authorities must all for the development of accessory dwelling units (ADUs) and junior accessory dwelling units (JADUs) on all parcels zoned for residential use. It is required to have ministerial approval for ADUs and JADUs if certain conditions are met. It is optional for local authorities to adopt local ordinances that are more liberal than state law and that include only objective standards. City Attorney Rice outlined the different types of ADUs – attached, detached, a conversion, and a junior ADU. She also outlined what is not considered an ADU – motorhomes, travel trailers, park trailers, or a converted bus. The Planning Commission made the following recommendations regarding ADUs for the draft ordinance: the number of ADUs/JADUs are to be limited to one each, single-family, the size of the ADUs will be no larger than 1200 square feet and no more than 50% of the primary dwelling, the height is to be limited to 16 feet, the lot coverage is subject to a minimum of 800 square feet, there is no requirement for owneroccupancy, rental terms will not be regulated, there will be no parking requirements or utility connection fees. City Attorney Rice outlined the application process for the ADUs and the local ordinance options. Mayor Pro Tem Inscore stated that although there will not be connection fees, it should be communicated clearly that the connections for the ADUs be sufficient to meet the needs. City Attorney Rice stated that the Statewide exemption states for ADUs we cannot require a connection fee unless it’s a new single-family dwelling being built. Mayor Wright asked for clarification on the 16’ height limit and if it applied to an ADU over a garage; Mayor Pro Tem Inscore stated it would be non-conforming and would require a permit. City Attorney Rice stated that if it was attached it would be according to the zoning code.
There were no comments from the public.
10. Housing Element Update
• Recommendation: Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Provide comments and Council direction to staff
Bob Brown, City Planning Consultant from SHN presented the Housing Element to the Council.
Mr. Brown explained that the Housing Element is one of seven state-mandated elements of the City’s General Plan and is updated every eight years. He advised the Council that the State requires a 30-day public outreach, and the comment period began November 14 and goes until December 16th. The City will then have a 10-day minimum response time to revise this draft version and submit it to the State Department of Housing and Community Development, who then have a maximum 60-day period to review it. After the review, the City will receive comments from HCD to advise what didn’t meet the requirements. Tonight is to receive public comment on this Housing Element. Mr. Brown went over in detail the chapters within the Housing Element. Mayor Pro Tem Inscore asked in Chapter 5 for population growth on pages 26 and 27 with California Department of Finance tables. He stated that section is very confusing, and his concern is with the estimates from 2021 are dramatically different from what was estimated in 2014. The document states they are anticipating Crescent City to grow, when in actuality they are anticipating a decline. On page 43 with the discussion of the homeless, the list of services based on 2019, it would be good to include Del Norte Mission Possible who were not here in 2019.
Additionally there is a transitional housing program now in place. Under Chapter 8 – Emergency Shelters – listing the Fairgrounds, City Hall, the Police Department and Fire Department was not the appropriate way to address that need. The City has no control over the Fairgrounds as it is State property. The only viable spots for emergency shelters would be the back parking lot of the PD and Fire Department.
There were no comments from the public.

12/5/22 COUNCIL MINUTES
Council Member Altman asked Mayor Pro Tem Inscore in what circumstance would there be a need for emergency shelter; Mayor Pro Tem Inscore stated that it could be used for natural disasters, not just for the unhoused. They are wanting a permanent location for an Emergency Shelter and the only spot where one can be built is on the Fairgrounds. Council Member Altman stated that it was his understanding that there was a natural disaster, there is already an agreement with Pelican Bay State Prison to be utilized. Council Member Greenough spoke about the parcels owned by the City down on Front Street as being an opportunity for an emergency shelter location. Council Member Altman spoke about emergency housing are temporary, there is not ongoing emergencies. If there was an emergency shelter permanently built, it would stay predominantly empty as there would not be a large amount of emergencies. Due to the size of our City, are we going to be providing services that will be more than we can accommodate? Since the County is so much larger, it would be more conducive for them to have a shelter. Council Member Altman further stated that there is already an emergency shelter and would like to know what the State’s guidelines are on having one, as it’s not going to be based on population. Does not feel the City should bear the brunt of sheltering the entirety of Del Norte County. City Attorney Rice Wier stated that the State requires that the City establish certain parcels by zoning that are allowed without conditional use permit to establish emergency shelters which are identified with minimal services designed for homeless persons as transitional housing of less than six months.
It's more of an individual emergency, not a community emergency. She further stated that the City, years ago, identified the public facility zone as where those types of shelters could be established without a conditional use permit. Mayor Wright clarified that if someone were able to build the shelter, it would be at the facilities we have listed and that we need to have a possibility of another area besides those listed. Council Member Altman stated that with the discussions about ADUs and JADUs would be a great idea as well. Mayor Pro Tem Inscore stated that there are more developable parcels the City has. Mr. Brown suggested to the Council that he bring back a memo answering the Council’s questions, if that would be their direction. Council Member Greenough agreed with looking into this further and find something more realistic to our jurisdiction. City Manager Wier stated that the size of the shelter is not specified, it just need to be allowed as a principally permitted use without a conditional use permit. He further stated that the Council could pick a location and allow it by conditional use permit with specific conditions on it similar to cannabis. Mayor Wright stated that direction has been given by the Council to bring something back for further discussion.
Ethan Lawton, of SHN: stated he assisted with the Housing Element Update and wanted to address the discussion of the emergency shelter. The City can add to its public facility zoning and that can control location and inventory. Another option is that the City can direct staff to come up with a second zoning district or having a special overlaying District that would be limited to a certain area.
City Manager Wier reminded the public this Housing Element is available for comment on the City’s website, found on the front page.

The Competitive Permanent Local Housing Allocation (CPLHA) funding will help with the DANCO project of senior housing; and this project meets the criteria for the funds and is ready to go. City Manager Wier showed the Council the proposed development drawing. The one year ground lease agreement in the amount of $1 will give DANCO site control and will allow for a competitive application. They will be applying for $5million, the project is $16million, and should the application be successful, it will make DANCO more competitive for the tax credits they have applied for.
They are hoping to close construction financing by January 2024, and have construction complete in February 2025. The City would then move forward with the Surplus Land Act which would make us compliant with the selling of the property. Chris Dart, with DANCO Communities, stated that this project has been worked on with the City for a long time, the project was tabled, however, they were able to get the land use permits approved by the Planning Commission. There are now more funding opportunities that will help fund this project. The Council was in agreement that there is a big need for housing in Crescent City.

