ELECTION
BACKGROUND
On June 6, 2022 the City Council adopted Resolution No. 2022-40 specifying offices to be filled and requesting consolidation of the November 8, 2022 Crescent City Election with the November 8, 2022 Statewide Election. The offices to be filled were those of Council Member Ray Altman, Council Member Blake Inscore and Council Member Isaiah Wright. There were two candidates that filed to run for the and hold a four-year term; those candidates were: Raymond Altman and Isaiah Wright. There was one candidate that filed to run for and hold a two-year term; that candidate was Blake Inscore.
On June 20, 2022, the City Council adopted Resolution No. 2022-48 calling for the addition of an initiative measure to the November 8, 2022 Municipal Election Ballot.
ANALYSIS
On November 8, 2022 the Crescent City Election was consolidated with the Statewide General Election and it was determined that Ray Altman, Blake Inscore, and Isaiah Wright were appointed to the vacancies as there were no challengers. It was also determined that Measure T – Repeal of Measure S City Sales Tax had a majority of votes in opposition and therefore failed. The elections are certified by resolution and once approved by the Council, the City Clerk will swear in the newly appointed Council Members and they will take their seats at the dais. Proclamation
of the
City of Crescent City
WHEREAS, in the annals of American history, only a few events are so well known and so deeply rooted in national remembrance that the mere mention of their date suffices to describe them. Of these occurrences, none could have had more significance for our Nation than December 7, 1941; and
WHEREAS, 71 years ago, our service members and civilians awoke on a quiet Sunday to a surprise attack on Pearl Harbor by Japanese forces. Employing whatever weapons were at hand, those who defended Hawaii that fateful morning stand as examples of the selfless heroism that has always characterized the Armed Forces of the United States. More than 3,500 Americans were killed or wounded, and the images of burning battleships and the grief for lives lost were forever seared into our national memory; and
WHEREAS, despite the shock and confusion of the moment, American service members and first responders on the island of Oahu mounted an incredibly brave defense against insurmountable odds. American pilots took to the air to engage enemy aircraft, sailors took their battle stations, and medical personnel cared for the wounded. Many witnesses to the events of that day perished in the attacks, leaving countless acts of valor unrecorded.
Nevertheless, 15 Medals of Honor were awarded, 10 of them posthumously, to the United States Navy personnel for acts of valor above and beyond the call of duty; and WHEREAS, Del Norte County lost one of its own citizens that fateful day, as Roscoe Earl “Rocky” Peterson, who enlisted in the Navy in 1940 was a seaman 2nd class on the U.S.S Arizona when he was tragically killed in the attack. Dedicated in 1943, Peterson Park now bears his name with a monument dedicated to Rocky, his legacy as an outstanding baseball player, and the supreme sacrifice he gave to our Country WHEREAS, the deadly attack on Pearl Harbor did not accomplish its mission of breaking the American spirit. Instead, it reinforced our resolve. Americans responded with unity and courage to a tragedy that President Franklin D. Roosevelt called “a date which will live in infamy”. In the aftermath of Pearl Harbor, thousands of resolute individuals immediately volunteered their service to a grieving Nation. Sixteen million of America’s sons and daughters served during World War II, and more than 400,000 paid the ultimate sacrifice in defense of life and liberty.
Countless other patriots served on the home front, aiding the war effort by working in manufacturing plants, participating in rationing programs, or planting Victory gardens. In the face of great loss, America once again showed the resilience and strength that have always characterized our great country; and
WHEREAS, every honor is appropriate for the courageous Americans who made the supreme sacrifice for our Nation at Pearl Harbor and in the many battles that followed in World War II.
Their sacrifice was for a cause, not for conquest; for a world that would be safe for future generations. Their devotion must never be forgotten; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Crescent City do hereby proclaim December 7, 2022 as Pearl Harbor Remembrance Day. We encourage all Americans to observe this solemn day of remembrance and to honor our military, past and present, with appropriate ceremonies and activities.
Pearl Harbor Remembrance Day, December 7, 2022.

RECOMMENDATION
• Hear staff presentation
• Technical questions from the Council
• Receive public comment
• Further Council discussion and direction regarding the development of an ADU/JADU ordinance
BACKGROUND
In 2021, the City Council directed staff to take up discussions with the Planning Commission regarding the development of an ordinance regulating accessory dwelling units (ADUs) and junior accessory dwelling units (JADUs). At a meeting held on September 30, 2021, the Planning Commission made the following recommendations on provisions to be included in the ordinance:
1. Number of ADUs/JADUs shall be limited to one ADU and one JADU (singlefamily); (no mention of multi-family)
2. Size of ADUs shall be limited to no more than 1200 SF; (law also requires that attached ADUs be no more than 50% of primary dwelling)
3. Height of detached ADU shall be limited to 16ft; (does not address attached ADU for detached ADU with multi-story MFD)
4. Lot coverage limitations are applicable to ADUs/JADUs (subject to min 800 SF ADU)
5. Owner-occupancy shall not be a requirement
6. Rental term shall not be regulated; (law is unclear on mandatory 30+ day rentals)
7. No parking requirements for ADU/JADU
8. No utility connection fees for ADU/JADU
On October 11, 2021, the Planning Commission recommended approval of a draft ADU ordinance (attached to this staff report).
