterprise funds if necessary, and interest would be paid to the enterprise fund in that case.
• Investments
o Local Agency Investment Fund (LAIF)
The City is a voluntary participant in the Local Agency Investment Fund (LAIF) that is regulated by California Government Code Section 16429 and managed by the Treasurer of the State of California. Cash is pooled with cash from local agencies state-wide and invested. Each agency has its own account within the pool. Each participating agency has a maximum account limit of $75 million, with no minimum balance, and is permitted to make up to 15 transactions per month. Investments in LAIF are available upon demand, although 24-hour notice is required for withdrawals of $10 million or more. More information about LAIF can be found at their website: http://www.treasurer.ca.gov/pmialaif/laif.asp. o Current Investment Portfolio
The City’s investment portfolio at this time is 100% in LAIF. o Individual Transactions During Quarter

5 o Individual Securities Held
None.
o Realized and Unrealized Gains/Losses and Market Value Although the City does not hold any securities with a maturity over one year, the City does record a Fair Market Value (FMV) adjustment for its investment in LAIF, consistent with GASB 72. This GASB requirement is to provide transparency for the market value fluctuations in investments that are intended to be sold. Although the City does not sell or intend to sell its investments (which are currently 100% in LAIF) and therefore does not have risk of market losses, we are required to periodically calculate the value of our investments if they were to be sold on a particular date and report that fair market value. The FMV adjustment is calculated quarterly, and the adjustment as of March 31, 2022 was an unrealized loss of $191,155 (or 1.1% of our actual holdings in LAIF on that date). There is no actual (realized) gain or loss as the investments were not sold on that date. The City actually earned a small amount of interest during the quarter.
o Return on Investments
The quarterly earnings rate in LAIF as of March 31, 2022 was 0.29%. Crescent City’s Investment Policy specifies the two-year Treasury note as a benchmark, which is to be used for reference purposes only. The daily treasury yield for two-year notes on March 31, 2022 was 2.28%.

LAIF administrative cost as of September 30, 2021 was 2.3% of earnings. By law, LAIF administrative costs may not exceed 5% of the quarterly earnings of the fund, unless the 13-week Daily Treasury Bill on the last day of the fiscal year is below 1%, in which case administrative costs may not exceed 8% of quarterly earnings for the subsequent fiscal year.
o Percentage of Portfolio
▪ 100% LAIF
o Compliance Statement
The City’s investment portfolio as of March 31, 2022 is in compliance with the City’s Investment Policy and is meeting the policy objectives of (1) safety, (2) liquidity, and (3) yield.

CITY COUNCIL AGENDA REPORT
TO: MAYOR GREENOUGH AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: MARTHA D. RICE, CITY ATTORNEY
DATE: MAY 2, 2022
SUBJECT: MUNICIPAL CODE UPDATE – OFFICIAL BONDS
______________________________________________________________________

RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Waive full reading, read by title only and adopt Ordinance No. 829, An Ordinance of the City Council of the City of Crescent City Amending Chapters

2.14, Office of the City Clerk, and 2.20, Director of Finance, of the Crescent City Municipal Code Relating to Official Bonds

BACKGROUND
As a general law city, the City of Crescent City is subject to the general laws of the State of California. Government Code Section 36518 requires that the City Clerk and the City Treasurer furnish official bonds to the City upon entering office. The Finance Director serves as the City Treasurer per Section 2.20.020(D). Government Code Section 1463 authorizes the City to purchase a government crime insurance policy or an employee dishonesty insurance policy as an alternative to official bonds.

ITEM ANALYSIS
The proposed ordinance will accomplish two things:

1. Consistency with state law. The City’s municipal code currently requires that the City Clerk obtain an official bond, but it does not contain the same requirement for the City Treasurer aka Director of Finance. The proposed update will fix this inconsistency.

MUNI CODE UPDATE – OFFICIAL BONDS
MAY 2, 2022
2 2. Consistency with current practice. The proposed ordinance will officially authorize and codify the authority of the City to procure a government crime insurance policy or an employee dishonestly insurance policy as an alternative to official bonds.

The City’s insurance policies provide greater coverage than do the official bonds in terms of policy limits and employees/officials covered and do not cost anything additional as the City will maintain its insurance policies guarding against employee crimes (theft, fraud, etc.) regardless.

This item was introduced on April 4th and if adopted, will be effective in 30 days.

FISCAL ANALYSIS
The approval of this update will have no fiscal impact.

STRATEGIC PLAN ASSESSMENT
This action supports the following Strategic Plan goals and objectives:
• Goal 3: Obtain the highest levels of organizational excellence • Objective 3(B): Maintain responsible fiscal management and accountability

COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2021-22 BUDGET OF THE CITY OF CRESCENT CITY

BACKGROUND
The Crescent City – Del Norte Chamber of Commerce / Visitor’s Bureau has been working with Lynnette Braillard (LuLish) on marketing and promoting Del Norte County. The City has an opportunity to join in these marketing efforts with an emphasis on Crescent City.

