• Hear staff report
• Technical questions from the Council
• Further Council discussion
• Discuss potential applications
• Consider recommendations
• Direct staff to prepare an application for CDBG funding under the 2022 Notice of Funding Availability to include [name projects]
Mayor Greenough opened the public hearing at 6:17 p.m.
Economic Development and Recreation Director Taylor reported to the Council the reason for the public hearing was to get public input on the Notice of Funding Availability through the Community Development Block Grant (CDBG) through the Department of Housing and Urban Development.
Grants and Economic Development Coordinator Lacey reported to the Council the open CDBG activities for 2022. Mayor Greenough asked when they got their funding; Coordinator Lacey stated that there was a long process. Mayor Greenough asked if the second round will include those who had previously applied; Coordinator Lacey said that yes, those applications will be included. Lori Adams of Adams Ashby went over the Notice of Funding Ability (NOFA). It changes based on what the state wants to make available; the City has been successful obtaining funds for infrastructure, however that is not available for this year. What is available and what staff is recommending the City apply for Economic Development – Microenterprise TA & FA for up to $750k and for Planning &Technical Assistance – Storm Drain Master Plan up to $250k. Council Member Inscore asked about the Housing Rehab loan; Lori Adams, of Adams Ashby stated that these can be given to homeowners to do small projects such as a bathroom, or larger structural issues, or for code enforcement violations. The loan is given by the City and the City sets up terms of the loan. Council Member Inscore stated that the two that are listed will be very beneficial to the community – homebuyer assistance and housing rehab. Mayor Greenough asked if Council Member Inscore wanted to pursue those two items in this year’s NOFA; Council Member Inscore stated he would because it would do so much for community members. City Manager Wier asked for Ms. Adams explain how heavy of a lift this would be for staff; Ms. Adams stated that it is not the right time to apply for this as the readiness time is not where it would need to be to have a 4 | P a g e

successful application. She recommended to apply for the next cycle of this funding; it is a very heavy lift and a lot needs to be done before an application is put in. She further explained that there will be a portfolio of properties that the City will be responsible for until the loans are paid off. City Manager Wier asked in order to set us up for the 2023 NOFA, we would need a consultant; Ms. Adams $50k is a general figure to get the documents in place and offer training. Mayor Greenough asked if Council Member Inscore was looking for a forgivable loan; Council Member Inscore that the time is right to do this. Council Member Altman asked for clarification from the Council if they wanted to move forward with the Housing Rehab Loan; Coordinator Lacey stated that this is something we have audited for years; when the terms are not met, the City does not have any leverage; the grant will help with that. Ms. Adams stated that one of the most popular terms is a forgivable loan over a period of time and explained the obligations and time line. Council Member Inscore said he was interested in exploring limited times and limited scope housing loans for the foreseeable future.
There were no public comments.
On a motion by Council Member Inscore, seconded by Council Member Altman, and carried on a 4-0 polled vote with Mayor Pro Tem Wright being absent, the City Council of the City of Crescent City directed staff to prepare an application for CDBG funding under the 2022 Notice of Funding Availability to include the included projects listed in the staff report for the Economic Development – Microenterprise TA & FA for up to $750k and for Planning &Technical Assistance – Storm Drain Master Plan up to $250k.

9. Budget Recommendations From Measure S Oversight Committee for FY 21 /22 • Recommendation: Hear staff report
• Technical questions from Council
• Receive public comment
• Council discussion
• Adopt Resolution No. 2022-35, A Resolution of the City Council of the City of Crescent City Amending the Fiscal Year 2021-22 Budget
City Manager Wier reported to the Council the last Measure S Oversight Committee meeting and the outcome. In between the last meeting and the one before, the ceiling tiles in the pool started to fall and will cost approximately $50k to repair. Finance Director Leaver gave a PowerPoint presentation of the budget recommendations of the Measure S Oversight Committee.
Additionally, Director Leaver went over the specific changes made at the last Measure S Oversight Committee meeting. Council Member Inscore asked for an update on the HVAC project with Johnson Controls; City Manager Wier stated something should come this week. Council Member Altman asked what the pool is doing for staff retention since it’s closed so much for repair; he also asked about the expenses for pool repair. City Manager Wier stated that having the pool closed saves the City money; a pool is a mechanical beast and hard to manage. Several components of the pool have not been replaced in several years. Having the HVAC replaced, it 5 | P a g e
5/16/22 COUNCIL MINUTES
will help improve the condition of the pool. Council Member Altman stated he is more concerned over the employees than the cost savings because they are barely working as it is. City Manager Wier stated that staffing is difficult; there are a lot of things the employees can do while the pool is closed such as cleaning, etc. This particular project would close the pool for 3 weeks for the ceiling. Mayor Greenough asked if is possible to make the work area safe so the pool can stay open; City Manager Wier stated that having a netting up to the existing beams, it will reduce the hazard. Director Olson stated it is 3 weeks out to get the parts to do that, so it’s better to just move forward with the repair and closing the pool. Council Member Smith asked if people are pressuring the City to get the pool open; City Manager Wier stated that people have been understanding. Director Leaver explained that a part of the recommendation of Measure S funds for parts and supplies to make sure parts are on hand when they are needed. Council Member Smith asked about the $325k and if it included staffing; Director Leaver answered that it does cover staffing, as well as parts, supplies and equipment. CCPD had the most changes and Director Leaver went over it in detail. There is $60k that will not be used since the Lt. position has been vacated, Chief Griffin would like a new patrol vehicle purchase. Chief Griffin stated the plan would be to have 10 vehicles to be on rotation. His desire is to have the four Crown Victoria’s to be replaced as there is a safety concern with them to continue to be used. Director Leaver stated that a second vehicle will be replaced this year and then two for next year. Chief Griffin stated that in regards to the recruiting process, it has been difficult to find candidates that meet the standards of CCPD. Director Leaver stated that Measure S would fund one officer this year, one the next year, and one the following year. The other positions being spoken for are already City funded positions. We are not adding more staff than planned. Council Member Smith asked if the Lieutenant position would be filled; Chief Griffin stated that as the position is now, the staffing plan needs to be changed before we can entertain the idea of filling the position. CCPD retention and wellness is going very well. Council Member Inscore asked what the total cost of the recruit process; Chief Griffin outlined what would be covered; Director Leaver stated that the $12k number on the graph is to cover 2 recruits and only includes paying them for two months.
Ernie Perry: stated that the Measure S Oversight Committee asked for the fourth category of repairs to be added to the resolution as recommended by the Committee.
On a motion by Council Member Inscore, seconded by Council Member Altman, and carried on a 4-0 polled vote, with Mayor Pro Tem Wright being absent, the City Council of the City of Crescent City adopted Resolution No. 2022-35, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2021-22 BUDGET.