12/5/22 COUNCIL MINUTES
• Further Council discussion
• Recommend that Elk Valley Rancheria, California reject all bids for the Amador Phase 2 Rehabilitation Project and direct staff to reduce scope and re-bid.
City Manager Wier stated that this item has been before the Council on a number of times. Some of the rehabilitation to the Amador Tank have been completed, called Phase 1. The funding received was in the amount of $200,000 however Phase 1 total cost is $242,000. The project went to bid and the estimates that came in where higher than what the engineers anticipated.
Staff knew a substantial amount would have to come out of the Water Fund to pay for the project, however, it wasn’t projected to be at $1.7 million. The Water Fund has other priorities such as the redundant transmission main, the Ranney collector, the meter replacement project. Having capital reserves to fund these projects has to be taken into consideration. Water rates hasn’t been raised in over five years. Staff is asking the Council if they should move forward with the project of $1.7 million with only $200k in grant funds, or find pieces of the project that would more closely fit the $200k. The Bureau of Reclamation funding is offered every year and could be compatible with the project. Staff recommends the Council direct staff to have Elk Valley Rancheria reject all bids and to repackage the project to come back before the Council. Council Member Greenough asked that if by doing pieces of the rehabilitation, will it put the tank at risk for further damage. City Manager Wier stated that the project needs to be done, staff asked Harper & Associates what the immediacy of this rehabilitation. They advised it would be fine to do it a year at a time as long as we stay after it. Mayor Pro Tem Inscore asked what the anticipated cost to go back and repackage the project and who will be doing it; City Manager Wier answered that Harper & Associates who would be doing it and they are presently working on a Task Order that will come before the Council. It should be in the $10k - $15k range. Council Member Greenough asked what the time frame be for repackaging and getting the project out there; City Manager Wier stated it is expected to be February. Council Member Altman asked about the modifications to the foundation and how that would be accomplished; City Manager Wier stated that they would excavate around the tank and enhance the foundation.
There were no comments from the public.

Special Meeting Minutes
January 23, 2023
2 • If appropriate for the transit hub location, direct staff to bring back an Memorandum of Agreement (MOA) between the City / RCT Board for the use of public property
Redwood Coast Transit General Manager Joe Rye reported to the Board and Council that as previously discussed, there were concerns of transient activity at the transit hub proposed location at the library. There will be staff down there all day to answer questions about the service as well as keeping an eye on the location to notify law enforcement if necessary. Green Dot has put together plans for two sites for both locations for consideration. Jeff Schwein, of Green Dot Transportation reported to the Board and Council that he took their advisement from the last meeting and incorporated it into the plans being presented this evening. This project will bring millions of dollars into the community as the current status is not providing the same type of service. Riders and drivers need a place to rest as well as have restrooms to use. Having a staff member kiosk at the transit will support both riders as well as drivers. Engineering and Design has not been done yet, however, these projects are always successful and improve the community. The Library site is a larger site that serves the Library, Wild Rivers Foundation and has electric vehicle charging stations. The entire parking lot will need to be reconstructed to meet the present needs. There will be traffic flow through the northern half of the parking lot as well as preserving parking stalls as well as improving pedestrian safety, traffic will not be allowed in the bus lanes and the charging spots would not be moved. For the Front and H Street location, it’s next to the Surf Apartments and across from the Park. The entire parking lot will be used for the transit hub, unlike the other location. There will be a few parking spaces for staff as well as the required handicapped parking spaces. This is a $2-3million project and Transit Intercity Capital Program is a good source of funding. RCTA is doing a joint application with Humboldt Transit Authority; other funding is the SB1 Rural Connectivity Program, SB39, RAISE program, Build Back Better, IGA, and capital investment grants. Grants will be pursued over the next several months, design and environmental work, and then under construction in Fall or Winter of 2023-
24. Director Starkey asked if the estimated cost was for both sites; Mr. Schwein answered in the affirmative. Council Member Schellong asked how the bringing millions of dollars to the community, how was that determined; Mr. Schwein stated there is no quantifiable data, however public investment has always, in time, brought in more investments. Council Member Schellong asked about the Farmers Market and have discussions been held in regards to being moved elsewhere; City Manager Wier answered that there were a few alternative locations offered to Billie Kaye Tygart, representative for the Farmers Market. Council Member Schellong asked how many buses and how long they will be there; Manager Rye stated 2 buses at a time and they would not be there 24 hours. Council Member Schellong asked about staffing; Manager Rye stated the kiosk would be staffed from 7am- 7pm. Council Member Schellong asked about the maintenance of the restroom; City Manager Wier stated that would be evaluated. Manager Rye stated that having a site selected, which is the requested action tonight, is a benefit to the application for funding. Jeff Schwein stated that the cost estimates will come in within the next three weeks. Director Short asked if 6 months for CEQA and Planning, is that an ambitious timeline being its in the Coastal Zone; Mr. Schwien stated it is ambitious, however the site is already developed. City Manager Wier clarified that these locations are actually outside of the Coastal Zoning. Council Member Schellong asked the Board what feedback they had from the stakeholders regarding the Library; Director Starkey had the same question; City Manager Wier stated that the main concern was loss of parking and safety of the site with transient activity. The manning of the kiosk will definitely help mitigate the safety concerns. Chief Griffin was present at the stakeholders meeting as well to answer any questions. City Manager Wier went over plans to discuss with public for the Beachfront Park Master Plan which included the transit hub being in the library parking lot.

