1. Letter in Opposition to the Nearshore Groundfish Closure • Recommendation: Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Authorize the Mayor to sign a letter in opposition to the Nearshore Groundfish Closure City Manager Wier reported to the Council regarding the letter of opposition that was brought to the Council by the public at the last meeting. He further stated that the reason for the special meeting is to ensure that the letter in opposition is included in the full agenda packet that will go before the Pacific Fishery Management Council. He explained the contents of the letter of opposition and how the closure is impacting our community negatively. City Manager Wier stated that there are many other options that can be done to protect the quillback fish and are outlined in the letters submitted by the Crescent City Harbor District. Council Member Schellong stated that this closure also effects our gas taxes. Residents have grown up with fishing and this closure is a big negative impact. Council Member Altman asked about the data from trawling; CIty Manager Wier stated that they weren’t able to trawl for data and that is why the data is incorrect.

Board of Supervisor Howard addressed the Council that the economic impacts cannot be understated. He further stated that the County will be sending letters to other agencies on the impacts this closure has on our community. Supervisor Howard stated that due to the terrain underwater, trawling cannot be done to obtain the appropriate data for a closure. He stated that there should not be boundaries; suggested the same language to be added to the letter. Draft a

letter to CalOES and Congressman Huffman to ask for a disaster declaration. The economic impact of the salmon closure does not come close to the impact the groundfish closure has. The data collected for this closure is not accurate. He further stated that Assemblyman Jim Wood Council Member Schellong stated that a zero bag limit should be added to those three species; that Brookings is very close and they do not have these restrictions, to send to CalOES, Congressman Huffman, and the California Fish and Game Commission. Council Member Schellong asked Supervisor Howard to clarify what he meant about the closure of the salmon was not as big of an impact as the groundfish closure; Supervisor Howard stated that the emergency declaration needs to be specific to the concern. Mayor Wright spoke in support of adding the items mentioned to the letter. Council Member Schellong stated that the safety of the fishermen should be also outlined as we no longer have the Coast Guard here. City Manager Wier agreed.

George DeCossio: his main concern is the people who work in the community and these jobs are needed. This came as a surprise to everyone.

Council Member Schellong liked the comment about how this closure effects the jobs in the community.

On a motion by Council Member Schellong, seconded by Council Member Altman and carried on a 3-0 polled vote with Council Member Greenough and Mayor Pro Tem Inscore being absent, the City Council of the City of Crescent City directed staff to draft a letter in opposition to the Nearshore Groundfish Closure to include the impact the closure has on jobs, our location being so close to Brookings, there are safety concerns for our fishermen as we have no Coast Guard.

The letter is to be sent to Congressman Huffman, CalOES, and the California Fish and Game Commission.

Within the motion, Council Member Schellong added to have a letter drafted to CalOES and Congressman Huffman requesting a Declaration of Economic Disaster.

City Attorney Rice stated that the letter requesting disaster relief will need to be agendized for the next Council meeting.

OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE CRESCENT CITY MUNICIPAL CODE BY ADDING CHAPTER 8.36, REGULATION OF TOBACCO RETAILERS, TO TITLE 8, HEALTH AND SAFETY
Mayor Wright opened the public hearing at 6:39 p.m.

City Attorney Rice gave a summary of what was contained in the ordinance and detailed the following portions: fees, eligible businesses, advertising regulations and enforcement. The ordinance that is before them has had no changes since the introduction. Council Member Greenough spoke in opposition to this ordinance as he believes it is government overreach. He said there are already regulations on the books both State and Federally that cover this. Council Member Altman stated that his position remains the same, he says he doesn’t understand why there is such a push for marijuana in California, but tobacco is being severely regulated. Feels both marijuana and alcohol is far more problematic than tobacco. Flavored tobacco has already been removed in our County. Doesn’t feel like the local pharmacies weren’t represented. Rite Aid recently filed for bankruptcy, and he hopes it’s not due to taking away some of their products.

There are a lot programs that are paid for by tobacco tax, such as our School Resource Officer, and it had already been decided not to take tobacco completely away by the State.

Robert Derego: spoke about being a marijuana user and smokes regular cigarettes as well. He feels cigarettes are more difficult to quit but that marijuana has health benefits.

Mayor Wright closed the public hearing at 6:50 p.m.

On a motion by Council Member Schellong, seconded by Mayor Pro Tem Inscore, and carried on a 3-2 polled vote with Council Member Altman and Council Member Greenough voting no, the City Council of the City of Crescent City waived full reading, read by title only and adopted Ordinance No. 835, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE CRESCENT CITY MUNICIPAL CODE BY ADDING CHAPTER 8.36, REGULATION OF TOBACCO RETAILERS, TO TITLE 8, HEALTH AND SAFETY.

• Direct staff to prepare and submit an application for CDBG funding under the 2023 NOFA for OTC – PUBLIC INFRASTRUCTURE – STORM DRAIN PROJECT PHASE III (F STREET) IN THE AMOUNT OF $1,065,485
Mayor Wright opened the public hearing at 6:51 p.m.

