CITY COUNCIL AGENDA REPORT
TO: MAYOR INSCORE AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: LINDA LEAVER, FINANCE DIRECTOR
DATE: MARCH 4, 2024
SUBJECT: BUDGET-TO-ACTUAL FINANCIAL REPORTS FOR JANUARY 2024 ______________________________________________________________________
RECOMMENDATION
• Receive and file budget-to-actual financial reports of the City’s major operating funds for Fiscal Year 2023-24 as of January 31, 2024
BACKGROUND
In order to provide timely information to the City Council and to the public, the City’s Finance Department has prepared the attached monthly budget-to-actual reports. These reports provide a summary as of January 31, 2024 of the fiscal year-to-date revenues and expenses of the City’s major operating funds: General Fund, Housing Authority Fund, RV Park Fund, Sewer Fund and Water Fund.
ITEM ANALYSIS
As of January 31, 2024, we are 58% through the fiscal year, with 42% of the year remaining. If revenues were received and expenditures made evenly throughout the year, there would be 42% of each budget line remaining. However, revenues and expenditures are not even throughout the year for many reasons. Many revenues are not received evenly throughout the year (particularly tax revenues and grant reimbursements), most expenses are not recorded until the invoice is received in the following month, and budgets may include large projects that have not yet been completed. In addition, many revenues and invoices (expenses) received by the City during July and August have been accrued back to FY 2022-23, which can result in July and August activity appearing to be very low.
This report summarizes the actual revenues and expenditures for the year to date; additional information is provided in the budget-to-actual reports attached. • General Fund
BUDGET TO ACTUAL REPORT – JANUARY 31, 2024
MARCH 4, 2024
2 General Fund revenues show that 49% of the budgeted amount is yet to be received. This is dependent on the timing of when certain revenues are received.
For example, most taxes, third party billings, and grant reimbursements are recorded quarterly. In addition, many revenues received in July and August will be accrued back to Fiscal Year 2022-23. General Fund actual expenditures show that 62% of the budgeted amount is yet to be expended.
• Housing Authority Fund
The Housing Authority is funded by monthly disbursements from the federal government. At this point, actual revenues show 45% remaining to be received and actual expenditures have remaining amounts of 49%.
• RV Park Fund
Revenues collected by the Recreational Vehicle Park (RV Park) show 35% remaining to be collected. RV Park revenues are highly seasonal, and most rental revenues are typically received in the summer months. Actual expenses in the RV Park show 55% of the budget left to be expended.
• Sewer Fund
The Sewer Fund earns revenue primarily from charges to the users of its services.
Actual revenues show 41% of the total revenue budget remaining to be collected.
Operational expenses (not including debt service or capital improvements) show 55% of the budget remaining to be expended.
• Water Fund
The Water Fund earns revenue primarily from charges for service. Actual revenues show 46% of the budget remaining to be collected and 52% of budgeted operational expenses (not including debt service or capital improvements) remaining to be expended.
• Summary
The following table summarizes the actual revenues and expenses for the City’s five major operating funds, not including encumbrances:

3 • Long-term Liabilities
The City’s long-term liability balances are included in the table below. Net Pension Liability, Net OPEB Liability, and Compensated Absences are updated annually during the audit process. These amounts below are from the most recent audit that has been completed (June 30, 2023). The Sewer Fund and Water Fund loan balances are updated when payments are made (in July for the Sewer Fund loan, and in December and June for the Water Fund loan). These do not include interfund balances (amounts owed from one City fund to another).

CITY COUNCIL AGENDA REPORT
TO: MAYOR INSCORE AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: ROBIN ALTMAN, CITY CLERK
DATE: MARCH 4, 2024
SUBJECT: GSRMA BOARD OF DIRECTORS CITY REPRESENTATIVE VOTE
RECOMMENDATION
• Vote for the City of Crescent City to be the city district representative on the GSRMA Board of Directors for the 2024-2026 term
BACKGROUND
The City is a member of the Golden State Risk Management Authority (GSRMA), which provides general liability, auto, and workers compensation insurance to the City. GSRMA members include cities, districts, and counties. The GSRMA Board of Directors is made up of seven members, with at least one from each type of membership (city, fire district, cemetery district, special district, and county). The member agencies vote for agencies to serve on the board. Note the vote is for the agency to send a representative (for example, the City of Crescent City), rather than an individual person. If the agency (city, district, or county) is elected, that agency then determines who to send as its representative on the board.
On February 1, 2024, Golden State Risk Management Authority reached out to their city members to invite them to nominate their cities to potentially fill the city representative position on the GSRMA Board of Directors. Crescent City chose to be nominated, and now the member agencies are called upon to submit their votes for board representation.
The two nominated cities are the City of Crescent City and the City of Orland.
Members of the Board provide governance and oversight to the Authority. In addition, they, and their agency serve as both liaison and example of best practices to the member industry group that they represent. These are important roles that make it beneficial to the Authority to encourage the professional development of board members and their associates in their respective agencies.
GSRMA BOARD OF DIRECTORS
March 4, 2024
2 The length of the term for the GSRMA board position is two years and the term runs from July 1, 2024 through June 30, 2026. The board meetings are bi-monthly starting in July and held in the GSRMA board room in Willows, CA from 6-8 p.m. on the second Wednesday of each meeting month. Remote participation by board members is available.
The Golden State Risk Management Authority Board of Directors makes sure that at least one of the seven positions on the GSRMA board is dedicated to a representative from each of GSRMA’s member types, including: cities, counties, fire districts, cemetery districts and special districts. This insures each member type participation in the governance of the risk pool.
The Board of Directors for GSRMA reviews member services/loss prevention, claims, finance reports, proposed budgets and other administrative business.
If the Council desires to have the City of Crescent City serve on the Board of Directors, the Council needs to vote to do so and direct staff to submit the election form to GSRMA before the deadline of April 15, 2024.

