• Authorize the Mayor to sign a letter in opposition to the AB 399 – Water Ratepayers Protections Act of 2023
City Manager Wier stated that the County Water Authority Act (CWAA) of 1943 includes provisions on how a public water agency that is a member of a county water authority may choose to detach itself from the county water authority. Under the CWAA, the agency wishing to detach must hold a regular or special election, and the majority of its voters must approve the detachment. This process is generally consistent with LAFCo rules and processes. AB 399 proposes to change this rule and require not only the approval of the voters of the agency wishing to detach, but also the majority approval of the voters of the county agency the local agency wishes to leave. CalLAFCO voted to oppose this bill. Mayor Pro Tem Inscore stated that this stems from a conflict in San Diego County. This is about local control and it would be taken away.

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: LINDA LEAVER, FINANCE DIRECTOR
DATE: AUGUST 21, 2023
SUBJECT: QUARTERLY CASH AND INVESTMENTS REPORT AS OF JUNE 30, 2023
______________________________________________________________________

RECOMMENDATION
• Receive and file quarterly cash and investments report as of June 30, 2023

BACKGROUND
California Government Code Section 53600 requires timely reporting of local agency investment transactions and portfolio to the agency’s legislative body. The Government Finance Officers Association’s (GFOA) best practice recommendation is for local agencies to periodically report cash and investments to the governing body.

ITEM ANALYSIS
Below is a summary of the City’s cash and investments as of June 30, 2023 (general ledger balances). These totals do not include fiduciary funds that are held by other entities (e.g. trust account held by PARS for the City’s OPEB liability).

2 • Cash
o Petty Cash
The City maintains petty cash in various departments for change drawers and incidental purchases.
o Bank Accounts
Amounts listed are general ledger amounts and reflect activity through June 30, 2023. These amounts include checks that have been written but not yet presented to the bank (outstanding checks) and deposits that have been made but not yet recorded by the bank (deposits in transit). The general ledger balance reflects the City’s balances more accurately than the bank statements of the same date. Transactions are recorded by finance staff during various reconciliation processes which may not all be complete as of the writing of this report. Any updates are not anticipated to be significant.
▪ US Bank Main – This is the City’s checking account. All cash receipts and accounts payable are processed through this account. Balances fluctuate based on activity and cash flow needs. When funds accumulate that are not immediately
needed for cash flow, they are transferred to LAIF. When Account Balance

3 additional funds are required to meet immediate needs, they are transferred from LAIF into the main checking account.
▪ US Bank Payroll – This is a Zero Balance Account (ZBA). When payroll expenditures (direct deposits, checks, and wire transfers) are presented to the bank, the amount of the expenditure is automatically transferred from the main checking account into the payroll account.
▪ US Bank Savings (CDBG Program Income) – The California Department of Housing and Community Development (HCD),
which administers our Community Development Block Grant (CDBG) strongly suggests using a separate, interest-bearing bank account for Program Income. Interest earned on Program Income is also qualified as Program Income.
▪ US Bank Housing Authority – This account is used to receive funding from the Federal Department of Housing and Urban Development (HUD). Housing Assistance Payments are made from this account. The amount allowed by HUD for
administrative costs is periodically transferred into the City’s main checking account and allocated for costs within the Housing Authority Fund.
▪ US Bank Sewer Fund Capital Reserve – This account was required under the terms of the State Revolving Fund loan. Over a period of 10 years, the City was required to set aside $2,187,700 as a capital reserve. The balance in this account represents the first three years’ contributions plus interest. In October 2017, the City successfully negotiated a contract amendment to the SRF loan, removing the Capital Reserve Requirement. The majority of funds previously held in this account were transferred to the Sewer Fund for an authorized project. The remaining balance is held until needed for a project. ▪ US Bank Water Fund Debt Service Reserve – This account is required under the terms of the Safe Drinking Water loan. The funds will only be available to make the debt service payment should the Water Fund be unable to make payments from its operating account. The debt service reserve will be held in this account until the loan is paid off in 2024. The balance in this account is one year’s debt service plus interest.
o Pooled Cash
With the exception of restricted bank accounts (US Bank Savings, US Bank Housing Authority, US Bank Sewer Fund Capital Reserve, and US Quarterly Cash and Investments Report June 2023
August 21, 2023
4 Bank Water Fund Debt Service Reserve), the City’s cash and investment resources are pooled. The pooling of cash and investments provides several advantages, including better physical custody and control, enhanced investment opportunities, and ease of operations. It also simplifies custody, collection, and disbursements.