ADU Presentation
December 5, 2022
2 Each legislative session over the past few years has seen the passage of several bills that reduce local control over the development of ADUs. New laws went into effect January 1, 2022 and new laws will also take effect January 1, 2023. All of these changes have been taken into account in this presentation.
ITEM ANALYSIS
It is the intent of this agenda item to:
1. introduce the City Council to the regulatory framework for accessory dwelling units, including the limited options for local governments to impose standards; and
2. update the City Council on where we are at in the process of adopting an ADU ordinance; and
3. answer questions and receive general direction from the City Council on the process moving forward.
Staff is not requesting any specific action of the City Council. It is the intent of staff to create a revised draft ADU ordinance for the Planning Commission to consider and to then to return to the City Council with a recommendation from the Planning Commission.
FISCAL ANALYSIS

Background & Description:
In 2020, the City Council directed staff to work with the Planning Commission on development of an accessory dwelling unit ordinance. Over the past month, the Planning Commission held two workshops considering the permitting of accessory dwelling units in the City and provided direction to staff. Most recently, at the September 30, 2021, Planning Commission meeting, the Commission provided specific direction to staff on several items for which staff requested clarification. This additional direction from the Commission is summarized below:
• The Planning Commission reached consensus that the number of allowable ADU/JADUs shall be limited to one ADU and one JADU.
• The Planning Commission reached consensus that the size of an allowable ADU is limited to 1,200.
• The Planning Commission reached consensus that the height of an allowable detached ADU is limited to 16-ft.
• The Planning Commission reached consensus that the lot coverage within the zoning limitations is applicable to the ADU/JADU and shall remain the same. • The Planning Commission understands that replacement parking for the primary residence due to the development of an ADU/JADU is not required.
• The Planning Commission reached consensus that the owner occupancy shall not be a requirement in developing an ADU/JADU.
• The Planning Commission reached consensus that the rental-term of an ADU/JADU shall not be regulated.
• The Planning Commission reached consensus recommending that the utility connection fees should be waived.
Draft ADU/JADU Ordinance:
Based on the direction received from the Planning Commission at the September 30, 2021, meeting, a draft Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) Ordinance has been developed by planning staff, which is attached to this staff report. Below is staff’s analysis of the draft ordinance consistency with the City’s General Plan, Municipal Code, Economic Development Strategic Action Plan, and Housing Element.
General Plan Consistency:
The general plan designates the ordinance impact are within the residential designations, which reads as follows:
Single-Family Residential 0-2 (SF 0-2)
This designation provides for very low to low density residential development within the urban boundary that has few or no community services, or where only community water is available. The need for development of these areas at higher urban densities is dependent upon the extension of urban services. Residential density may not exceed two dwelling units per acre. The principal permitted use under the Residential 0-2 designation is single family residential with accessory buildings and home occupations. The City may grant conditional use permits for home enterprise, second units, guest lodging, small public facilities, large care homes as defined by the California Health and Safety Code, and small, non-intensive, quiet, neighborhood commercial uses such as grocery stores that are compatible with surrounding neighborhoods. Farm animals should be limited generally to larger parcels. (Page 1-7)
Single-Family Residential 2-6 (SF 2-6)
This designation provides for low to moderate residential development within the urban boundary. The principal permitted uses under this designation are single family dwellings with accessory buildings and home occupations. Residential densities range from two to six dwelling units per acre. The City may grant conditional use permits for churches, second units, guest lodging, parking lots, small public facilities, large care homes as defined by the California Health and Safety Code, and small neighborhood commercial
uses that are compatible with surrounding neighborhoods, such as owner/resident grocery shops. (Page 1-7)
Multi-Family Residential 6-15 (MF 6-15)
This designation provides for moderate to high density residential development within the urban boundary. Residential densities range from a minimum of six to a maximum of 15 dwelling units per acre. The principal permitted uses are duplexes and clustered multipleunit buildings. Other uses permitted in this designation include single family dwellings, accessory buildings, and home occupations. The City may grant conditional use permits for churches, day care (exceeding 14 children), convalescent or assisted care homes, professional offices, guest lodging, parking lots, and small public facilities. (Page 1-7) Multi-Family Residential 15-30 (MF 15-30)
This designation provides for high density residential development within the urban boundary. Residential densities range from a minimum of 15 to a maximum of 30 dwelling units per acre. The principal permitted use under this designation is multiple-unit buildings. Other uses in this designation include two-family dwellings, townhouses (row houses), rooming houses, accessory buildings, and home occupations. The City may grant conditional use permits for churches, day care (exceeding 14 children), dormitories, guest lodging, convalescent or assisted care homes, nonprofit organizations, parking lots, and small public facilities. (Page 1-7)
The General Plan also contains goals, polices, and programs relating to land use and development in Crescent City. The following residential development goal and policy supports the proposed Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) Ordinance:
Goal 1.F. To provide adequate land in a range of residential densities to accommodate the housing needs of all income groups expected to reside in Crescent City, while ensuring a high quality of residential development. (Page 1-17)
Policy 1.F.3. The City shall encourage higher residential densities at locations where convenient access and adequate facilities, including parks and open space, are readily available. (Page 1-17)
Staff believes that the proposed Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) Ordinance, which provides for residential development within the urban boundary, to be consistent with the Crescent City General.