SUBJECT: RFP FOR WASTEWATER SLUDGE COLLECTION, HAULING AND
DISPOSAL FROM THE WASTEWATER TREATMENT PLANT
______________________________________________________________________
RECOMMENDATION
• Authorize the publication of a Request for Proposals (“RFP”) for the collection, transportation, and disposal of the wastewater sludge from the Wastewater Treatment Plant (WWTP).
BACKGROUND
On August 11, 2010, the Del Norte County Solid Waste Management Authority entered into a franchise agreement with Recology Del Norte for solid waste and recyclables collection services for Crescent City and Del Norte County. This agreement provides a provision for the collection, transportation, and disposal of the WWTP sludge. The City also has the option to contract with a non-franchised company to haul and dispose of sludge directly from the Waste Water Treatment Plant.
In 2011, following a competitive procurement, the City Council entered a 10-year contract with Hambro/WSG (#C2496796) for the purpose of collecting, transporting, and disposing of municipal sludge from the City’s WWTP. The base fee was $114.75/ton with an annual increase equal to 85% of CPI-U effective on the first of July each year. Hambro was responsible for the storing of sludge at the WWTP in a container supplied by Hambro and removal on an as-needed basis with sufficient notice.
The Agreement was amended three times to extend its term, most recently through June 30, 2024. The current cost is a base fee of $174.58 per ton, with a 10% ($192.04 per ton) surcharge on weekends, and a 25% (218.23 per ton) surcharge on holidays.
In consultation with the City’s Wastewater Treatment Plant operator, it will be several years before it may be possible to offer a higher quality biosolid (sludge) that could be used for beneficial reuse rather than being disposed at a landfill.
ITEM ANALYSIS
SLUDGE HAULING RFP
MARCH 5, 2024
2 Hambro/WSG has been contracted to perform collection, transportation, and disposal of the WWTP solid waste through June 30, 2024. This RFP will invite all qualified companies to submit proposals for this service beginning July 1, 2024. The agreement will be for an initial term of five years.
All proposing companies are responsible for securing disposal facilities. The City does not independently have an agreement with a landfill to accept City wastewater sludge.
Currently, Hambro/WSG disposes of the sludge at the Dry Creek Landfill in White City, Oregon.
FISCAL ANALYSIS
It is unknown what the fiscal impact will be until a new contract is approved.
STRATEGIC PLAN ASSESSMENT
This action meets the goals and objectives of Strategic Plan Goal 1 “Support quality services and community safety to enhance the lives of our citizens and visitors”, and Goal 2 “Promote a thriving local economy.”

Wastewater Sludge Hauling & Disposal Services
REQUEST FOR PROPOSALS FOR
WASTEWATER SLUDGE HAULING
& DISPOSAL SERVICES
SECTION 1: INTRODUCTION
1.1 PURPOSE OF THE REQUEST FOR PROPOSALS
The City of Crescent City (“City”) seeks to contract with an individual, company, partnership, or other legal business organization (referred to as a “firm”) to provide wastewater sludge hauling and disposal services as described in this Request for Proposals (RFP). The City owns a Class IV Wastewater Treatment Plant (WWTP), which is currently operated by a contractor. The City is looking to award a contract with an initial term of five years (FY 2024-25 through FY 2029-30).
1.2 BACKGROUND INFORMATION
The City of Crescent City was incorporated as a general law city in 1854 and is the only incorporated city in Del Norte County. The City operates under a council-manager form of government. Five city councilmembers are elected at large by the resident voters to serve fouryear staggered terms. The Council selects a mayor for a one-year term from among its members.
Crescent City is located on the northern California coast approximately 20 miles south of the Oregon border. The town is a popular stopping point for tourists driving along the northern California Coast or visiting the Smith River National Recreational Area and the Redwood National and State Parks. Crescent City is also known for its commercial and recreational ocean fishing.
Besides tourism, major industries in the region include agriculture, timber, fishing, cheese production, micro-brewing, and the Pelican Bay State Prison. The mission of the City of Crescent City is to promote high quality leadership, services, and life to our residents, businesses, and visitors by providing efficient, innovative, and economically sound municipal services. The City owns and operates many facilities, which include a wastewater treatment plant, sewer collection facilities, water distribution facilities, including a well, chlorination building, water tanks, and piping infrastructure, a public swimming pool, fire station, police station, Housing Authority, a Public Works service yard, parks and recreation facilities, street infrastructure, and an administrative office facility.
The City’s WWTP serves approximately 3,800 sewer connections. During pre-discharge treatment, wastewater sludge is separated out using sedimentation and filtration processes. The sludge is then sent to a series of digesters where it is further broken down to a Class C product. The sludge is then processed through a belt press to approximately 18-20% solids prior to leaving the plant.
City of Crescent City RFP NO. 2024-WWSL P a g e 2 | 10
Wastewater Sludge Hauling & Disposal Services
Currently, the sludge that comes off the belt press drops into a 20 cubic yard dumpster bin that needs to be emptied 2-3 times per week in the winter and up to once per day in the summer.
Alternatively, the sludge could be dropped directly into a dump truck for reduced transfer handling.
The treatment process also separates grit and screenings that need to be disposed of as part of this service. The grit and screenings are loaded into 2-cubic yard bins that need to be emptied once a month (winter) and once per week (summer). Cleaning processes throughout the year at wet wells, lift station pumps, sewer lines, etc. also generate solids that are collected at the dewatering/drainage station. These solids are also loaded into 2-cubic yard bins for removal upon request as needed. It is anticipated that the WWTP will produce a total of approximately 1,200 tons of sludge to be disposed of annually.
Currently, the sludge is being hauled by a contractor to Dry Creek Landfill in White City, Oregon.
However, it is the contractor which has secured disposal rights to the landfill and not the City.
Thus, it will be the responsibility of the proposing firm to secure disposal capacity and submit evidence of its ability to dispose of the sludge at an appropriately permitted facility.
1.3 REGISTRATION OF INTERESTED FIRMS
Firms interested in submitting a proposal in response to this RFP are not required but are encouraged to register their firm with the City to ensure that the firm is notified of any subsequently issued interpretations, corrections, or amendments to the RFP. Each such interpretation, correction or amendment will come in the form of an RFP Addendum and will be sequentially numbered. In order to register your firm for notifications, send an email to Dave Yeager at [email protected] and copy Andrew Leighton at [email protected] with the subject line “RFP No. 2024-WWSL Statement of Interest” and in the body of the email include the firm’s name, contact person, address, phone number(s) and email address(es). The deadline for firms to register a statement of interest is listed in Section 2.3, “REQUEST FOR PROPOSALS SCHEDULE”.

