CITY COUNCIL AGENDA REPORT
TO: MAYOR INSCORE AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: DAVID YEAGER, PUBLIC WORKS DIRECTOR
DATE: NOVEMBER 18, 2024
SUBJECT: PEBBLE BEACH DRIVE SLIDE EMERGENCY CONSTRUCTION ______________________________________________________________________

RECOMMENDATION
• Hear staff report
• Technical questions from Council
• Receive public comment
• Further Council discussion
• Declare by a 4/5 vote that there is a need to continue the emergency action for the continuous slide activity along Pebble Beach Drive between 7th and 8th Streets per Public Contract code § 22050

BACKGROUND
The December 2016 storms caused significant beach cliff erosion within the City along Pebble Beach Drive from Preston Island to Sixth Street. This was evidenced by the visible road cracks indicating loss of road foundation and loss of bluff. By August 2021 the design contractor had achieved 30% plans, and the first Coastal Development Permit (CDP) application was submitted. The resulting increase in scope complexity increased the project cost estimate to $32.6 million. The Damage Assessment Form (DAF) was updated and submitted to FHWA in January of 2022 and was approved by Federal Highways Administration (FHWA) on January 26, 2024. This approval authorizes the City to receive funding from FHWA in the amount of 88.53% of the project costs, and California Office of Emergency Services (CalOES) will reimburse the City for 75% of the remaining amount, leaving the City’s local match responsibility at just under 3%.

On January 14, 2024, during a winter rainstorm, a 75-foot section of the bluff supporting Pebble Beach Drive slid down to the beach between 7th and 8th streets undermining the western (ocean side) bicycle lane. On January 31, 2024, during a subsequent winter rainstorm, a second slide occurred just to the north of the January 14th slide.

On June 21, 2024, Governor Gavin Newsom added Del Norte County to the list of counties that suffered extensive storm damage in March 2024 to include the Pebble Beach slide between 7th and 8th Streets. This action makes the project eligible for Emergency Opening (EO) funds, which can be used for minimizing the extent of the

PEBBLE BEACH DR SLIDE EMERGENCY CONSTRUCTION
NOVEMBER 18, 2024
2 damage, opening the roadway to essential traffic, and to protect the remaining facilities from damage. EO funding is 100% reimbursable and must be spent within 270 days of the event causing the emergency (March 4, 2024). Per the Caltrans EO funding allocation, this 270-day window closes November 30, 2024.

The City submitted an Initial Damage Estimate (IDE) for this emergency repair to Caltrans in the amount of $6,680,798 for emergency traffic control, remediation of the existing slide, stabilization wall construction, rock slope protection (RSP) at the toe of the wall, and reconstruction of the road section.

Cal Trans Local Assistance and FHWA requested the City close out the existing bank stabilization project and submit a new DAF with the Emergency Opening project (EO) and the remaining permanent repair (PR) project combined. On July 26, 2024 FHWA approved the finalizing of the old DAF in the amount of $925,000 for costs incurred to date and the new DAF in the total amount of $38,477,798. The new DAF includes the remainder of the previously approved PR funding in the amount $31,672,000 and an updated EO amount of $6,805,798. The new total amount of authorized FWHA funding is $39,402,798.

At the July 15, 2024 City Council meeting, the Council adopted Resolution No. 2024-55, declaring an emergency due to the continuous slide activity and the failure of Pebble Beach Drive and authorizing the City Manager to act pursuant to Public Contract Code § 22050. This specific declaration of emergency allows the City to bypass the normal competitive bidding process in order to procure services and contractors to address the emergency; in this case, the continual slide activity that has undermined a section of Pebble Beach Drive between 7th and 8th Streets. Due to the limited time available to complete the repairs, the City does not have sufficient time to complete the standard procurement process of design-bid build and still get the emergency repairs done before the winter storm season.