improvement drawings and specifications for Front Street from G to I Street as a standalone project. Staff published an invitation to bid for materials only for Front Street improvements on April 27, 2022. The purpose of separately bidding the materials was to maximize the probability of obtaining longer lead items and materials with the desire to move directly into construction in Fiscal Year 2023. The City received two bids. One from Tidewater Contractors, Inc. and one from Budge-McHugh Supply Co. The bid from Budge-McHugh Supply Co. was deemed nonresponsive. Staff recommends awarding Tidewater Contractors, Inc. the contract for all materials upon which they bid. The City received two bids. One from Tidewater Contractors, Inc. and one from Budge-McHugh Supply Co. The bid from Budge-McHugh Supply Co. was deemed nonresponsive. Measure S funding in the amount of $516,233 was previously authorized by the City Council for the proposed project. Staff recommends approving the materials purchase contract with Tidewater Contractors, Inc., and authorizing the City Manager to sign additional materials only contracts for streetlights and other long lead items in an amount not to exceed $255,688.
The City plans to allocate additional funding from the General Fund, ARPA funds, and the Local Transportation Commission to complete this project. Those budget approvals will be coming back to Council at a future meeting after bids are received and more precise amounts are known. In another item on this agenda, Council is asked to approve the budget amendment for the Measure S portion, which is sufficient to begin ordering materials. Should any of the Measure S funds not be needed for materials, it will be carried over to the construction portion of the project. Council Member Inscore asked when the project is complete and put out to bid, and Tidewater doesn’t get this bid, will they have all these materials and not be able to use them; Director Olson said that the RFP is for materials, purchase, and delivery only is an independent contract.

• Approve plans and specifications for the Measure S Collector Streets Rehabilitation and direct City staff to advertise for bids
Director Olson reported that repairs to Harding, Ninth, and H Street will be performed using Measure S funds. Staff evaluated Harding, 9th, 5th, 3rd (from H to L) and H Streets, which are all collectors, as proposed during the joint Measure S City Council meetings. Harding is in generally good condition with the exception of age-related fatigue failures and delamination of asphalt layers which are presenting as potholes and cracking. Mill and inlay repairs are recommended along with minor crack sealing. 9th Street is generally in good condition requiring mostly crack sealing with some mill and inlay of the asphalt at the intersections of A and B streets. Some concrete work is required to replace damaged manhole and valve collars and replacing sections of sidewalk which are damaged or do not comply with accessibility standards. Both 5th and 3rd Streets, though collectors, need major repairs and are therefore recommended for inclusion in a 7 | P a g e

OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY
ESTABLISHING STIPENDS FOR CRESCENT CITY FIRE AND RESCUE VOLUNTEER FIREFIGHTERS EFFECTIVE JULY 1, 2022
City Manager Wier reported to the Council and Board that pursuant to the Fire Services Agreement, the City shares the cost of volunteer stipend payments with the Crescent Fire Protection District based upon the percentage of calls in each jurisdiction. Periodically, the City and the District review stipend amounts and suggest adjustments when deemed operationally beneficial. The City, along with the rest of the nation, has been experiencing rising rates of inflation and soaring gasoline prices. When volunteer firefighters respond to calls for service, they are utilizing their own vehicles and fuel. When volunteers are covering a 12-hour shift, they have City of Crescent City/Crescent Fire Protection

