Mayor Altman explained that most paid departments are in bigger cities. He further stated that the Career Captains are funded by Measure S funds.
Sam Strait: asked why certain items are on consent and not for full discussion; challenged the 3- minute public comment period on the consent calendar.

Director Yeager reported to the Council the reason for the need for a four-way stop at 5th and A Street. Currently, it is a two-way stop and there have been accidents there due to the new striping causing some confusion by motorists. This is the only stop sign area on 5th Street. Mayor Pro Tem Wright asked for the timeframe when the 6 accidents happened; City Manager Wier said 2021-2024.
The following residents addressed the Council:
Roger Gitlin: asked for clarification on the 6 accidents if they were minor or major; supports this project. City Manager Wier stated that there were minor injuries in these accidents. 6 | P a g e

DATE: MAY 19, 2025
SUBJECT: MEASURE S OVERSIGHT COMMITTEE APPOINTMENT
_____________________________________________________________________
RECOMMENDATION
• Confirm the Mayor’s appointment of PJ Estlund to the Measure S Oversight Committee
BACKGROUND
On November 3, 2020, the voters of the City of Crescent City approved a 1.0% local transactions and use (“sales”) tax and the City Council has formally adopted the Ordinance. Imposition of the sales tax began April 1, 2021. Ordinance No. 824 provides for the appointment of an oversight committee made up of two non-voting staff members and five voting City resident members. The Ordinance charges the oversight committee with reviewing and publicly reporting on the expenditure of revenues generated by the tax. In addition, the Bylaws for the Committee task it with also advising on the expenditure of anticipated revenues as part of the annual budget process. Committee Members serve two-year terms.
ITEM ANALYSIS
The Mayor has the duty to appoint members to the Committee, subject to the confirmation of the City Council. Committee members must be residents of the City and at least 18 years of age. The committee currently has one vacancy. The City recently received an application from City resident PJ Estlund.
Ms. Estlund was interviewed by Mayor Altman and Chairman Shamblin. Mayor Altman appointed the applicant to serve on the Measure S Committee and is presented to the Council at tonight’s meeting for confirmation. If Ms. Estlund’s appointment is confirmed, there will be no vacancies on the committee. Ms. Estlund’s term will fill a two-year term through December 2027.
FISCAL ANALYSIS
There is no cost to the City to appoint the Measure S Oversight Committee, as its members are volunteers.

SUBJECT: LIST OF PROPOSED LOCAL STREET PROJECTS FOR THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 (SB1)
______________________________________________________________________
RECOMMENDATION
• Adopt Resolution No. 2025-17, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CRESCENT CITY ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2025-26 TO BE FUNDED BY SB1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017
BACKGROUND
On April 28, 2017, Governor Brown signed Senate Bill 1 which is known as the Road Repair and Accountability Act of 2017. The purpose of the bill is to address basic road maintenance, rehabilitation and critical safety needs on the state highway system and local streets. Funds are derived from increases in per gallon fuel excise taxes, increases in diesel fuel sales taxes and increases in vehicle registration fees. In November 2017, the State Controller started depositing various portions of the new funding to the newly created Road Maintenance and Rehabilitation Account (RMRA). The funds are apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code (SHC) Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and road systems.
According to the most recent estimates provided by the California Transportation Commission (CTC) in January 2025, the City of Crescent City will receive $176,626 in RMRA funds during the fiscal year 2025-26. Prior to receiving an apportionment of RMRA funds from the State Controller in a fiscal year, each City and County must submit to the California Transportation Commission a list of projects to be funded with the Local Streets and Roads Funding. All projects proposed to use RMRA funding must also be included in the approved City budget. The approved project list for FY 2025-26 must be adopted by Resolution and submitted to the CTC by July 1, 2025. 5 FY 25/26 RMRA Project List SB 1
` May 19, 2025
2 ITEM ANALYSIS
Staff recommends dedicating the money received each year to design of future projects or to use as an additional funding source for construction projects. Typically, the total amount received is insufficient as a sole funding source to perform major maintenance and repairs but is sufficient for project designs or to augment otherwise funded construction projects
The following carry-over design projects are proposed for listing on the SB1 List for FY 2025-2026:
1. Front Street Storm Drain from G-Street to M Street Design
2. K Street Storm Drain from Front-Street to 2nd Street Design
3. 2
nd Street S-curve from B-Street to A Street Design
4. H Street from Front Street to 5
th Street Design
5. 3rd Street from F Street to L Street Design
6. Pebble Beach Drive Design and Construction from 6th Street to City Limit (north of 9 th Street)
The following new construction project is proposed for listing on the SB1 List for FY 2025- 2026:
1. A Street Construction Project – 2nd Street through Pacific Avenue
2. Front Street Construction Project – Play Street through M Street
3. Northcrest Drive – Construction Project – Highway 101 to Harding Ave In addition, a portion of the RMRA funds (approximately 17%) are required to be passed through to the County based on the Pelican Bay annexation agreement, under which certain population-based revenues including gas taxes are shared with the County.
FISCAL ANALYSIS
The FY 25-26 budget, currently being developed, will include the FY 25-26 RMRA funds and approved projects. The approval of the attached list does not have any direct impact on the budget. Approving the project list simply informs the State of the City’s proposed projects and does not commit the City to spending any particular amount. In addition, the project list may be updated if the City’s priorities change. City staff time for design may be reimbursable.