At the August 5, 2024 City Council meeting, the Council ratified the City Manager’s execution of the Emergency Force Account (EFA) Agreement between the City of Crescent City and Tidewater Contractors, Inc. for construction of a temporary restoration of Pebble Beach from 7th to 8th Street. Additionally on this date, the Council approved Resolution 2024-59 budgeting $3,750,000 for the Emergency Opening contract. Based on preliminary designs the contract signed with Tidewater Contractors, Inc. was for $3,200,000. Of this contract amount, $1,800,000 was budgeted to pay for the engineering and construction services of Access Limited, a specialist wall contractor hired by Tidewater Contractors with City approval.

Since August, both the COWI engineering team and the Access Limited engineers have been finalizing a comprehensive wall design, including wall alignment, wall depth, rock revetment, drainage, and the repaired road alignment. Current wall design has a maximum depth at approximately 33 feet deep, with the maximum depth wall length to be approximately 170 feet. This wall length will provide proper embedment into the existing rock at either end of the walls. Based on this current design, the EFA with Tidewater Contractors was amended by Change Order #1 to a total contract amount of $4,600,000.

NOVEMBER 18, 2024
3 ITEM ANALYSIS
Continuation of Emergency
The Public Contract Code requires the City to revisit whether an emergency declaration allowing the City to contract without formal bids is still necessary at each regular meeting.

It is necessary to continue the emergency action as the slide has yet to be fixed. At the August 5th meeting, the City Council ratified contracts with COWI (design) and Tidewater (construction) to repair the slide. And at the September 16th meeting, the City Council approved Change Order #1 to the Emergency Force Account Agreement with Tidewater Contractors for the increased wall size.

Current Project Status
The contractors have reached a wall bottom elevation of 32 feet below existing road level.

All vertical and horizontal stabilization drilling has been completed. The concrete grade beam foundation has been placed. The behind the wall drainage system has been completed, collecting all subsurface waters flowing beneath the roadway and passing it through the permanent “road wall”.

The contractor has completed forming the backside of the permanent wall. The vertical micro piles and the horizontal soil nails are connected to the wall structure with the installation of reinforcing steel to the provide support for the wall. The shotcreting of the permanent wall has begun and should continue through the third week of November. We anticipate sculpting of the wall face to begin on or around November 20th. This sculpting will include a third layer of shotcrete, which will be shaped and stained to resemble existing cliff surfacing. While the sculpting is occurring, backfilling of the wall can be completed with the flowable lightweight fill. We are anticipating wall construction completion by the end of November.

With the remaining work consisting of the placement of rock revetment, reconstruction of road section and shoulder, clean-up and erosion control plantings, we are still anticipating a road opening in late January 2025, weather permitting. Staff continues to work with the Coastal Commission on a design strategy to correspond with the requirements of a Coastal Development Permit which will need to be obtained once the emergency prescription is achieved.

Financial Assistance
On September 30, 2024, Governor Newsom signed AB 157, an act to amend the Budget Act of 2024. This bill appropriates $7,999,000 for Crescent City to use toward the Pebble Beach Stabilization Project. The City will receive the full amount in one payment, which can be used to cash flow the project moving forward. This funding makes this emergency construction project possible as the City does not have the cash resources to pay the

PEBBLE BEACH DR SLIDE EMERGENCY CONSTRUCTION
NOVEMBER 18, 2024
4 contractor $4.6 million and await reimbursement from Emergency Opening Funds (FHWA / Caltrans), which are yet to be funded by Congress.

FISCAL ANALYSIS
There is no direct fiscal impact to continuing the emergency. The continuance of the emergency will, however, allow the City to continue to take advantage of the emergency procurement procedures as necessary.

The Funds Transfer Agreement has resulted in the City being awarded $7,999,000 in funds to use toward the Pebble Beach Bank Stabilization Project. This funding was recently received by the City and will be used for cash flow and any project costs not covered by other funding.

While the EO repair remains ongoing through the 270-day 100% reimbursement period, which concludes on November 30, 2024, the City is billing and is anticipating 100% reimbursement from the Federal Highway Administration. After November 30, the City will bill FHWA 88.53%, and CalOES 75% of the balance, or 8.6025%. The remaining

2.8675% of incurred expenses will be paid utilizing the $7,999,000 funding through AB157.