DAVID YEAGER, DIRECTOR OF PUBLIC WORKS
DATE: MARCH 4, 2024
SUBJECT: DECLARING THE CONTINUANCE OF AN EMERGENCY DUE TO
CONTINUOUS SLIDE ACTIVITY ALONG PEBBLE BEACH DRIVE
__________________________________________________________________________
RECOMMENDATION
• Declare by a 4/5 vote that there is a need to continue the emergency action for the continuous slide activity along Pebble Beach Drive between 7th and 8th Streets per Public Contract code § 22050
BACKGROUND
At the February 5th City Council meeting, the Council declared an emergency pursuant to Public Contract Code Section 22050. This declaration of emergency allows the City to by pass the normal competitive bidding process in order to procure services and contractors to address the emergency; in this case, the continual slide activity that has undermined a section of Pebble Beach Drive between 7th and 8th Streets.
As of the posting of this agenda there are not any additional updates or significant changes in the current emergency. City staff are maintaining communication with Coastal Commission staff regarding permitting and Caltrans regarding funding. As a reminder, the City has applied for Emergency Opening (EO) funding. If approved, EO funding is 100% reimbursable. Once granted the EO funding has to be spent within 270 days. These funds are intended to cover only the immediate costs to stabilize the emergency, reopen the roadway, and provide for public safety. It is not yet guaranteed that EO will be granted.
If granted, the timeline for reimbursement is also not yet known. Staff is continuing to work on funding options for this portion of the repair work.
ANALYSIS
The Public Contract Code requires the City to revisit whether an emergency declaration allowing the City to contract without formal bids is still necessary at each regular meeting.
Pebble Beach Slide Emergency Declaration
MARCH 4, 2024
2 2
It is necessary to continue the emergency action as the slide has yet to be fixed. The City will only be able to complete a “temporary” fix, which itself is complicated by its coastal location. Funding, design and construction will all need to come together in a very short window of time. This window is not enough time to competitively let bids.
FISCAL ANALYSIS
Both the immediate emergency costs and the permanent repair costs are unknown as the scopes of work for both are unknown at this time.

SUBJECT: BEACHFRONT PARK 60% DESIGN PRESENTATION / REVIEW
RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Provide comments / direction to staff and/or consultant team regarding the contents of the 60% Design of Phase 1 of the Beachfront Park General Development Plan
BACKGROUND
The City was awarded $5 million in Statewide Park funding, $3 Million in Rural Recreation and Tourism, and approximately $178,000 in per Capita funding, all funded by Prop 68.
That funding will be used to complete the following features in Beachfront Park: (1) Park Entry at Stamps Way; (2) Bike Park - Pump Track; (3) Tolowa Cultural Interpretive Area with Indigenous Plantings; (4) One Mile Class 1 Trail/Exercise Loop; (5) New ADA Playground; (6) Waterfront Plaza; and (7) an Amphitheater. These funded elements are now referred to as Phase 1 of the overall Beachfront Park Plan.
The City conducted a very robust competitive procurement process to select a team of design professionals to create the final design of the above-described elements of Beachfront Park and to assist with bidding and construction clarifications. On June 20, 2022, the Council approved an agreement with GreenWorks, PC, who best demonstrated the ability to communicate an understanding of both the importance of this project to the community and the City’s vision of creating a shared space inclusive of a multitude of uses that can be enjoyed by everyone that lives and visits here; uses such as recreational opportunities, historical and cultural education and experiences, live entertainment, venues for large and small celebrations or gatherings, etc.
ITEM ANALYSIS
Beachfront Park 60% Design
March 4, 2024
2 The first task in completing this scope of work was for the Greenworks team to develop a General Development Plan (GDP) for the Beachfront Park Area. As stated in the scope of work for the professional services agreement,
“The General Development Plan will set the theme, elements, style, and signage of the Park through a thoughtful consideration of the arc of the region from the Tolowa People through today. The General Development Plan will focus on what the City and key stakeholders define as the desired future visitor experience(s).
This will be done while taking into consideration an assessment of budget allocations prepared previously while also considering the long and complicated history and the changing economy of Del Norte County.”
On February 27, 2023, after multiple site visits, interviews with key stakeholders, and public meetings, the GDP was presented and approved by the City Council and Planning Commission.
The GDP includes a concept layout for the entire 35 acres of Beachfront Park. As stated above, the City was successful in obtain funding for only certain elements of this GDP.
These funded elements now termed “Phase 1” includes the one mile loop, bike pump track, Tolowa interpretive trail, Kidtown playground expansion, waterfront plaza, and amphitheater. Over the past year the Greenworks team has been developing the construction documents (plans, specifications, estimates) for the elements of Phase 1.
The 60% design presentation represents the outcome of this work. Phase 2 will be designed and constructed as a future project. The timeline on phase 2 remains unknown and will likely depend on the success of future grant applications.
FISCAL ANALYSIS
The 60% plan presentation is provided as a check in / informational item to Council. There are no direct fiscal impacts associated with this agenda item. However, staff and the Greenworks team have had several conversation regarding “value engineering” of the various elements to try keep the overall project within the current 100% grant funded project budget. Current estimates show a gap in the estimated construction costs and level of funding. As such the value engineering / scope reduction effort will need to continue as the design progresses. Construction expenses remain a moving target and are a concern that will continue to be evaluated.
Staff has been successful in obtaining additional grants to augment the current project.
Those additional grants / funding sources include the Coastal Stories Grant in the amount $200,000 augmenting the Tolowa Interpretive Walk; the Del Norte Health District funding in the amount $275,000 augmenting the exercise loop and Kid Town accessibility, as well as the Clean California Grant in the amount of approximately $3,000,000 which will build the plazas and entryway in front of the Cultural Center as well as improvements to the S Curve and gateway signage. Staff is also currently working on several other grant / funding sources to try to bridge the funding gap. If additional funding is not obtained additional scope revisions may be needed.