• Technical questions from Council
• Receive public comment
• Further Council discussion
• Authorize the City Manager to sign and file a Notice of Completion for the Crescent City Beachfront Park Improvements Phase 1A Project (Contract #2024-1056.1)
BACKGROUND
The original Beachfront Park Master Plan was developed through a community input process in 2012 and adopted in 2013. Since that time, several projects have been completed within the park as funding was secured, including the Dog Park, improved beach access via a staircase at Stamps Way and an accessible ramp at Howe Drive West, parking area and picnic area at Howe Drive East, as well as improvements to Kidtown, the Fred Endert Municipal Swimming Pool, and the Cultural Center.
On August 16, 2019, the City Council authorized staff to apply for Coastal Conservancy Grant for $90,000 and on October 17, 2019 the Conservancy approved the award of grant funding to the City of Crescent City to update the Beachfront Park Master Plan.
On March 2, 2020, the City Council approved a contract with PGA design to complete the updated Beachfront Park Master Plan. City staff worked closely with the PGA design team to develop a comprehensive Beachfront Park Master Plan in order to have a competitive Prop.68 grant application ready by March 12, 2021.
On January 14, 2021, PGA design and staff presented the final Beachfront Park Master Plan to the Planning Commission, which approved the plan and determined it to be exempt from California Environmental Quality Act (CEQA). 6 BEACHFRONT PARK PHASE 1A NOTICE OF COMPLETION
MAY 19, 2025
2 On February 2, 2021, staff presented the final Master Plan to the community with the cost estimates for the entire project and the specific break down per feature, key area and phases of larger amenities with the focus being to identify priority projects for the Prop. 68 Statewide Park Development and Community Revitalization Program (SPP) grant application due March 12, 2021 for a total of $8.5 million.
On February 16, 2021, the City Council directed staff to apply for funds available from the Parks and Water Bond Act of 2018 (Proposition 68). (1) Per Capita, for which the funding amount is based on population, (2) Statewide Park Development and Community Revitalization Grant, which is a competitive application for which the City applied for the maximum $8.5 million, and (3) Rural Recreation and Tourism Grant, which is competitive and for which the City also applied for the maximum $3.0 million. (1) The City was granted $177,952 in Prop 68 Per Capita funding, which the Council approved to fund the Paths of Culture project on the west side of the park adjacent to the pool and Tolowa Cultural Interpretive Area.
(2) In December 2021, the City was awarded $5 million in Statewide Park Development that will be used to complete the following features in Beachfront Park: (i) Park Entry at Stamps Way; (ii) Bike Park - Pump Track; (iii) Tolowa Cultural Interpretive Area with Indigenous Plantings; (iv) One Mile Class 1 Trail/Exercise Loop; and (v) New ADA Playground.
(3) On August 18, 2022, the City was awarded $3 million dollars in Proposition 68 RRTP grant funding to complete the amphitheater and waterfront plaza.
On June 20, 2022, GreenWorks, PC was awarded the contract for the Beachfront Park development and design. On February 27, 2023, GreenWorks presented the General Development Plan (GDP) for the Beachfront Park Area with 60% design constituting plans, specifications, and estimates (PS&E) for Phase 1. The plan was approved by the City Council and Planning Commission on March 4, 2024.
Phase 1 of the park development plan contained all of the elements included within the two Prop 68 grants. Phase 1A was created to allow construction to begin within Beachfront Park for areas that were permitted by the Coastal Commission granting of a de minimis waiver. The majority of the Prop 68 park improvements will occur after the City has obtained a Coastal Development Permit in the spring of 2025. Work completed within Phase 1A permitting includes the Bike Pump Track and the western sections of the 1-mile loop trail. The Bike Pump Track was completed in the Fall of 2024 under a separate contract.
On September 12, 2024, the city published a Request for Bids (RFB) for the Beachfront Park Phase 1A Project. Bids were opened on September 30, 2024 at 2:00pm. The City received three bids, of which two were responsive. The apparent low bidder was Tidewater Contractors, Inc. (TWC). On October 7, 2024 the City Council approved the plans and specifications and authorized the City Manager to sign a contract with TWC in the amount of $535,112.