It is important to note that the City’s pooled resources include fiduciary, grant, and capital project funds as well as the City’s major operating funds (but not restricted funds). The cash and investment totals represent balances as of a specific date and do not represent amounts available for future appropriations.

The use of pooled cash allows the City to cover negative cash balances in certain funds internally, rather than borrowing from an external source.

Certain funds – particularly when grant-funded – experience a negative cash balance due to the timing of expenditures and the delay in reimbursement. Instead of using external borrowing to cover these timing issues, the City’s pooled cash covers the negative fund(s) until reimbursed. Typically, the General Fund covers any negative funds.

However, when the negative funds are for very large amounts (for example, large CIP projects), the General Fund alone may not have sufficient cash flow to cover the entire negative balance. Per the City’s Debt Policy, short-term cash flow needs may be covered by one of the enterprise funds if necessary, and interest would be paid to the enterprise fund in that case.
• Investments
o Local Agency Investment Fund (LAIF)
The City is a voluntary participant in the Local Agency Investment Fund (LAIF) that is regulated by California Government Code Section 16429 and managed by the Treasurer of the State of California. Cash is pooled with cash from local agencies state-wide and invested. Each agency has its own account within the pool. Each participating agency has a maximum account limit of $75 million, with no minimum balance, and is permitted to make up to 15 transactions per month. Investments in LAIF are available upon demand, although 24-hour notice is required for withdrawals of $10 million or more. More information about LAIF can be found at their website: http://www.treasurer.ca.gov/pmialaif/laif.asp. o Current Investment Portfolio
The City’s investment portfolio is 100% in LAIF. City staff reviewed this policy with its financial advisor in 2022 and determined the balances invested (less amounts already appropriated for capital improvement projects and other budgeted items) would not warrant the investment fees and administrative overhead required to invest in other vehicles.

Quarterly Cash and Investments Report June 2023
August 21, 2023
5 o Individual Transactions During Quarter
These transactions represent the City’s cash flowing between the checking account and LAIF investment account as cash is needed to fund budgeted items.
o Individual Securities Held
None.
o Realized and Unrealized Gains/Losses and Market Value Although the City does not hold any securities with a maturity over one year, the City does record a Fair Market Value (FMV) adjustment for its investment in LAIF, consistent with GASB 72. This GASB requirement is to provide transparency for the market value fluctuations in investments that are intended to be sold.

Although the City does not sell or intend to sell its investments (which are currently 100% in LAIF) and therefore does not have risk of market losses, we are required to periodically calculate the value of our investments as if they were to be sold on a particular date and report that fair market value. The FMV adjustment is calculated quarterly, and the adjustment as of June 30, 2023 was an unrealized loss of $277,637 (or 1.6% of our actual holdings in LAIF on that date). There is no actual gain or loss as the investments were not sold. The City receives actual interest earnings from LAIF each quarter. During this reporting period, interest of $114,325 was received in April, representing interest earnings for January – March 2023. The next interest earnings for the April – June 2023 quarter will be reported in the July – September cash report. o Return on Investments
The monthly rate in LAIF as of June 30, 2023 was 3.167%. Crescent City’s Investment Policy specifies the two-year Treasury note as a benchmark, which is to be used for reference purposes only. The daily treasury yield for two-year notes on June 30, 2023 was 4.87%.