June 30, 2022
3 committed to being available and ready to respond to any and all calls for service during that 12- hour period. These volunteer services are of immeasurable value to the community served.
Therefore, staff supports the request for increased stipends.
City Attorney Rice went over the process to get to the stipend amounts being presented tonight and stated that the law limits the amount that “volunteers” can be paid for their service.
Specifically, “[v]olunteers may be paid expenses, reasonable benefits, a nominal fee, or any combination thereof, for their service without losing their status as volunteers.” 29 CFR 553.106(a). If an individual were to lose his or her status as “volunteer”, then the employing agency would be required to pay minimum wages, overtime and penalties. The stipends must be analyzed under the “nominal fee” category. The Department of Labor has issued guidance by way of opinion letters defining what constitutes a nominal fee in the context of volunteer firefighters.
Generally, payments to volunteers cannot be paid by the hour and should not exceed 20 percent of the total compensation that the employer would pay to a full-time firefighter performing the same services. Fire Chief Carey stated that this is important to him as the leader of the fire department, but for the community. He spoke of the many sacrifices firefighters make to respond to calls and due to the change in the economy and everything being more costly, the stipend would need to be raised. He detailed the types of coverages and the ranks along with their stipend amounts. For 12-hour shifts, Duty Battalion Chiefs: current stipend: $100, new: $175; Duty Captains: current: $50, new: $100; Sleeper Program: current: $50, new: $75. For response stipends: Medical- Non-EMT: current: $5, new $10; Medical – EMT: current: $10, new $15; Fire Non-Officer: current: $10, new $20; Fire – Officer: current: $15, new: $25; Training: current: $10, new: $10; ARFF Shift: current: $50, new $50. The monthly stipend caps are as follows:
firefighters: $1,485.25; engineers: $1,666.63; captains: $1,871.98; battalion chiefs: $2,230.92.
Mayor Greenough asked if the firefighters cap out, would they still be able to respond to calls? City Manager Wier stated that they can still respond to calls, they just wouldn’t be able to receive the stipend.
Vice Chair Short asked when the last time we spoke about stipends; City Manager Wier stated it was back in 2018 and changes were made at that time. Vice Chair Short asked that a policy be created so stipends can be reviewed every two years; City Manager Wier stated that yes, that could be direction to staff. He further stated that a budget adjustment would not be necessary for this stipend at this time.
Director Erler asked how the cap was determined; City Attorney Rice stated that payments to volunteers cannot be paid by the hour and should not exceed 20 percent of the total compensation that the employer would pay to a full-time firefighter performing the same services. And the analysis calculated total compensation for a paid firefighter by averaging the wages paid to firefighters at Humboldt Bay Fire and Arcata Fire District plus the benefits afforded the City’s only safety unit – the Crescent City Police Officers Association. The proposed stipends were then compared to 20% of the calculated total compensation for comparable paid firefighters.
Additionally, each volunteer firefighter will have a cap on the total amount of stipends that they may earn in any given month. This is another safeguard to ensure that volunteers do not cross the 20% threshold. The memorandum concludes that the stipends as set forth in the resolution meet the parameters established by Department of Labor guidance regarding the 20 percent rule for “nominal” fees. Director Erler asked if it includes benefits; City Attorney Rice answered in the affirmative. Director Erler asked if the statewide average was used; City Attorney Rice stated that no, it was based on Humboldt Bay and Arcata Fire District.
Fire Chief Carey stated what was important is to retain the firefighters. City Manager Wier stated that in the resolution it states that if someone has to travel out of the area who come to Del Norte City of Crescent City/Crescent Fire Protection
Special Meeting Minutes

4 for duty time, they will be compensated for travel. Director Erler asked how someone out of the area could be a firefighter in Del Norte as there is training and meetings that they have to attend; Fire Chief Carey answered stated that in our policy it states that they have so many meetings they are required to attend in order to stay a volunteer firefighter. Council Member Inscore stated that he supports the stipend and agrees that the stipends need to be reviewed annually. Mayor Greenough agreed that it needs to be reviewed biannually.
The Council was in unanimous consensus to make it a policy that the stipends need to be reviewed biannually.
There were no public comments.

3. Val Polyanin Artwork Donation
• Recommendation: Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Direct staff to take one or more of the following actions:
o Accept the donated art
o House the artwork in the Bank of America building while staff seek out a permanent home(s)for the collection
o Develop a short-term plan that addresses the budgetary considerations for housing and exhibiting the work of Val Polyanin, and a timeframe for finding a permanent home
o Develop a long-term plan that addresses the budgetary considerations and economic benefits of retaining a portion of the work to be displayed on a consistent basis, potential tourism opportunities and indirect benefits of having the art exhibited in the community and a permanent solution for preserving and housing the remaining pieces of work
Economic Development and Recreation Director Taylor explained that Hambro had contacted the City stating that the artist Val Polyanin wanted to donate his life’s work to the City. The artwork has been on display across from South Beach for several years, and within the Conex boxes are over 5,000 pieces of art. She gave a detailed outline of his background and how he emigrated to America. Director Taylor explained that the art could be used as a tourism attraction. Options are to store the art at the Bank of America Building, exhibit a portion of the art, work with an organization to preserve and permanently house the collection, or to place the art with an art preservationist or a gallery that can properly care for it as a permanent steward. The Kohler Foundation, a team of preservationists, has shown interest in possible restoration, preservation, and placement in one or more museums or galleries. They typically look for non-profits or educational institutions that have sufficient ongoing funding to properly display and maintain the art. Kohler’s process, however, is long and will likely take a year to fund due to the volume of their other ongoing art preservation work. Director Taylor said that some staff time would be used to move the art to the locations. Council Member Altman asked if the art would be wrapped so they won’t be damaged which would require additional staff time; Director Taylor said yes. Council Member Smith supports receiving the donation; Council Member Altman supports having them on display. Mayor Pro Tem Wright does not want to use the new City Hall for a permanent housing of the art. Director Taylor said tonight’s decision would be to either accept the art donation and then staff will bring plans back to the Council. City Manager Wier stated that the art needs to be removed from the current location by the end of August. Our Public Works Department will not be able to help as this is a busy time of the year for them and they are not art transporters and do not have experience. Council Member Altman stated that we need to accept the donation and have professional movers take care of transporting the art to where it needs to go; Council Member Inscore stated that broader direction also needs to be given and agrees with the professional movers and to find out how much it will cost. Have a budget of $5k to do the move.
Council Member Altman said our employees cannot be used as this is a very busy time of the year. Council Member Smith asked if $5k was enough; City Manager Wier stated it was a good place to start. Council Member Inscore said he could modify it to up to $10k. Council Member Altman said it’s a good short-term idea to have a museum at the Bank of America, but it will need 3 | P a g e