Zoning Code Consistency:
The Crescent City Municipal Code (CCMC) defines the following Residential Districts:
R-1 Zone: Low Density Residential District
The purpose of the R-1 district is to provide living areas within the city where development is limited to low-density concentrations of one-family dwellings and where regulations are designed to: promote and encourage a suitable environment for family life, provide space for community facilities needed to complement urban residential areas, provide for the
safety, health and general welfare of its inhabitants, and implement the general plan of the city. (17.10.010.A)
R-2 Zone: Moderate Density Residential District
The purpose of the R-2 district is to provide living areas within the city where the residential density is of moderately dense concentrations and where regulations are designed to be those of a low density residential district, except as to the concentrations of dwelling units and ancillary compatible uses. (17.14.010.A) R-3 Zone: High Density Residential District
The purpose of the R-3 high density residential district is to provide living areas within the city where development provides for high density concentrations of dwelling units together with specific ancillary and complementary uses. It is intended to implement the applicable provisions of the general plan, as amended from time to time. (17.16.010.A) R-P Zone: Residential-Professional District
The purpose of the RP residential professional district is to provide transition between residential and commercial areas near the downtown core by providing for a mixture of residential and professional office uses. (17.18.010.A) Staff believes that the proposed Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) Ordinance, which promotes living in areas within the city where developments provide for the concentration of dwelling units according to provisions within residential districts, to be consistent with the Crescent City Municipal Code.
Economic Development Consistency:
The city adopted an Economic Development Strategic Action Plan (also known as the Economic Cookbook) on June 21, 2021. This Strategic Action Plan envisions a future with a variety of housing that provides an adequate supply of housing that meets the needs of the community. Part of this strategy includes the development of Accessory Dwelling Units through a program outlined in Recipe 4A:
4A: Accessory Dwelling Unit Program
One of the easiest ways to generate new housing is through the creation of Accessory Dwelling Units, or ADUs, which are colloquially referred to as granny flats, mother-inlaw units, backyard cottages, attic apartments, and other common informal terms. An ADU is defined as a fully independent second residential unit that is accessory to a primary residential structure located on the same lot. As infill development, ADUs are an efficient and “green” use of existing infrastructure with lower costs and quicker permitting processes than multi-family buildings. Because ADUs tend to be relatively small and their amenities modest, they provide more affordable housing options (at less than one-third of the cost of comparable units in multi-family buildings). Oftentimes, these units are the only rental housing available in older, predominantly single-family neighborhoods, making it possible for people from all walks of life to live in the area. Yet, they also significantly improve the value of the property, in essence constituting an asset-building strategy for
homeowners. This recipe provides recommendations for strategies for increasing the number of ADUs in Crescent City. (Page 111)
Staff believes that the proposed Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) Ordinance, which promotes generating new housing through the creation of Accessory Dwelling Units, to be consistent with the Economic Development Strategic Action Plan.
Housing Element Consistency:
The Crescent City Housing Element contains several goals, polices, and implementation actions relating to housing development in Crescent City, including:
Goal A: To support housing development opportunities meeting quantified City objectives
Policy A.2. The City will continue to encourage maximization of residential development potential and limit underutilization of land through project development entitlement review.
Action A.2.1: The City shall encourage multi-family residential development in the upper half of the density ranges prescribed by the General Plan and Zoning Ordinance, subject to development entitlement, environmental, and related applicable City review and approval actions. Per state density bonus law, on a case-by-case basis, the City will work with developers who agree to build projects that have a realistic unit capacity greater than half of the permitted density, provide flexibility in development standards (such as reduced setbacks, reduced parking requirements, and increased height limits), and promote density bonuses to increase densities.
Policy A.6. The City will plan for varying densities that will provide for a variety of housing types in all income levels in the community and will ensure that there is a sufficient supply of multi-family and single- family zoned land to meet the City’s regional housing needs allocation (RHNA).
