Mayor Inscore opened the public hearing at 6:57 p.m.

City Manager Wier reported to the Council that the Notice of Funding Availability for the 2024 Community Development Block Grant (CDBG) was just released this past Friday. Under the Overthe-Counter (OTC) category, City Manager Wier proposed submitting an application for another Business Assistance Loan Program, since the last CDBG-funded Business Assistance Loan Program was so successful and oversubscribed. While the Council has already given direction at a previous public hearing for this NOFA, held in October 2023 to proceed with funding for the FRC Food Pantry, it remains a proposed activity and is before the Council once again as one of the competitive applications under the Public Services category. The second activity being proposed under the competitive category would be for a Planning Grant that will execute a Downtown Specific Plan for the purpose of improving economic development. Council Member Schellong asked if any of the funds are eligible to help the empty buildings downtown to help rehabilitate them; City Manager Wier stated that this funding is specifically for the planning of the Downtown Plan, but that the OTC application for the Business Assistance Loan Program could certainly help get new businesses into the empty storefronts.

City Attorney Rice went over the ordinance and the discussions held at previous meetings for its introduction. This will disallow nitrous oxide to be a staple at every convenience store with exception of the businesses that use it for legal purposes such as the food industry, medical offices and automotive shops.

Makenzie Menifee: Manager of a local store, asked what do the regulations mean; only grocery stores and not convenience stores? City Attorney Rice stated that this will make it unlawful to sell nitrous oxide unless it is being used in a food product, dentists’ and doctors’ offices, automotive type work, and restaurants. Cannot be sold to an individual within the City limits; businesses will need to purchase it from a wholesaler.

On a motion by Council Member Wright, seconded by Council Member Feola, and carried on a 4-0 polled vote with Council Member Greenough being absent, the City Council of the City of Crescent City waived full reading, read by title only, and adopted Ordinance No. 845, AN

10/7/24 COUNCIL MINUTES
Planner Lawton explained the amendment of the landscaping standards of the municipal code and what has been recommended to the Council by the Planning Commission. Council Member Feola asked about the 20% requirement for open space on a property and asked if it was excessive; Planner Lawton stated that public comment was given that expressed it was the desire of the community to have more open space for a sense of community and gave the environment they wanted within developments. Mayor Inscore asked if the this applies to low-income housing; Planner Lawton stated that certain development standards can be waived and this is one of them.

Planned unit developments has a 10% open space rule. Mayor Pro Tem Altman supported the decision of the Architectural Review Committee and thought the space could be used for spaces to recreate. Mayor Inscore stated he is concerned with this standard that will only apply for a small amount of people as it is something that has not been required previously. Discussion on the regulations already within the municipal code were held at length.

There were no comments from the public.

On a motion by Mayor Pro Tem Altman, seconded by Council Member Wright and carried on a 3-1 vote with Council Member Feola voting no and Council Member Greenough being absent, the City Council of the City of Crescent City waived full reading, read by title only and introduced Ordinance No. 848, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING CHAPTER 17.43, LANDSCAPING STANDARDS, OF TITLE 17, ZONING, OF THE CRESCENT CITY MUNICIPAL CODE.

CITY COUNCIL AGENDA REPORT

FROM: ERIC WIER, CITY MANAGER
BY: DAVID YEAGER, PUBLIC WORKS DIRECTOR
DATE: OCTOBER 21, 2024
SUBJECT: PEBBLE BEACH DRIVE SLIDE EMERGENCY CONSTRUCTION ______________________________________________________________________

RECOMMENDATION
• Declare by a 4/5 vote that there is a need to continue the emergency action for the continuous slide activity along Pebble Beach Drive between 7th and 8th Streets per Public Contract code § 22050

BACKGROUND
The December 2016 storms caused significant beach cliff erosion within the City along Pebble Beach Drive from Preston Island to Sixth Street. This was evidenced by the visible road cracks indicating loss of road foundation and loss of bluff. By August 2021 the design contractor had achieved 30% plans, and the first Coastal Development Permit (CDP) application was submitted. The resulting increase in scope complexity increased the project cost estimate to $32.6 million. The Damage Assessment Form (DAF) was updated and submitted to FHWA in January of 2022 and was approved by Federal Highways Administration (FHWA) on January 26, 2024. This approval authorizes the City to receive funding from FHWA in the amount of 88.53% of the project costs, and California Office of Emergency Services (CalOES) will reimburse the City for 75% of the remaining amount, leaving the City’s local match responsibility at just under 3%.