Special Meeting Minutes

3 Director Starkey stated that both locations are good with pros and cons.
The following public comment was received:
Kevin Hartwick: stated that with current rules in public parking lots, enforcement is difficult, so rules can be changed. Having the riders taken care of and a location close to the Cultural Center for tourists will help bring money into the community. Safety is a huge concern for those who have businesses, etc in the area.
Fernando Hernandez, RCT Operations Manager: manpower is there for the transit hub.
Director Roberts concurred with Manager Hernandez; Director Short stated that the Board hears the concerns for safety. Council Member Schellong asked who will own the building; City Manager Wier stated that RCT will own it, the City will maintain it. Council Member Schellong asked if there were any cost projections for the maintenance; City Manager Wier stated that he would review the janitorial services contract and the design itself will need to be reviewed. Council Member Schellong asked about Urban Campgrounds for relocating the transients to that location; Chief Griffin explained how the Urban Campgrounds work. The rules in the parking lot for vehicles is that they can park in public parking places for 72 hours, and after moving 1,000 feet, can come back afterwards for another 72 hours. Director Roberts asked if by putting the transit hub at that location, would it eliminate having people camp in the parking lot; Chief Griffin stated that camping is not allowed within the City limits, only being able to “rest”. Director Roberts stated that she has seen RVs parked in those places; Chief Griffin stated that oversized vehicles are only allowed 8 hours, but after being moved 1,000 feet, they can return for another 8 hours. Council Member Schellong asked if this State law; Chief Griffin answered that it is State Law. Council Member Schellong asked what if you are paying for parking; Chief Griffin stated that with a permit or pass from Redwood Coast Transit it would be allowable. Mayor Pro Tem Inscore asked for clarification on the language in the MOU that says “leasing” and wanted to make sure we were not leasing the property to RCT, only cost recovery for general maintenance; City Manager Wier stated that either would be options. Council Member Schellong asked if there was any future plans for businesses at locations; City Manager Wier stated that the site that has the most benefit for economic development is the H to I Street location because there are buildings with apartments above and business space above. If Crescent City ever have a parking problem, that would be a good thing. Council Member Schellong asked how many parking spaces are planned for Front Street; City Manager Wier stated 15 parking spaces per block. Council Member Schellong stated that parking near the Veterans Monument is very important for people to access the Monument.
Council Member Greenough asked if there was a potential to partner with RCT for the RAISE grant funds, etc; City Manager Wier stated that yes, some of these are transit only, others are transportation. We are currently working with Elk Valley Rancheria for the next round of funding for the RAISE grant. Clean California and the Coastal Conservancy are other potential sources of funding. Mayor Pro Tem Inscore stated that the most pressing need is housing, therefore if you want State funding for housing there is a connectivity for that and having access to transit. He stated that he prefers the Library Parking Lot location as the Cultural Center could be reenvisioned. Mayor Wright asked if there are plans for a charging station for electric buses; Manager Rye stated that the application they are applying for are 6 electric buses as well as a charging station. Chairman Altman stated that the RCTA Board had already chosen a location.
Director Roberts stated her decision was changed after tonight’s meeting; Director Short stated that the Board had chosen the H & I location, but he is now rethinking his choice.

Chairman Perry stated he was impressed that the thermal imaging would find people and finds that the most valuable aspect of the tool. Vice-Chair Reno asked about the increase in price and for clarification, that it would mean getting it all in one shot instead of piece-mealing it. Fire Chief Carey stated that it would not be the $35k, it would be $33k after he did more research. ViceChair Reno asked about the outside drainage and when it would be worked on; City Manager Wier stated that now that we have a new Public Works Director, the project is anticipated to start soon.
Donna Westfall: asked to confirm 12 structure fires for the year; Chief Carey stated he would have to check the numbers, but they respond to much more than 12 a year.
City Manager Wier stated that they only thing that changed was $4k for taxes and personnel costs for the part-time position being eliminated as there were already funds available. Committee Member Tinkler asked why there was no Lieutenant position and the amount for the Detective; Chief Griffin said a Lieutenant was selected, but he moved out of the area. Chief Griffin decided he would rather have more officers on patrol instead of a lieutenant. Committee Member Tinkler asked if the detective position would be filled; Chief Griffin stated not at this time, there are currently two cadets in the Academy. Finance Director Leaver stated that the detective pay is just an additional 5% special pay, that is why it is such a small amount – it is also for a short period of time. Chief Griffin stated that he does not anticipate filling that position this FY. Council Member Greenough asked what the process and requirements for using the cellphone analyzer; Chief Griffin stated that presently CCPD is using other agencies; Council Member Greenough asked if 3 | P a g e

a requirement was to get a warrant; Chief Griffin stated that warrants and consent is what is being used now to access the phones. Council Member Schellong stated she is happy about the approval of the ½ position for CCPD. She had a tour of the Department and noticed great improvements. Chief Griffin stated that CCPD has reached Gold Standard for Lexipol for the last couple of years.
Donna Westfall; asked how many officers would CCPD need to be fully staffed; Chief Griffin stated 15 officers would be fully staffed.
Mayor Pro Tem Inscore asked if there was a targeted plan for the unspent street design funds from FY22 estimated at $55k; City Manager Wier stated that it is a rollover from last budget and was targeted for pavement design for this particular year on the projects we are working on.
Donna Westfall: received complaints about the staff working on potholes On a motion by Vice Chair Reno, seconded by Committee Member Tinkler, and carried on a 3-0 polled vote, the Measure S Oversight Committee approved and adopted Resolution No. MS2023- 01, A RESOLUTION OF THE CRESCENT CITY MEASURE S OVERSIGHT COMMITTEE AMENDING THE COMMITTEE’S RECOMMENDATION FOR FY 22-23 MEASURE S

City Manager Wier explained that there will be a CalOES grant match for radios, so the budget stays at $17,500, however the total expenditures will be double that number, in total $35k with half coming from the CalOES grant.
There were no comments from the public.