Action A.6.1: The City will allow for flexibility in density and design standards including encouraging the use of small residential lots through reduced setbacks, increased height limits, and increased lot coverage to help facilitate a variety of housing for lower-income and special needs groups which will include multi-family, single-family, and mixed-use product types.
Goal B: To assist in the development of adequate housing to meet the needs of extremely low-, very low-, low-, and moderate-income households.
Policy B.1. The City shall provide residential development incentives in flexibility of design standards and will continue to provide pre-application assistance to create affordable housing.
Goal C: To pursue conservation and enhancement of existing housing units to provide adequate, safe, and decent housing for all Crescent City residents.
Staff believes that the proposed Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) Ordinance, which promotes to support, assist, and pursue a variety of housing development to increase supply to provide for the housing needs of all income levels, to be consistent with the Crescent City Housing Element.
Environmental Determination:

DRAFT (October 11, 2021)
Crescent City Municipal Code
Chapter 17.49 Accessory Dwelling Units (ADUs) and
Junior Accessory Dwelling Units (JADUs) Ordinance
The city recognizes the importance of a suitable living environment for all residents. The State Legislature has declared that ADU/JADUs are a valuable form of housing in California. In 2019, the California Legislature approved, and the Governor signed, SB 13 (Chapter 653, Statutes of 2019), AB 68 (Chapter 655, Statutes of 2019), and AB 881 (Chapter 659, Statutes of 2019) into law, which amended Government Code sections 65852.2 and 65852.22 to impose new limits on the City’s ability to regulate ADU/JADUs. This Ordinance will impact the following sections of the Crescent City Municipal Code (CCMC) sections: Definitions (17.40), Zone R-1 (17.10), Zone R-2 (17.14), Zone R-3 (17.16), and Zone R-P (17.18).
17.49.010 Purpose and Intent.
The purpose of the accessory dwelling unit (ADU) regulation is to clearly define what is considered an ADU or junior ADU (JADU); to identify locations and standards for ADU/JADUs in residential zones; to identify requirements for ADU/JADUs to provide flexibility in housing options, an opportunity for the development of small rental units, to provide relatively affordable housing for low- and moderate-income individuals and families, to provide economic support for property owners and to provide rental units while protecting the integrity, value and character of residential neighborhoods and public health and safety concerns. ADU/JADUs in compliance with the California Government Code sections 65852.2 and 65852.22; may be permitted, subject to the regulations governing the underlying zoning district, and the requirements set forth in this chapter.1It is the intent of the City to review the ADU/JADU ordinance upon meeting the housing needs identified in the City’s Regional Housing Needs Assessment (RHNA).

SUBJECT: HOUSING ELEMENT UPDATE
______________________________________________________________________
RECOMMENDATION
• Recommendation:
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Provide comments and Council direction to staff
BACKGROUND
The Council; 1) will be provided a brief staff report of progress on the Housing Element to date; 2) can ask questions of staff; 3) should open the agenda item to receive any public comment; 4) direct staff to respond to comments and questions that they or the public raise and; 5) identify any specific direction prior to this draft being submitted to the State. A similar meeting will be held at the Planning Commission meeting on December 8 th
.
The Housing Element is one of seven state-mandated elements of the City’s General Plan. It contains the goals and policies the City of Crescent City intends to implement to address several important housing-related issues, as well as programs to achieve those goals. The Housing Element is updated every eight years; the 6th Cycle Housing Element update planning period is for 2022-2030. The State requires a minimum 30-day public outreach, and the comment period began November 14 and extends until December 16, after which the City has a 10-day minimum response time to revise this draft version and submit to the State Department of Housing and Community Development (HCD). HCD has a 60-day review period to respond with comments and the City is required to respond to those comments before HCD provides a ‘substantial compliance letter to the City. After this, the City would schedule the Housing Element for a public hearing for modification of the City’s General Plan resulting in a CEQA determination and adoption of the 6th Cycle Housing Element.
December 5, 2022 2
ITEM ANALYSIS
PROJECT DESCRIPTION:
The 6
th Cycle Housing Element consists of nine chapters.
• Chapter 1 is an introduction to the process and contents. • Chapter 2 discusses the public outreach program and will be updated to reflect the process and comments received during the 30-day community outreach. • Chapter 3 contains the goals and implementation programs. These are based on meeting State law requirements and actions found necessary to meet the City and State goals. This Chapter should be considered the most important as it commits the City to specific actions with funding commitments.
• Chapter 4 evaluates the effectiveness of the previous Housing Element (5th Cycle).
Most of these were implemented or determined less than sufficient to meet the specified actions. Many were modified and incorporated into Chapter 3. • Chapter 5 discusses the housing data and trends, based on census and other data sources. An analysis of the topics required by State law is provided and is the basis for the programs proposed in
Chapter 3.