LAIF administrative cost as of June 30, 2023 was 0.06% of earnings. By law, LAIF administrative costs may not exceed 5% of the quarterly earnings of the fund, unless the 13-week Daily Treasury Bill on the last day of the fiscal year is below 1%, in which case administrative costs may not exceed 8% of quarterly earnings for the subsequent fiscal year.

URBAN DEVELOPMENT
Chairman Wright opened the public hearing at 6:25 p.m.

Director Miller presented the FY2023 Annual Plan to the Council and explained the difference between the PHA 5-Year and Annual Plan, as well as how they are developed. She reported that when the last 5-Year Plan was developed the following three goals were set: expand the supply of affordable housing opportunities, deliver excellence in program administration and increase public awareness of agency services; she went into detail of what they each entailed. The CCHA has been very successful in their programs for the community; the average number of families assisted monthly is 529. As of March 1st, 65 applicants have been pulled from the waiting list, with 46 vouchers issued. Vice-Chair Inscore stated that he noticed that the VASH numbers had dropped; Director Miller stated that the reason for the drop in numbers is due to the Housing Authority not getting the referrals from the VA team. Staff has reached out once a month for the last several months with no success. Vice-Chair Inscore asked how the lack of availability of housing affecting those who are being pulled from the waiting list; Director Miller stated that the 46 vouchers that have been issued are waiting for housing to be available, however, some already had housing to use the voucher for.

There were no comments from the public.

On a motion by Vice Chair Inscore, seconded by Director Schellong, and carried unanimously on a 5-0 polled vote, the City of Crescent City Housing Authority Board of Directors approved and adopted Resolution No. HA2023-02, A RESOLUTION OF CRESCENT CITY HOUSING AUTHORITY APPROVING AND AUTHORIZING EXECUTION OF THE FY23 PHA ANNUAL

CRESCENT CITY HOUSING AUTHORITY

AGENDA REPORT
TO: CHAIR WRIGHT AND MEMBERS OF THE BOARD
FROM: ERIC WIER, CITY MANAGER
BY: MEGAN MILLER, HOUSING DIRECTOR
DATE: AUGUST 21, 2023
SUBJECT: CONDITIONALLY AWARD 26 PROJECT BASED VOUCHERS TO THE

HARBOR POINT APARTMENTS PROJECT

RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Conditionally award 26 Project Based Vouchers (PBV’s) to Danco for use at Harbor Point Apartments, pending completion of NEPA review and subsidy layering analysis prior to execution of an agreement to enter into an Agreement to execute a Housing Assistance Payments Contract (“AHAP”). • Approve and adopt Resolution No. HA2023-03, A Resolution of the Board of Directors of the Crescent City Housing Authority Approving the Selection of a Housing Choice Voucher Project Based Voucher Proposal.

BACKGROUND
The Crescent City Housing Authority (CCHA) receives grant funding from the Department of Housing and Urban Development (HUD) to administer the Housing Choice Voucher (HCV) program. The HCV program grant provides tenant-based rental assistance to verylow-income families (no more than 50 percent of the area median income) to rent safe, decent, and affordable housing units in the private rental market. The CCHA has the authority to administer 662 Housing Assistance Payment (HAP) vouchers.

Project Based Vouchers (PBV’s) are a component of the HCV program. A Public Housing Authority (PHA) may project-base up to 20 percent of its authorized number of vouchers for a contract term of up to 20 years with the ability to renew or extend the contract depending on funding availability. A PHA may project-base an additional 10% of its units above the 20% limit if the units are specifically made available to homeless, elderly, disabled, or veteran populations. Under the tenant-based HCV program, the CCHA issues an eligible family a voucher and the family selects a unit of its choice. If the family moves out of the unit, the contract with the landlord ends and the family can move with Conditional Award of Project Based Voucher – Harbor Point August 21, 2023
continued assistance to another unit. Under the PBV program, the CCHA would enter into an assistance contract with the property owner for specified units and for a specified term.

The CCHA would refer families from its PBV waiting list to the project owner to fill vacancies.