By working with Ms. Braillard, as opposed to another marketing consultant, the messaging campaign can be made consistent and seamless. The City has worked with Ms. Braillard in the past as part of the “Go for the Gold” campaign in 2019-2020. Because Ms. Braillard can provide unique services to the city in this respect, this agreement is exempt from competitive procurement per CCMC 14.28.020.

ITEM ANALYSIS
City staff proposes utilizing a marketing agreement with Ms. Braillard (LuLish) with the scope of services and budget to be detailed by individual task orders. The agreement

LULISH MARKETING AGREEMENT
MAY 2, 2022
2 provides that the City Manager can approve any single task order up to $10,000. Any task orders in excess of $10,000 will be brought to the City Council for approval.

In addition to the marketing agreement, City staff requests approval of Task Order No. 1 for the following services:
• Digital Ads for Lighthouse Cove RV Park / Pool / Beachfront Park • Website Redesign for Lighthouse Cove RV Park
• Print Ads for RV Park / Pool / Beachfront Park
• Bay Area Travel Show Brochures / Attendance
• Photo / video of RV Park / Pool / Beachfront Park
• Creative & Marketing Services
The total cost of Task Order No. 1 is $24,000.

FISCAL ANALYSIS
The approval of the Agreement and Task Order No. 1 will cost $24,000, with $10,406 coming from the General Fund and $13,595 coming from the RV Park Enterprise Fund.

A budget amendment is required as the current budget allocates $8,000 to the RV Park, $8,000 to the General Fund for the Pool, and $8,000 to the General Fund for the Park.

STRATEGIC PLAN ASSESSMENT
This action supports the following Strategic Plan goals and objectives:
• Goal 2: Promote a Thriving Local Economy
• Objective 2(C): Engaging with residents, visitors, and businesses through ongoing marketing of City products, services and facilities; and Aiding or leading in the promotion and coordination of community-wide events

CITY COUNCIL AGENDA REPORT
TO: MAYOR GREENOUGH AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: JON OLSON, PUBLIC WORKS DIRECTOR

ANDREW LEIGHTON, ENGINEERING PROJECT MANAGER
DATE: MAY 2, 2022
SUBJECT: CONTRACT FOR MEMBRANE REPLACEMENTS AT THE

WASTEWATER TREATMENT PLANT
______________________________________________________________________

RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Approve and Authorize the City Manager to execute the MEMCOR MemPulse Membrane Bioreactor System Upgrade Purchase Agreement for Goods and Services.
• Direct staff to engage needed contractors to assist with installation.

BACKGROUND
Crescent City’s WWTP was originally constructed in 1958 and has undergone four major retrofits since then. The most recent upgrade was a 2007-2011 $40+ million dollar project in response to 1997 cease and desist orders associated with plant effluent violations.

Many portions of the facility were upgraded including the addition of a 1.1 million gallons per day rated Membrane Bioreactor (MBR).

In 2004, the City conducted a competitive procurement process for the design, fabrication and installation of membrane bioreactor equipment at the WWTP. US Filter was awarded the contract and designed, fabricated and installed the MemJet system. The MemJet system, as designed, contained 1600 B10R modules to process 1.2 MGD. The contract contained a 20-year price guarantee (with CPI) for the modules.

Over the years, a series of corporate mergers and acquisitions have taken place so that now DuPont has taken the place of US Filter. The original B10R modules are longer in production and the MemJet system is no longer cutting edge technology. The MemPulse system is more efficient and less expensive to maintain. DuPont has lowered the price of its MemPulse B40R modules to match the guaranteed price of the B10R modules (in total).
m
Dupont Contract for Membrane Replacement
MAY 2, 2022
2 Because this agreement is an extension of the previous 2004 US Filter agreement and because DuPont is the sole manufacturer of the MemPulse system, a competitive procurement process is not required. CCMC 12.48.020.

ITEM ANALYSIS
Over the last 11 years, the filter technology has changed which necessitates an upgrade of the MBR system to include MemPulse technology. The new technology will releases coarse bubbles of air below the membranes (filters) to more efficieantly dislodge and prevent solids accumulation on the membranes. The upgraded scouring technology willlower operating cost by lowering airflow rates, reducing energy demand.

Staff recommends moving forward with the proposal from Dupont after much review and price negotiation. Staff opinion is that the proposed filters represent the best available technology that meets the plants operational parameters and is able to fit with existing equipment.

City employees, Jacobs’ plant staff, and an external contractor will work cooperativily under Dupont’s direction to accomplish this project. Dupont estimates that it will take approximately three weeks to complete the work once started.