On January 14, 2024, during a winter rainstorm, a 75-foot section of the bluff supporting Pebble Beach Drive slid down to the beach between 7th and 8th streets undermining the western (ocean side) bicycle lane. On January 31, 2024, during a subsequent winter rainstorm, a second slide occurred just to the north of the January 14th slide.

On June 21, 2024, Governor Gavin Newsom added Del Norte County to the list of counties that suffered extensive storm damage in March 2024 to include the Pebble Beach slide between 7th and 8th Streets. This action makes the project eligible for Emergency Opening (EO) funds, which can be used for minimizing the extent of the damage, opening the roadway to essential traffic, and to protect the remaining facilities from damage. EO funding is 100% reimbursable and must be spent within 270 days of the event causing the emergency. The City submitted an Initial Damage Estimate (IDE) for this emergency repair to Caltrans in the amount of $6,680,798 for emergency traffic

2 control, remediation of the existing slide, stabilization wall construction, rock slope protection (RSP) at the toe of the wall, and reconstruction of the road section.

Cal Trans Local Assistance and FHWA requested the City close out the existing bank stabilization project and submit a new DAF with the Emergency Opening project (EO) and the remaining permanent repair (PR) project combined. On July 26, 2024 FHWA approved the finalizing of the old DAF in the amount of $925,000 for costs incurred to date and the new DAF in the total amount of $38,477,798. The new DAF includes the remainder of the previously approved PR funding in the amount $31,672,000 and an updated EO amount of $6,805,798. The new total amount of authorized FWHA funding is $39,402,798.

At the July 15, 2024 City Council meeting, the Council adopted Resolution No. 2024-55, declaring an emergency due to the continuous slide activity and the failure of Pebble Beach Drive and authorizing the City Manager to act pursuant to Public Contract Code § 22050. This specific declaration of emergency allows the City to bypass the normal competitive bidding process in order to procure services and contractors to address the emergency; in this case, the continual slide activity that has undermined a section of Pebble Beach Drive between 7th and 8th Streets. Due to the limited time available to complete the repairs, the City does not have sufficient time to complete the standard procurement process of design-bid build and still get the emergency repairs done before the winter storm season.

At the August 5, 2024 City Council meeting, the Council ratified the City Manager’s execution of the Emergency Force Account (EFA) Agreement between the City of Crescent City and Tidewater Contractors, Inc. for construction of a temporary restoration of Pebble Beach from 7th to 8th Street. Additionally on this date, the Council approved Resolution 2024-59 budgeting $3,750,000 for the Emergency Opening contract. Based on preliminary designs the contract signed with Tidewater Contractors, Inc. was for $3,200,000. Of this contract amount, $1,800,000 was budgeted to pay for the engineering and construction services of Access Limited, a specialist wall contractor hired by Tidewater Contractors with City approval.

Since August, both the COWI engineering team and the Access Limited engineers have been finalizing a comprehensive wall design, including wall alignment, wall depth, rock revetment, drainage, and the repaired road alignment. Current wall design has a maximum depth at approximately 33 feet deep, with the maximum depth wall length to be approximately 170 feet. This wall length will provide proper embedment into the existing rock at either end of the walls. Based on this current design, the EFA with Tidewater Contractors was amended by Change Order #1 to a total contract amount of $4,600,000.

ITEM ANALYSIS
Continuation of Emergency
The Public Contract Code requires the City to revisit whether an emergency declaration allowing the City to contract without formal bids is still necessary at each regular meeting.

PEBBLE BEACH DR SLIDE EMERGENCY CONSTRUCTION
OCTOBER 21, 2024
3 It is necessary to continue the emergency action as the slide has yet to be fixed. At the August 5th meeting, the City Council ratified contracts with COWI (design) and Tidewater (construction) to repair the slide. And at the September 16th meeting, the City Council approved Change Order #1 to the Emergency Force Account Agreement with Tidewater Contractors for the increased wall size.