The advantage of PBV’s for CCHA is to provide developers with an additional financial tool to leverage other financing resources for construction, conversion, rehabilitation, or preservation of housing for low-income families. PBV’s have the potential to improve the project’s cash flow because most funding resources available to affordable housing developers restrict the rent that can be collected from tenants to an affordable amount that is usually far less than a comparable unit would generate on the open market. The PBV program pays market-rate rents by essentially subsidizing the difference between an affordable rent required by other affordable housing funding sources, and the marketrate rent for a particular unit.

In June 2023, the CCHA issued a Request for Proposals (RFP) and announced the availability of up to 30 PBV’s for new development multi-family housing projects. Danco’s Harbor Point proposal was the only one submitted and it was determined to be compliant with the basic RFP requirements.

THE PROJECT
The proposed project, Harbor Point Apartments, will be comprised of 26 affordable senior housing units. PBV’s have been requested for all 26 units. The project site is located at the former El Patio Motel location (655 H Street), conveniently located within one mile of grocery shopping, pharmacies, and public parks.

Harbor Point was originally selected for a PBV commitment in December 2017. A critical component of new construction development is the award of tax credits, and the application process is highly competitive. The project was unsuccessful in obtaining tax credits and the PBV commitment expired after a three-year period of inactivity.

In December 2022, the City applied for $5M in Competitive Permanent Local Housing Allocation funds from the State. The City was awarded the CPLHA funds, which have been committed to the Harbor Point project. Commitment of the CPLHA funding makes the Harbor Point project significantly more competitive at the tax credit level.

ANALYSIS
The Housing Authority stands to benefit substantially from a dedication of project-based vouchers. The ability to provide more opportunities for affordable housing to our participants, particularly a specified designation of units for the exclusive use of our program participants, is the most significant advantage. Other benefits include reduced inspection requirements, reduced affordability barriers for our participants, and improved voucher utilization.

Conditional Award of Project Based Voucher – Harbor Point August 21, 2023
The proposed project also offers benefits to the City of Crescent City. Securing low-tomoderate housing units is important for the City to meet its annual housing allocations as required by HCD. Several policies within the Housing Element, which is a part of the General Plan, require that the City promote the development of low-to-moderate income housing. The project site is located within the City limits and will increase the City’s affordable housing stock by 26 units.

A PBV commitment at Harbor Point will support the CCHA’s goal of expanding housing opportunities in our jurisdiction for low-income families and will diversify the CCHA’s portfolio to encourage full utilization of available vouchers.

FISCAL IMPACT
Committing PBV’s to the proposed project will have no fiscal impact to the CCHA. The funds for PBV are already included within the CCHA’s annual budget authority.

FROM: ERIC WIER, CITY MANAGER
BY: BRIDGET LACEY, GRANT AND ECONOMIC DEVELOPMENT

COORDINATOR
DATE: AUGUST 21, 2023
SUBJECT: LETTER OF SUPPORT TO ELK VALLEY RANCHERIA FOR AN

AMERICAN INDIAN ALASKA NATIVE TOURISM ASSOCIATION
(AIANTA) GRANT APPLICATION TO HELP FUND THE TOLOWA

INTERPRETIVE WALK
______________________________________________________________________

RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Approve and authorize the Mayor to sign a letter of support for Elk Valley Rancheria’s AIANTA grant application to help fund the Tolowa Interpretive Walk.
• Direct staff to bring back a memorandum of understanding with Elk Valley Rancheria regarding implementation of the project.

BACKGROUND
The American Indian Alaska Native Tourism Association (AIANTA) was founded in 1998, by tribes, for tribes, to address inequities in the tourism system. Their mission is to define, introduce, grow and sustain American Indian, Alaska Native and Native Hawaiian tourism that honors traditions and values. One of its priorities is to highlight the importance of visiting authentic Native destinations, including cultural, heritage, historic, and artistic sites.

On July 3rd, 2023 a Request for Proposals (RFP) was released by AIANTA, the only national organization dedicated to advancing cultural tourism in Native Nations and communities across the United States, as a collaborative partner with the U.S. Forest Service, for a project called the NATIVE Act, to fund tribal projects and initiatives on or adjacent to U.S. Forest Service managed lands.