• Provide direction to staff regarding street maintenance budget and five-year street maintenance plan
City Manager Wier introduced Lindsi Hammond of GRI to present the street maintenance fiveyear plan. She stated that the best way to do street maintenance is to have the best streets cared for first as it is not as expensive. She gave a detailed presentation on the streets within the City that are slated for repair and the degree in which they are in disrepair. She gave three different scenarios of funding. She showed a map with the streets and what would be needed on those streets; Mayor Pro Tem Inscore stated he was surprised to see the already repaired section of Front Street on the map. Ms. Hammond stated that was a future projection of what will be needed.
Chairman Perry asked what the status of the rock slope protection project on Pebble Beach Drive.
He further stated that there is the need of pedestrian improvements at 9th St and Pebble Beach Drive. Could the improvements of the rock slope protection project could include this area? City 4 | P a g e
1/30/23 COUNCIL/MEASURE S MINUTES
Manager Wier stated that it would only go halfway. The grant funding has been obtained, however there are specific requirements for the funding. This is advance construction, meaning the City would have to fund it first and then be reimbursed. Chairman Perry stated that having some set aside funding for some unknowns that could occur. Del Norte Local Transportation Commission Executive Director Tamera Leighton applauded the street maintenance plan Ms. Hammond had recommended and supported Chairman Perry’s opinion to have set aside money for matching funds. She stated that the Pebble Beach project is so large that Measure S funds cannot be used for it; the challenges of that project are very expensive. Committee Member Tinkler asked if there is any chance after the recent storms, we could get some of the available emergency funding recently announced; City Manager Wier stated that funding is not available for this project as this project started before the storms that triggered the emergency funding. The City has been in discussions regarding the storm damage to see if there is any funding that could be allocated.
Committee Member Tinkler stated that educating the public on what streets will be worked on is an important piece for people to understand how Measure S is being used to fund those projects.
Public Works Director Yeager stated that it is the plan to have a Master Plan to present to the Council annually. Chairman Perry is in favor of the pavement management plan. Vice-Chair Reno asked what the life expectancy of crack sealing; City Manager Wier stated that an overlay would last 10-15 years; full reconstruction would last 20 years. Mayor Pro Tem Inscore asked how many blocks in red are there; Ms. Hammond stated there are 180 blocks. Mayor Pro Tem Inscore stated that if we spent $600k annually for the next 60 years, all of these streets will be done Council Member Schellong asked about potholes and how when they are fixed and they subsequently sink; City Manager Wier stated that there are many ways to fix a pothole; Public Works Maintenance Manager Wylie explained the different ways to patch potholes. If it is raining, it washes away and is impossible to completely repair. Council Member Schellong asked for an update on the timing of Front Street; Director Yeager stated that by February 6th the Council will see plans for putting it out to bid. The plan is to have the project started May 1st; G – I and Play Street. Council Member Schellong asked if the whole $50k has been spent yet; City Manager Wier stated that all of that funding is still available for striping. Council Member Schellong asked about street signs and if there was a plan to have the missing ones replaced; Manager Wylie is working with the company making the signs and they should be coming in soon. He further stated that not only weather is an issue for the street signs missing, but it is also caused by vandalism.
Council Member Schellong asked about streetlights; Manager Wylie explained that when one light goes out, it can effect several down the chain as they are linked.
Russell South: asked if the City has applied for Rural Surface Transportation grant.
Donna Westfall: spoke about living in Beverly Hills and Ojai; how were the 135 miles of roads diagnosed; stated that the majority of the people who live in the City limits do not live on Pebble Beach Drive. City Manager Wier stated that for this particular presentation, they actually walked all of the roads and visually surveyed it. Ms. Hammond stated this is an international standard and is a repeatable method.
City Manager Wier addressed the Council and the Committee the grants that have been applied for for these projects. Some of them are very competitive. Local road grants are very difficult to obtain grant funding since they aren’t used as much. Mayor Pro Tem Inscore stated that the grant Mr. South spoke of is specifically targeted with mobility and public transportation. Like the INFRA grant it has a target for economically disadvantaged communities. It is also a four-year funding cycle. City Manager Wier stated he is looking for direction on where to put the funds for the upcoming budget. The current Measure S budget is $2million; the actuals are $2.248 million. The projection for Measure S funding for 2023 is $2.3 million. Mayor Pro Tem Inscore stated the best way to do this is to have money targeted to our streets. The money should be allocated for the first three years. Stated the higher allocation is his preference to take care of the worst streets.
Council Member Schellong said if $600k is allocated for the next three years, when will the projects happen; City Manager Wier stated there would be a project planned every year.
Chairman Perry stated that Measure S funds cover not only streets, but police, fire, and the pool. 5 | P a g e
1/30/23 COUNCIL/MEASURE S MINUTES
That should be taken into consideration when determining where this money is allocated to. Also encouraged seeking funding as well. Finance Director Leaver stated that staff would like direction from the Committee and Council on where they want the focus to be budget wise. Mayor Pro Tem Inscore stated he wants the $600k to streets. Vice- Chair Reno agreed with Chairman Perry that the police, fire, and pool’s needs should be considered before putting everything towards streets.
If we fund streets, it should be reviewed annually so it is fair to the other departments’ needs.
Mayor Pro Tem Inscore stated that he proposes $600k towards streets this year. Vice-Chair Reno asked what streets that are marked red that would reach the $600k amount, would like to see a list of priority red streets. Director Yeager stated that staff can give three options to present to the Council on what streets are priority. Council Member Schellong said that budgeting for the $600k makes sense to her and that it won’t take from the other departments as it’s a budget.
The Council and Measure S Oversight Committee were in unanimous consensus to budget $600k for streets.
ADJOURNMENT
There being no further business to come before the Council and Measure S Oversight Committee, Mayor Wright adjourned the meeting at 8:11 p.m. to the regular meeting of the City Council of the City of Crescent City scheduled for Monday, February 6, 2023 at 6:00 p.m. in the Board Chambers of the Flynn Center, 981 H Street, Crescent City, CA 95531.