EXECUTIVE SUMMARY
Dear Mr. Olson,
Thank you for your interest in MEMCOR’s MemPulse Membrane Bioreactor (MBR) System. MemPulse MBR technology uses the latest advances in filtration specifically designed to create highly efficient membrane aeration in conjunction with the assurances of an absolute barrier provided by membrane filtration. MemPulse MBR offers several key advantages include a more effective cleaning at 40-60% of the energy used in the MemJet system.

This proposal includes a section on retrofitting your existing system to MemPulse, which involves some minimal civil/construction work to modify the existing mixed-liquor headers, but otherwise is a simple changeover of membrane hardware.

MemPulse represents the cutting-edge of membrane bioreactor processes, and as with all MEMCOR innovations, we make sure that our existing customers get the benefits of our latest developments. Features of the MemPulse system include:

Low Energy Air Scour System
MemPulse MBR was the first low-energy, high-efficiency aeration system to be introduced to the marketplace. MemPulse uses a simple device with no moving parts to intermittently release pulses of air to effectively scour the membranes and keep them free form solids accumulation.

MemPulse provides the most efficient scouring technology on the market, at the lowest operating cost – providing long-term, stable operation at low airflow rates.

Minimizing Maintenance Requirements

1.4 MemPulse Upgrade
The existing Crescent City Waste Water Treatment Plant uses the MemJet MBR system. This system uses a combined flow of mixed liquor delivered via a jet-motive pump and air from the rack air headers to provide scour energy to the MBR membrane fibers. While this system is very effective, it uses higher quantities of air than more recently developed, third-generation membrane systems.

MEMCOR has developed a simple and cost-effective method of converting legacy MemJet systems to MemPulse.

The changeout requires very limited mechanical changes to the system. Rack components and membranes don’t need to be replaced, although often the MemPulse upgrade is undertaken at the same time as a module changeout.

The MemPulse equipment simply “snaps on” to the existing system.

The following civil changes may be required to accommodate the MemPulse system:
• Removal of the MemJet Headers – Legacy MemJet systems will have a distribution header system beneath the membranes which will have to be removed. In most cases, the primary lateral that runs perpendicular to the membrane racks will be left in place. The smaller headers that run underneath the actual modules will need to be removed.
• Anti-sway Bracket Installation – Three anti-sway brackets (provided by DuPont) will need to be installed in the cell floor for each rack position. The existing ML lateral supports can be re-purposed for this.

At the Crescent City WWTP, the aeration system is already set up such that air to the cells can be reduced with a VFD. A simple programming change (included in this proposal) is all that is required to allow the existing system to operate with the energy savings of MemPulse.

1.5 Energy Savings with MemPulse
The savings provided by MemPulse are easy to put into perspective. The table below is based on the original design air scour flow rates for the plant versus the proposed MemPulse design.

PARAMETER Average Per Tank Peak Per Tank
MemJet System 324 SCFM 393 kWh/day 597 SCFM 768 kWh/day MemPulse System 280 SCFM 176 kWh/day 339 SCFM 264 kWh/day Notes:

1. Average air is used when the membrane system is operating at 25 lmh flux (instantaneous, temperature corrected) or less. Per our calculations, operating at average daily flow (1.2 MGD) with one unit offline and operating at maximum daily flow (1.9 MGD) with all three tanks online will result in a temperature-corrected flux less than 25 lmh.

2. Air flow rates and power are dependent on ambient air temperature, ambient humidity, water temperature, and overall electrical efficiency. The values used for the above estimates were equivalent to design values used in the original project submittal.

Using a cost of $0.113 per kwH, and assuming that 90% of operation takes place at average flows, changing over to MemPulse would save the City of Crescent City $27,000 per year in power costs and reduce power consumption by 239,000 kwH/year.

1.6 MemPulse Process Benefits
The improved MemPulse process will result in the following improvements:
• Reduced maintenance: With no small openings for solids to accumulate and “plug” orifices, the flow of mixed liquor to the membranes is reliable and consistent. This reduces the occurrence of “solids packing” in fiber bundles and results in longer membrane life.
• Better mixing: The MemPulse system is engineered to deliver the most mixing energy to the fiber bundles at the lowest cost. The reliable, powerful “pulse” of air prevents solids from accumulating at the top of the fiber bundles, which impedes performance.

We are confident that you will find the upgraded system easier to operate with reduced costs and better performance. We encourage you to reach out to other MEMCOR customers that have upgraded from a MemJet system to a MemPulse system to hear it from them! We have included a list of MemPulse upgrade references to this proposal.

1.7 MemPulse Process with Existing Blowers
For the MemPulse system with one tank online the minimum design flow would be 280scfm which should be which will work with the existing blowers, unless the membrane blower is the 5LR in a vertical configuration. In that case the blowers can just run at the minimum recommended operating flow if one tank is online and the design flowrate when multiple units are online. Based on the attached original project P&ID’s each blower is currently sized for 1,395 scfm, therefore the revised design would have one blower duty and two blowers standby during average flows conditions.