Current Project Status
The contractors have reached a wall bottom elevation of 32 feet below existing road level.

The rock drilled vertical drilled micro-piles have been completed. A reinforced concrete grade beam was installed at the bottom of the wall providing a solid foundation. A permanent reinforced wingwall has been placed with shotcrete to support the existing northern bluff. The behind wall drainage system has been completed, collecting all subsurface waters flowing beneath the roadway and passing it through the permanent “road wall”.

The contractor is currently forming the backside of the permanent wall. The vertical micro piles and the horizontal soil nails are connected to the wall structure with the installation of reinforcing steel to the provide support for the wall. The shotcreting of the permanent wall should continue through the first week of November. As the wall face is constructed in lifts from the ground up, the wall will also be backfilled with a flowable lightweight fill in lifts once a section of wall face has been completed. When the structural wall is completed, the face of wall will then be sculpted with an additional layer of shotcrete that is shaped and stained to resemble existing cliff surfacing. We are anticipating wall construction completion by the third week of November.

With the remaining work consisting of the placement of rock revetment, reconstruction of road section and shoulder, clean-up and erosion control plantings, we are still anticipating a road opening in late January 2025, weather permitting. Staff continues to work with the Coastal Commission on a design strategy to correspond with the requirements of a Coastal Development Permit which will need to be obtained once the emergency prescription is achieved.

Financial Assistance
On September 30, 2024, Governor Newsom signed AB 157, an act to amend the Budget Act of 2024. This bill appropriates $7,999,000 for Crescent City to use toward the Pebble Beach Stabilization Project. These funds will be disbursed through Caltrans by way of a Funds Transfer Agreement. This funding makes this emergency construction project possible as the City does not have the cash resources to pay the contractor $4.6 million and await reimbursement from Emergency Opening Funds (FHWA / Caltrans), which are yet to be funded by Congress.

The Funds Transfer Agreement has been executed by both the City and Caltrans, and the City has submitted an invoice to Caltrans for the full amount of funding. The City will receive the full amount in one payment, which can be used to cash flow the project moving

4 forward. There may be a slight delay between the City needing to pay the first payment to the contractor and receiving this funding, but we anticipate being able to cover the need with internal resources for a short time.

FISCAL ANALYSIS
There is no direct fiscal impact to continuing the emergency. The continuance of the emergency will, however, allow the City to continue to take advantage of the emergency procurement procedures as necessary.

RECOMMENDATION
• Approve and adopt Resolution No. 2024-75, A Resolution of the City Council of the City of Crescent City Approving Amendment No. 1 to the Memorandum of Understanding Between the City of Crescent City and the Crescent City Employees Association
(implements special pay of $5,200/yr for Cross-Connection Control Specialist) • Approve and adopt Resolution No. 2024-76, A Resolution of the City Council of the City of Crescent City Amending the Fiscal Year 2024-25 Budget of the City of Crescent City
($10,000 for consultant services (Freshwater Environmental) to create and implement CCCP)

BACKGROUND
The State Water Board pursuant to authority under the California Safe Drinking Water Act has promulgated regulations establishing standards for backflow protection and crossconnection control in the Cross Connection Control Policy Handbook. The purpose of a Cross-Connection Control Program is to prevent the occurrence of backflow into a drinking water distribution system in order to protect customers from contamination or pollution from any on-site hazards. Properly installed and maintained BPAs, devices or methods provide protection against the threat posed by many conditions typically found on a user’s premise.

The Cross Connection Control Policy Handbook was updated effective July 1, 2024. The City is required to have a Cross-Connection Control Program that meets the requirements of the Handbook. The Cross-Connection Control Program must designate a CrossConnection Control Program Coordinator to be involved in the development of and be

2 responsible for the reporting, tracking, and other administration duties of the CrossConnection Control Program.

In addition, the City is required to have a Cross-Connection Control Specialist that can respond within one hour of receiving a consultation request and whom is also consulted in the creation of the City’s Cross-Connection Control Program. A Cross-Connection Control Specialist must have a cross-connection specialist certification from a State Water Board approved organization.