Grants Coordinator Lacey reported to the Council that in 2020 the City applied for funding for the Storm Drain Project Phase III (F Street) with the 2020 NOFA but was not awarded. Instead, this project has been waitlisted for the last three years. As more funding has become available through CDBG for OTC projects, they have simply been funding down this list, rather than opening the OTC category up for more applications. The Storm Drain Project will now be eligible under the 2023 NOFA and is very likely to be funded, assuming all the threshold requirements are met. The Housing Element will be a threshold item and is on track to be approved before applications are due. There is apparently enough funding to cover all remaining projects on the waitlist and HCD will go back to accepting new OTC applications with the 2024 NOFA. Council Member Greenough asked the creation of another outfall for the storm drains; City Manager Wier stated that no, it is not a part of this. Council Member Greenough asked for an update and if we’ve heard back from Coastal Commission; City Manager Wier stated that the timeliness and the timing of the funding, this project was prioritized.

Robert Derego: commented on Mayor Pro Tem Inscore’s comment under the Housing Authority Consent Calendar regarding the housing need and asked if the City is selling the city short by having a lot of short-term rentals. Agreed that housing is desperately needed.

Mayor Wright closed the public hearing at 6:59 p.m.

BUDGET AND POSITION CONTROL
Finance Director Leaver stated that the Finance Department is nearly finished with the department’s restructure, this is the one remaining item. The current item approved is two Account Clerks which is usually in the Water Department, there is one Finance Analyst that does invoices, purchase orders, etc), and one Finance Technician that does Accounts Payable and Payroll. There is a need in the Water Department to have an additional employee to help with the workload as two is not enough. Instead of hiring another Finance Analyst, to hire a part-time Account Clerk and a part-time File Clerk position. Staff requests direction from the Council to adjust the position control to remove the vacant Finance Analyst position and add the part-time Account Clerk and part-time File Clerk position. Council Member Schellong stated that she is concerned about removing the Finance Analyst position and would hate to see the position gone that is helpful for the larger picture in the Finance Director. Director Leaver stated that the staffing plan proposed will continue the high quality of work and transparency. Once the automatic meterreading program is implemented, the positions in the Water Department will be reevaluated.

Council Member Altman stated he appreciated the adaptive nature of the Finance Department.

Would like to see whatever helps her department run more smoothly.

There were no comments from the public.

➢ City Manager Report and City Council Directives – Council Member Greenough asked for the Council’s opinion of adding a letter of support for Israel to the next Council agenda.

Mayor Pro Tem Inscore and Council Member Schellong stated they were unsure who to send the letter to; Council Member Greenough stated it would go to the California Israel Embassy. Council Member Schellong asked what the goal and content would be of the letter; Council Member Greenough stated it would be us showing our support to the people of Israel, condemn the acts publicly. Mayor Pro Tem Inscore stated he would like to see the content of the letter before he made the decision as there are many innocent lives that have been lost on all sides. He does not want to single out one people group when lives have been lost. Mayor Wright stated that he would like to see how the United States is going to respond before wanting to draft a letter. Council Member Schellong stated that she agrees that this is atrocious, however, there have been other people dying in other countries from terrorism and would this be a regular action for the Council? Mayor Wright asked if there was an official level on the State or Federal level; City Attorney Rice stated that there will not be any state government that will do anything aside from the Federal government to send troops, etc. It’s not uncommon for a local jurisdiction to send letters of support such as this. City Manager Wier stated that direction is needed by consensus to have it added to the next agenda. Council Member Altman stated that the whole area has been fighting since Biblical times. Mayor Pro Tem Inscore stated that the letter could simply say that violence against the innocents is condemned, and we stand in solidarity for Israel. The Council was in unanimous consensus to place this on a future agenda.

City Manager Wier reported the following to the Council:

10/16/23 COUNCIL MINUTES
o Shared photos from the Fallen Firefighter Memorial Ceremony; Council Member Altman explained each photo and spoke of the honor it was to be present for the ceremony. Chief Carey thanked Council Member Altman and City Clerk Altman for attending and for the support of the City Council for the fire department. He stated the most heartbreaking thing he saw was all of the children who were present because they lost their fathers. City Manager Wier stated he appreciated all of the work that Chief Carey is doing for the Department and that Chief Wakefield would have been proud.
o There is a housing crisis in our community that is having a ripple effect. There are a few housing projects in the works now – there is a 162-unit project that was just presented to the Planning Commission known as Battery Point Apartments. There can be a presentation by the developers to the Council, should they desire one. The Council was in unanimous consensus to have this presentation at a future Council meeting. The Valhalla project was approved at the last Planning Commission meeting and the Danco project will be before them soon. Council Member Schellong stated it is a good idea to make sure the public knows that although the Council approves the project, there is no control over what they charge for rent. o Beachfront Park is well underway for design – there were additional grants applied for, such as the Clean California Grant (a presentation will be before the Council at a future meeting) and the Clean California Grant was obtained for just under $3million.
o Monster Splash at the Pool is this Saturday, from 3pm-5pm in the parking lot as well as in the pool.
o Chamber Mixer for the City will be on October 26th at the Bank of America Building hosted by the City to celebrate the art gallery.
o The Homecoming Parade starts at 3:45pm this Friday downtown o The high school band program competed at the Marching Band Competition o Chief Griffin reported on the untimely passing of Del Norte Sheriff Deputy Deanna Esmael last Thursday. He wanted to communicate that help is available for those who are mourning her loss. Asked anyone who needs the help to please reach out to him.