When the reimbursements are received from the FHWA and CalOES, they will be returned to the working capital account for the Pebble Beach Stabilization Project, as described in the FHWA approved DAF. These funds will remain available to the City through June 30, 2030, and may be used for repair costs associated with road damage on Pebble Beach Drive as described in the DAF from Sixth Street to the City Limit on Pebble Beach Drive just north of Ninth Street.

HOUSING AUTHORITY BOARD AGENDA REPORT
TO: CHAIR INSCORE AND MEMBERS OF THE BOARD
FROM: ERIC WIER, CITY MANAGER
BY: MEGAN MILLER, HOUSING DIRECTOR
DATE: NOVEMBER 18, 2024
SUBJECT: 2025 UTILITY ALLOWANCE SCHEDULES
______________________________________________________________________

RECOMMENDATION
• Approve and authorize the 2025 utility allowance schedules for the HCV program.

BACKGROUND
Under the HCV program, the total tenant payment of rent includes both shelter and the costs for reasonable amounts of utilities which are not supplied by the owner. The amount that a PHA determines necessary to cover the tenant’s reasonable utility costs is called the utility allowance. Separate schedules are maintained for single family detached (house) rental units and apartment/townhouse/duplex units.

The utility allowance schedule is based on the typical cost of utilities and services paid by energy-conservative households that occupy housing of similar size and type in the same locality. The objective is to establish allowances based on actual rates and average consumption estimates and should provide participating families an allowance that is adequate to cover expected average utility costs and other services over a 12- month period. Non-essential utilities, such as telephone and cable, are not included.

ANALYSIS
The utility allowance schedules are reviewed annually. The review was performed by Nelrod, a company specializing in rate and consumption analysis. Their analysis revealed the following changes:
• ELECTRICITY: Baseline energy rates increased by 9.5% from the values represented in last year’s schedules. The bi-annual California Climate Credit changed from $269 to $174 (45% decrease) which is reflected under the “other electric” values.
• BOTTLE GAS/PROPANE: The cost for propane decreased by 5% from the values represented in the previous year schedules. For the proposed 2025 schedules, the average fuel rate between suppliers Blue Star and Suburban calculates at $5.06 per gallon ($5.33/gallon in previous year schedules). • KEROSENE: The cost for kerosene increased by 6% from the values represented in the previous year schedules and calculates at $4.29/gallon ($4.08 per gallon in previous year schedules).
• WATER/SEWER: No change; rates for the previous year schedule and 2025 schedules are the same.
• GARBAGE: The cost for garbage increased by 5% from the values represented in the previous year schedules. The rate for garbage and recycling collection (64 gallons per month) calculates at $52.48 ($50.17 in the previous year schedules.) Implementation of the revised utility allowance schedules will go into effect immediately for all new admissions and for any participant families moving from one unit to another.

They will otherwise become effective at the time of each participant family’s annual recertification in 2025.

FISCAL IMPACT
Families leasing a unit with a gross rent at or below the payment standard may see a slight increase to their portion of rent where applicable allowances have decreased, and a slight decrease to their portion of rent where applicable allowances have increased.

Families leasing a unit where the gross rent exceeds the payment standard will see no impact.

CITY COUNCIL AGENDA REPORT
TO: MAYOR INSCORE AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
DATE: NOVEMBER 18, 2024
SUBJECT: CLEAN CALIFORNIA LOCAL GRANT - CRESCENT CITY CULTURAL GATEWAY AND BEAUTIFICATION PROJECT – CULTURAL CENTER

ENTRY PLAZA CONCEPT DESIGN
______________________________________________________________________

RECOMMENDATION
• Hear staff report
• Technical questions from Council
• Receive public comment
• Further Council discussion
• Give direction to staff regarding the concept designs of new entry plaza in front of the Cultural Center.

BACKGROUND
The Clean California Local Grant Program (CCLGP) is a competitive statewide program created to beautify and clean up local streets and roads, tribal lands, parks, pathways, transit centers, and other public spaces.