• Chapter 6 discusses the adequacy of the City’s vacant parcel inventory in providing the necessary housing allocations (Regional Housing Needs Assessment or RHNA) required by the State.
• Chapter 7 is a new State housing element requirement and describes the City’s ability to ‘Affirmatively Further Fair Housing (AFFH)’. This describes the process and steps to assure that all types of housing needs for all people are being met with the City’s zoning and other regulatory controls. Many of the requirements are currently being met through the City’s Housing Authority.
• Chapter 8 describes the constraints to building more housing within Crescent City and what measures are necessary to either remove the constraints or accommodate the constraint. This describes government constraints such as fees and process times and environmental factors such as wetlands and tsunami runup. Reducing City requirements and fees, speeding up processing times or increasing building heights when wetlands are present on the property all lend to addressing constraints. • Chapter 9 includes a brief discussion of energy conservation programs.
ECONOMIC DEVELOPMENT:
This Housing Element will implement and further goals from the Economic Development Plan. The Economic Development Plan outlines two goals related to housing. Goal 3:
Simplify and streamline regulations to stimulate and ease economic development data and trends, and Goal 4: undertake actions that stimulate the private sector creation of housing and development. Task 11 under Goal 3C articulates the need for an updated Housing Element. Task 9 in Goal 3C is consistent with the City’s intention to update the C-1 zoning district. The Housing Element includes an update recommendation for an ADU ordinance adoption which is identified as a need in Goal 4A. The Housing Element is consistent with the Economic Development Plan. The Housing Element sets the foundation for future residential development which will drive economic development, wealth creation, and job creation.
December 5, 2022 3
FURTHER ACTION:
At this point in the process, the focus of City staff will be on community outreach and comment. While the 30-day comment period is a minimum State requirement, the City will continue its community outreach throughout the process. The City Council should assure that all segments of the City’s population are represented in both the outreach process and in proposed programs meant to provide all types of housing needs in the City. The City Council should also be focused on the adequacy of the proposed programs in Chapter 3 and the City’s willingness to implement these programs. To date, the City has provided many avenues for public participation including an online survey available in English and Spanish, a brochure that was distributed city wide as well as to the Elk Valley Rancheria, Yurok Tribe, and Tolowa Dee-Ni’ Tribes. The brochure provided a QR code to the online survey, announced the planning and commission meetings where public comments can be received, and contact info to send comments regarding the housing element directly to staff. Additionally, the Housing Element was featured and solicited comments on KCRE and KPOD FM public radio. So far, the survey has received five responses and has not received any comments sent directly to staff. Brochures were distributed to the following business’ and more:
• Del Norte County Historical Society
• Del Norte Superior Court Library
• Del Norte County School District
• Del Norte Family Connections
• Del Norte Senior Center
• Crescent City Board of Realtors
• Open Door Health Center
• Crescent City Chamber of Commerce
• Assorted retail businesses
FISCAL ANALYSIS:
Updating and approval of the 6th Cycle Housing Element will facilitate housing development and redevelopment. Activities to update the Housing Element were paid for through SB2 and LEAP funding. Additional funds to implement the 6th Cycle Housing Element are provide with REAP funding. Moreover, some Federal and State grant opportunities require a compliant Housing Element. The programs in Chapter 3 make a future commitment for the City (through 2030) to fund some of these programs.

BACKGROUND
In September 2017, the California Legislature approved Senate Bill 2 (SB 2), known as the Building Homes and Jobs Act (Act), which established a $75 recording fee on real estate documents to increase the supply of affordable housing. The Act establishes the Permanent Local Housing Allocation (PLHA) program administered by the California Department of Housing and Community Development (HCD). The PLHA provides a permanent source of funding to cities and counties to help meet the unmet need for affordable housing and increase the supply of affordable housing units. HCD released its Notice of Funding Availability for these funds on August 17, 2022.
There are two types of assistance under PLHA:
1. Formula grants to entitlement and non-entitlement jurisdictions based on the formula prescribed under federal law for the Community Development Block Grant.
Competitive PLHA Application & Lease Agreement 655 H Street December 5, 2022

Eligible Activities
CPLHA funds are limited to the following activities and must take place within the City limits.
1. Development of new multifamily rental housing that is Affordable to households at or below 60 percent of AMI or substantial rehabilitation of multifamily rental housing that will be Affordable to households at or below 60 percent of AMI, but which is not currently restricted as Affordable housing. In order to be eligible as “substantial rehabilitation”, a project must complete a minimum of $40,000 per unit in hard construction costs; or
2. Assistance to persons who are experiencing or At Risk of homelessness, including, but not limited to, through rapid rehousing, rental assistance, supportive services, and case management services that allow people to obtain and retain housing, operating and capital costs for Navigation Centers, or new construction, rehabilitation, or preservation of permanent or transitional rental housing.