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: LINDA LEAVER, FINANCE DIRECTOR
DATE: FEBRUARY 21, 2023
SUBJECT: BUDGET-TO-ACTUAL FINANCIAL REPORTS FOR JANUARY 2023 ______________________________________________________________________
RECOMMENDATION
• Receive and file monthly budget-to-actual financial reports of the City’s major operating funds for the month of January 2023
BACKGROUND
In order to provide timely information to the City Council and to the public, the City’s Finance Department has prepared the attached monthly budget-to-actual reports. These reports provide a summary as of January 31, 2023 of the fiscal year-to-date revenues and expenses of the City’s major operating funds: General Fund, Housing Authority Fund, Lighthouse Cove RV Park Fund, Sewer Fund and Water Fund.
ITEM ANALYSIS
As of January 31, 2023, we are 58% of the way through the fiscal year, with 42% of the year remaining. If revenues were received and expenditures made evenly throughout the year, there would be 42% of each budget line remaining. However, revenues and expenditures are not even throughout the year for many reasons. Many revenues are not received evenly throughout the year (particularly tax revenues and grant reimbursements), most expenses are not recorded until the invoice is received in the following month, and budgets may include large projects that have not yet been completed. In addition, as part of the fiscal year-end process, many revenues and expenses received in July and August are accrued back to the prior year for proper accounting.
This report summarizes the actual revenues and expenditures for the year to date; additional information is provided in the budget-to-actual reports attached. • General Fund
BUDGET TO ACTUAL REPORT – JANUARY 2023
FEBRUARY 21, 2023
2 General Fund revenues show that 52% of the budgeted amount is yet to be received. This is dependent on the timing of when certain revenues are received.
For example, most taxes, third party billings, and grant reimbursements are recorded quarterly. In addition, many revenues received in July and August were accrued back to Fiscal Year 2021-22. General Fund actual expenditures show that 52% of the budgeted amount is yet to be expended. The expenditures include transfers made to capital funds for construction or purchase of capital assets, which may not be complete.
• Housing Authority Fund
The Housing Authority is funded by monthly disbursements from the federal government. At this point, actual revenues show 49% remaining to be and actual expenditures have remaining amounts of 51%.
• Lighthouse Cove RV Park Fund
Revenues collected by the Lighthouse Cove Recreational Vehicle Park (RV Park) show 40% remaining to be collected. RV Park revenues are highly seasonal, and most rental revenues are typically received in the summer months. Actual expenses in the RV Park show 59% of the budget left to be expended. • Sewer Fund
The Sewer Fund earns revenue primarily from charges to the users of its services.
Actual revenues show 44% of the total revenue budget remaining to be collected.
Operational expenses (not including debt service or capital improvements) show 54% of the budget remaining to be expended.
• Water Fund
The Water Fund earns revenue primarily from charges for service. Actual revenues show 41% of the budget remaining to be collected and 51% of budgeted operational expenses (not including debt service or capital improvements) remaining to be expended.
• Summary
The following table summarizes the actual revenues and expenses for the City’s five major operating funds, not including encumbrances:

On November 3, 2020, the voters of the City of Crescent City approved a 1.0% local transactions and use (“sales”) tax and the City Council has formally adopted the Ordinance. Imposition of the sales tax began April 1, 2021. Ordinance No. 824 provides for the appointment of an oversight committee made up of two non-voting staff members and five voting City resident members. The Ordinance charges the oversight committee with reviewing and publicly reporting on the expenditure of revenues generated by the tax. In addition, the Bylaws for the Committee task it with also advising on the expenditure of anticipated revenues as part of the annual budget process. Committee Members serve two-year terms.
ITEM ANALYSIS
In December 2022, three committee member positions were up for re-appointment. The Mayor has the duty to appoint members to the Committee, subject to the confirmation of the City Council. Committee members must be residents of the City and at least 18 years of age. The City appointed one new member in January 2023 and the other two positions are currently vacant. Since January, the City has received one application from city resident Steve Shamblin.
Mr. Shamblin’s application was reviewed by the Mayor, who appointed the applicant to serve on the Committee and is presented to the Council at tonight’s meeting for confirmation. If Mr. Shamblin’s appointment is confirmed, there will remain one additional vacancy on the committee. The City is still accepting applications for that vacancy until it is filled.

RECOMMENDATION
• Approve and adopt Resolution No. 2023-12, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2022-23 BUDGET OF THE CITY OF CRESCENT CITY
BACKGROUND
The Infrastructure Investment and Jobs Act (Pub. L. 117-58, November 15, 2021, “Bipartisan Infrastructure Law,” or “BIL”) authorized and appropriated $1.5 billion to be awarded by the Department of Transportation (“DOT”) for FY2023 for Local and Regional Project Assistance Programs under National Infrastructure Investments. On December 29, 2022, this amount was increased to $2.275 billion. The DOT is currently soliciting applications for projects to be funded under the Local and Regional Project Assistance Program, by way of the Rebuilding American Infrastructure with Sustainability and Equity (RAISE) grant program, which will include any additional funding appropriated for the RAISE grants program under the FY2023 Appropriations Act.
The RAISE grant program provides an opportunity for the DOT to invest in surface transportation infrastructure projects that will have a significant local or regional impact.
RAISE grants will be competitive and awards will range from $1,000,000 to $45,000,000.
Eligible applicants for RAISE grants are: States and the District of Columbia; any territory or possession of the United States; a unit of local government; a public agency or publicly chartered authority established by one or more States; a special purpose district or public authority with a transportation function, including a port authority; a federally recognized Indian Tribe or a consortium of such Indian Tribes; a transit agency; and a multi-State or multijurisdictional group of entities that are separately eligible. Eligible primary project Budget Adjustment 2023 RAISE Grant Application
February 21, 2023
2 types for the RAISE grant include road, transit, rail, maritime, aviation, and bicyclepedestrian.
City staff received approval from Council on February 6th, 2023 to submit an application for this funding to support the Front Street Complete Street and Cultural Inclusion Project in partnership with Elk Valley Rancheria as a joint application for approximately $13,000,000.
ITEM ANALYSIS
An associated cost of this application is the required Benefit Cost Analysis, which could cost up to $7,500. Last year, the City split the cost with Elk Valley Rancheria. This year, Elk Valley Rancheria has agreed to contribute $5,000 and the City would contribute the remaining balance. The City will be paying for the upfront cost of the Benefit Cost Analysis and has adequate budget for $2,500 in the existing contracts account for Economic Development projects to cover this cost, however a budget adjustment is needed to cover the remaining $5,000 until reimbursed by Elk Valley Rancheria.
FISCAL ANALYSIS
There is a budget of $2,500 currently in the Economic Development line item to cover the City’s portion of the Benefit Cost Analysis. The $5,000 budget increase will cover the remaining cost of the Benefit Cost Analysis that will be reimbursed to the City by Elk Valley Rancheria. Approval of the attached resolution will amend the budget to reflect the expense and matching revenue and will have no net impact on the General Fund.
STRATEGIC PLAN ASSESSMENT
This action supports the following Strategic Plan goals:
• Goal 1(E): Target economic development improvements that provide additional benefit by enhancing the quality of life for residents
• Goal 2(F)(1): Streamline services that support new, existing, and prospective businesses
• Goal 2(F)(9): Expand on the success of grant funding by maximizing utilization of opportunities with corresponding community needs