EVR AIANTA Grant Application – Letter of Support
August 21, 2023
2 Grants range from $25,000 - $250,000 and project timelines are for a duration of two years. Grants must be used for cultural tourism, interpretation and/or recreation initiatives.

All applicants must be Tribal Nations, Tribal Enterprises or native nonprofits that border and/or have historic ties to US Forest Service managed lands.

The US Forest Service/AIANTA NATIVE Act grant program is a new initiative designed to advance the intent and purpose of the NATIVE Act through supporting and investing in efforts to enhance and integrate cultural tourism/cultural recreation to empower Native American communities and to advance the National Travel and Tourism Strategy.

The City was awarded approximately $8.2 million in Prop 68 funding to complete seven Beachfront Park features, including a Tolowa Interpretive Area with Indigenous Plantings and the Paths of Culture. The excitement and momentum that has been building around the new Tolowa park features has led the City to secure additional funding through the Coastal Conservancy’s Coastal Stories Grant Program and the California Endowment to expand the storytelling elements of this park experience beyond the designated Tolowa Cultural Interpretive Area with Indigenous Plantings and Paths of Culture sections of the park. The Paths of Culture, now referred to as the Tolowa Interpretive Walk, will tell ten (8) unique Tolowa stories by using QR codes linked to video content at kiosks throughout the park and along the California Coastal Trail. What began as two small sections of the park has now expanded into a guided experience which ties all park features together and acts as the framework of the park.

As these stories have developed they have greatly informed the design of the kiosks. The expanded design of the kiosks has become a series of public art installations, which elevate the stories being told in the space and create a fully immersive experience for the visitor. The construction costs for these new elements, however, is estimated at between $100,000 - $225,000 per kiosk, depending on the site.

The breakdown of current funding sources for the Tolowa Interpretive Walk kiosks is as follows:
• Prop 68 (Per Capita and SPP): First three fully immersive kiosks fully built out at the start of the Tolowa Interpretive Walk.
• California Endowment – (Cultural Diversity): Basic kiosk at Brother Jonathan. • Coastal Conservancy - Project management, story development, video production, binoculars/static viewers, scavenger hunt design.

ITEM ANALYSIS
City staff believe the Tolowa Interpretive Walk project to be a perfect fit for the US Forest Service/AIANTA NATIVE Act grant program. The City is not a qualified applicant, however, Elk Valley Rancheria, as a partner on this project, has graciously agreed to EVR AIANTA Grant Application – Letter of Support
August 21, 2023
3 apply for the additional funding needed to expand the construction of the Tolowa Interpretive Walk kiosks.

Prop 68 funds are currently only able to fund three of the fully built-out kiosks at the start of the Tolowa Interpretive Walk in Beachfront Park (the redwood tree, canoe, and burden basket designs). If awarded, this $250,000 grant would fund the following additions:
• One fully built out Dance House kiosk at Battery Point • Site improvements at Battery Point
• Three basic kiosks along Howe Drive/California Coastal Trail to house the remaining videos.

At this time, City staff would like direction from council to submit a letter of support for Elk Valley Rancheria’s application for AIANTA funding to expand the construction of the Tolowa Interpretive Walk kiosks. City staff would also like direction to draft a MOU with Elk Valley Rancheria detailing the logistics of this addition to the Tolowa Interpretive Walk.

Once the contract has been drafted and reviewed by all necessary parties, it will be brought back to council for approval.

GRANT APPLICATION TIMELINE
Grant Performance Period: January 1, 2024 – December 31, 2025 • Applications due August 31, 2023
• Successful applicants notified Oct/Nov 2023
• Grant agreements signed Dec 2023/Jan 2024
• Projects completed by December 31, 2025

FISCAL ANALYSIS
There is no cost associated with submitting a letter of support. If awarded like all expanded elements in the Beachfront Park the City will be responsible for maintenance.