Funding Limits:
The maximum application amount, including administrative costs, for the development of new multifamily rental housing or substantial rehabilitation of a multifamily rental housing project, or development of a Navigation Center, is $5 million. The minimum application amount shall be $500,000. Administrative expenses may be incurred to implement the project or program Activity, up to a maximum of 5 percent of the grant amount.
Applicants are expected to have an adopted Housing Element at the time of award.
However as stated in the NOFA jurisdictions that are undergoing Department review of their housing element at the time of Award, and jurisdictions that are receiving Department technical assistance to bring their housing element into compliance at the time of Award, shall both be deemed to be in a presumptive state of substantial compliance by the Department.

3 ITEM ANALYSIS
Recently the City was contacted by DANCO Communities about applying for the CPLHA funding. The City would submit the application with DANCO listed as a co applicant / sponsor for the development of 27-unit senior housing complex located at 655 H Street.
The brief history of the parcel and previous agreements with DANCO for development are as follows:
In 2011, before the dissolution of the Redevelopment Agency of the City of Crescent City (Redevelopment Agency), the Redevelopment Agency acquired the former El Patio Motel located at 655 H Street (APN 118-170-02). The property was purchased with Redevelopment Agency housing funds with the intent of redeveloping the property with a low-to-moderate income housing complex.
In 2015 the City entered into a Disposition and Development agreement (DDA) with DANCO Communities for the sale of the subject property and development of a 27-unit senior housing complex. To date DANCO has completed the required environmental review and secured entitlements for the development of the proposed project. This agreement was extended twice, with the last extension expiring in 2019. However, though DANCO did attempt multiple times to acquire additional competitive grants or tax credits to fund and complete the project, they have not currently been successful.
The CPLHA funding source provides another opportunity to partner with DANCO on submitting an application for needed additional senior housing. The application would be for the maximum grant allocation amount of $5 Million. The overall projected project construction costs are estimated at over $16 Million. As such additional grant to make the project feasible additional funding in addition to this grant would be required. However as discussed with previous multi family development applications, if this CPLHA funding is secured, then this project becomes much more competitive for State and Federal tax credits.
The proposed project schedule would be as follows if awarded funding:
• CPLHA application due on December 5th, 2022
• CPLHA Award date February 2023
• First Round 9% Tax Credit Applications Due – April 2023 • First Round 9% Tax Credit Awards – July 2023
• Close Construction Financing – Jan 2024
• Construction Completion – Feb 2025
Competitive PLHA Application & Lease Agreement 655 H Street December 5, 2022
4 One of the requirements of the application is for the developer to have site control. To meet these requirements, if approved, the Council would be ratifying a short term 1 year ground lease with a City controlled option for extensions up to 65 years which is maximum the required development life of the funding source. By completing this lease agreement and establishing site control we are eligible to submit for CPLHA funding. A City controlled lease is not the preferred long term option for this site. As such staff will coming back to Council requesting the authorization to receive proposals for the sale / transfer of the property in conjunction with the Surplus Land Act.
FISCAL ANALYSIS
DANCO Communities have completed the majority of the work associated with submitting the CPLHA grant application, other than minimal staff time there are no direct financial costs to the City to apply for these funds. The Ground Lease to establish site control is in the amount $1 dollar per year with the City retaining the right to transfer the property in the future in accordance with the Surplus Land Act. If awarded the project would receive $5 Million of funding to create 27 senior housing units. Of that up 5% can be allocated to cover future administrative costs including City staff time.
STRATEGIC PLAN ASSESSMENT
This action is consistent with the following 2016 Strategic Plan Goals:
• Goal 1: Support quality services, community safety, and health to enhance the quality of life and experience of our residents and visitors. o Target economic development improvements that provide additional benefit by enhancing the quality of life for residents.

BACKGROUND
On November 3, 2020, the voters of the City approved Measure S, authorizing the imposition of a local 1% transactions and use (sales) tax within the City. The Ordinance was formally adopted by the City Council on December 7, 2020. The collection of the tax began on April 1, 2021.
Through a series of public meetings, the Measure S committee recommended, and the City Council adopted a budget detailing how the Measure S funds were to be spent. The proposed project carried out the recommendations based on the adopted budget. As discussed in the Measure S – Streets workshop held on March 9, 2021, this project was based on the “best first” approach, as recommended by industry experts. Under this approach, streets that are in relatively good condition are maintained first, which results in overall savings by preventing the need for extremely expensive repairs later. Streets that are already in poor condition are targeted for grant opportunities, or funded with onetime funds as they become available.
The Measure S Collector Street Maintenance and Preservation Project (the “Project”) extends the useful life of Harding Avenue, 9th Street, and H Street in Crescent City. The work involved milling existing asphalt and inlaying new, crack sealing, pothole repairs, accessibility improvements, and various other maintenance items.