The City applied for and was awarded $2,988,000 in grant funding for the Crescent City Cultural Gateway and Beautification Project, which will be used to improve the public space located at the juncture of US Highway 101 South and Front Street. The project includes establishing a gateway, expanding Beachfront Park beyond US Highway 101 to Front and N Street, cleaning the banks of Elk Creek, improving public access at the Cultural Center/Visitor’s Center and Veteran’s Monument, establishing a designated starting point for the Tolowa Interpretive Walk, and moving the Transit Hub to a safer and more convenient location. (This new location will tie into the future transit hub expansion to be performed by the Redwood Coast Transit Authority.) On June 3, 2024, after advertising and completing the Request for Proposal process, the City Council awarded the design agreement for the above scope of work to Greenworks PC. Greenworks is the lead design consultant for the City’s Beachfront Park improvements and proposed to hire the same team of subconsultants including Stover Engineering (Civil design) and SeaReach (Interpretive Planning / Signage) that are currently working on that project. With this team they are able to maximize efficiencies Clean California Grant – Concept Entry Plaza Designs

2 and create consistent design themes throughout the Front Street and Beachfront Park area.

ITEM ANALYSIS
On October 21, 2024, the Council provided initial feedback and directed staff to perform additional outreach regarding the design of the Gateway Monuments / Wayfinding signs along the intersection of Front Street and Highway 101 (L and M Street). The objective is to help establish a sense of arrival and guide visitors down Front Street to Beachfront Park. Native landscaping berms and design elements are proposed to be complementary with the elements found in the soon to be constructed Beachfront Park. As such the intent is that these features will become visual points of interest, with a sense of context and connection as visitors enter our community. SeaReach and City staff have created an online survey to gather public opinion of the options. This survey is set to close on 11/25/2024, after which the results will be compiled and presented to Council for direction on the preferred concepts on 12/2/24.

Additionally, part of this project’s scope of work is improving public access to the Beachfront Park and Cultural Center. Attached is the proposed concept design for the new Cultural Center entry plaza which aims to accomplish these objectives. The design incorporates three accessible pathways to the plaza, cultural design components including Tolowa basket patterns (located at both the entrance to the Cultural Center and the entrance to the Tolowa interpretive pathway), interpretive visitors information signage, as well as a sense of entry and experience that will match the “S” curve, Front Street, and Beachfront Park improvements. The Tolowa basket patterns shown are in concept only, the final basket pattern design will be informed and directed by the Tolowa Cultural Committee.

Please be aware time is of the essence for this project as the Clean California Grant stipulates that all funds must be expended by June 30, 2026. The design and acquisition of all necessary permits (Coastal Development and Caltrans encroachment / signage) must be complete by February 2025 so the vast majority of the work can be completed during the “good weather” construction window (May – October) of 2025.

FISCAL ANALYSIS
The exact cost estimates of this concept design will not be known until the consultants are further along in the design process. The consultant is aware of the overall grant budget and has been tasked with designing all of the elements to fit within that budget.

CITY COUNCIL AGENDA REPORT
TO: MAYOR INSCORE AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: MARTHA D. RICE, CITY ATTORNEY
DATE: NOVEMBER 18, 2024
SUBJECT: AGREEMENT TO STAFF BROOKINGS POOL DURING CRESCENT

CITY POOL CLOSURE
______________________________________________________________________

RECOMMENDATION
• Hear staff report
• Technical questions for staff
• Receive public comment
• Further council discussion
• Approve and authorize the City Manager to sign the Staffing Agreement between South Coast Community Aquatics, Inc. and the City of Crescent City • Approve and adopt Resolution No. 2024-91, A Resolution of the City Council of the City of Crescent City Amending the FY 2024-25 Budget of Crescent City

BACKGROUND
The City owns and operates the Fred Endert Municipal Swimming Pool, which will be closed for approximately three months (December through February) for a couple of significant maintenance projects. The HVAC Project will replace two boilers that are currently beyond their expected useful life. The boilers are critical as they provide the heat for the building and the water. The HVAC Project will also install air handler units, which will dehumidify the facility resulting in a much more pleasant indoor environment and heating efficiency. The second project includes placing new surfacing on the locker room floors and pool deck. Various other maintenance items will also be addressed while the pool facility is closed to the public, including touching up the mural.