to be staffed. Mayor Greenough agreed with Council Member Inscore to determine how much we need to budget and it was agreed that $10k was enough to start with. Council Member Inscore stated that this art will become a destination for tourists. The outdoor art in Wilson, North Carolina ended up being their downtown revitalization and could be the same for Crescent City should we accept this art. Council Member Inscore said that a good use of the Bank of America building as a museum could be good for economic development. Council Member Altman stated that he travels to see art and it’s a very popular thing to do. Mayor Greenough said that by Mr. Polyanin chose Crescent City over anywhere else is very meaningful. Council Member Smith asked if the letter from Mr. Polyanin was sufficient for the City to accept the donation; City Attorney Rice stated that since Val Polyanin is no longer in the area, the only thing we have is his letter and the intent told by Hambro to the City. Council Member Inscore asked if a something to be notarized establishing his consent; Director Taylor explained that since he is no longer in the area, we do not have any contact information for him where he currently resides.
On a motion by Council Member Inscore, seconded by Council Member Smith, and carried unanimously on a 5-0 polled vote, the City Council of the City of Crescent City directed staff to accept the art, temporarily store it in the Bank of America building, provide an initial budget for transition of the art of $10,000 out of the Economic Development line item and to direct staff to come back for discussion and future options on what the City will do.

SUBJECT: BUDGET-TO-ACTUAL FINANCIAL REPORTS FOR MAY 2022 ______________________________________________________________________
RECOMMENDATION
• Receive and file monthly budget-to-actual financial reports of the City’s major operating funds for the month of May 2022
BACKGROUND
In order to provide timely information to the City Council and to the public, the City’s Finance Department has prepared the attached monthly budget-to-actual reports. These reports provide a summary as of May 31, 2022 of the fiscal year-to-date revenues and expenses of the City’s major operating funds: General Fund, Housing Authority Fund, Lighthouse Cove RV Park Fund, Sewer Fund and Water Fund.
The information in the attached report is a snapshot at this point in time and may change as additional information is entered into the accounting system and verified.
ITEM ANALYSIS
As of May 31, 2022, we are 92% of the way through the fiscal year, with 8% of the year remaining. If revenues were received and expenditures made evenly throughout the year, there should be approximately 8% of each budget line remaining. However, revenues and expenditures are not even throughout the year for many reasons. Many revenues are not received evenly throughout the year (particularly tax revenues and grant reimbursements), most expenses are not recorded until the invoice is received in the following month, and budgets may include large projects that have not yet been completed. Additionally, revenues and expenses that belong to this fiscal year will continue to be received and verified for several months.
This report summarizes the actual revenues and expenditures for the year to date; additional information is provided in the budget-to-actual reports attached.
BUDGET TO ACTUAL REPORT – MAY 2022
JULY 5, 2022
2 • General Fund
General Fund revenues show that 20% of the budgeted amount is yet to be received. This is dependent on the timing of when certain revenues are received.
For example, most taxes, third party billings, and grant reimbursements are recorded quarterly. General Fund actual expenditures show that 27% of the budgeted amount is yet to be expended.
• Housing Authority Fund
The Housing Authority is funded by monthly disbursements from the federal government. At this point, actual revenues show 14% remaining to be received and actual expenditures have remaining amounts of 16%.
• Lighthouse Cove RV Park Fund
Revenues collected by the Lighthouse Cove Recreational Vehicle Park (RV Park) are already 14% over budget. RV Park revenues are highly seasonal, and most rental revenues are typically received in the summer months. Actual expenses in the RV Park show 32% of the budget left to be expended. • Sewer Fund
The Sewer Fund earns revenue primarily from charges to the users of its services.
Actual revenues show 14% of the total revenue budget remaining to be collected.
Operational expenses (not including debt service or capital improvements) show 33% of the budget remaining to be expended.
• Water Fund
The Water Fund earns revenue primarily from charges for service. Actual revenues show 7% of the budget remaining to be collected and 24% of budgeted operational expenses (not including debt service or capital improvements) remaining to be expended.
• Summary
The following table summarizes the actual revenues and expenses for the City’s five major operating funds, not including encumbrances:

3 • Long-term Liabilities
The City’s long-term liability balances are included in the table below. Net Pension Liability, Net OPEB Liability, and Compensated Absences are updated annually during the audit process. These amounts below are from the most recent audit (June 30, 2021). The Sewer Fund and Water Fund loan balances are updated when payments are made (in July for the Sewer Fund loan, and in December and June for the Water Fund loan). These do not include interfund balances (amounts owed from one City fund to another).