The City currently has an employee in the Public Works Department who is qualified to serve the City as the Cross-Connection Control Program Coordinator / Cross-Connection Specialist. This certification is not a job requirement for any City classification.

ITEM ANALYSIS
The agreed to Amendment No. 1 to the CCEA Memorandum of Understanding provides that an eligible (properly certified) CCEA employee that is assigned to serve as the City’s Cross-Connection Control Specialist and Program Coordinator will receive $200 per paycheck ($5,200 annually) while serving in this capacity. This is the same amount that the City’s Safety Officer receives. While, the certifications are different, the additional role and responsibilities that the assigned employees take on are similar.

Amendment No. 1 states that this special compensation would be retroactive to July, when the City’s eligible employee began working with our consultant (Orrin Plocher of Freshwater Environmental Services) to develop the Cross-Connection Control Program.

In addition to the Cross Connection Control Specialist, the City is required to develop a Cross-connection Control Plan by July 2025 as well as perform a comprehensive review and update of our Cross-connection Control Hazard Assessment. The City intends to execute an additional task order to our current water regulatory consultant, Freshwater Environmental Services. The Cross-connection Control Plan will become the City’s policy describing the processes necessary to comply with the new regulations. This includes an evaluation of the enforcement authority contained within the Crescent City Municipal Code. The Cross-Connection Control Hazard Assessment will include a reevaluation of cross-connection risk at facilities already equipped with backflow prevention devices. It may also be determined that other facilities connected to the water system may be required to install new backflow prevention devices.

FISCAL ANALYSIS
The addition of the Cross-connection control specialist pay will cost approximately $6,000 per year for the specialty pay and associated benefit costs. Due to vacancies in the Public Works Department, a budget adjustment for the current fiscal year is not necessary at this time.

CROSS CONNECTION CONTROL PROGRAM
OCTOBER 21, 2024
3 To complete the additional consultant support work described above an estimated additional $10,000 will be needed in FY24/25. The attached budget resolution will increase the FY24/25 Water budget to account for this expense. Staff anticipates increases in future annual budgets as well as for on-going implementation and compliance with these new regulations.

SUBJECT: RANNEY COLLECTOR VARIABLE FREQUENCY DRIVE REPAIR ______________________________________________________________________

RECOMMENDATION
• Approve and adopt Resolution No. 2024-77, A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2024-25 BUDGET OF THE CITY OF CRESCENT CITY

BACKGROUND
The City’s current water system was originally developed in 1958. The Ranney Collector removes water from the Smith River aquifer and is the sole source of potable water to the City of Crescent City.

There are three vertical turbine pumps that are utilized to pump water to meet all City water demands and ensure that there is sufficient supply for fire suppression throughout the community. Variable Frequency Drive (VFD) motors were installed in 2011 as an energy efficiency project to replace the single speed motors previously used. VFD electronics require ongoing maintenance and eventual replacement.

On or before March 2022, one of the VFD circuit boards failed and was replaced by Northridge Electric. The City shifted the tank filling strategy to nights, enabling operation of the city water system using the two remaining pumps. Northridge Electric installed the replacement VFD in June 2022. On October 20, 2022, a power outage which affected Del Norte County unfortunately damaged the new VFD due to power spikes when the power was restored. The VFD was again replaced in November 2022. Solomon Electric was hired in February 2023 to conduct a diagnostic study. The results showed that the VFD motor circuit conductors indicated a phase-to-phase and a phase-to-ground fault caused by insufficient insulation. Replacement of the conductors was required to meet manufacturer specifications. In June 2023, new conductors were installed during the replacement of pump #2 in the collector.

RANNEY VFD REPAIR
OCTOBER 21, 2024
2 On August 18, 2023, at 4:20 pm the power to Crescent City was turned off by Pacific Power as a pre-emptive measure due to the Smith River Complex fire which was started on August 15, 2023 due to lightning strikes. The diesel generator installed at the Ranney Control building failed shortly after startup due to an electrical problem in the generator itself. A mobile generator was brought in to supply power for the next 2 weeks until line power was restored.