Between Del Norte and Curry counties, the Fred Endert Pool is the only public pool that operates year-round. Brookings, Oregon has a public outdoor pool that is open during the summer months. Recently, the City of Brookings turned over the Brookings pool management and operations to a local non-profit that was formed for that purpose, South Coast Community Aquatics (SCCA). After hearing of the winter closure of Fred Endert Pool, SCCA approached the City about the possibility of using City staff to open up the

BROOKINGS POOL STAFFING AGREEMENT
NOVEMBER 18, 2024
2 Brookings Pool during the closure. This would offer access to an aquatic facility for both Crescent City / Del Norte and Brookings / Curry residents to exercise, recreate, and rehabilitate while the pool in Crescent City is closed.

ITEM ANALYSIS
Under the Staffing Agreement, the City will provide lifeguards and supervisors to staff the Brookings Pool during the months of December through February according to a specific agreed upon schedule. This schedule may be adjusted as necessary and as agreed to by the parties. SCCA will be responsible to pay for all of the non-personnel operational costs – chemicals, maintenance, utilities, etc. All revenue received for utilizing the Brookings Pool will be split evenly between SCCA and the City. The City will receive a payment each month.

The plan is to offer a full array of aquatic activities including lap swim, exercise aerobics, open swim, family swim, swim lessons, and swim team practice. There is also the potential to create additional “events”, however, further vetting is needed prior to implementation. Annual passes for the Fred Endert Municipal Pool will be honored at the Brookings Pool as well as senior passes sponsored by the Del Norte Health Care District.

Both parties will carry insurance to cover their respective liabilities under the Agreement.

FISCAL ANALYSIS
The City anticipates receiving $5,000 in revenue and expending $35,000 (over current budget) for personnel, resulting in a projected additional net expense to the General Fund of $30,000.

STRATEGIC PLAN ANALYSIS
This action supports the following Strategic Plan goals:
• Goal 1: Support Quality Services, Community Safety, and Health to Enhance the Quality of Life and Experience of Our Residents and Visitors

STAFFING AGREEMENT
This staffing agreement (the “Agreement”) is entered into by and between South Coast Community Aquatics, Inc., a nonprofit public benefit corporation organized under the laws of the State of Oregon, referred to herein as “SCCA,” and the City of Crescent City, a municipal corporation governed by the general laws of the State of California, referred to herein as “Crescent City.” SCCA and Crescent City may be individually referred to as a “Party” and jointly as the “Parties.”

RECITALS
A. The City of Brookings, Oregon owns a public outdoor swimming pool located at 1130 Ransom Avenue in Brookings (the “Brookings Pool”), which has historically only been open during the summer months.

B. South Coast Community Aquatics, Inc. is a non-profit organization that has contracted with the City of Brookings to manage the Brookings Pool operations through February 28, 2025 (the “Management Agreement”). The SCCA mission statement is “[t]o provide a year-round community pool that meets the diverse aquatic needs of Brookings and the surrounding communities.”
C. The City of Crescent City owns a public indoor swimming pool that is typically open yearround. The pool is frequented by residents of both Curry County and Del Norte County. The Crescent City pool will be undergoing renovations during the months of December, January and February, during which it will be closed to the public.

D. SCCA approached Crescent City about the possibility of staffing the Brookings Pool with Crescent City lifeguards during the closure of the Crescent City pool. Such an arrangement would be mutually beneficial to the parties as residents of both communities would continue to have an aquatic facility available for recreation, health and fitness, and Crescent City could keep some of its lifeguards employed during the prolonged closure.

AGREEMENT
Now, therefore, for good and valuable consideration, the parties hereto have reached agreement on the following terms and conditions.

1.0 RECITALS. The recitals set forth above, and all defined terms set forth in such recitals and in the introductory paragraph preceding the recitals, are hereby incorporated into this Agreement as if set forth herein in full.

