10. Public Access onto the Crescent City Jetty
• Recommendation: Receive presentation from the US Army Corps of Engineers • Technical questions from the Council
• Receive public comment
• Further Council discussion
• Council to take further action as necessary and appropriate Chief of Construction Jerry Harper for the San Francisco Division of the Army Corps of Engineers was on the phone to answer questions. Mayor Pro Tem Inscore stated that the concerns by the Council and community members are that better signage regarding the dangers of the jetty be posted as well as limiting access to the jetty. Mr. Harper said that the signage is not individual to Crescent City. The sign issue can be something the Army Corps of Engineers can work with the City on. Mayor Wright stated that we would like to have the jetty closed down since there have been harrowing incidents risking the lives of the people on the jetty as well as for our first responders. Mr. Harper stated that for the fence, they will work with the City, but stated that there will be push back from the recreational fishing industry. Feels that if the two organizations work together a chain link fence is doable. Council Member Schellong asked if it is a Coastal Commission issue in regards to the waterfront and who has liability for the first responders who are putting their lives at risk. Mr. Harper stated that the Federal Government in general would not be liable, but could not elaborate. City Manager Wier asked who would be responsible for enforcement; Mr. Harper stated that local law enforcement would be responsible. City Manager Wier asked what would happen if someone got washed off the jetty. Mr. Harper stated that it is a personal responsibility to protect oneself from danger. He stated trying to keep people off the jetties is a problem across the coast. The locks get cut just as soon as they are put on it. City Manager Wier stated that a chain link fence would replace the original fence to extend out to prevent anyone to get onto the jetty. Mr. Harper stated that a basic plan would need to be discussed for the most effective fence.
Roger Gitlin: stated that since the sign does not say "no entry", people aren't aware they cannot go on the jetty, just that it's dangerous. Suggested a specific type of fencing to use. 4 Page
1/17/23 COUNCIL MINUTES
Tamera Leighton: stated that she sees a lot of activity on the jetty. She stated that the sign that was there was knocked down by a wave, and then further destroyed by an individual. A maintenance plan for the sign needs to be in place so it can be maintained regularly. Agrees with signage that prohibits access to the jetty.
Mayor Wright stated that it appears that the Army Corps of Engineering is willing to work with the City to do what it needs to do to prevent access. Mayor Pro Tem Inscore stated that if we are going to change how the public perceives this part of the community, there is a responsibility to do a public engagement to talk about the issue. Feels it would prevent push back. He would prefer taking action after community engagement. Council Member Greenough stated that increasing signage is effective, however, for enforcement wouldn't an ordinance need to be adopted? City Attorney Rice stated that an agreement with the Army Corps of Engineers and the City stating the City would be enforcing their (the USACE) rules. Council Member Schellong stated there is already an agreement in place according to Mr. Harper that it would be local authorities, agrees with the public engagement, and is not against keeping people off of the jetty. Mayor Pro Tem Inscore asked the Council if we want the USACE to close the jetty; Chief Griffin stated that if the jetty is officially closed, if someone goes onto the jetty, it is trespassing. He said that currently the police have no authority to go out there and remove people because it's not against the law to go on the jetty. He recommended speaking with Search and Rescue first before putting a fence up. Chief Griffin further explained that it is CCPD's policy to not attempt a rescue on the jetty, but they will assist Search and Rescue. Council Member Greenough stated that for the jetty to be closed, there will need to be enforcement. Chief Griffin stated that if it is closed, citations can be issued to the people who violate the closure. CCPD will not go retrieve people off of the jetty, but will contact them when they come off of it. Council Member Altman suggested working with USACE for a fence that Mr. Harper stated would be up by the summer. Asked whose jurisdiction it was and why the City would need to resolve it. Mayor Pro Tem Inscore stated that it's in the City limits, although since it is owned by the USACE, the City can't say close it. Council Member Schellong agreed with meeting with Search and Rescue and public engagement. Council Member Greenough supports public engagement to make sure the public is fully aware of the dangers. Council Member Altman stated that there have been no fishermen have come forward to state that they do not want the jetty closed, therefore the best plan is to have the fence erected by summer to give the people what they want. Council Member Altman asked if the fence was necessary to have a trespassing infraction; Chief Griffin stated that all USACE has to do is call CCPD to say that no one is allowed on the jetty and they can enforce trespassing.
Member Altman asked about the fireworks and how that jetty is being used for the 4'h of July, will they get a pass to use the jetty, or do we enforce all of it. City Manager Wier stated that the USACE requests to use the jetty for fireworks of the City every year. Chief Griffin stated that the fireworks are closely monitored as well. Council Member Schellong stated she has worked with the USACE to plan the fireworks and coordinated with Search and Rescue to provide security of the area. She also stated that fireworks have been set off of a barge. Mayor Wright stated that if using the jetty is a concern, B St Pier could be considered if the trajectory is altered. Council Member Altman asked if the signage needs to be revised first; Council Member Schellong stated that she felt that public engagement should happen before the language is changed. Mayor Pro Tem Inscore stated that first, Search and Rescue should be contacted, USACE should come to Crescent City to see the jetty for themselves, and then have public engagement with them The Council was in unanimous consensus to reach out to Search and Rescue for discussion and then public engagement to include the USACE before signs are modified. Mr. Harper agreed with getting public input before a decision is made.