RECOMMENDATION
• Adopt Resolution No. 2022-50, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY CORRECTING RESOLUTION NO. 2022-44
BACKGROUND
The City’s annual budget for Fiscal Year 2022-23 was adopted by the City Council on June 20, 2022 by Resolution No. 2022-44. The full budget document including details of all funds of the City was attached to that Resolution.
Staff discovered two calculation errors in the table shown on Resolution No. 2022-44 for the total appropriations by fund type. The totals for Special Revenue funds and General CIP funds do not match the totals within the detailed budget document. The attached resolution will correct Resolution No. 2022-44 to reflect the correct totals for each fund type.
FISCAL ANALYSIS
This is a correction of a clerical error and does not change the budgets that were approved in the detailed budget document.
STRATEGIC PLAN ASSESSMENT
This report is consistent with the Strategic Plan Goal of “Maintaining a balanced budget while executing strong fiscal management, optimized staffing levels, and through maximizing services with available resources.”

RECOMMENDATION
• Approve and adopt Resolution No. 2022-51, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2022-23 BUDGET OF THE CITY OF CRESCENT CITY
BACKGROUND
Two water mains run in parallel down Wonder Stump Road. The 24 inch diameter ductile iron water main is not affected by this installation. The 12 inch diameter cast iron pipe presently serves 4 water meters at Orchard Lane from a 2 inch diameter tee service and additional services have been approved but not yet connected due to the insufficient water service pipe diameter.
ITEM ANALYSIS
The Orchard Lane 2 inch water service feeds from the 12 inch cast iron water main. It presently serves 4 meters at the intersection of Orchard Lane and Wonder Stump Road.
The 2 inch service has developed multiple leaks in the past and is in need of replacement.
There are 5 future hookups additionally located at this intersection. The diameter of the current water service pipe is insufficient to meet future demand for this site. Secondly, the Fire Chief of Fort Dick has requested the installation of a fire hydrant at this intersection considering that the nearest fire hydrant is located over a mile away south of Vivienne Lane. To meet the future needs at this intersection, engineering recommends installation of 60 linear feet of 6 inch PVC water service to a manifold with 8 water meters.
Installation of the fire hydrant will be connected between the 12 in cast iron pipe and the new water meter manifold directly to the 6 inch water service at a location directed by the Fort Dick Fire Chief.
Water Main Installation at Orchard Lane
July 18, 2022
2 Tidewater has provided a quote covering labor, equipment, chlorination, pressure testing, backfill material, and asphalt to patch the roadway. The city will provide the waterline materials, fittings, fire hydrant and water meters.
The four existing connections will be re-attached to the new 6 inch water service free of charge. The five new connections at this location will be made at the standard installation fee.
FISCAL ANALYSIS
On May 19, 2022 all parts pertaining to the plumbing were purchased from the FY21/22 Water Parts & Supplies account.
Tidewater’s estimate minus the City provided parts is $19,900 which according to the City procurement procedure allows for direct contract/force account.
FY21/22 purchased parts $11,887.07
FY22/23 construction $19,900.00
Contingency 9% $ 3,212.93
Total $35,000.00
FY21/22 Water Parts & Supplies $11,887.07
FY22/23 Resolution 2022-xx $25,000.00
Total Budget $36,887.07
There will also be four water connection fees to be paid into the water fund, for a total revenue of approximately $11,000. Estimates for annual water connections are already included in the budget.

CITY COUNCIL AGENDA REPORT
TO: MAYOR GREENOUGH AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: LINDA LEAVER, FINANCE DIRECTOR
DATE: JULY 18, 2022
SUBJECT: DELINQUENT SEWER-ONLY ACCOUNTS
______________________________________________________________________
RECOMMENDATION
• Open public hearing
o Receive staff report
o Technical questions from the Council
o Hear public comments
o Further Council discussion
• Close public hearing
• City Council may revise, change, reduce, or modify any charge, or may overrule any or all objections
• Approve and adopt Resolution 2022-52, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CRESCENT CITY DETERMINING THE AMOUNT
OF DELINQUENT SEWER CHARGES FOR CERTAIN PARCELS OF
PROPERTY AND AUTHORIZING THE COLLECTION THEREOF WITH
ORDINARY PROPERTY TAXES
BACKGROUND
When the City provides sewer service to parcels of property where the property owner is responsible for the charges and such charges subsequently become delinquent, Section 5473 of the Health and Safety Code and Chapter 13.13 of the Crescent City Municipal Code provide:
1. That a written report be prepared describing the parcel where the service was rendered and stating the amount of delinquency.
2. That each property owner be notified of the time and place when a public hearing will be held to hear any and all objections and protests regarding the report as prepared. (Notice was mailed to affected property owners on July 6, Public Hearing – Delinquent Sewer Charges
July 18, 2022
2 2022 and the notice of public hearing was published in the Triplicate on July 8, 2022.)
3. That upon Council approval, the report is to be filed with the County Auditor for collection as a special assessment upon the current tax roll. The deadline for filing the report of sewer delinquencies with the County of Del Norte is July 31, 2022.
ITEM ANALYSIS
The attached report lists accounts with delinquent sewer charges, meaning the property owner owes at least two months of sewer charges. For customers with both water and sewer service provided by the City, delinquent accounts are normally handled by suspending water service. In the case of the attached accounts, the customer receives only sewer service from the City and therefore disconnection of water service is not an option. For these accounts (referred to as “Sewer Only” accounts), delinquent balances are placed on the property tax roll of the property owner once per year.
The affected property owners were mailed a notice on July 6, 2022 and a notice of this hearing was published in the Triplicate on July 8, 2022. The property owners who received notice are attached to this report. The mailed notice informed the affected property owners that they may pay the delinquent balance by 12:00 pm on the date of the public hearing in order to have their account removed from the list. Staff will provide an updated report at the public hearing to remove the names of any property owners who have paid their past due balances. Property owners also have the right to attend the public hearing and make an objection to the City Council. The Council may change or reduce any of the attached charges or may overrule any or all objections.
Upon approval of the Council, the updated list of delinquent sewer charges will be sent to the County auditor to be added to the FY 2022-23 property tax roll.
FISCAL ANALYSIS
The attached report shows those parcels of property which have delinquent sewer charges as of July 6, 2022. The total amount due to the City’s Sewer Fund as of that date was $20,170.67, which if not collected will result in a loss of revenue. The amount to be included on the 2022-23 tax roll will include the delinquent sewer charges plus a 6% administrative fee.
The actual list to be sent to the County for collection will be the updated list provided at the public hearing (to remove any accounts which have paid by noon on the hearing date) plus any revisions the Council may direct staff to update at the public hearing.