2.0 PURPOSE. The purpose of this Agreement is to define the roles and responsibilities of the Parties as it pertains to the operation and staffing of the Brookings Pool for the months of December 2024, January 2025, and February 2025 during which Crescent City will provide staff to perform facility management and lifeguard duties.

BY: RICHARD GRIFFIN, CHIEF OF POLICE

DATE: NOVEMBER 18, 2024
SUBJECT: DISPATCH AGREEMENT WITH DEL NORTE COUNTY
______________________________________________________________________

RECOMMENDATION
• Hear staff report
• Technical questions for staff
• Receive public comment
• Approve the Agreement for Local Emergency Telephone System Services Between the City of Crescent City and the County of Del Norte • Approve and adopt Resolution No. 2024-92, A Resolution of the City Council of the City of Crescent City Amending the FY 2024-25 Budget of Crescent City

BACKGROUND
The Del Norte Sheriff’s Office (DNSO) has been providing emergency dispatch services to the City pursuant to formal agreement since 2005. The most recently executed agreement has been expired for several years. Last year, the County expressed the need to create an updated agreement and increase the City’s monetary contribution to dispatch services.

As part of its due diligence, City staff explored the idea of obtaining dispatch services from another source, such as Fortuna PD. This could potentially be an option for DNSO as well, as it has had difficulty recruiting and retaining dispatchers for many years.

However, it became readily apparent that based on the City’s call volume, the cost for required equipment upgrades, and additional supervisors, the cost of regional dispatch through Fortuna PD would exceed the City’s proportional cost of DNSO dispatch. Thus, City staff were satisfied that receiving dispatch services through the DNSO was the most beneficial option for the City.

DISPATCH AGREEMENT
NOVEMBER 18, 2024
2 ANALYSIS
City and County staff have worked over the past year to create a new agreement that meets the needs of both parties and equitably shares in the costs of DNSO dispatch services.

The new dispatch agreement provides that the City will pay 25% of the actual costs of dispatch for up to 8 dispatchers. The actual cost is made up of both direct costs and indirect costs. Direct costs include wages, benefits, uniforms, equipment, etc. for dispatchers. Indirect costs include items such as insurance, utilities, supplies, equipment maintenance, building maintenance, and a portion of non-dispatch personnel that provide service to dispatch operations (capped at 25%). This amount will be calculated and invoiced each quarter.

The DNSO currently has 5 dispatchers. Based on current costs, the City’s annual share for dispatchers would be (approximately) as follows:
# of dispatchers Est. City Quarterly Cost Est. City Annual Cost 5 $41,777 $167,108
6 $50,132 $200,528
7 $58,487 $233,948
8 $66,843 $267,372
Prior agreements for dispatch services between the parties specifically included the Crescent City Fire Department. However, the Sheriff insisted on removing the fire department because the DNSO does not have agreement with other fire districts that it provides dispatch services to and he would like to come up with a consistent approach to fire departments. However, Sheriff Scott has also represented that he has no intent to discontinue providing dispatch services to the local fire departments.

The Del Norte County Board of Supervisors approved the agreement at their November 12th meeting.

FISCAL ANALYSIS
The City’s current General Fund budget includes $111,139 for dispatch. The bill for the 1 st quarter of this fiscal year during which the DNSO had 5 dispatchers is $41,777.00.

The DNSO goal is to have 8 dispatchers. They are reported to be in the process of hiring two additional dispatchers. Thus, staff recommends increasing the dispatch budget to a total of $200,528 (2 quarters at 5 dispatchers and 2 quarters at 7 dispatchers). We can adjust this budget again at mid-year, if the two proposed hires do not materialize. This is

DISPATCH AGREEMENT
NOVEMBER 18, 2024
3 an increase of $89,389 over the current budget for dispatch. The City has received a grant from Sutter Coast Hospital that will cover $70,000 of this increased cost (for this fiscal year only). Thus, the City Council is presented with a General Fund budget amendment totaling $19,389 in additional expenses.