Below are the minimum recommended operating points from the manufacturer:
5CDL9 ……minimum speed 1500 RPM…….180 cfm
5LR……..

Horizontal configuration……..764 RPM…….270 cfm
Vertical configuration………..1137 RPM…….398 cfm

c. Buyer will return to Seller a photograph of the end of each low-pressure membrane module with the serial number to qualify for a replacement module.

4. Low Pressure Membrane Module Warranty Exclusions: The Buyer recognizes that damage resulting from any of the following shall be excluded from coverage under the low-pressure membrane module warranty:
a. Any person other than an employee or representative of Seller has altered the membrane operating system without prior written approval by Seller;
b. OWNER causing or permitting the membrane modules to dry or to have moisture content below that specified in the operating instructions either during storage or operation. Shutdown, storage, maintenance and start-up procedures of membranes must be as specified in the Operation & Maintenance Manual; c. Mixed liquor suspended solids concentration exceeding a maximum of 14,500 mg/L in the membrane tank:
d. Unusual plant upsets, presence of other potential transients or other undefined operating conditions that can affect membrane performance or life. This includes but is not limited to polymer “dumps”, emulsified fats, oil and grease content in excess of 100 mg/L entering the biological system, the use, malfunction or by-pass of any equipment which allows the accumulation of non-biodegradable material in the membrane tanks, any bypass of the ≤2.0mm punched hole or woven wire pre-screen ahead of the aeration basins, rags or debris that fall into the biological or membrane tanks, toxic wastes entering the plant that upset the biological process;
e. Any damage/defect caused by chemical or physical conditions such as (but not limited to) pH, temperature, chemicals, effluent COD is greater than 50 mg/L or climatic factors outside the recommended operating parameters in the appropriate section of the Operation & Maintenance Manual; f. Ammonia concentrations in the membrane tank greater than 3 mg/L; g. Any damage directly or indirectly related to PLC and/or HMI/SCADA modifications without Seller’s express written consent.
h. Improper maintenance or operation of equipment (including failure to perform periodic chemical cleans) as defined in Seller supplied operating and maintenance manual. i. Neutralization and/or reduction of chemical cleaning solutions are performed in the membrane tank without written authorization from Seller;
j. Supply of influent water exhibiting parameters inconsistent with the parameters determined or specified at time of bid and/or pilot testing.
k. Sludge retention time (SRT) is:
• less than 5 days total SRT over a 2-day history or
• less than as determined by the over any 30-day period: SRT = 10 / 1.029(T-20) Where: SRT = minimum SRT for biological process (average for any 30-day period) T = wastewater temperature (°C); or
• Design total SRT below over any 30-day period or greater than 50 days total SRT over a 30-day period.

5. Warranty Conditions: This warranty is conditioned upon Buyer:
a. Not being in default of any payment obligations to Seller; and b. Maintaining hand-written or electronic operational logs and providing such logs to Seller in the event of a warranty claim.
c. Unless the capillary suction time (CST) is less than 100 seconds for mixed liquor before the membrane tank, the CST method should be as defined in Standard Method 2710G for the Examination of Wastewater Treatment (latest edition), except that a 10-mm diameter stainless steel reservoir should be utilized rather than an 18-mm diameter.

6. The Warranty is expressly excluded from any performance bond(s) which may be furnished by the Seller.

7. IN NO EVENT SHALL SELLER BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR OTHER DAMAGES AND SELLER’S TOTAL LIABILITY UNDER THIS EXTENDED

Title 14 PROCUREMENT PROCEDURES
Chapter 14.28 EXCEPTIONS TO PROCUREMENT RULES

14.28.020 Sole source procurement.

A. In the event the contract or purchase contemplated is only capable of being performed by a sole provider such as a public utility or the holder of an exclusive patent or franchise, for purchase of unique or innovative goods or services including but not limited to computer software and technology, or for purchase of goods or services when there is a demonstrated need for compatibility with an existing item or service, then the contract or purchase shall be exempt from normal procurement procedures as outlined in this title.

B. A sole source may be designated when it is apparent that a needed product or service is uniquely available from the source, or for all practical purposes, it is justifiably in the best interest of the city. Under these circumstances, city bidding requirements may be dispensed with when the services or goods are only available from one source either because:

1. The brand or trade name article, goods, or product or proprietary service is the only one which will properly meet the needs of the city; or

2. The item or service is unique and available only from a sole source; or

3. The item or service is designed to match others already in use or necessary to be compatible with others already in use.

C. Each sole source procurement must be documented in a manner to clearly articulate the justification for the sole source procurement. The city manager must approve all sole source determinations. (Ord. 808 § 2, 2019) View the mobile version.