DATE: JULY 18, 2022
SUBJECT: AMADOR TANK PHASE 2 REHABILITATION PLANS & BID ______________________________________________________________________
RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Approve plans and specifications for the Amador Phase 2 Rehabilitation and give consent for Elk Valley Rancheria to advertise for bids.
BACKGROUND
In order to complete essential CIP and other projects, staff issued a request for qualifications (RFQ) on December 5, 2018 for Engineering Support Services. Council approved contracts with five engineering and engineering support teams to assist with capital improvement projects, special projects, and projects to implement new and existing regulatory requirements.
Staff issued a short format RFQ to the previously selected firms on January 6, 2020 for the development of plans and specifications to make needed repairs to the Amador Water Tank Rehabilitation Phase 1. The Amador Tank is a 1.5-million-gallon municipal water storage tank which represents approximately 27% of the City’s total water storage. Three studies have been performed on the Amador Tank and all conclude that there is a need to make significant repairs: Coleman Engineering (2017), Pittsburg Tank & Tower Maintenance Co., Inc. (2013), and CSI Services (2016).
The Elk Valley Rancheria (EVR) obtained a $197,000 grant to cover much of the construction costs for Phase I of the Amador Tank Rehabilitation project. EVR was the project owner and the City was the beneficiary of the invested funds. The invitation to bid from the Elk Valley Rancheria was made public on December 1, 2020 for a reduced scope project including exterior ladder, safety rails, fall restraint system, new roof hatch, AMADOR TANK PHASE 2 REHABILITATION
JULY 18, 2022
2 replacing center vent, adding a new auxiliary roof vent, and minor patching and painting as required. City staff and City-hired engineer/inspectors oversaw the construction.
At the January 26, 2021 City Council meeting, the City Council recommended that EVR select Farr Construction to complete Phase 1 of the Amador Tank Rehabilitation. Also, a budget amendment for $95,000 was approved to cover additional construction costs, contingency and special inspections for the Amador Tank Rehabilitation Project that were not covered by the grant received by EVR.
At the March 1, 2021 City Council meeting, the City Council approved SHN Task Order
2.1 for special inspections and construction management support of Phase 1.
Farr Construction was the low bidder for Phase I at $267,700. EVR sent the Notice of Award to Farr Construction on February 10, 2021 and a Notice to Proceed on March 11, 2021. Fabrication of appurtenances began immediately, and once installation was complete the Amador Tank was returned to service on May 13, 2021. The final construction cost for Phase 1 came in under budget at $242,500.
On March 18, 2021 the City signed Task Order 3 with SHN to complete an evaluation and design services for the Amador Tank Phase 2 Rehabilitation. Phase 2 entails removal of all paint and oxidized metals internally and externally for the entire tank, patch repairs, followed by new paint, installation of a new foundation to meet seismic design standards, and a cathodic protection system to extend the useful life of the tank. EVR obtained a second Bureau of Reclamation grant on May 5, 2022 for an additional $200,000 committed to Phase 2 of the Amador Tank rehabilitation.
On July 20, 2021, the City signed Task Order 4 with SHN to complete Phase 3 of the Washington Boulevard Tank Rehabilitation project ($71,060). Design of Phase 3 is scheduled for this coming Fiscal Year. EVR is also seeking a one million dollar Water Smart Grant that would help pay for Phase 3.The City’s matching funds on the first two phases of the Washington Tank Rehabilitation project will be counted and leveraged to help gain the Water Smart Grant.

RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Waive full reading, read by title only, and introduce Ordinance No. 831, An Ordinance of the City Council of the City of Crescent City Amending the Crescent City Municipal Code by Adding Chapter 15.36, Permits for Electrical Vehicle Charging Stations, to Title 15, Buildings and Construction
BACKGROUND
State law requires all cities and counties to approve an application for the installation of electric vehicle charging stations, as defined, through the issuance of over-the-counter permits, unless the city makes specified written findings based upon substantial evidence in the record that the proposed installation would have a specific, adverse impact upon the public health or safety, and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact.
State law provides for the implementation of consistent statewide standards to achieve the timely and cost-effective installation of electric vehicle charging stations throughout the State. State law requires each city and county to adopt an ordinance that creates an expedited and streamlined permitting process for electric vehicle charging stations.
ITEM ANALYSIS
It is the purpose of this ordinance to provide an expedited administrative permit review process for electric vehicle charging stations. The ordinance contains the following mandatory provisions:
EV Charging Stations Ordinance
JULY 18, 2022
2 • Requires the Building Official to adopt a checklist of all requirements with which electric vehicle charging stations must comply in order to be eligible for expedited review;
• Requires the City’s adopted checklist to be published on the City’s website; • Allows for electronic submittal of permit applications and associated supporting documentation;
• Upon confirmation that applicant has submitted all required information and that the EV charging station will not have a specific, adverse impact to public health and safety or building occupants, the Building Official must issue the permit; • Potential specific, adverse impacts to public health and safety or building occupants will require a CUP or project alteration;
• Actual specific, adverse impacts to public health and safety or building occupants will result in the denial of the permit application; and • Denials and CUP requirements may be appealed to the Planning Commission.
Staff have also included a draft of the “checklist” to be adopted by the Building Official as an attachment to this staff report.
If introduced at this meeting, then the ordinance will be brought back to the second meeting in August for final adoption. The ordinance will take effect 30 days after its adoption.
FISCAL ANALYSIS
The costs associated with introducing the ordinance include staff time and costs to publish the ordinance summaries. There is also a potential for savings in future staff time as this ordinance and its associated processes may help to streamline the process of obtaining an over-the-counter electrical vehicle charging station permit. The fees for the permits themselves are calculated the same as any other building permit fee.
STRATEGIC PLAN ASSESSMENT

SECTION 1. RECITALS. The City Council finds the above recitals to be true and correct and are incorporated herein as if set forth in full.
SECTION 2. CODE AMENDMENT. The Crescent City Municipal Code is hereby amended by adding Chapter 15.36, Permits for Electric Vehicle Charging Stations, to Title 15, Buildings and Construction, as follows:
[CONTINUED ON NEXT PAGE]
CRESCENT CITY ORDINANCE NO. 831 PAGE 2 OF 5
Chapter 15.36 – Permits for Electric Vehicle Charging Stations
15.36.010 – Purpose
It is the purpose of this chapter to comply with Government Code Section 65850.7, which requires the City to adopt an ordinance that creates an expedited and streamlined permitting process for electric vehicle charging stations.
15.36.020 – Definitions
(a) “Electric vehicle charging station” or “charging station” means any level of electric vehicle supply equipment station that is designed and built in compliance with Article 625 of the California Electrical Code and delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle. (b) “Specific, adverse impact” means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified, and written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete.
(c) “Electronic submittal” means the utilization of one (1) or more of the following:
(1) Electronic mail or email.
(2) The internet.
(3) Facsimile.
(d) “Association” means a nonprofit corporation or unincorporated association created for the purpose of managing a common interest development.
15.36.030 – Expedited Plan Check Review Process
Consistent with Government Code Section 65850.7, the Building Official shall implement an expedited administrative permit review process for electric vehicle charging stations and adopt a checklist of all requirements with which electric vehicle charging stations must comply in order to be eligible for expedited review. The expedited administrative permit review process and checklist may refer to the recommendations in the checklist prescribed by the most current version of the “Plug-In Electric Vehicle Infrastructure Permitting Checklist” of the “Zero-Emission Vehicles in California: Community Readiness Guidebook” published by the Governor’s Office of Planning and Research. The City’s checklist must be published on the City’s website.
15.36.040 – Electronic Submittals.
Consistent with Government Code Section 65850.7, the Building Official must allow for electronic submittal of permit applications covered by this chapter and associated supporting documentation. In accepting such permit applications, the Building Official will also accept electronic signatures on all forms, applications, and other documentation in lieu of a wet signature by any applicant.
CRESCENT CITY ORDINANCE NO. 831 PAGE 3 OF 5
15.36.050 – Association Approval
Consistent with Government Code Section 65850.7, the Building Official must not condition the approval for any electric vehicle charging station permit on the approval of such a system by an association, as that term is defined herein.
15.36.060 – Permit Application Processing
(a) Prior to submitting an application for processing, the applicant must verify that the installation of an electric vehicle charging station will not have specific, adverse impacts to public health and safety and building occupants. Verification by the applicant includes but is not limited to: electrical system capacity and loads; electrical system wiring, bonding and overcurrent protection; building infrastructure affected by charging station equipment and associated conduits; areas of charging station equipment and vehicle parking.
(b) A permit application that satisfies the information requirements in the City’s checklist will be deemed complete and be promptly processed. Upon confirmation by the Building Official that the permit application and supporting documents meet the requirements of the City’s adopted checklist, and is consistent with all applicable laws, the Building Official shall, consistent with Government Code Section 65850.7, approve the application and issue all necessary permits. Such approval does not authorize an applicant to energize or utilize the electric vehicle charging station until approval is granted by the Building Official. If the Building Official determines that the permit application is incomplete, he or she must issue a written correction notice to the applicant, detailing all deficiencies in the application and any additional information required to be eligible for expedited permit issuance.
15.36.070 – Technical Review.
It is the intent of this chapter to encourage the installation of electric vehicle charging stations by removing obstacles to permitting for charging stations so long as the action does not supersede the Building Official’s authority to address higher priority life-safety situations. Each application will be reviewed for compliance with all applicable local, state and federal health and safety requirements. Applicable local laws are limited to those standards and regulations necessary to ensure that the electric vehicle charging station will not have a specific, adverse impact upon the public health or safety.
15.36.080 – Electric Vehicle Charging Station Requirements. (a) Electric vehicle charging station equipment shall meet the requirements of the California Electrical Code, the Society of Automotive Engineers, the National Electrical Manufacturers Association, and accredited testing laboratories such as Underwriters Laboratories, and rules of the Public Utilities Commission.
CRESCENT CITY ORDINANCE NO. 831 PAGE 4 OF 5
(b) Installation of electric vehicle charging stations and associated wiring, bonding, disconnecting means and overcurrent protective devices must meet the requirements of Article 625 and all other applicable provisions of the California Electrical Code.
(c) Installation of electric vehicle charging stations must be incorporated into the load calculations of all new or existing electrical services and meet the requirements of the California Electrical Code. Electric vehicle charging equipment is to be considered a continuous load.
(d) Anchorage of either floor-mounted or wall-mounted electric vehicle charging stations must meet the requirements of the California Building or Residential Code as applicable per occupancy, and the provisions of the manufacturer’s installation instructions. Mounting of charging stations must not adversely affect building elements.
15.36.090 – Permit Denial and Appeal
(a) Pursuant to government Code Section 65850.7(b), the City may require an applicant to obtain a conditional use permit if the Building Official makes a written finding, based on substantial evidence in the record, that the proposed electric vehicle charging system could have a specific adverse impact upon public health and safety. The intent of the CUP is to put in place mitigation measures to protect the public health and safety. Any conditions imposed on an application to install an electric vehicle charging station must be designed to mitigate the specific, adverse impact upon the public health and safety at the lowest cost possible. (b) Pursuant to Government Code Section 65850.7(c), the City may deny a permit application if the Building Official makes a written finding, based on substantial evidence in the record, that the proposed electric vehicle charging system would have a specific, adverse impact upon the public health and safety, and there is no feasible method to satisfactorily mitigate or avoid the specific adverse impact. The findings must include the basis for the rejection of the potential feasible alternatives of preventing the adverse impact.
(c) The decision of the Building Official to require a conditional use permit or to deny an application for a permit under subsections (a)-(b) may be appealed to the Planning Commission by filing a written notice of appeal with the City Clerk within 30 days of the date of decision of the Building Official. The appeal will be heard by the Planning Commission within 45 days of receipt of the notice of appeal. ***END TEXT AMENDMENT***