RECOMMENDATION
• Approve and authorize the City Manager to sign a letter of support for the South Beach Climate Resilience Plan grant application by the Del Norte Local Transportation Commission, Elk Valley Rancheria and the Crescent City Harbor District
BACKGROUND
The Adaptation Planning Grant Program through the Governor’s Office of Planning and Research provides funding to help fill local, regional, and tribal planning needs, provides communities the resources to identify climate resilience priorities, and supports the development of climate-resilient infrastructure projects across the State of California.
ITEM ANALYSIS
Tamera Leighton, Executive Director of the Del Norte Local Transportation Commission, has requested that the City Council consider sending a letter of support for the South Beach Climate Resilience Plan grant application by the Del Norte Local Transportation Commission (DNLTC) along with their partners, Elk Valley Rancheria and the Crescent City Harbor District.
According to Ms. Leighton’s report to the Del Norte Local Transportation Commission on February 7th,
The winter storm on January 5 resulted in a closure of US 101 at South Beach in the greater Crescent City area in Del Norte County. The tide was only 7.5

2 according to NOAA. There will be 53 days in 2023 with higher tides than this, and 24 of these days are over 8 feet, with 2 days of 8.7 feet. The stronger, more intense storms resulting from climate change are increasing the threat to US 101, our lifeline highway, and our only north/south route through the County.
The risks to US 101 in the South Beach area from more intense storms and sea level rise pose a significant risk to the safety and commerce in the Del Norte region.
When US 101 is closed, all the traffic is diverted to local roads, primarily Elk Valley Road, which already has significant safety concerns with local traffic. For anyone traveling north or east of Crescent City, Google Maps and similar wayfinding software direct traffic to Elk Valley Road, which is narrow and hilly, with blind curves.
The South Beach Climate Resilience Plan is critical to both the local and traveling public. It’s our only north/south route and our lifeline highway.
The grant is being submitted in partnership with the Elk Valley Rancheria and the Crescent City Harbor District to fund the hiring of a consultant to prepare a South Beach Climate Resilience Plan.
FISCAL ANALYSIS
Authorizing one or more letters of support as requested has no direct fiscal impact.
STRATEGIC PLAN ASSESSMENT
The Council’s consideration of this action is consistent with Strategic Plan Goal 1: Support Quality Services, Community Safety, and Health to Enhance the Quality of Life and Experience of Our Residents and Visitors.

RE: South Beach Climate Resilience Plan Support
Dear Ms. Leighton,
I am writing this letter to support the South Beach Climate Resilience Plan grant application by the Del Norte Local Transportation Commission and its partners, the Elk Valley Rancheria and Crescent City Harbor District. The increasing frequency of the closures of Anchor Way and US 101 due to the Pacific Ocean washing over the roadways must finally be solved, and the South Beach Climate Resilience Plan is the first important step. US 101 is the Pacific Northwest lifeline highway, and its closure causes not only local problems but multi-state problems for the traveling public. It is important that a climate adaptation plan be developed for the transportation infrastructure to support the health and economy necessary for a vibrant community.
The winter storm on January 5 resulted in a closure of Anchor Way and US 101 at South Beach in the greater Crescent City area in Del Norte County, as seawater and debris washed across and onto the roadway. This event was not a record-setting storm surge or “King Tide”. Per the NOAA Tide Station in Crescent City, that day the tide was only 7.5 feet. NOAA predicts there will be 53 days in 2023 with higher tides; 24 days are over 8 feet, with 2 days of 8.7 feet. The stronger, more intense storms and sea level rise resulting from climate change are increasing the threat to US 101, our lifeline highway and our only north/south route through the County.
When US 101 is closed, all the traffic is diverted to a local road route, primarily Elk Valley Road, which already has significant safety concerns. This local route goes through residential areas and places an unmanageable burden on the community.
Anchor Way is the only access to the Harbor’s public boat launching facility which provides for the commercial, private, and tourist use of the harbor and ocean. The
launch facility is also a critical asset during times of emergencies. The closures of US 101 and Anchor Way pose a significant impact to the commerce in the Del Norte region.
The South Beach Climate Resilience Plan is the needed critical step to help this community adapt to climate change. US 101 is our only north/south route and our lifeline highway. The problems of flooding in the South Beach area need to be solved.
The Del Norte Local Transportation Commission, in partnership with Elk Valley Rancheria and Crescent City Harbor District, is a strong team of capable professionals.
Sincerely,
Eric Wier, City Manager