With this in mind City staff and the design team are designing the elements to be as low maintenance as possible.

STRATEGIC PLAN ASSESSMENT
This action is consistent with the following 2016 Strategic Plan Goals:
• Goal 1: Support quality services, community safety, and health to enhance the quality of life and experience of our residents and visitors. • Goal 2: Promote a thriving local economy.

RE: Tolowa Interpretive Walk 2023 AIANTA Application
Dear Ms. Richardson,
Please accept this letter as formal support for the Tolowa Interpretive Walk 2023 AIANTA Application. The American Indian Alaska Native Tourism Association funding, which the Elk Valley Rancheria is pursuing, will help create a much-needed Beachfront Park feature aimed at correcting one-sided histories, encouraging land stewardship, and keeping the traditions of Tolowa people alive for future generations.

The Tolowa Interpretive Walk presents an opportunity to help heal the intergenerational trauma of our community surrounding the genocide that started 170 years ago by telling ten unique Tolowa stories, from the Tolowa perspective, throughout the park and along the California Coastal Trail. These stories will act as the framework to the new Beachfront Park design and hold great importance to the community.

The City of Crescent City, a local government entity, is pleased to support the Tolowa Interpretive Walk project. This project will benefit residents and visitors of Del Norte County by establishing a coastal destination to recreate, relax, connect to the land, and engage in learning about the region’s past and present.

• Authorize Staff to Apply for Coast Central Credit Union’s Community Investment Grant Program
• Approve and adopt Resolution No. 2023-61, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FY 2023-24

BUDGET OF THE CITY OF CRESCENT CITY

BACKGROUND
On May 18, 2022, the City was contacted by the Hambro Group and informed that their tenant, Val Polyanin, had decided to donate all his remaining artwork to the City. There was a total of four shipping containers, housing over 900 pieces of art, representing the artist’s life work. The pieces were of various mediums, including paintings, mosaics, sculptures and more.

Mr. Polyanin’s roadside art gallery had been a notable part of Crescent City’s southern corridor, sitting across from South Beach on Highway 101, and was featured in stories on various outlets, including Roadsideamerica.com and Spaces Archives.

On June 30, 2022, City staff presented this donation offer to the City Council and asked for acceptance of the work and approval to store it in a City owned building until further plans could be made for both short-term and long-term efforts. Council members directed staff to accept the art, temporarily store it in the old Bank of America building at 240 H Street, provide an initial budget for transition of the art of $10,000 out of the Economic Update on Val Polyanin Art Collection
August 21, 2023
2 Development line item, and to return to Council to discuss options for what the City will do with the work.

Between August 1st & 3rd, 2022 the art was relocated to the old Bank of America building, and since that time has been photographed, cataloged, and properly stored for future use.

A total of 914 pieces were recorded as a capital asset with an assumed value of $694,500.

As the work was being moved into its new location, several passers-by took interest in the effort and out of that came the involvement of a handful of volunteers who have helped with the cataloging and photographing of each piece of work.

On February 6, 2023, staff brought a proposal to Council to establish a temporary Art Exhibit showcasing Mr. Polyanin’s collection, to be funded out of the existing Economic Development line item, and open during First Friday events each month from May through October 2023. It was agreed that the remaining budget of $2,000 from the original $10,000 allocation for the project, plus $1,500 received in donations, and $6,500 from the existing Economic Development budget, totaling $10,000, would be authorized to put towards setting up the exhibit and bringing on two consultants to assist with the endeavor.

ITEM ANALYSIS
After receiving approval from Council, staff went to work transforming the former Bank of America into a carefully curated exhibition space. With the help of several committed volunteers, paintings were hung from the ceiling, sculptures were thoughtfully arranged in their spaces, and the facility was cleaned and prepped for showing.