FISCAL ANALYSIS
Filing a notice of completion does not have a direct fiscal impact. The 5% retention payment which was withheld from each progress payment and is currently held in a separate City account, will be released 30 days after the notice of completion is recorded.
This project is funded with Measure S funds. As recommended by the Measure S Oversight Committee and adopted by the City Council, a budget of $250,000 was allocated in FY 21-22 to fund half of this project. The Oversight Committee further recommended the second $250,000 in the FY 22-23 budget. The total funding for the project, all of which comes from Measure S funds, is $500,000.

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: ANDREW LEIGHTON, ENGINEERING PROJECT MANAGER
DATE: DECEMBER 5, 2022
SUBJECT: AMADOR TANK PHASE 2 REHABILITATION, RECOMMENDATION TO
REJECT ALL BIDS, REDUCE SCOPE AND RE-BID
______________________________________________________________________
RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Recommend that Elk Valley Rancheria, California reject all bids for the Amador Phase 2 Rehabilitation Project and direct staff to reduce scope and re-bid.
BACKGROUND
The Amador Tank is a 1.5-million-gallon municipal water storage tank which represents approximately 27% of the City’s total water storage. Multiple studies have been performed on the Amador Tank and all conclude that there is a need to make significant repairs:
Coleman Engineering (2017), Pittsburg Tank & Tower Maintenance Co., Inc. (2013), and CSI Services (2016) and Harper and Associates.
Phase 1 of the Rehabilitation was completed in 2021 in partnership with Elk Valley Rancheria (Tribe). The Tribe obtained a $197,000 grant which covered 81% of the $242,500 costs for Phase I of the Amador Tank Rehabilitation project. The Tribe was the project owner and the City was the beneficiary of the invested funds. At the November 16, 2020 City council meeting, the council authorized the City Manager to sign a revised Memorandum of Agreement (MOA) with the Elk Valley Rancheria, California (Tribe) which outlined the bidding process and the transfer of ownership. The agreement was fully executed on January 25, 2021.
On March 18, 2021 the City signed Task Order 3 with SHN to complete design services for the Amador Tank Phase 2 Rehabilitation. Phase 2 entails removal of all paint and oxidized metals internally and externally for the entire tank, patch repairs, followed by new paint, installation of a new foundation to meet seismic design standards, and a AMADOR TANK PHASE 2 BID REJECTION RECOMMENDATION

2 cathodic protection system to extend the useful life of the tank. The Tribe obtained a second Bureau of Reclamation grant on May 5, 2022 for an additional $200,000 to be committed to Phase 2 of the Amador Tank rehabilitation.
On June 22, 2022, Harper and Associates Engineering, Inc. provided 100% plans and specifications for review. These plans include the following repairs, replacements, and/or installations.
The Tribal Council of the Elk Valley Rancheria authorized bidding the Amador Tank Rehabilitation Phase 2 project on July 29, 2022. The city published the request for bids on August 16, 2022. A pre-bid conference was held on September 8, 2022 with six prospective bidders in attendance. Bid opening was on September 27, 2022 at 2:00pm.
Three responsive bids were received.
ITEM ANALYSIS
Unified Field Services Corporation provided the lowest bid of $1,693,474 with no irregularities, current and active contractor licensing, current and active Department of Industrial Relations standing and no presence on the federal exclusion list. Competing bids from Farr Construction Group at $1,926,578 and Mercer-Fraser at $2,317,100 were also received.
Harper and Associates is the sub-consultant to SHN and will be providing construction management and inspection for coatings, structural modifications, and other specialized inspection work. The cost for this work would be an additional $75,415. City would provide other daily logs and ensure that certified payroll reporting is being performed by the contractor as required by statute.
Due to the funding shortfall detailed in the Fiscal Analysis below, City Staff is requesting the Council to recommend to Elk Valley Racheria, California to reject all bids in favor of a reduced scope bid advertisement to be published at a future date. The next EVR council meeting is planned for December 12, 2022. It is necessary for their decision prior to December 27, 2022 which is the deadline to accept or reject bids.
Consequences of rejecting all bids:
1) The Bureau of Reclamation grant for $200,000 received on May 5, 2022 is not at risk of forfeiture. The BoR has agreed to apply it towards a reduced scope Phase
2. 2) Reduction of scope for phase 2 will require Harper & Associates to rework the bid specifications. Phase 2 will likely include inspection blasting, lateral bracing, rafter straightening and/or replacement, manholes, interior ladders, platforms, fall restraint, vent screens, cathodic protection, miscellaneous caulking, grinding, patching and touch-up paint as required. The goal for the scope of work for this phase is $500,000 including contingency and construction management. 3) Phase 3+ sequencing of bid items including seismic improvements and interior/exterior painting will need to be coordinated to prevent installation conflicts and rework.