• Adopt the North Coast Resource Partnership Integrated Regional Water Management Plan, 2020
• Approve the revised scope of work and authorize the City Manager to submit a revised application and any additional required documents for the City's Water Supply Augmentation Project to the Department of Water Resources City Manager Wier stated that this is before the Council again to have a study done for an additional groundwater well at the Ranney Collector. There is a representative from GHD Engineers to present to the Council regarding the full plan. All projects need to be reviewed and selected by the North Coast Resource Partnership, who has given funding of $500k to the City for the project. This is not the full expense of the project of $1.3million which would have drilled a test well to test the aquifer and then to have two wells for the amount of water we need. The revised plan is to do the drilling only for a test well. Ryan Crawford, Project Hydrogeologist of GHD Engineers, went over the well pack details of the project in detail. Mayor Pro Tem Inscore stated that his concern is doing away with all of the three wells to have just a test well. Mr.
Crawford explained the costs of drilling the other wells and that it was more feasible to do the test well only. Rebecca Crow, Engineer with GHD, stated that the well site is more than likely going to have a productive well. Mayor Pro Tem Inscore asked what basis was used to determine that this was going to be a productive well; Mr. Crawford stated that process includes research of the local area and knowledge of the current productive well as well as others in the area. Council Member Greenough asked what the warning signs in the adjacent wells that show we shouldn't use that location; Mr. Crawford stated what he would be looking for is the background information of the well owners as it is key for baseline data. Council Member Schellong asked if the benefit is that once this works, we'll be able to secure more funding. City Manager Wier stated that this will stay within the funding of the grant within this project. Mayor Pro Tem Inscore asked if surrounding neighbors have been contacted for permission for fact finding; City Manager Wier stated that letters have not yet been sent out; Mr. Crawford stated that he has sent letters to the residents before and people are very responsive. He can send the template for the City to put on their letterhead. Mayor Wright asked if prevailing wage laws of California are being followed; Ms. Crow said the prevailing wage costs are incorporated into the construction costs.
There were no comments from the public.
On a motion by Council Member Greenough seconded by Mayor Pro Tem Inscore, and carried unanimously on a 5-0 polled vote, the City Council of the City of Crescent City adopted the North Coast Resource Partnership Integrated Regional Water Management Plan, 2020 and approved the revised scope of work and authorize the City Manager to submit a revised application and any additional required documents for the City's Water Supply Augmentation Project to the Department of Water Resources

City Attorney Rice recommended that Council Member Schellong abstain from voting on this item since she was a member of the MeasureS Oversight Committee to continue the transparency with Measure S. She further stated, however, that Council Member Schellong is free to ask questions. City Manager Wier went into the history of MeasureS being approved by the voters to stay in place. Dennis Dong, Architect with CH&D, gave an overview of what they intend to design for the Police Station Renovation Project which will be using MeasureS funds. He worked very closely with Chief Griffin to ensure the needs of staff were met accurately. City Manager Wier explained that a contract with Engineer Mike Young has been secured to work on the structural piece of the project with SHN assisting in the planning portion. Mayor Pro Tem Inscore asked about this discussion as there is item 13 that is the project. City Manager Wier stated that this item addresses the Measure S fund use of the project. The next piece is to take care of the Amendment and the Task Orders. City Manager Wier went over the report given to the Measure S Oversight Committee at the last meeting. Thermal imaging cameras, radios, and a Utility Skid Mounted Pump has been requested of the fire department. Fire Chief Carey reported to the Council how the equipment works and why they needed them. City Manager Wier explained the funding that isn't available in this cycle but will be next year. Police Chief Griffin stated that the leftover funds from EMPG was no longer available, MeasureS funding was requested. He further stated that he received approval from EMPG for funding next year that will provide radios to CCPD and he will give the older radios to the fire department until they can obtain the funding to get their radios, which is forthcoming from EMPG. Mayor Pro Tem Inscore asked if the firefighters be trained on different radios then what they will finally be purchasing; Chief Carey stated that no, this is a temporary use until they can purchase all of the radios at once. Mayor Pro Tem Inscore asked if they can just go ahead and have their radios now with a match from the District so that hand-me-downs are no longer being given. City Manager Wier stated that the scenario has changed since reported to the Measure S Oversight Committee. The Council will only need to be approving the City's portion of this, which is $40k for all firefighters to receive new radios. Mayor Pro Tem Inscore asked for this item to come back before the Council when funding from the District can be secured. Chief Griffin stated that morale is boosted when new equipment is assigned. Council Member Greenough stated that the sooner the new radios can get to the firefighters the more effective they will be. The Council was in unanimous consensus to bring this item back before the Council on the January 30, 2023 agenda so District funding can be Mayor Wright called a five minute recess at 8:25 p.m.; Mayor Wright reconvened the meeting at 8:29 p.m.
Chief Carey went over the Utility Skid Mounted Pump in detail. Chief Griffin reported on the needs of the police department to include additional facility improvements, forensic cellphone analyzer, non-contact substance analyzer, and a part-time Records Specialist. He stated that at the recommendation of the Measure S Oversight Committee, this will be a City only piece of equipment (cellphone) and not a shared cost with other agencies that will need to use it. Now, it will be used by the other agencies, but the sole property of the CCPD. Mayor Pro Tem Inscore asked about servicing; Chief Griffin stated that both IT Administrator Fritz Ludemann and IT/GIS Technician Taylor Patch will both be certified in the equipment. City Manager Wier stated that since there was a change for funding after the posting of the agenda, a modification of the resolution will need to be made to reflect the correct figure. Chief Griffin explained the need for a part-time position at the PD and how it is already temporarily being filled by a former Records Technician to assist with training. Mayor Pro Tem Inscore asked that since the PD has been under staffed for such a long time, why is Measure S funding being used instead of what's left over from the staffing available funds; Finance Director Leaver explained that although there have been staffing shortages at the PD, there has also been more expenses towards overtime, and that the Measure S Oversight Committee recommended the funds be used for this item. Mayor Pro Tem 7 | Page

inscore stated that he is in tavor of approving all of the requests with the caveat to add the $4k for the non-contact drug analyzer, with the understanding the City will be pursuing additional funding for the radios to be discussed at a future meeting.