Council Member Schellong said she was proud about the award of the grant for Beachfront Park and applauded Grants Coordinator Lacey for all of the work she has done to obtain them.

Mayor Wright asked about the proposed meeting on Monday, October 30th for a Housing Set Aside discussion.

ADJOURNMENT
There being no further business to come before the Council, Mayor Wright adjourned the meeting at 7:58 p.m. to a special meeting of the City Council of the City of Crescent City on Monday, October 30, 2023, at 6:30 p.m. at the Wastewater Treatment Facility, 210 Battery Street, Crescent City, CA 95531.

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: KEVIN CAREY, FIRE CHIEF
DATE: NOVEMBER 6, 2023
SUBJECT: ACCEPTANCE OF CAL FIRE GRANT FOR TURNOUTS
______________________________________________________________________

RECOMMENDATION
• Approve and adopt Resolution No. 2023-74, A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE CITY BUDGET FOR FY 2023-24 AND APPROVING THE CAL FIRE COOPERATIVE FIRE PROTECTION GRANT AGREEMENT #7FG23027

BACKGROUND
Each year Cal Fire manages the Volunteer Fire Capacity (VFC) Program, which is a Federally-funded grant program that allows California to provide local and rural fire departments with minor firefighting, training, communications and safety equipment for their volunteer firefighters. The VFC Program has a 50/50 match requirement which means that Crescent City Fire & Rescue must be able to meet the intended grant award, dollar for dollar. Awards for departments range from a minimum of $500 with a maximum of $20,000.

ITEM ANALYSIS
Crescent City Fire & Rescue was awarded $19,902 to fund crucial structural gear needs.

The department’s number one goal is safety for our volunteers; with aging structural gear it is vital that we purchase and provide NFPA compliant gear for all members of the department. With a combined total of $39,804, we will be able to purchase 12 new bunker coats and 12 new bunker pants. This grant, along with Measure S approved purchasing will help bring Crescent City Fire & Rescue into compliance with NFPA and OSHA mandated requirements.

The grant must be accepted and the agreement fully executed by December 1, 2023, and the funds must be spent by June 30, 2024.

FISCAL ANALYSIS
The City will receive $19,902, which is half the cost of buying 12 bunker coats and 12 bunker pants. The grant revenue will require a budget amendment. The City will be required to pay an upfront cost of $39,804, half of which will be reimbursed by the Cal Fire Grant. In addition, the District will be reimbursing $9,951, making the City’s net expense $9,951. The City will have an expenditure of $39,804 and a total of $29,853 in revenue in FY24.

STRATEGIC PLAN ANALYSIS
This action supports Strategic Plan Goals #1C Empower and utilize Police, Fire, and Public Works departments to make Crescent City one of the safest cities in the United States; #2A Evaluate and optimize additional revenue sources; #2D Collaborate with other jurisdictions and non-profits to maximize regional effectiveness and amplify funding opportunities; and #3B Maintain responsible fiscal management and accountability.

CITY COUNCIL AGENDA REPORT

BY: DAVID YEAGER, PUBLIC WORKS DIRECTOR

ANDREW LEIGHTON, ENGINEERING PROJECT MANAGER
DATE: NOVEMBER 6, 2023
SUBJECT: CHANGE ORDER FOR CHEMICAL TANK CONSTRUCTION AT THE WWTP
______________________________________________________________________

RECOMMENDATION
• Approve and authorize the City Manager to sign Change Order No. 1 with LNL Design and Construction for the completion of the installation of 4 chemical tanks at the Wastewater Treatment Plant

BACKGROUND
In February of 2023, the City published an informal request for quotations for the replacement of the two sodium bisulfite tanks (3,000 gal each) and two sodium hypochlorite tanks (6,500 gal each). The City received quotes from 5 suppliers with National Tank Outlet being the lowest cost.

Final delivery of the tanks was on July 12, 2023.

On July 21, 2023, the City entered into a time and materials agreement with LNL Design and Construction for the sum of $30,000 for the removal and installation of the four chemical tanks, removal and reinstallation of the exterior wall, removal and reinstallation of the HVAC ducting, and plumbing as required to complete the project.