When the mobile generator was brought on line, only a single VFD was functioning properly. The City hired Northridge Electric to modify the control strategy so that one pump operated on/off and the other ran from the only remaining functional VFD. The system is relying on the two tanks in town to augment the water supply during peak flow times.

ITEM ANALYSIS
In August 2024, one of VFDs was replaced with a VFD that had been purchased previously. A third VFD was repaired and installed by Northridge Electric. However, they were not brought back online until a diagnostic could be performed to determine the root cause of the VFD failures, so that the two non-active VFDs didn’t fail upon startup. In September 2024, Rexel, the VFD provider, sent out a Field Technician who diagnosed faulty circuit boards. The correction was to install positive air ventilation in each of the 3 VFD cabinets resolving the circuit board overheating issue which led to the previous VFD failures. All three VFDs are now installed and operating normally.

FISCAL ANALYSIS
The proposed project is not currently budgeted in the Capital Improvement Program (CIP). Staff recommends funding this project from Water Fund reserves. The cost of the replacement VFD damaged at the time of the fire-based power outage has been submitted as part of an insurance claim to GRSMA for the repair of both the generator and VFDs. Reimbursement for the claim is anticipated based on conversations with GRSMA.

The Community Development Block Grant (CDBG) program is a federally funded program through the Department of Housing and Urban Development (HUD). As a nonentitlement jurisdiction (cities with population less than 50,000 and counties with populations less than 200,000), Crescent City applies for CDBG program funding through the State Department of Housing and Community Development (HCD). HCD receives funding from the federal government and releases a Notice of Funding Availability (NOFA) to invite applications.

The City applied for and was awarded a grant under the 2023 NOFA for street and storm drain improvements along F Street in the amount of $1,065,485. The City also applied for and was awarded a grant under the 2023 NOFA Amendment 1 for storm drain improvements along Front Street in the amount of $3,296,180.

ITEM ANALYSIS
The City has received fully executed grant agreements for both of the approved projects.

In order to accurately track the revenues and expenses, each grant contract should be in a separate fund. Two resolutions attached for Council approval will establish a special revenue fund for each of these contracts.

The third resolution attached for approval will create the budget for each of the projects. 2023 CDBG Grant Awards
October 21, 2024
2 FISCAL ANALYSIS
Creating new funds does not have a direct fiscal impact. There are no matching funds required for these grants, so establishing the budget has no net impact on the City’s budget. These grants are on a reimbursement basis, so the City will pay the project costs and then request reimbursement from the State. This is expected to have an impact on the City’s cash flow and staff is working with the City’s financial advisor to determine the best path forward. This will likely involve a line of credit financing as discussed previously with the Council. Staff anticipates the line of credit will be needed beginning in FY 2025- 26, and the costs associated with the line of credit will be brought to Council for discussion prior to entering into the financing.

STRATEGIC PLAN ASSESSMENT
This action supports the following Strategic Plan goals:
• Goal 1: Support quality services, community safety, and health to enhance the quality of life and experience of our residents and visitors • Goal 2(F)(9): Expand on the success of grant funding by maximizing utilization of opportunities with corresponding community needs
• Goal 3(B): Maintain responsible fiscal management and accountability

ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY

AMENDING THE CRESCENT CITY MUNICIPAL CODE BY ADDING
CHAPTER 17.55, RECREATIONAL VEHICLES TO TITLE 17, ZONING

BACKGROUND
On June 3, 2024, the City Council reviewed and considered an ordinance approved by the Planning Commission that regulates the storage and occupancy of recreational vehicles on private property. At that meeting, the Council expressed that the draft ordinance was too restrictive and the proposed permit fees were too high. In addition, the Council requested staff to report back on the current status of regulations of nearby jurisdictions as well as what is currently allowed under the City’s ordinances for RV parking and occupancy.

On August 5, 2024, staff presented the City Council with the results of a survey of neighboring jurisdictions’ regulations regarding occupancy and parking of recreational vehicles. Staff also presented the City Council with suggestions for regulations based upon discussions up to that point. The Council provided feedback for a draft ordinance to be brought back for further consideration.