CITY COUNCIL AGENDA REPORT
BACKGROUND
The Fiscal Year (FY) 2023 Assistance to Firefighters Grant (AFG) Program is one of three grant programs that constitute the Department of Homeland Security (DHS), Federal Emergency Management Agency’s (FEMA’s) focus on enhancing the safety of the firefighters and therefore public with respect to fire and fire-related hazards. The AFG Program provides financial assistance directly to eligible fire departments, nonaffiliated emergency medical service (EMS) organizations, and State Fire Training Academies (SFTAs) for critical training and equipment. On January 23, 2024, FEMA released a Notice of Funding Opportunity for the AFG Program. There is a total of $324 million in funding available and the projected number of awards is 2,000 nationwide.
The goal of the AFG Program is to enhance the safety of the public and firefighters with respect to fire and fire-related hazards. The objectives of the AFG Program are to provide critically needed resources that equip and train emergency personnel to recognized standards, outfit responders with compliant personal protective equipment to increase responders’ physical protection against hazards during incident response, provide TO: MAYOR INSCORE AND MEMBERS OF THE CITY COUNCIL

• Direct staff to prepare an application under the Federal Emergency Management Agency’s (FEMA) Assistance to Firefighters Grant (AFG) Program for Self-Contained Breathing Apparatus (SCBA) personal protective equipment in the amount of $467,529.59.
• Approve and authorize the City Manager sign a Memorandum of Agreement between the City of Crescent City and the Crescent Fire Protection District to facilitate a cooperative effort to purchase self-contained breathing apparatus (SCBA) and accessories for Crescent City Fire & Rescue personnel under a FEMA Assistance to Firefighters Grant.
FEMA ASSISTANCE TO FIREFIGHTERS GRANT PROGRAM
MARCH 4, 2024
2 funding to retrofit or modify facilities to protect personnel from known health hazards, acquire emergency response vehicles, design and implement health, wellness and resiliency programs that prepare responders for incident response, enhance operational efficiencies, foster interoperability, and support community resilience.
Applications for this round of funding are being accepted from January 29, 2024 through March 8, 2024 and eligible entities may request up to $1,000,000.
ITEM ANALYSIS
The City has submitted an application for Self-Contained Breathing Apparatus (SCBA) equipment under the AFG Program for the past three years, but due to the competitive nature of the funding source, has not yet been successful in receiving an award. City staff still believes the need for SCBA equipment to be an extremely high priority and well worth the staff time involved in submitting another application this year. Staff has attended FEMA grant workshops and communicated with application review staff to better position our submission.
The personal protective equipment being proposed under this application is a total of 46 Self-Contained Breathing Apparatus (SCBA) sets to cover the 46 firefighters currently on staff. (This is the maximum number of SCBA sets the grant could cover.) Each full set will include a face piece, harness, and two cylinders. Smart charger batteries and chargers are included in the request. In addition to the basic SCBA equipment itself, staff is also requesting funds for Rapid Intervention Team (RIT) rescue SCBAs for the purpose of firefighter rescue scenarios at emergency incidents.
The total for all requested equipment is: $467,529.59
The proposed timeline for this grant is as follows:
Application submittal deadline March 8, 2024
Anticipated award date April 30, 2024 – Sept 30, 2024
Expenditure deadline April 30, 2026
The City will be the grant applicant on behalf of both the City and the Fire District. In order to apply for the grant and share the purchased assets, the FEMA requires the City and Fire Distrct to execute a Memorandum of Understanding (MOU) outlining the rights and responsibilities of each agency with respect to the grant. The Fire District Board approved the attached MOU at their February 27, 2024 meeting.
The terms of the MOU include:
• The City will be the grant applicant and administrator • The District will reimburse the City for 50% of the required match plus a small admin fee to cover City staff’s time spent on the grant application • The City will purchase the equipment, and upon receipt of the District’s share of the match, will turn over half of the equipment to the District (each agency will own half of the assets)
FEMA ASSISTANCE TO FIREFIGHTERS GRANT PROGRAM
MARCH 4, 2024
3 • All of the purchased equipment will be available for the use of Crescent City Fire & Rescue
• Maintenance and repairs of the equipment will be split equally between the City and District
FISCAL ANALYSIS
The Assistance to Firefighters Grant Program requires a 5% grant match or $22,263.31.
The City’ required match will be paid for with previously budgeted Measure S funding.
The City and District will each be responsible for approximately $11,000 (2.5% each) as per the Memorandum of Agreement attached.
STRATEGIC PLAN ASSESSMENT
This action supports the following Strategic Plan goals:
• Goal 1: Support quality services, community safety, and health to enhance the quality of life and experience of our residents and visitors. • Goal 2(E): Create an environment that is conducive to attracting and retaining strong, sustainable businesses that reflect community needs and culture. • Goal 2(F)(9): Expand on the success of grant funding by maximizing utilization of opportunities with corresponding community needs.