______________________________________________________________________
RECOMMENDATION
• Hear staff report
• Technical questions from Council
• Receive public comment
• Further Council discussion
• Authorize staff to advertise for bids for Front Street Improvements from G to I Street including an additive for I Street to Play Street
BACKGROUND
Phase 1 of Front Street improvements (from B to G streets, along with some other local streets), was funded by a Community Development Block Grant (CDBG) and was substantially complete on January 26, 2021.
The City then contracted with Stover Engineering on December 27, 2021 to repackage the existing drawings and specifications for Front Street from G to L Streets. Staff proposed the use of Measure S funds, General funds, and ARPA funds at the April 27, 2022 Measure S Oversight Committee to complete additional Front Street improvements.
The Measure S committee met again on May 11, 2022 and adopted a resolution recommending partial funding for two additional blocks of Front Street improvements from G to I Street.
Stover Engineering was directed to repackage the Front Street improvement drawings and specifications for Front Street from G to I Street as a standalone project with an additional bid item to continue from I to Play Street when funding becomes available.
Stover has substantially completed the design repackaging from G to Play Street.
FRONT STREET IMPROVEMENTS
FEBRUARY 21, 2023
2 Staff published an invitation to bid for materials only for Front Street G to I Street improvements on April 27, 2022. The purpose of separately bidding the materials was to maximize the probability of obtaining longer lead items and materials with the desire to move directly into construction in Fiscal Year 2023. As of February 3, 2023, Tidewater has delivered all ordered parts which are presently stored in the stockpile yard between Front and 2nd Street. Campton Electric was awarded the streetlight purchase.
ITEM ANALYSIS
Front Street improvements include storm drain, new water lines, streetlights, sidewalk, ADA ramps and driveway replacements along Front Street with infrastructure connections at G, H/Stamps, I, and Play Street intersections. Surface improvements will include the “road diet” of lane reduction from 4 to 2 lanes. The H Street/Stamps Way intersection will introduce a chicane with turning lanes that will become the main entrance to the future Beachfront Park. This chicane will have the added benefit of reducing vehicle speeds as they approach the park entrance. Additional parking will be included with the alternate bid item from I Street to Play Street similar to the parking which presently exists between D and G Streets.
Traffic control during construction will be diverted as far as Third Street as necessary while G to I intersections are closed. Should funding be available, the additive bid item from I to Play will be performed as a second phase once the intersection at H Street/Stamps Way is no longer restricted. The pool and Kid’s Town will always be accessible.
Staff is seeking authorization to put out the Front Street plans and specifications for bid for the Base Bid, which includes work from G to I Street. There will also be an Alternate Bid which will include additional work from I Street to past the Play Street intersection.

3 amount of $516,233, ARPA funding in the amount of $516,233, and City General Fund in the amount of $767,534 for the proposed project. In addition, the Del Norte Local Transportation Commission has allocated $515,063 in CRRSSA funding and $400,000 in RSTP funding. Congressman Huffman also included $750,000 in legislation for Community Project Funding, which has been approved by the Congress. Staff is still working with Cal Trans and DNLTC for the actual award of CRSSSA funding which is expected to be officially allocated by the end of March.
In addition to the street rehabilitation work, this project also Includes the replacement of existing cast iron water mains within the construction area. These mains are estimated to be over 60 years old are recommended to be replaced with new C900 PVC mains during the reconstruction of the road. The current FY22/23 Water Fund budget included $150,000 for this expense. With the escalation of costs over the past year and well as the additional scope of work to include I Street to Play Street, staff is now estimating the total water main replacement expense to be $350,000. This results in an estimated additional $200,000 that will be needed from the water fund to pay for this replacement. If authorized to bid, staff will return to the Council for additional funding authorization once actual construction bids are received.
Money spent to date for pre-purchased water, storm drain, and streetlights is $420,671.00.

FRONT STREET IMPROVEMENTS
FEBRUARY 21, 2023
4 Our current projection of estimated costs compared with current available funding shows there is funding to complete the entire project as estimated by City staff. This cost estimate was derived from performing yearly escalation to the averaged unit costs from the 2020 Front Street project involving similar work.
The current cost of material and services is extremely volatile. Recent analysis of bid results shows contractor’s bids regularly exceeding owner budgeted amounts. With confidence we can promise to complete G to I Street. We also have a contingency plan to minimally reduce the bid alternate to substantially complete the work from I Street to Play Street if the bids exceed the available funding.

BACKGROUND
In December 2021, the City was awarded $5 million in Statewide Park funding under Prop
68. That funding will be used to complete the following features in Beachfront Park: (1) Park Entry at Stamps Way; (2) Bike Park - Pump Track; (3) Tolowa Cultural Interpretive Area with Indigenous Plantings; (4) One Mile Class 1 Trail/Exercise Loop; and (5) New ADA Playground.
The City was also granted $177,952 in Prop 68 Per Capita funding, which the Council approved to fund the Paths of Culture project on the west side of the park adjacent to the pool and Tolowa Cultural Interpretive Area.
Earlier this year, the City conducted a very robust competitive procurement process to select a team of design professionals to create the final design of the above-described elements of Beachfront park and to oversee their construction. The City received three

The GreenWorks team was able to communicate an understanding of both the importance of this project to this community and the City’s vision of creating a shared space inclusive of a multitude of uses that can be enjoyed by everyone that lives and visits here; uses such as recreational opportunities, historical and cultural education and experiences, live entertainment, venues for large and small celebrations or gatherings, etc.
Upon the unanimous recommendation of the city selection panel, the City Council approved an agreement with GreenWorks, PC on June 20, 2022.
ITEM ANALYSIS
The City recently applied for and was awarded $200,000 in grant funding from the Coastal Conservancy for the Tolowa Coastal Stories project to expand on the Tolowa Cultural Interpretive Area and Indigenous Plantings as part of the design for Beachfront Park.
Through the redevelopment of Beachfront Park, the City is taking this opportunity to promote awareness and healing by engaging with local Tribal representatives in the design, signage and story development in several aspects of site design. As part of this process, City staff invited representatives from Tolowa Dee-ni’ Nation, Elk Valley Rancheria, the Del Norte Historical Society, and Tolowa Nation to serve as a Tolowa Cultural Committee to advise the City on the historical and cultural aspects of the project.
The committee steered the content for the Coastal Stories grant application and have been actively working with SeaReach, the Interpretive Design firm sub-contracted with GreenWorks, to design the Tolowa interpretive elements of Beachfront Park.
The City sees the inclusion of Tolowa stories in the park design as a crucial and meaningful aspect of healing historical trauma and maltreatment of the Tolowa people, who have lived on and stewarded the land where Crescent City was built since time immemorial. In an effort to ensure adequate time is given to achieve the goals of these projects, the City applied for and has been awarded additional grant funding through The California Endowment for $35,000. This will allow the GreenWorks and SeaReach teams to increase their engagement with the Tolowa Cultural Committee to ensure their history and stories are told in the most meaningful way possible.
FISCAL ANALYSIS
The contract amount is not-to-exceed $33,290. As this is not a budgeted expense for FY 22-23, a budget amendment is also required. The budget request is for $35,000 which would allow for the contract amendment with GreenWorks plus a small contingency.