The most significant increases are for streetlights and the water system.
FISCAL ANALYSIS
City staff recommends the following budget adjustments to cover electricity costs for FY 24-25:
Budget Increase
General Fund $36,388
Housing Authority Fund $2,600
Sewer Fund $11,903
7 FY 24-25 BUDGET ADJUSTMENT FOR ELECTRICITY

SUBJECT: TASK ORDER AMENDMENT FOR FY 24-25 SHN PLANNING SERVICES ______________________________________________________________________
RECOMMENDATION
• Approve and authorize the City Manager to sign Task Order 13 Amendment 1 with SHN Consulting Engineers & Geologists for planning services for FY 24- 25 BACKGROUND
As part of the City’s strategic planning workshop in 2019, Council directed staff to move forward with contract planning services to provide basic planning support and technical expertise. The City signed a Professional Services Agreement on February 19, 2019 with SHN Consulting Engineers & Geologists, Inc. Pursuant to that agreement, SHN provided engineering and planning services to the City for the next three years.
Over the course of those three years, SHN performed tasks covering general inquiries, Business Licenses, Sign Permits, Building Permits, Use Permits (including Cannabis Use Permits), and special projects as requested. In anticipation of the contract expiration, the City Council directed City staff to issue a new request for qualifications on February 15, 2022 for City-wide planning and engineering related services. Qualifications were received from 12 engineering, planning, architectural, environmental, and professional services firms. SHN was selected to provide engineering and planning services to the City on an as-needed basis. SHN signed the five-year Agreement for Professional Services on May 30, 2022.
On July 15, 2024 the City Council approved and authorized the City Manager to sign Task Order 13 with SHN for planning services for FY24/25.
On March 3, 2025 the city council approved and adopted Resolution No. 2025-05 which increased the planning budget from $160,000 to $185,000. 8 AMENDMENT TO SHN PLANNING SERVICES
MAY 19, 2025
2 ITEM ANALYSIS
The City continues to require the services of an engineering and planning firm to handle general inquiries, business licenses, sign permits, building permits, and special use permits. SHN has been responsible for these activities for the last five years and City staff have been very pleased with their level of expertise and responsiveness to our communities’ planning needs. SHN has additionally been tasked with planning director and staff services, preparing and facilitating the Planning Commission meetings, ordinance revisions and publication, and application processing.
Task Order 13 Amendment 1 increases the planning support services contract from the not to exceed $160,000.00 to $185,000.00. The fiscal analysis below shows that the planning assistance, inquiries, licenses and permits have been higher than budgeted activities.
FISCAL ANALYSIS
According to the City’s procurement procedure, the City Council approves all contracts exceeding $75,000. The additional funding for this amendment is currently budgeted for FY25 including the mid-year adjustment. Council approval and authorization is required to provide planning services through the end of this fiscal year.