• Direct staff to reallocate ARPA funding
• Adopt Resolution No. 2024-16, A Resolution of the City Council of the City of Crescent City Amending the Fiscal Year 2023-24 Budget and Position Control of the City of Crescent City
BACKGROUND
The City Council adopted the Fiscal Year 2023-24 budget at a public hearing on June 5, 2023 by way of Resolution No. 2023-39 and has the authority to amend the adopted budget by resolution when necessary. Staff monitors the City’s budget throughout the year and provides regular reports to the Council comparing budgeted amounts to actual results. After the mid-point of the fiscal year (December 31), staff reviews actual revenues and expenditures during the first half of the fiscal year and makes recommendations for the remainder of the year. This analysis includes budget amendments that have been approved by the Council up to this point as well as new information gathered from staff, outside consultants, and other sources.
Staff presented the FY 2022-23 final results to the Council on January 16, 2024 after the audit was completed and informed the Council the mid-year update for the current fiscal year would be presented in March. The City Manager, Finance Director, and City staff have reviewed the year-to-date revenues and expenses of each fund and are suggesting several revisions to the budget for this mid-year update.
ITEM ANALYSIS
Wages and Benefits
• Wages and benefits have been evaluated across all funds and adjustments have been made to account for vacancies, benefit costs, and other changes FY 2023-24 MID-YEAR BUDGET UPDATE
MARCH 4, 2024
2 year-to-date (including updates for overtime and allocation of staff time to different departments) plus projections for the second half of the fiscal year.
With numerous staff vacancies along with unused benefits, the budget reduction (total of all funds) is approximately ($300,000) or 3% of the total wages and benefits budget for the year.
Significant changes other than the adjustments for wages and benefits are described below. A complete listing of changes along with the totals by fund is attached to this report.
General Fund
• General revenues
o Sales tax – the City contracts with HdL for sales tax consulting. HdL is forecasting an increase in the current year. Staff recommends increasing the budget by $115,000.
o Transient Occupancy Tax – at this time, the first two quarters of TOT have been collected. Actual results for the first two quarters came in higher than budgeted and staff is recommending an increase of $153,000. o Interest revenue – interest revenues since the COVID-19 pandemic had been significantly decreased, and this year’s budget included only a modest amount of interest revenue. Actual results for the first two quarters have come in higher than budgeted, and staff recommends an increase of $53,000.
• Economic Development / Community Support / Grants
o Staff recommends a budget increase of $4,000 for the DNACA concert in the park (during the Forest Moon festival), as approved by the Council in January, plus an increase of $6,668 in materials and supplies, mostly for the Forest Moon festival.
• Human Resources
o There is a reduction in wages and benefits due to a vacancy, offset by an increase in contract services for safety consultant and HR consultant. Some of this is offset by a transfer from the RMAP fund for the safety consultant. • Fire Department
o The Fire Department occasionally sends volunteers to work on fires outside our service area through a process called mutual aid. This is processed in coordination with the Crescent Fire Protection District: the City pays the volunteers and is reimbursed by the District; the District is reimbursed in full by the requesting agency. There is a recommended increase of $48,000 in stipends (plus benefits) with an offsetting revenue for mutual aid. o Other increases are requested for fuel, vehicle repairs (reimbursed by insurance less the City’s deductible), and training, with a reduction in internal service charges.
o The net increase in all expenses is $60,871 with a total revenue increase of $86,061.
• Police Department
o Expenses (not including wages and benefits, which will be reduced as described above) are recommended to increase $7,710 for public outreach, K9 supplies, investigations, and generator maintenance, but offset by a decrease in internal service charges.
FY 2023-24 MID-YEAR BUDGET UPDATE
MARCH 4, 2024
3 • Code Enforcement
o Contract expense will increase $5,940 to account for the amortization of a multi-year computer service contract.
• Planning Department
o A total increase of $16,198 in expenses is mostly related to the REAP grant. • Street Department
o Revenues are projected to decrease ($9,896) due to a decrease in projected gas tax revenue from the State.
o Expenses are projected to decrease for utilities and internal service charges, offset by an adjustment to account for the transfer of $31,000 to the CIP Fund for the initial work on Pebble Beach slide. This may be reimbursed by Caltrans at a later date, but the General Fund will need to transfer the funds until then.
• Parks
o Expenses are recommended to increase a total of $3,202, with a decrease in wages and benefits offset by an increase in contracts for janitorial services and relocating the dog park fence.
• Cultural Center
o Revenue is recommended to increase $10,000 for the Chamber of Commerce’s contribution toward the Cultural Center feasibility study. • Pool
o The original budget for the pool assumed the HVAC and flooring projects would occur this fiscal year, requiring an 8-week closure. The budget reduced revenues and also staffing for part-time lifeguards. These projects are now anticipated to occur in the next fiscal year, so the midyear budget update recommends an increase in revenue of $21,500, an increase in expenses of $35,934, and an increase to the position control for additional lifeguard hours.
Total revenues in the General Fund are projected to increase $434,770, and total expenses will increase $8,407.
General Fund Reserve
o The Council adopted a General Fund reserve policy in 2022 (Resolution No. 2022-47) to require 25% operating reserves, not including grant-funded and capital expenditures, and including an assumption of 5% budget-to-actual savings.
o The total budgeted expenditures including the recommended mid-year changes would be $12,008,510. Of this total, $1,929,445 is for grant-funded and one-time capital projects, which are not included in the calculation of the reserve requirement. The operating budget for calculating the reserve is $10,079,065 which means a 25% reserve requirement of $2,519,766.