On September 3, 2024, the City Council reviewed the draft ordinance and heard a presentation from staff. The Council directed staff to bring back the draft ordinance for

introduction, with the proposed administrative conditional use permit process for the RV permit with an existing building permit for residential construction.

The ordinance was introduced by the City Council at a regular meeting held on September 16, 2024.

ANALYSIS
The ordinance before the City Council for adoption contains the following regulations:

1. Storage of Recreational Vehicles: Recreational vehicles parked or stored on a residential parcel for longer than 72 hours must comply with this section. No permit is required. The residential parcel must have a dwelling unit that has received a certificate of occupancy. Storage is limited to one RV per dwelling unit with a maximum of 2 RVs per residential parcel at a time. Planned Unit Developments are exempt from this limitation. RVs must also comply with the general regulations.

2. Temporary Occupancy of Recreational Vehicles: RVs may be temporarily occupied on a residential parcel with a certificate of occupancy. No permit is required. Such occupancy is limited to 14 consecutive nights and 14 nights total in any 90-day period. Only one RV may be occupied on a residential parcel at a time.

RVs must also comply with the general regulations.

3. Temporary Occupancy of Recreational Vehicles During Construction: A residential parcel with an active residential building permit may obtain a permit for the owner to occupy an RV on the lot. The permit will be an administrative conditional use permit (includes site plan review and CEQA filing). The cost of the permit will be $300 according to the current fee schedule. Occupancy is limited to one RV on a residential parcel at a time. RVs must also comply with the general regulations.

4. General Regulations for Recreational Vehicles: RVs must be parked at least 5 feet from lot lines and structures. This space must be kept clear of trash, clutter, debris and vegetation. RVs must not be parked within utility easements or the public ROW. RVs must be level and stable when parked. All RVs must remain operational, mobile, registered with the DMV, and maintained in such a manner as to not constitute a visual blight or public nuisance. Only fitted covers designed for RVs may be used to cover the RV. Any electrical connection to an RV must be in compliance with the Electrical Code. If the RV is occupied, provisions must be made for safe and legal disposal of wastewater from sinks, showers, and toilets.

Every occupied RV must have an operable smoke alarm and fire extinguisher.

Written permission of property owner to park, store or occupy the RV is required.

If adopted at this meeting, the ordinance will be effective 30 days following adoption.

ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING CHAPTER 17.20, C-1 DOWNTOWN BUSINESS DISTRICT, OF TITLE 17, ZONING, OF THE CRESCENT CITY MUNICIPAL CODE

BACKGROUND
On September 5, 2023, the City Council adopted the 6th cycle Housing Element by Resolution No. 2023-64. There are two programs that reevaluate the City’s Municipal Code regarding Affordable Housing:

P‐1 Downtown Mixed-Use and RHNA Sites. Promote infill and rehabilitation in the downtown core (C-1) in three parts:

1. Amend zoning code to permit multi-family residential in a mixed-use project byright (subject to Site Plan and Architectural Review). Amend zoning code densities in the RP, C-1, and CW to be consistent with the General Plan.

2. Amend zoning code to reduce parking requirements for the C-1 zone.

3. Revise the existing Site Plan and Architectural Review section to list objective design standards and ministerial review for certain types of housing development projects in the C-1 district, thereby reducing the need to obtain approval from the

2 Planning Commission. These zoning code amendments will increase the availability of sites for residential development in Census Tract 1.01, which contains the City’s downtown core.

During the current planning period, it is projected that these rezoning actions could result in the development of a minimum of 25 additional multi-family residential units.

P-22 Lower Income and Supportive Housing. A five-part program:

1. Single Room Occupancy Units (SROs). Allow SROs, as principally permitted in the High Density Residential (R-3), Residential-Professional (RP), Business Commercial (C1) and Commercial Waterfront (CW) zones.

2. Manufactured housing/Mobile homes. Allow and define manufactured housing and mobile homes in the same manner and in the same zone as conventional or stickbuilt structures are permitted (Government Code Section 65852.3).

3. Promote development of low and extremely low-income housing and housing for targeted special needs groups with an applicant proposing multi-family developments. Ensure that development for or including low- and extremely lowincome or special needs receive priority processing. Ongoing, throughout the planning period as projects are proposed.