AMADOR TANK PHASE 2 BID REJECTION RECOMMENDATION
DECEMBER 5, 2022
3 4) During the discussion with the BoR, a future grant opportunity for $400,000 was offered which could be applied towards phase 3 of the project. Grant application is due December 14, 2022.
FISCAL ANALYSIS
There are no financial consequences regarding the recommendation to reject bids. Below is a financial summary leading towards the recommendation.
Phase 2 of the Amador Tank Rehabilitation project incurred a design cost of approximately $21,911 which was budgeted in FY21/22. Lowest construction bid received was for $1,693,474. Construction costs would be covered partially by an approximately $200,000 grant provided by the Elk Valley Rancheria, California. The City Council budgeted $748,417 from the City Water fund in the FY22/23 budget.
Expenses
SHN TO3 Design, Bidding & Construction Assisstance $ 18,047 Harper & Associates Construction Management $ 75,415
UFSC Bid Items 1-12 $1,002,535
UFSC Bid Items 13-23 $ 690,939
Total Costs $1,711,521
Funding Sources
Bureau of Reclamation Grant $ 200,000
City Water Fund $ 748,417
Total Available funds $ 948,417
Funding Shortfall ($ 761,104)
The total amount currently budgeted for the project is insufficient to fund the construction project. Legal review has determined that a scope reduction of $760,000 by elimination of bid items including some of the base bid items (5, 8, & 11) constitutes sufficient cause to reject all bids.

• Motion to call a special election to be held in [April (by mail) or November (in person)] 2023
BACKGROUND
On November 17, 2022, Council Member Beau Smith resigned from the City Council to pursue an employment position with Crescent City Fire and Rescue. This has created a vacancy on the City Council.
ITEM ANALYSIS
The City Council has two methods to choose from when it comes to filling a vacancy on the City Council. The Council may choose to appoint a qualified City resident to fill the vacancy or it may choose to call a special election.
Appointment: If the City Council chooses to fill the position by appointment, then the person appointed will serve until the November 2024 election. The appointment is to be made within 60 days of the occurrence of the vacancy. Mr. Smith’s resignation was effective November 17, 2022 and, therefore, the Council must make the appointment on or before January 16, 2023. The typical process for filling a vacancy involves advertising and receiving applications for a pre-determined amount of time, Council interviews of

Special Election: If the City Council chooses to fill the vacancy by calling a special election, then the person elected will fill the remainder of the term (through November 2024). The special election must be called within 60 days of the vacancy and cannot take place for 114 days from the date of the call for the special election (114 days from today is March 29, 2023). If the City Council chooses this option, it will then have two choices for when to hold the special election. The special election could be held as a vote by mail only ballot in April 2023 or as a special in-person election in November 2023. In either event, the special election will cost the City thousands of dollars. County Elections Official Alissia Northrup recently estimated that either special election method would cost in excess of $40,000.
FISCAL ANALYSIS
If the City Council chooses to fill the vacancy by appointment, there will be no cost to the City other than staff time. If the City Council chooses to fill the vacancy by special election, then the cost could be upwards of $40,000.

Chapter 2.04 CITY COUNCIL
2.04.016 Elected vacancies.
A. Purpose. The purpose of this section is to provide the city council with several options, if feasible and economically viable, to be decided by a majority vote of the council, to fill an elected vacancy, such as council member.
B. If a vacancy occurs at an elected position, other than by expiration of term, the council shall, at its option, within sixty days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy. The special election may be held on the next regularly established election date, or as set forth in California Elections Code Sections 4004 and 1500 (e.g., mail-in ballot), but at any rate shall not be less than one hundred fourteen days from the call of the special election. A person elected to fill a vacancy holds office for the unexpired term of the former incumbent. A person appointed to fill a vacancy holds office pursuant to one of the following:
1. If the vacancy occurs in the first half of a term of office and at least one hundred thirty days prior to the next general municipal election, the person appointed to fill the vacancy shall hold office until the next general municipal election that is scheduled one hundred thirty or more days after the date the council is notified of the vacancy, and thereafter until the person who is elected at that election to fill the vacancy has been qualified. The person elected to fill the vacancy shall hold office for the unexpired balance of the term of office.
2. If the vacancy occurs in the first half of a term of office, but less than one hundred thirty days prior to the next general municipal election, or if the vacancy occurs in the second half of a term of office, the person appointed to fill the vacancy shall hold office for the unexpired term of the former incumbent.
C. Notwithstanding any other provision of this section, an appointment shall not be made to fill a vacancy on the city council if the appointment would result in a majority of the members serving on the council having been appointed.
The vacancy shall be filled in one of the following ways:
1. The city council may call an election to fill the vacancy to be held pursuant to subsection B of this section.
2. If the city council does not call an election pursuant to subsection B of this section, the vacancy shall be filled at the next regularly established election date. (Ord. 809 § 2, 2019; Ord. 786 § 6.1, 2015; Ord. 708, 2005) View the mobile version.