o Based on the recommended mid-year budget, the budgeted ending General Fund balance would be $3,253,629 (if all revenues and expenditures come in as budgeted this fiscal year). Per the General Fund Reserve Policy, we assume a conservative 5% budget-to-actual savings on operational expenses, which means a projected ending fund balance of $3,757,582. (Actual expenses have been more than 5% under budget most years, but using a conservative assumption is best practice.)
o Some of the General Fund balance is Measure S funds, which are set aside for Measure S approved activities. The Measure S balance as of June 30, 2023 was $1,141,510. The projected Measure S balance at the end of the current fiscal year is $544,957. This amount will be set aside for future Measure S activities.
o Of the projected fund balance for the end of the current fiscal year, less the required reserve and the Measure S set-aside funds, the remaining unallocated amount is $692,859. The actual reserve amount will depend on actual results of this year’s revenues and expenditures.

Although this is a larger “unallocated” reserve than we have seen in the past, there are several very large projects the City is either currently working on or planning to begin in the near future. One such project is the emergency repair of the slide on Pebble Beach Drive. The emergency repair may ultimately be reimbursed, but that has not been guaranteed at this point. In either case, the City will be required to fund the project up front. If the reimbursement is not awarded, the entire project would have to come out of the General Fund reserve. Staff recommends planning for this unallocated reserve to be set aside for the repair (or to assist with cash flow for the project, even if it is ultimately reimbursed). We do not yet know the cost of the emergency repair, but it will certainly be more than this unallocated reserve.

• Housing Authority Fund expenses are proposed to decrease slightly ($1,388) in various line items.
• The budgeted fund balance on June 30, 2024, if the above recommendations are approved and all revenues and expenditures come in as budgeted, would be $340,621.

• Revenues in the RV Park Fund are proposed to increase by $30,000 in space rent due to the new rate structure approved in February and decrease by ($7,500) in merchandise sales (the logo was only recently approved, and merchandise needs to be ordered), and there is a slight decrease in expenditures of ($609) in various line items.
• Working capital budgeted for June 30, 2024, if these recommendations are approved and revenues and expenses come in exactly as budgeted, would be $433,309. A minimum recommended reserve of 25% of operating expenses would be $150,156. (Additional reserves may be recommended for emergencies, capital improvements, or debt service.)
Sewer Fund
• Revenues are recommended to increase $50,000 in interest revenue, $235,000 in connection fee revenue (based on year-to-date), $1,215 in ARPA funds, and $8,539 in CSA charges for a total increase of $294,754. • Expenses are recommended to decrease ($21,988). There is an increase in the Lab department for equipment purchases and building repairs, offset by decreases in other departments largely due to staffing vacancies. • The only change in the Sewer CIP Fund (which is used for tracking capital improvement projects and is combined with the Sewer Fund on the City’s financials) is to increase interest revenue by $25,000. • Working capital budgeted for June 30, 2024, if these recommendations are approved and revenues and expenses come in as budgeted, would be $2,824,254.
A minimum reserve of 25% of operating expenses would be $1,144,154. (Additional reserves may be recommended for emergencies and capital improvements.)
Water Fund
• Revenues are recommended to increase $38,000 in interest revenue, $85,000 in connection fee revenue (based on year-to-date), and $1,215 in ARPA funds. • Operating expenses are recommended to decrease ($80,551), mostly in staffing vacancies and utilities.
• Transfers expenses are recommended to increase $274,200. A part of this is to the Equipment Fund for equipment replacements ($4,200), while the majority ($270,000) is requested to continue the AMR (Automated Meter Read) project.
This is a multi-year project that is replacing all water meters in the system with auto-read meters. Staff has been working diligently on replacing meters and has installed nearly all the meters we had on hand. Public Works would like to make a FY 2023-24 MID-YEAR BUDGET UPDATE

6 significant purchase to keep this project going. The overall project is not changing; this request is to move purchases that were planned for the next couple of years into this year, to complete the project faster.
• The Water CIP Fund (which is used for tracking capital improvement projects and is combined with the Water Fund on the City’s financials) is projected to increase revenue by $30,000 in interest revenue, with a revenue from the Water Fund of $270,000 and an equal expense to make additional progress on the meter project. • Working capital budgeted for June 30, 2024, if these recommendations are approved and revenues and expenses come in as budgeted, would be $1,854,631.
A minimum reserve of 25% of operating expenses would be $663,037. (Additional reserves may be recommended for emergencies and capital improvements.) Internal Services Funds
• Internal Services Funds (ISF) provide services to other City funds, which reimburse the ISF for their share of the total costs.
• Information Technology – expenses are recommended to decrease ($13,037) for decrease in wages and benefits offset by some increases in parts and contracts.
Revenue would decrease by a matching amount and has been reflected in the other funds’ internal service charge budgets.
• Building Maintenance – net zero with a decrease in wages and benefits due to vacancies offset by an increase in materials.
• Equipment Fund – expenses are recommended to decrease ($31,248) due to staffing vacancies offset with increased parts and equipment purchases. Revenue would decrease by a matching amount and has been reflected in the other funds’ internal service charge budgets.
• Insurance Fund – requested increase of $10,817 to transfer RMAP funds for safety expenses.
Gas Tax and RMRA (SB1)
• Gas Tax Fund is projected to decrease ($9,984), per the updated State budget. • RMRA (SB1 gas tax) is projected to decrease revenue by ($5,658) per the updated State budget and decrease expense by ($962).
General CIP
• Increase revenues by $31,000 to reflect the transfer from the General Fund for the initial repairs authorized for the Pebble Beach slide emergency. This may be reimbursed by Caltrans eventually.
ARPA
• ARPA Fund is recommended to increase transfers by $4,546, representing eligible economic development expenses in other funds that are reimbursed by this funding source.
The American Rescue Plan Act (ARPA) granted the City $1,623,595 in COVID-19 relief funds. Because the City’s allocation is less than $10,000,000, all of it may be used for any government service. The City Council approved the following projects:
FY 2023-24 MID-YEAR BUDGET UPDATE
MARCH 4, 2024
7 • Economic Development $437,204 – staffing and project expenses to expand the City’s economic development efforts. This includes partial funding for two positions (Economic Development / Recreation Director and Grants & Economic Development Coordinator) and some small projects.
• Pool HVAC project $670,158 – partial funding for replacing and upgrading the HVAC system at the swimming pool and adding dehumidification. • Front Street $516,233 – partial funding for the reconstruction of Front Street between G Street and Play Street.
This funding must be obligated (under contract) by December 31, 2024 and fully expended by December 31, 2026. For staffing and small projects without a contract, the deadline for expenditure is December 31, 2024.
The economic development spending has been used for part of FY 21-22, FY 22-23, FY 23-24, and the remainder of that budget will be spent in FY 24-25 prior to the December 31, 2024 deadline.
The pool project and Front Street projects have multiple funding sources including ARPA:

The Front Street project is already partially completed, while the pool project has been designed but is not yet ready to enter a contract. Considering the ARPA deadlines and to streamline the grant reporting process, staff recommends reallocating the ARPA funding from the pool to the Front Street project. The pool project would then be backfilled with some of the General Fund money that had been allocated to Front Street in FY23. This would allow the City to completely spend all ARPA money prior to the deadline and using FY 2023-24 MID-YEAR BUDGET UPDATE
MARCH 4, 2024
8 General Fund dollars for the pool project (instead of ARPA) would provide greater flexibility in bringing that project to fruition.
The new proposed allocations are shown below. Note that only ARPA and General Fund monies are proposed to switch; there is no change suggested for any of the Measure S funds or any of the other grants involved in the Front Street project. The General Fund money was transferred to the CIP Fund in FY23 and will simply be allocated to the appropriate projects. The ARPA funds were received by the City in advance and the City only needs to report to the State once per year how the money was spent.

This is not a budget adjustment, as the total project budgets are not changing; it is simply to realign the ARPA funding to the project that is certain to be completed well in advance of the ARPA spending deadline.

• Approve and adopt Resolution No. 2024-17, A Resolution of the City Council of the City of Crescent City Authorizing the Application for, and Receipt of, Prohousing Incentive Program funds.
BACKGROUND
The primary goals of the California Department of Housing and Community Development (HCD) are to increase the availability of housing statewide and help end homelessness. With the 2019-2020 Budget Act, HCD was able to provide a spectrum of support, incentives, and accountability measures to meet California’s housing goals, including the establishment of the Prohousing Designation Program. The Prohousing Designation Program provides incentives to cities and counties in the form of additional points or other preference in the scoring of competitive housing, community development, and infrastructure programs.
On December 18, 2023, City Council authorized staff to apply for the Prohousing Designation Program and an application was submitted on December 29, 2023. The City’s application has since moved on to the final level of approval and is expected to receive results of the application process by March 15, 2024.
On January 23, 2024, HCD released a Notice of Funding Availability (NOFA) for the second round of the Prohousing Incentive Program (PIP). There will be approximately

2 $9,483,400 available in funding for planning and implementation activities related to housing and community development. The PIP Program was designed to alleviate California’s housing crisis by making additional community development resources available to local governments with Prohousing Designation. The PIP Program rewards local governments with Prohousing Designation with additional funding to accelerate affordable housing production and preservation through a competitive application process.
ITEM ANALYSIS
HCD is currently accepting applications until March 15, 2024 from qualified applicants for this round of the Prohousing Incentive Program. Successful applicants must meet the following threshold requirements:
• Must be a city or county
• Must have a compliant housing element and annual progress reports • Must have a Prohousing Designation
• Must complete the PIP application
• Must be compliant with state and federal housing laws • Must have a resolution authorizing submittal of the application With an official Prohousing Designation, the City will meet all threshold requirements and be qualified to apply for the following amount:
Project Costs $620,000
General Admin $30,000
Total: $650,000
Grant funds may be used for any of the following activities:
1. The predevelopment, development, acquisition, rehabilitation, and preservation of multifamily, residential live-work, rental housing that is affordable to extremely low, very low, low, and moderate-income households, including necessary operating subsidies.
2. Affordable rental and ownership housing that meets the needs of a growing workforce earning up to 120 percent of the area median income, or 150 percent of area median income in high-cost areas.
3. Matching portions of funds placed into local or regional housing trust funds.
4. Matching portions of funds available through the Low and Moderate Income Housing Asset Fund pursuant to subdivision (d) of Section 34176 of the Health and Safety Code.
5. Capitalized reserves for services connected to the creation of new permanent supportive housing, including, but not limited to developments funded through the Veterans Housing and Homelessness Prevention Bond Act of 2014.
6. Assisting persons who are experiencing or at risk of homelessness, including providing rapid rehousing, rental assistance, navigation centers, emergency