ITEM ANALYSIS
The Small Public Works Agreement (SPWA) was originally written as a time and materials (T&M) project with a not to exceed limit of $30,000. At the time of the agreement, the full details of the scope could not be determined until wall removal began, other impediments removed, and how exactly the new tanks would be incorporated into the existing systems.

The proposed change order reflects the increased costs that became apparent after the project had begun. The total contract amount will be $63,477.09.

WWTP CHEMICAL TANK CONSTRUCTION CHANGE ORDER
NOVEMBER 6, 2023
2 The change order reflects an increase in scope of work necessitated by the multiple mobilizations required due to the delivery schedules of the sodium bisulfite and sodium hypochlorite tanks. The exterior wall appeared to be designed to be removed in two complete pieces. It turned out we needed to remove the upper wall section piecemeal, including the windows, siding, and trim pieces. Other cost overruns were due to replacement parts for siding, interior wall and paint, additional plumbing components to the new tanks, and replacement parts for the stainless-steel HVAC ducting.

FISCAL ANALYSIS
The table below summarizes the total project costs. The City purchased the tanks directly totaling $29,143.28. The contract cost for LNL Design and Construction with Change Order No. 1 is $63,477.09.

Item Cost
2x 3000 gallon tanks $7,922.48
2x 6,500 gallon tanks $19,304.38
Sales Tax $1,916.42
Installation $30,000.00
Installation Change Order $33,477.09
Total $92,620.28
Authorization for the City Manager to sign the change order per City procurement procedure requires Council approval for a total contract value exceeding the $60,000 signature limit.

Although the contract value exceeds the original estimate, the total project is under budget. The budget for the project was $140,000. This project was completed $47,380 under budget. The original budget did not include the replacement of the two sodium bisulfate tanks. These tanks were added to this project to take advantage of the expense incurred with the wall removal.

RECOMMENDATION
• Approve and adopt Resolution No. 2023-75, A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2023-24 BUDGET OF THE CITY OF CRESCENT CITY

BACKGROUND
The City first entered into an agreement with Operations Management International, Inc. (Jacobs) to manage the City’s Waste Water Treatment Plant (WWTP) in June of 2019.

The City provides the WWTP infrastructure, consumables, and pays for capital expenditures and major repairs over $5,000. Jacobs provides WWTP management, crew to operate the plant, and performs minor repairs within a set yearly budget. Within the plant is 1.25 megawatt generator which enables the WWTP to continue running when the supply of commercial electrical power is interrupted.

On August 18, 2023 at 4:20 pm, the power to Crescent City was turned off by Pacific Power as a pre-emptive safety measure due to the Smith River Complex fire closing in on the power transmission mains.

ITEM ANALYSIS
During the power outage, the generator to maintain the WWTP ran continuously to maintain the plant’s operation. Due to its large power draw, the plant was not initially reconnected to mainline power with the first few waves of local power reconnects. The generator was able to shut-off when the last of the local temporary generators were put on-line to power the County’s power grid.

WWTP DIESEL EXPENSES
NOVEMBER 6, 2023
2 While mainline commercial power was not accessible to the Treatment Plant, Jacobs was incurring unusually large fuel costs through the purchase of diesel fuel to run the generator.

FISCAL ANALYSIS
The accumulated costs for the purchase of this emergency supply amount are detailed below and are to be funded from the Sewer Fund. The emergency response required to handle the Smith River Complex Fire was not anticipated and therefore not included in the FY 23-24 budget.

Additional Expense to Jacobs for Diesel Fuel $ 24,762
Reimbursement by the State of California for expenses
Incurred during the declared Emergency @ 75% $ 18,572
It is anticipated that the State of California will reimburse these expenses, but it should be noted at this time that the breadth of coverage from the State has not been guaranteed.

Staff is still analyzing the City labor expenses for response to the Smith River Complex Fire. Once those expenses and revenues are finalized, staff will return to the Council with an additional budget adjustment if necessary.

STRATEGIC PLAN ASSESSMENT

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: BRIDGET LACEY, GRANTS AND ECONOMIC DEVELOPMENT

COORDINATOR
DATE: NOVEMBER 6, 2023
SUBJECT: UPDATED RESOLUTION FOR 2023 CDBG APPLICATION
______________________________________________________________________

RECOMMENDATION
• Approve and adopt Resolution No. 2023-76, A Resolution of the City Council of the City of Crescent City Rescinding Resolution No. 2023-72 • Approve and adopt Resolution No. 2023-77, A Resolution of the City Council of the City of Crescent City Approving an Application for Funding and the Execution of a Grant Agreement and Any Amendments Thereto from the 2023 Funding Year of the State CDBG Program for amended project and general administration amounts.

BACKGROUND
The Community Development Block Grant (CDBG) program is a federally funded program through the Department of Housing and Urban Development (HUD). The principal objective of CDBG is the development of viable urban communities by providing decent housing and a suitable living environment, and by expanding economic opportunities, principally for persons of low-and moderate-income.