BACKGROUND
Both the City Council and the Measure S Committee have given City staff direction to purchase a second police K9 for deployment on patrol with CCPD. CCPD maintains a contract for services through Meyer’s Police K9 Training, LLC, and is currently working with them for the purchase of a second K9. Recently, Chief Griffin became aware of the AKC Reunite adopt a K9 Cop matching grant program. The program is focused on the purchase of police K-9’s throughout the country and must be co-sponsored through a local K9 Kennel Club.
ANALYSIS
Chief Griffin has been able to secure a private donation for the required matching amount of $2500. That donation was made to the Lost Coast Kennel Club in Eureka and has since been remitted to the City. The AKC Reunite matching grant has been approved for the initial grant of $7500 to go towards the purchase of a K9. As a condition of the grant, the CCPD will be required to display a decal from AKC Reunite on the patrol vehicle that is being used for the K9 purchased with the grant funding. ©

RECOMMENDATION

• Council discussion
• Approve and adopt Resolution No. 2022-54, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING RESOLUTION NO. 2022-48 TO INCLUDE THE FORM OF THE QUESTION TO BE PRESENTED
TO VOTERS
BACKGROUND
At the June 20, 2022 meeting, the City Council adopted Resolution No. 2022-48 placing the initiative to repeal “Measure S” on the November 8, 2022 municipal election ballot because the petition was verified to have received the legally required number of signatures to qualify for the ballot. The resolution was forwarded to the County Elections Official, who has subsequently requested that the City Council also adopt the form of the question to be presented to the voters.
ANALYSIS
The goal when crafting the form of the question is to present a question that is clear, concise, non-argumentative and unbiased. A vote in favor of the initiative is a vote to eliminate the tax. Therefore, voters will not be confused by this language as to what a ‘yes’ vote means or what a ‘no’ vote means. The question identifies the specific tax that voters will be voting to repeal or keep. If they read nothing else, the voters will be clearly informed as to the effect of their vote by the form of the question.
BALLOT QUESTION
JULY 18, 2022
2 The resolution presented states that the form of the question shall be as follows:
Shall the City of Crescent City’s one percent local sales tax (known as “Measure S”), which funds essential city services such as street maintenance, the fire department, the police department, and the community pool, be eliminated? If adopted, the City Clerk will forward the resolution to the County’s Elections Official for inclusion on the ballot.
FISCAL ANALYSIS
The adoption of this resolution will have no direct fiscal impact.