Re: Crescent City Planning & Design Additions
Dear Paul,
Sea Reach is delighted for the opportunity to expand our scope of services for Crescent City to include the following elements.
Project Additions:
• Increase time allotted for site visits, in person meetings and engagement with the Tolowa • Additional rounds of review for exhibit text
• Further development of conceptual design to include sketch-up renderings • Add budget for custom illustrations
Site visits & in person meetings
The original proposal only included a site visit at the beginning of the project. We recommend and estimate an additional five (5) on site planning meetings to develop the interpretive content in coordination with the Tolowa.
• Deliverable: Sea Reach travel to Crescent City and conduct planning meetings (estimate five) Additional reviews for exhibit text
All of Sea Reach’s interpretive exhibits are driven by the content. The additional rounds of review and revision for exhibit text will ensure the exhibits are as concise and impactful as they should be for such an important story. The original proposal only included one full draft of exhibit text. • Deliverable: Sea Reach will add two rounds of review and revision to the exhibit text (drafts two and three)
Sketch-up renderings & drawing review
We anticipate the exhibits developed for this project will be unique and custom designed for the space.
Since these are not “off the shelf” items, Sea Reach recommends adding an additional round of review and revision to tweak the design if necessary as well as 3D renderings of the exhibits placed throughout the site to aid in visualization of the concepts.
• Deliverable: 3D renderings of exhibit structures in situ • Deliverable: Sea Reach will add an additional round of review and revision to the exhibit base shop drawings
Proposed scope of work 1 of 2
Sea Reach Ltd September 13, 2022
Custom illustrations
The original proposal did not include budget for the development of custom artwork. Sea Reach has wonderful illustrators on staff, but we could also work with someone in the local community depending on what is determined during the planning phase. The addition of custom illustrations will greatly enhance the exhibits and their timelessness.
• Deliverable: custom illustrations to include the following steps - 1) pencil sketches for concept, 2) color study, and 3) final illustrations (production-ready) Please do not hesitate to call with questions.
Sincerely,
Susan Jurasz, President

Activities Outcomes and Indicators Timeline
The City will host a series of meetings with the Beachfront Park design team and the Tolowa Cultural Committee to facilitate the story development and project preparation of the Tolowa Interpretive Walk in the Beachfront Park. 1. Story Development: A total of ten unique Tolowa stories will be fully developed with outlines, scripts, casting, and art direction.
2. Design Development: A videographer and photographer will be hired to shoot, edit, and produce all ten videos. A web developer will be hired to design the website that will house the videos, as well as the scavenger hunt which will be provided as an option to visitors. A graphic designer will be hired to design the tribal pins that will be used as the scavenger hunt prizes. While the kiosk design and construction will be covered by another funding source, they will be directly informed by the stories being told in that space.

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: RICHARD GRIFFIN, CHIEF OF POLICE
DATE: FEBRUARY 21, 2023
SUBJECT: CCPD GRANT APPLICATION 2023 – ABC ALCOHOL POLICING
PARTNERSHIP PROGRAM
______________________________________________________________________
RECOMMENDATION
• Hear staff report
• Technical questions from Council
• Receive public comment
• Further Council discussion
• Authorize staff to submit a grant application for ABC Alcohol Policing Partnership Program in the amount of no more than $30,000
BACKGROUND
The California Department of Alcoholic Beverage Control is offering grant funding for up to $100,000 per agency, effective July 1, 2023. The grant proposal deadline is April 3, 2023. The Crescent City Police Department successfully applied for the Alcohol Policing Partnership (APP) Grant in 2020 and 2021 and was awarded over $20,000 in funds each year. These funds were utilized for minor decoy/shoulder tap operations, impact inspections, and general enforcement patrols. Some of the funds were also utilized to buy a new computer and other equipment for the grant program operations. CCPD applied for the same funding in 2022 but did not receive a grant award for that year.
ANALYSIS
This grant opportunity provides for up to $100,000 of funding per agency, which is eligible to pay for wages (straight time and overtime), benefits, up to $2,500 of equipment, and training costs for a required APP Conference that takes place in July 2023. Funds from this program would again be used for minor decoy/shoulder tap operations, impact inspections, and general enforcement patrols.
City Council Agenda Report
ABC GRANT APPLICATION
February 21, 2023
2 CCPD is looking to apply for the 2023-24 grant cycle in the amount of no more than $30,000. The grant deadline is April 3rd and if directed staff will submit the needed grant application by the deadline.
For the specified operations the proposal will be to have two extra officers on duty for an 8-hour overtime shift each. This would be planned for a total of 16 operations during the grant cycle. This would result in 256 total overtime hours and benefits. Also, a mandatory portion of the grant is attendance at the APP Conference in July of 2023. The grant will cover all associated costs for travel and attendance to this conference. CCPD is also looking to purchase four new Alco-Sensor FST (Breath Alcohol Testing) machines, along with a dry gas cylinder for testing and maintenance. Two binoculars would also be purchased to help with surveillance during operations.
FINANCIAL IMPACT
If approved for the proposed ABC funding, there would be up to $30,000 in grant revenue added to the CCPD budget along with matching expenses. Up to $2,500 of this money can be used for equipment and the rest would go towards overtime, regular time pay, benefits, and training for the operations to be completed.
STRATEGIC PLAN ANALYSIS
Attempting to acquire grant funding through these sources meets the goals and objectives of Goal 1 “Support quality services and community safety to enhance the lives of our citizens and visitors”, Subsection C. “Empower and utilize Police, Fire, and Public Works departments to make Crescent City one of the safest cities in the United States” Attachments