As a non-entitlement jurisdiction (cities with population less than 50,000 and counties with populations less than 200,000), Crescent City applies for CDBG program funding through the State Department of Housing and Community Development (HCD). HCD receives funding from the federal government and releases a Notice of Funding Availability (NOFA) to invite applications. The 2023 NOFA was released on September 29, 2023, with approximately $36.5 million in funding to be awarded to waitlisted Over-the-Counter (OTC) projects only. On October 16, 2023 Council directed staff to prepare an application for CDBG funding under the 2023 NOFA for the Storm Drain Project Phase III (F Street) in the amount of $1,065,485.

ITEM ANALYSIS
In past years the amount of general administration dollars allowed for each grant was calculated as 7% of the total award amount. This is the amount that was identified in Resolution 2023-72, approved at the October 16, 2023 council meeting. Since then, it has been determined that, for this round of funding, HCD would like for the general RESOLUTION FOR 2023 CDBG NOFA
NOVEMBER 6, 2023
2 administration budget to be calculated at 7% of the total activity amount. As a result, we will need to rescind Resolution 2023-72 and adopt a new Resolution reflecting the new breakdown of activity vs. general administration dollars.

STAFF RECOMMENDATIONS
Staff recommends rescinding Resolution 2023-72 and executing Resolution 2023-76 to reflect the following changes:

Resolution 2023-72
Activity budget: $990,901.10
General Admin budget: $74,583.90
Total: $1,065,485.00
Resolution 2023-76
Activity budget: $995,781.00
General Admin budget: $69,704.00
Total: $1,065,485.00

FISCAL ANALYSIS
The proposed changes to Resolution 2023-72 will result in a decrease of $4,880 in general administration dollars and an increase of $4,880 in construction dollars for the project. Staff is confident that the new budget of $69,704 will be sufficient to cover all necessary general administration duties for this project.

STRATEGIC PLAN ASSESSMENT
This action supports the following Strategic Plan goals:
• Goal 1: Support quality services, community safety, and health to enhance the quality of life and experience of our residents and visitors • Goal 1(A): Enhance collaboration with other agencies and the community to better aid the public
• Goal 1(E): Target economic development improvements that provide additional benefit by enhancing the quality of life for residents
• Goal 2(D): Collaborate with other jurisdictions and nonprofits to maximize regional effectiveness and amplify funding opportunities
• Goal 2(E): Create an environment that is conducive to attracting and retaining strong, sustainable businesses that reflect community needs and culture • Goal 2(F)(9): Expand on the success of grant funding by maximizing utilization of opportunities with corresponding community needs

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: LINDA LEAVER, FINANCE DIRECTOR
DATE: NOVEMBER 6, 2023
SUBJECT: QUARTERLY CASH AND INVESTMENTS REPORT AS OF SEPTEMBER 30, 2023
______________________________________________________________________

RECOMMENDATION
• Receive and file quarterly cash and investments report as of September 30, 2023

BACKGROUND
California Government Code Section 53600 requires timely reporting of local agency investment transactions and portfolio to the agency’s legislative body. The Government Finance Officers Association’s (GFOA) best practice recommendation is for local agencies to periodically report cash and investments to the governing body.

ITEM ANALYSIS
Below is a summary of the City’s cash and investments as of September 30, 2023 (general ledger balances). These totals do not include fiduciary funds that are held by other entities (e.g. trust account held by PARS for the City’s OPEB liability).

Quarterly Cash and Investments Report September 2023
November 6, 2023
2 • Cash
o Petty Cash
The City maintains petty cash in various departments for change drawers and incidental purchases.
o Bank Accounts
Amounts listed are general ledger amounts and reflect activity through September 30, 2023. These amounts include checks that have been written but not yet presented to the bank (outstanding checks) and deposits that have been made but not yet recorded by the bank (deposits in transit). The general ledger balance reflects the City’s balances more accurately than the bank statements of the same date. Transactions are recorded by finance staff during various reconciliation processes which may not all be complete as of the writing of this report. Any final updates are not anticipated to be significant.
▪ US Bank Main – This is the City’s checking account. All cash receipts and accounts payable are processed through this account. Balances fluctuate based on activity and cash flow needs. When funds accumulate that are not immediately
needed for cash flow, they are transferred to LAIF. When Account Balance