4. Amend the Zoning Code and permit procedures to allow group homes of seven or more persons in all residential zone districts with objective standards to promote approval certainty similar to other residential uses of the same form and consistent with State law and fair housing requirements.

5. Update standards and zoning related to transitional and supportive housing for compliance with AB 2162 (Government Code section 65651). Specifically permitting supportive housing without discretion in multi-family zones and nonresidential zones permitting multi-family uses.

Ordinance No. 846 was introduced at the City Council meeting held September 16, 2024.

ANALYSIS
In addition to the revisions based upon achieving compliance with the Housing Element and State law, staff and the planning commission updated the language of the chapter for clarification and consistency.

The updates included in the draft ordinance will achieve the following:
• Promote Mixed-Use.
• Add reference to Site Plan and Architectural Review.
• Expand Uses to include broad terms.
• Add special uses under Use Permit.
• Add performance standards.

If the ordinance is adopted, it will be effective 30 days following adoption.

SUBJECT: CLEAN CALIFORNIA LOCAL GRANT - CRESCENT CITY CULTURAL GATEWAY AND BEAUTIFICATION PROJECT – GATEWAY ELEMENT

DESIGN OPTIONS

RECOMMENDATION
• Hear staff report

• Receive public comment
• Further Council discussion
• Give direction to staff regarding the concept designs of Highway 101 S Curve / Front Street gateway signage

BACKGROUND
The Clean California Local Grant Program (CCLGP) is a competitive statewide program created to beautify and clean up local streets and roads, tribal lands, parks, pathways, transit centers, and other public spaces.

The City applied for and was awarded $2,988,000 grant funding for the Crescent City Cultural Gateway and Beautification Project, which will be used to improve the public space located at the juncture of US Highway 101 South and Front Street. The project includes establishing a gateway, expanding Beachfront Park beyond US Highway 101 to Front and N Street, cleaning the banks of Elk Creek, improving public access at the Cultural Center/Visitor’s Center and Veteran’s Monument, establishing a designated starting point for the Tolowa Interpretive Walk, and moving the Transit Hub to a safer and more convenient location. (This new location will tie into the future transit hub expansion to be performed by Redwood Coast Transit.)
On June 3, 2024, after advertising and completing the Request for Proposal process, the City Council awarded the design agreement for the above scope of work to Greenworks PC. Greenworks is the lead design consultant for the City’s Beachfront Park improvements and proposed to hire the same team of subconsultants including Stover Engineering (Civil design) and SeaReach (Interpretive Planning / Signage) that are currently working on that project. With this team they are able to maximize efficiencies Clean California Grant – Gateway Element Designs
October 21, 2024
2 and create consistent design themes throughout the Front Street and Beachfront Park Area.

ITEM ANALYSIS
A critical element in Greenworks scope of work is the design of the Gateway Monuments / Wayfinding signs along the intersection of Front Street and Highway 101 (L and M Street). The objective is to help establish a sense of arrival and guide visitors down Front Street to Beachfront Park. Native landscaping berms and design elements are proposed to be complementary with the elements found in the soon to be constructed Beachfront Park. As such the intent is that these features will become visual points of interest, with a sense of context and connection as visitors enter our community.

The Greenworks / SeaReach design team will present two options for Council consideration and direction.

Please be aware time is of the essence for this project as the Clean California Grant stipulates that all funds must be expended by June 30, 2026. The design and acquisition of all necessary permits (Coastal Development and Cal Trans Encroachment / Signage) needs to be complete by February 2025 so the vast majority of the work can be completed during the “good weather” construction window (May – October) of 2025.

FISCAL ANALYSIS
Although the design concepts will have different construction costs, the exact cost estimates will not be known until the concepts are further along in the design process.

The consultant is aware of the overall grant budget and has been tasked with designing the elements to fit within that budget.