During this process, the City was contacted by Paul Critz at Redwood Voice, a local nonprofit funded through The California Endowment, wanting to help with the filming of a short documentary outlining Mr. Polyanin’s life and pursuit to express his artistic vision freely. Mr. Polyanin had sat down with City staff prior to the request to Council in February, and a record of his life story was obtained, chronicling his experience of being a Ukrainian artist who had fled his country in search of freedom, and eventually finding a permanent home in Crescent City. With this footage as a baseline, the Redwood Voice team interwove narration, drone footage of the art when it was still inside the shipping containers, and interviews with City staff who were involved in the project and developed an intriguing and compelling 10-minute documentary that plays in a viewing room during the First Friday showings.

Also key in preparing for the exhibition was the development of a historical write-up done by consultant Jillian Morrison, a historical researcher based out of Chicago, Illinois. Her write-up included a background of socialist Ukraine in the era of Russian control and its history of artistic oppression and conformism, and the impact that this has on Mr. Polyanin and his desire to express himself freely. The write-up outlined Mr. Polyanin’s escape from Ukraine and his seeking asylum in the United States, as well as how he found himself living and creating art in Crescent City. The write-up provides context to Mr. Polyanin’s story of resilience, perseverance, and relentless pursuit to express himself in the way of his choosing - a cornerstone of American ideology.

Update on Val Polyanin Art Collection
August 21, 2023
3 As a vital part getting the exhibition space laid out properly, the City worked with Annalise Flynn, Curatorial & Management Consultant with SPACES Archives. Ms. Flynn worked with City staff to curate the exhibition space, including helping to identify themes, aesthetics, and spatial balance. Ms. Flynn also consulted on other aspects of organizing the exhibition and was key in working with staff to bring the entire vision to life. The guest experience was thoughtfully designed and offers interactive elements, including a familyfriendly scavenger hunt that guides individuals through many aspects of the pieces seen throughout the show and helps encourage conversation. Guests are also encouraged to fill out an index card describing what freedom means to them, which is then placed inside a safety deposit box inside the vault.

The opening of the exhibit was on May 5, 2023, and over 200 guests were estimated to have attended. Since then, the exhibit has been opened 5 times with an average of 100 or more attendees coming through each showing. Feedback from the community has been overwhelmingly positive, with many individuals expressing a desire to see the work be retained in Crescent City.

With the ultimate goal of transitioning the former Bank of America Building into a new City Hall, the collection’s time in the current building is limited. As such staff organized an Art Preservation Committee, and on June 28th held its first meeting, which was attended by a handful of community members with a vested interest in seeing the work stay in Crescent City and have a platform for community engagement. Since the inaugural meeting, there have been two additional meetings with an increasing interest from community members, bringing the total number of committee members to 16. The backgrounds of committee members range from business owners, artists, and real estate agents to non-profit leaders, teachers, and more. The most pressing challenge faced by this project is the limited time remaining to store the work in the old Bank of America building, so the focus of the committee meetings has been to brainstorm a future home for the collection and to begin pursuing possible avenues for relocation. The committee goals are to answer the following questions for council:
• Where will the art go after the construction of City Hall begins? • Who will pay for the future costs of storing or exhibiting the work? • Who will staff or manage the collection?
Committee members have started the process of seeking out new locations, financing options, and a nonprofit willing to take on the project. Some ideas for immediate action have included:
• Liquidating the collection at auction.
• Breaking up the work into smaller portions to display in multiple locations. • Seek funding to relocate the collection and store/exhibit the work for a year and staff with volunteers.
• Put everything into storage until another plan can be made.

The committee is also working on long-term options and some ideas have included:

Update on Val Polyanin Art Collection
August 21, 2023
4 • Purchasing several shipping containers to create a maze of exhibition space and a sculpture garden on a piece of City-owned property or purchase a lot with grant funding. This could potentially be a space for events and a non-profit could either be set up to run it, or an existing non-profit could step in. • Purchase a commercial building for exhibition and set up a non-profit to run it. • Use the old City Hall building to exhibit some of the work and store the rest in inaccessible spaces.