3 additional funds are required to meet immediate needs, they are transferred from LAIF into the main checking account.
▪ US Bank Payroll – This is a Zero Balance Account (ZBA). When payroll expenditures (direct deposits, checks, and wire transfers) are presented to the bank, the amount of the expenditure is automatically transferred from the main checking account into the payroll account.
▪ US Bank Savings (CDBG Program Income) – The California Department of Housing and Community Development (HCD),
which administers our Community Development Block Grant (CDBG) strongly suggests using a separate, interest-bearing bank account for Program Income. Interest earned on Program Income is also qualified as Program Income.
▪ US Bank Housing Authority – This account is used to receive funding from the Federal Department of Housing and Urban Development (HUD). Housing Assistance Payments are made from this account. The amount allowed by HUD for
administrative costs is periodically transferred into the City’s main checking account and allocated for costs within the Housing Authority Fund.
▪ US Bank Sewer Fund Capital Reserve – This account was required under the terms of the State Revolving Fund loan. Over a period of 10 years, the City was required to set aside $2,187,700 as a capital reserve. The balance in this account represents the first three years’ contributions plus interest. In October 2017, the City successfully negotiated a contract amendment to the SRF loan, removing the Capital Reserve Requirement. The majority of funds previously held in this account were transferred to the Sewer Fund for an authorized project. The remaining balance is held until needed for a project. ▪ US Bank Water Fund Debt Service Reserve – This account is required under the terms of the Safe Drinking Water loan. The funds will only be available to make the debt service payment should the Water Fund be unable to make payments from its operating account. The debt service reserve will be held in this account until the loan is paid off in 2024. The balance in this account is one year’s debt service plus interest.
o Pooled Cash
With the exception of restricted bank accounts (US Bank Savings, US Bank Housing Authority, US Bank Sewer Fund Capital Reserve, and US Quarterly Cash and Investments Report September 2023
November 6, 2023
4 Bank Water Fund Debt Service Reserve), the City’s cash and investment resources are pooled. The pooling of cash and investments provides several advantages, including better physical custody and control, enhanced investment opportunities, and ease of operations. It also simplifies custody, collection, and disbursements.

It is important to note that the City’s pooled resources include fiduciary, grant, and capital project funds as well as the City’s major operating funds (but not restricted funds). The cash and investment totals represent balances as of a specific date and do not necessarily represent amounts available for future appropriations.

The use of pooled cash allows the City to cover negative cash balances in certain funds internally, rather than borrowing from an external source.

Certain funds – particularly when grant-funded – experience a negative cash balance due to the timing of expenditures and the delay in reimbursement. Instead of using external borrowing to cover these timing issues, the City’s pooled cash covers the negative fund(s) until reimbursed. Typically, the General Fund covers the negative funds.

However, when the negative funds are for very large amounts (for example, large CIP projects), the General Fund alone may not have sufficient cash flow to cover the entire negative balance. Per the City’s Debt Policy, short-term cash flow needs may be covered by one of the enterprise funds if necessary, and interest would be paid to the enterprise fund in that case.
• Investments
o Local Agency Investment Fund (LAIF)
The City is a voluntary participant in the Local Agency Investment Fund (LAIF) that is regulated by California Government Code Section 16429 and managed by the Treasurer of the State of California. Cash is pooled with cash from local agencies state-wide and invested. Each agency has its own account within the pool. Each participating agency has a maximum account limit of $75 million, with no minimum balance, and is permitted to make up to 15 transactions per month. Investments in LAIF are available upon demand, although 24-hour notice is required for withdrawals of $10 million or more. More information about LAIF can be found at their website: http://www.treasurer.ca.gov/pmialaif/laif.asp. o Current Investment Portfolio
The City’s investment portfolio is 100% in LAIF. City staff reviewed this policy with its financial advisor in 2022 and determined the balances invested (less amounts already appropriated for capital improvement projects and other budgeted items) would not warrant the investment fees and administrative overhead required to invest in other vehicles.

Quarterly Cash and Investments Report September 2023
November 6, 2023
5 o Individual Transactions During Quarter
These transactions represent the City’s cash flowing between the checking account and LAIF investment account as cash is needed to fund budgeted items. Note the City typically makes large withdrawals in the first part of the fiscal year from LAIF into the City’s operating cash account to make large annual payments including insurance premiums, pension liability deposits, and loan payments.
o Individual Securities Held
None.
o Realized and Unrealized Gains/Losses and Market Value Although the City does not hold any securities with a maturity over one year, the City does record a Fair Market Value (FMV) adjustment for its investment in LAIF, consistent with GASB 72. This GASB requirement is to provide transparency for the market value fluctuations in investments that are intended to be sold.

Although the City does not sell or intend to sell its investments (which are currently 100% in LAIF) and therefore does not have risk of market losses, we are required to periodically calculate the value of our investments if they were to be sold on a particular date and report that fair market value. The FMV adjustment is calculated quarterly, and the adjustment as of September 30, 2023 was an unrealized loss of $201,131 (or 1.4% of our actual holdings in LAIF on that date). There is no actual (realized) gain or loss as the investments were not sold on that date. There is no actual gain or loss as the investments were not sold. The City receives actual interest earnings from LAIF each quarter. During this reporting period, interest of $139,487 was received in July, representing interest earnings for April – June 2023.
o Return on Investments
The monthly rate in LAIF as of September 30, 2023 was 3.534%, which is a slight improvement over the prior quarter. 6 specifies the two-year Treasury note as a benchmark, which is to be used for reference purposes only. The daily treasury yield for two-year notes on September 29, 2023 was 5.03%.