3 shelters, and the new construction, rehabilitation, and preservation of permanent and transitional housing.
7. Accessibility modifications.
8. Efforts to acquire and rehabilitate foreclosed or vacant homes.
9. Homeownership opportunities, including, but not limited to, downpayment assistance.
10.Fiscal incentives or matching funds to local agencies that approve new housing for extremely low, very low, low, and moderate-income households.
The City currently has a pipeline of proposed affordable housing projects needing financial gap assistance. City staff sees the Prohousing Incentive Program as an opportunity to provide additional funding to developers seeking assistance with increasing the City’s housing stock and recommends applying for the predevelopment, development, acquisition, rehabilitation, and preservation of multifamily, residential livework, rental housing that is affordable to extremely low, very low, low, and moderateincome households, including necessary operating subsidies.
Since the City has already adopted a very similar plan for the Permanent Local Housing Allocation (PLHA), staff recommends using PIP funds under the same framework. Grant funds would be provided to eligible affordable housing developers in the form of a tenyear deferred loan at 0% interest, with the option of forgiveness after 10 years if affordable housing requirements are met. Affordable housing developers would be selected through a competitive process initiated by a Notice of Funding Availability, with applications reviewed by City staff who will make an award recommendation to the City Council for final approval.
City staff are asking for City Council to authorize an application for up to $650,000 in PIP funding and to adopt the attached resolution. The resolution authorizes the City Manager to sign and execute any further contracts or documents during the grant performance period and states that the City will comply with all grant requirements.
GRANT APPLICATION TIMELINE
Application due March 15, 2024
Award announcements May 2024

FISCAL ANALYSIS
There are no matching funds required for this grant. Grant payments will be made on a reimbursement basis; however, the burden of project costs will fall on the developer, rather than the City. The City will act as a pass-through agency and will only be impacted by the reimbursement of staff time involved in administering the grant.

RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Authorize up to $750 for the Mayor to attend a meeting in San Fransisco with Consul General of Japan, California Senate Leader McGuire, Rikuzentakata, Japan Mayor Sasaki, and other State or Federal representatives on April 10, 2024
BACKGROUND
On March 11, 2011, a magnitude 9.1 earthquake hit eastern Japan, impacting the 24,000-plus residents of Rikuzentakata, Iwate Prefecture. Minutes later, a tsunami more than 30 feet high hit the coastal town, devastating the city’s entire low-lying downtown area. Hundreds of structures were wiped out instantly. Rikuzentakata was one of the areas hit hardest by the quake-tsunami disasters. The effects to Japan were devastating resulting in thousands of lives lost and entire towns being destroyed. Although minor compared to Japan, cities across North and South America were also affected including Crescent City, which endured the complete destruction of the Crescent City Harbor.
On April 7, 2013, a little over two years after the Tohoku earthquake, a lone boat washed up on the shores of Crescent City, California. The boat belonged to a high school in Rikuzentakata, which became the catalyst for the building of a relationship between the communities of Rikuzentakata and Crescent City.
Through the leadership of local students, the boat “Kamome” was cleaned and then returned to Japan. Since that time, four exchanges have taken place with students from Del Norte County traveling to Japan and students from Rikuzentakata visiting Del Norte County. In February of 2017, a formal “Sister School” relationship was signed in Rikuzentakata during a visit by Principal Randy Fugate. Special consultant to the City of Rikuzentakata Amya Miller facilitated on-going dialogue between the communities with the goal of establishing a “Sister City” relationship.
COUNCIL TRAVEL AUTHORIZATION
MARCH 4, 2024
2 In April of 2018, the City of Rikuzentakata sent a delegation consisting of the City’s then Mayor Toba, Chairman, City Council Members, Business Leaders, and Community Members to Crescent City to formally sign a Sister City agreement in Crescent City. In June of 2018 the City, County, and School District, as well as other community partners sent a delegation to reciprocate the signing of the agreement in Japan, as well as provide valuable information to City staff regarding Tsunami emergency management preparedness, response, and recovery.
The COVID pandemic required a pause in our cultural exchanges. In April of 2023, however, the City, in partnership with the Del Norte School District, the Kamome Foundation, the Del Norte County Office of Emergency Services and other community partners, facilitated the 1st Annual Kamome Festival celebrating the 10th anniversary of Kamome arriving on our shores. The Festival included an emergency management awareness event for all 3rd, 4th, and 5th graders, unveiling of the new sister city mural created by local artist Harley Munger, showing of the NBC documentary, as well as a Taiko drum performance. Rikuzentakata sent a delegation of community leaders to attend this event.
ANALYSIS
On April 12 and 13, 2024 the City will be facilitating the 2nd Annual Kamome Festival. This year’s event will again be in partnership with the School District, the Kamome Foundation, the Del Norte County Office of Emergency Services, as well as other community partners. The City of Rikuzentakata will be sending a delegation of nine community leaders to attend this event including their new Mayor Taku Sasaki, City Council Members, City staff, and their Board of Education Superintendent. This year’s event will again include an emergency management awareness event for 4th and 5th grades as well as a Taiko concert coordinated by Del Norte Awareness of Cultural Arts (DNACA) at Elk Valley Casino on Friday (April 12, 2024), and a Sister City celebration event for the public at the Cultural Center on Saturday (April 13, 2024) from 1pm to 4pm, during which there will be local cultural performances, a showing of the documentary, a Taiko performance, and opening / closing statements from local leaders and members of the delegation.
The delegation will be arriving in San Fransisco on April 10, 2024. The Consul General of Japan will be hosting a meeting with select members of the delegation including Mayor Sasaki, California State Senate Leader Mike McGuire, other State and Federal leaders, and has requested Mayor Inscore to attend.
The on-going exchange over the past four years has identified vast similarities between our two communities in areas of topography, climate, population, remoteness, community-mindedness, and vulnerability to tsunamis and other natural disasters. There has been a mutual desire of the parties to strengthen ties of friendship; and to develop collaborative activities and efforts in areas of business, culture, and emergency planning and disaster recovery. The 2017, 2018, 2019, and 2023 visits between our communities moved the Sister City process forward and cemented the bond between our communities. These visits also strengthened the ties that have led to additional partnerships. This trip again proposes to continue these efforts and further Crescent City’s world exposure.