As this project has been evolving, the City has actively been working on plans for redesigning the Bank of America building into the new City Hall. While the design phase is nearing completion, staff have also been in discussions with the United States Department of Agriculture (USDA) regarding loan funding for construction. In the most recent conversation, USDA representatives shared that the process would take about nine months, meaning construction could begin as early as May of 2024.

With a more defined timeframe for when the art will need to be relocated, staff recommend extending the time authorized by Council for the collection to be exhibited in the space and open to the public, in coordination with the start of construction, the collection will be moved to another location.. The community response has been overwhelmingly positive, and staff believe continuing the momentum of the project is vital for future placement and success. All the showings have been staffed by volunteers with one of two City staff, one of whom is salaried. There has been increasing interest from individuals who want to volunteer, and staff have not encountered any challenges with staffing the showings.

Costs to continue showing the work are minimal and include utilities, light refreshments, cleaning supplies, and marketing materials, such as postcards and website hosting. A breakdown of cost estimates is outlined in the Fiscal Analysis.

Staff have continued to explore other avenues for finding a permanent home for the collection and have recently been in contact with the Kohler Foundation, who has again expressed interest in assisting with the endeavor of preserving and finding permanent housing for it. A representative of the foundation told staff they would be including this project on their October agenda, and if it were accepted by their board, it would be in their queue to begin getting looked at in 2025, leaving at least two years in which a temporary solution would need to be executed. If the work were to be taken on by the Kohler Foundation, it would not be returned to the City and would require ownership be given to a non-profit.

In the interim, staff are actively pursuing a temporary location to both house and, ideally, exhibit the art. Staff have been in contact with property owners in the downtown area and are working to see if a feasible option could be arranged for a short-term lease, such as one year. If a space could be acquired, KFUG Community Radio has expressed an interest in taking a lead role in being a non-profit affiliated with the collection and assisting with operating the temporary exhibition. They have been active on the Art Preservation Committee and supportive of the project. This is an avenue being explored both on their Update on Val Polyanin Art Collection
August 21, 2023
5 end and by City staff, however it is currently in preliminary discussions as this process progresses.

To fund a short-term lease, staff have identified a small grant through Coast Central Credit Union for up to $25,000. These grants are designed to improve the quality of life of community members in Del Norte County, and staff believe this project is a good fit for this opportunity. The grant application is due by August 31st, and if awarded, funds would be used to lease a space and make modifications as needed to ensure it is brought to code and in a condition for exhibition.

The Council has articulated in the past that this opportunity of unique and unexpected chain of events has great potential to be an economic driver for the community by way of an interactive storytelling experience. This is similar to telling the story of Kamome, Tolowa Coastal Stories project, or Tsunami Walking Tour which really highlights our community’s unique history and stimulates heritage tourism. City staff believe that the heart and soul of this project lies, not only in one artist’s incredibly impressive collection of 914 pieces of art, but also in the backstory of the artist and the acquisition process. It is clear by the amount of interest generated by the public during the moving process, exhibition, and participation in the Art Preservation Committee, that our community is interested in seeing this work continue to have a place in Crescent City and be placed somewhere that is accessible for viewing on an ongoing basis. The City has a rich history and culture to share, and as outlined in the City’s Economic Development Strategic Action Plan, the expansion of arts and culture activities is a recipe for tourism attraction.

FISCAL ANALYSIS
There are minimal costs associated with continuing to utilize the Bank of America building for exhibition, including utilities, printed materials, light refreshments, and upkeep of the facility. To continue the exhibition from November 2023 through April 2024, staff estimate the following expenses:
• Utilities (gas & water) - $2,500
• Exhibition Supplies (printed materials, light refreshments, cleaning & toiletry supplies) - $1,200
• Marketing (postcards, Facebook advertising, etc.) - $550 These additional expenses would require a budget adjustment of $4,250 be authorized by the City Council. No additional costs are associated with showing the art.

The grant through Coast Central Credit Union does not require a match although it does require that the recipient pay any costs upfront and then submit for reimbursement. If the City is awarded that grant, depending on the negotiated lease terms, additional funding may be needed.