LAIF administrative cost as of September 30, 2023 was 0.29% of earnings. By law, LAIF administrative costs may not exceed 5% of the quarterly earnings of the fund, unless the 13-week Daily Treasury Bill on the last day of the fiscal year is below 1%, in which case administrative costs may not exceed 8% of quarterly earnings for the subsequent fiscal year.
o Percentage of Portfolio
▪ 100% LAIF
o Compliance Statement
The City’s investment portfolio as of September 30, 2023 is in compliance with the City’s Investment Policy and is meeting the policy objectives of (1) safety, (2) liquidity, and (3) yield.

• Approve and Resolution No. 2023-78, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FY 2023-24

BUDGET OF THE CITY OF CRESCENT CITY

BACKGROUND
The Tsunami Memorial Fountain and monument (bronze artwork) was commissioned by the City in 1965 in memory of the eleven lives lost during the 1964 tsunami. The sculpture was created by the famous artist Bruno Groth (1905-1992).

Originally, water jets sprayed water on the bronze monument and lights from within the pool lit up the display at night. The water was allowed to cascade over the basin ring into a perimeter drain around the exterior of the basin. In the mid-1970s, the perimeter trench drain was removed so the water was recirculated solely within the pond.

Prior to 2006, most likely due to age and maintenance issues, the perimeter drainage trench and lighting was removed and filled in with concrete and the fountain heads were capped. At the direction of the Council at the time, Public Works staff repaired the plumbing and the structure functioned as a fountain for the next decade.

On July 29, 2019, the monument sculpture was severely compromised due to vandalism.

It was immediately removed for safety reasons and stored at the City’s corporation yard.

TSUNAMI MEMORIAL FOUNTAIN REHABILITATION
NOVEMBER 6, 2023
2 Since that time Staff has received direction to perform the engineering design to reinstall the fountain. On April 15, 2023, City staff executed an agreement in the sum of $1,800 with Michael Young for the redesign of the monument foundations.

ITEM ANALYSIS
Resetting the monument first requires welding bronze foundational fittings to affix to the existing concrete foundation. This action has been approved by the Council and is was included ($5,000) in the adopted FY 23-24 budget. This will get the Tsunami monument sculpture back in place prior to the 60th anniversary on March 28, 2024.

In addition to this minimum repair, below are some options with associated budgets that staff evaluated to restore the monument’s water feature and provide an upgrade to the basin’s functionality with the following needed modifications.

1. Plumbing ($8,000)
Installation of the fountain heads in place of present caps, refurbish the circulation pump, adjust the float and return intake elevation, and make any necessary plumbing repairs to return the water feature to functioning status.

2. Electrical ($4,000)
Installation of switching, wiring, etc. as needed to power the circulation pump.

Verify materials are to code. This proposal does not include reinstallation of fountain lighting.

3. Concrete Capping ($18,000)
We propose raising the outside basin wall to bench height to approximately 20 inches. Currently it is too low to sit on comfortably. We will also pour concrete around the perimeter face of the bench wall to smooth the surfacing. Both the top and exterior are irregular in dimension and are too rough for tiling. The interior surfacing will also be veneered with a 4-inch layer of smooth concrete. The smoother surface will be aesthetically pleasing as well as allow the steepened bottom to remain cleaner.

4. Basin Surfacing
- Option 1 Tile Veneer ($14,000)
Harley Munger has volunteered the necessary time for he and his crew to manufacture and place themed images of nature and water on both the outer and bench (top) surface of the basin wall. His work would add an iconic touch to the fountain plaza. The top of the bench seating panels will be separated by bronze “T” angle metal to define the panels and prevent skateboarding and similar damaging activities. The tile veneer budget covers the costs for the clay, glazes, heating elements, cementitious adhesive, the fuel necessary to fire the tiles, and any incidentals required with the process of making and installing the tile panels. - Option 2 – Concrete Form Liner instead of the tile veneer. ($5,000)

TSUNAMI MEMORIAL FOUNTAIN REHABILITATION
NOVEMBER 6, 2023
3 Perform the concrete work as described above, but instead of providing a smooth finish on the face of the basin, use an integral form liner to provide a symbolic wave type pattern.

FISCAL ANALYSIS
The table below details the itemized list of repairs necessary to return the Tsunami Fountain to fully functional operation.

Item Cost
Bronze foundation welding $5,000
Plumbing $8,000
Electrical $4,000
Concrete Capping $18,000
Tile Veneer $14,000
Contingency $4,000
Total $53,000
The FY24 Budget already includes $5,000 for reinstallation of the Tsunami Fountain. The attached resolution if approved with all the options listed above will allocate an additional $48,000 for the repairs / upgrades.

If a concrete form liner is used in lieu of tile veneering, there would be a net $9,000 cost savings resulting in an additional $39,000 needing to be allocated.