CITY COUNCIL AGENDA REPORT

SUBJECT: STAFFING OF BROOKINGS POOL DURING CRESCENT CITY POOL

CLOSURE
______________________________________________________________________

RECOMMENDATION
• Hear staff report
• Technical questions from Council
• Receive public comment
• Further Council discussion
• Give direction to staff to draft an agreement for Council consideration at a future meeting for the City to provide personnel to staff the Brookings Pool during the Crescent City Pool closure (December – February)

BACKGROUND
In early 2024, the City advertised for bid two pool projects, the Fred Endert Pool HVAC Project, and the Fred Endert Pool Deck and Locker Room Flooring Project. On 5/20/24, Council approved Resolution No. 2024-39, and authorized the City Manager to sign contracts with Adams Commercial General Contracting (ACGC) for the HVAC Project, and Specialty Flooring, Inc. for the Pool Deck and Locker Room Flooring Project. These projects have been coordinated to take place during the same shutdown. Tentatively this shut down is scheduled for 12 weeks, with an initial start date of December 2, 2024 and lasting through February 2025.

The Crescent City swimming pool is the only public pool that operates during the winter months in both Del Norte and Curry counties. Brookings, Oregon does have a public outdoor pool that is open during the summer months (Memorial Day through Labor Day).

Recently, the City of Brookings turned over the Brookings pool management and operations to a local non-profit that was formed for that purpose, South Coast Community Aquatics (SCCA). According to SCCA, the City of Brookings is still funding the operations, however SCCA is responsible for conducting all operations including employee hiring, lifeguard training, management, meeting all pool standards, marketing, pool passes/fee collection, etc.

BROOKINGS POOL OPERATIONS
OCTOBER 21, 2024
2 Typically, during the non-summer months, Brookings pool users would have the option of utilizing Crescent City’s indoor pool. However, due to the improvement project, this year that will not be an option, and there will not be an operating pool in either Del Norte or Curry County from December through February.

ITEM ANALYSIS
Due to the lack of a public pool in either County, SCCA approached City staff about the possibility of a partnership to open the Brookings pool during our closure (December, January, February). The concept of their proposal includes the following:
• SCCA would be responsible for all facility related costs including utilities (electricity, propane, chemicals, etc.), supplies, insurance, and facilities / equipment maintenance.
• Crescent City would provide the lifeguards and supervisory staff needed for program operation (and bear the cost).

Pool programing will include a limited schedule that is still being developed and would be mutually agreed upon between the City and SCCA. Programing will include a morning session and afternoon session Monday – Saturday, with the intent to be able to offer lap swimming, exercise, rec swims, and times for the swim team. There is a possibility for swim lessons as well.

Outreach to the community indicates there is demand and a significant user group that would use the Brookings pool during these months. Although winter weather makes an outdoor pool not ideal, there are some public outdoor pools in the region that operate year-round (Coos Bay, Ashland, etc.). SCCA has committed to heating the pool and keeping it at 83 degrees.

City staff have discussed this potential arrangement with the City’s insurer, GSRMA, who did not see any insurmountable issues. However, there may need to be additional insurance coverages obtained to make sure that all liabilities are covered.

FISCAL ANALYSIS
The fee structure for use during this time would remain consistent with our current fee structure. Based on an analysis provided by SCCA 3-month revenues are projected to be approximately $10,000 on the low end and could be as high as $18,000 to $28,000 assuming a medium to high attendance rate. The agreement would provide that all revenues be split evenly between the City and SCCA.

Based on a preliminary program schedule we estimate that staffing will require approximately 2,300 lifeguard hours as well as approximately 900 supervisor hours for the three months. The FY24/25 budget already includes the supervisor labor; however, additional lifeguard hours will be needed as the adopted budget included an assumption that the part-time lifeguards would be temporarily laid off during the closure.

BROOKINGS POOL OPERATIONS
OCTOBER 21, 2024
3 The FY24/25 budget also anticipated only a 2-month closure. However, we now expect a 3-month closure due to the logistics and schedule of completing both the floor and HVAC project. From a financial standpoint this additional length of closure actually saves the City approximately $3,000. If the Council ultimately directs staff to enter into an agreement to operate the Brookings pool, the estimated to increase overall expenses is approximately $37,000 for the three months. When considering the additional revenue, the net cost to the City is estimated to be $32,000.

In order to justify this expense as not a gift of public funds, the City Council must find that staffing an alternative location for City residents to swim while the City pool is closed, is a sufficient public purpose to justify the expenditure.