The Council could also consider variations of these improvements including just restoring the plumbing / electrical to achieve a functional fountain. An additional $12,000 would be required to just complete that scope of work.

• Select a Mayor and Mayor Pro Tempore to serve for the next year

BACKGROUND
On August 15, 2016, the City Council adopted Resolution No. 2016-28 which established the Mayor’s and Mayor Pro Tempore’s term for a period of one year and specifying the conditions thereof. On even numbered years, at the first Council meeting following a general municipal election, the Council is to select one member for Mayor and one for Mayor Pro Tempore for a term of one year.

Within the Policies and Procedures Manual for the City Council, the duties of the Council and positions of the Mayor and Mayor Pro Tempore are outlined as follows:

Section 3.1 City Council Generally:…..The Council acts as a body, with no single member possessing any more power than any other member. The Mayor and Mayor Pro Tempore do have some ceremonial and administrative functions as described below, but in all aspects of policy establishment, voting, and in other significant areas the members are equals. (CA Gov. Code 40601) Section 3.2 Role of Mayor and Mayor Pro Tempore: The Mayor and Mayor Pro Tempore are chosen annually by a majority vote of the Council. These offices are taken at the beginning of the following meeting. The Mayor shall preside over all meetings of the City Council, and if he or she cannot be present or is unable to act, the Mayor Pro Tempore shall serve as Mayor until such time that the Mayor can be present or is able to act. While the Mayor may make or second any motion, Selection of Mayor and Mayor Pro Tempore

2 and present and discuss any matter as a member of the Council, he or she traditionally speaks and votes last.

3.2.1 Term: At the first regular meeting following a general municipal election, or at the first regular Council meeting in November of odd numbered years, the City Council shall choose one of its members as Mayor and one of its members as Mayor Pro Tempore for a term of one year. (Resolution No. 2016-28) Additionally, the Mayor and Mayor Pro Tempore are authorized signers on any bank or financial institution accounts held by the City, along with the City Manager and Finance Director. Both the Mayor and Mayor Pro Tem attend the agenda review meetings, the week preceding a Council meeting along with the City Manager, City Clerk/Administrative Analyst, and City Attorney. The Mayor also makes appointments to boards, commissions, and committees, with Council approval, and signs all documents that require an official signature unless the City Manager has been authorized to sign such documents.

The selection of Mayor is traditionally chosen first with the Mayor Pro Tempore being chosen second. Staff suggest the following nomination / selection procedure:

1. Nominations for Mayor: Any member of the Council may nominate any sitting councilmember to serve as Mayor. Said nominated councilmember shall either accept or decline the nomination. Once all nominations have been made, the then presiding Mayor shall announce that nominations are closed and the names of those councilmembers that have accepted their nomination.

2. Appointment of Mayor: Any member of the Council may then make a motion to appoint any one of the nominees as Mayor. Standard motion procedures apply (see below).

3. Nominations for Mayor Pro Tempore: Any member of the Council may nominate any sitting councilmember to serve as Mayor Pro Tempore except the member chosen to serve as Mayor. Said nominated councilmember shall either accept or decline the nomination. Once all nominations have been made, the then presiding Mayor shall announce that nominations are closed and the names of those councilmembers that have accepted their nomination.

4. Appointment of Mayor Pro Tempore: Any member of the Council may then make a motion to appoint any one of the nominees as Mayor Pro Tempore. Standard motion procedures apply (see below).
➢ Standard Motion Procedures: Rosenberg Rules of Order state that there can be up to three motions on the floor, simultaneously. The rules of order are as follows:

When there are two or three motions on the floor (after motions and seconds) at the same time, the vote should proceed first on the last motion that is made. After discussion and debate, a vote would be taken on the third motion. If this motion passed, no vote would be taken on the first or second motions.

BACKGROUND
During the October 16, 2023 Council meeting, the City Council was in unanimous consensus to place on a future agenda for consideration, a draft letter of support for Israel to be sent to the Consulate General of Israel to the Pacific Northwest.

456 Montgomery St #2100

Honorable Ambassador Marco Sermoneta,
It has been said that silence in the face of great evil is evil. It is with that spirit we send this letter. We, along with the world, were shocked and saddened by the barbaric terrorist attack on October 7, 2023. People that were just trying to live their lives in peace were brutally attacked without provocation. This attack was not only on the people of Israel but on the hearts and spirits of the Jewish people. Premeditated acts of murder, rape and kidnapping directed at innocent people should be forcefully condemned.

Therefore, we, the City Council of the City of Crescent City do adamantly condemn these acts committed by the terrorist organization Hamas. We send our condolences and our prayers to those affected by these atrocities and pray for the safe return of those that were kidnapped. No person should have to fear perpetual acts of violence just because of who they are.

We hope for a quick resolution to the current conflict, but not at the expense of Israel’s safety and security. Please express our support to the people of Israel along with our hope that Israel will be blessed with future peace and prosperity.

Respectfully,