CITY COUNCIL AGENDA REPORT

FROM: ERIC WIER, CITY MANAGER
BY: BRIDGET LACEY, GRANTS AND ECONOMIC DEVELOPMENT MANAGER DATE: MAY 19, 2025
SUBJECT: AGREEMENT FOR DESIGN OF GATEWAY MONUMENTS
____________________________________________________________________________
RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Approve and authorize the City Manager to execute an amendment to the professional services agreement with Greenworks, P.C., to include additional refinement to the gateway features on Front Street.
BACKGROUND
On June 3, 2024, the City Council approved and authorized the City Manager to execute a professional services agreement with Greenworks, PC for the design of all features included in the Crescent City Cultural Gateway and Beautification project, funded by the City's Clean California grant. Key scope tasks included the design of the gateway monuments, landscaping, public art features, Redwood Discovery Center entrance, and Tolowa Cultural Trail entrance. Sea Reach Ltd. was hired by Greenworks to complete the gateway monument designs. These designs received a positive response from the public when presented as a survey in November 2024, capturing more than 500 survey responses, and were approved by council on December 2, 2024.
On December 16, 2024, the City Council approved and authorized the City Manager to execute a professional services agreement with Crandall Arambula, PC for the development of a Downtown Specific Plan.
ITEM ANALYSIS
In early discussions with the design team for the Downtown Specific Plan, it became apparent that there was a need to take a more holistic approach to the gateway design to ensure connectivity, not only with the work that is scheduled to happen downtown, but also citywide. The Crandall Arambula team, which includes a Greenworks designer, proposed a refinement to the existing gateway design that would ensure the goals and objectives of the Downtown Specific Plan effort concerning land use, economic development, multi-modal access, and public realm design concepts are not precluded. Greenworks is now proposing an amendment to their existing Clean CA contract which would allow their design team to explore more design considerations that were out of Sea Reach's scope of work. This would include the following key considerations:
9 GREENWORKS AMENDMENT – GATEWAY REFINEMENT
MAY 19, 2025
2 • How the gateways respond to contextual considerations beyond the Front Street corridor and S-curves, such as how the gateway responds to key actions of the Economic Development Strategic Action Plan, visitor travel patterns, National and State Park headquarters, and Harbor District planning efforts. • How the gateway design can consider design elements to supplement the water, wind, and wave themes of the current design. Identified elements that embrace the City's iconic 'Where the Redwoods meet the Sea' branding should be explored. • How the gateway or elements of the gateway can be replicated for any future gateways that may be identified in the downtown planning effort. • The role that this gateway will play when considering the possibility of having a citywide branding effort in the future which includes city, downtown, and district wayfinding. The intent is to ensure that the Front Street gateway elements serve as a district rather than a downtown gateway.
• How to ensure pedestrian mobility, auto and bus sightlines, handicap parking, and other unresolved issues.
City staff recommend moving forward with the attached scope revision to the Greenworks (Clean CA) contract to include the proposed refinement to the gateway monument designs. All services are estimated to be completed within three weeks of the notice to proceed to stay on schedule for construction before the grant performance period ends on June 30, 2026.
FISCAL ANALYSIS
The total cost for the additional services is $30,350. There are currently sufficient funds remaining in the existing Economic Development budget to cover this cost.
STRATEGIC PLAN ASSESSMENT
This action supports the following Strategic Plan goals:
• Goal 1: Support quality services, community safety, and health to enhance the quality of life and experience of our residents and visitors
• Goal 1(A): Enhance collaboration with other agencies and the community to better aid the public

BACKGROUND
The City has been without a recreation director since Ashley Taylor left the position of Recreation and Economic Development Director in July of 2024. Since that time, the City completed a reorganization which included moving the economic development responsibilities to the Grants and Economic Development Manager, which is filled by Bridget Lacey. The Director of Recreation and Events Coordinator job duties were revised to focus more on recreation, marketing, and community engagement, including overseeing the Fred Endert Municipal Pool, the Lighthouse RV Park, Cultural Center and coordinating City events such as the Kamome Festival, Forest Moon Festival, Fourth of July, Monster Splash, holiday light parade, swim camps and more.
ITEM ANALYSIS
The City conducted an open recruitment to fill the Director of Recreation and Events Coordinator. Three applicants were selected for interviews. The interview panel unanimously recommends Kelly Feola for appointment to fill the role. Ms. Feola has a rich history with the City. Ms. Feola served as a City Council Member from 2006 to 2014 and again from 2023 to 2024. She also served on the inaugural Measure S Oversight Committee from 2021 to 2023.

• Receive the Military Equipment Use 2024 Annual Report • Waive full reading, read by title only and introduce Ordinance No. 856, An Ordinance of the City Council of the City of Crescent City Confirming Approval of the CCPD Military Equipment Use Policy
BACKGROUND
Assembly Bill 481 (AB 481), codified at Government Code sections 7070 through 7075 requires a law enforcement agency (LEA) to obtain approval from the applicable governing body, via adoption of a “military equipment” use policy (the Policy) by ordinance (the Ordinance), prior to the LEA funding, acquiring, or using military equipment. The term “military equipment” includes a variety of law enforcement tools (including less than lethal weapons) that are a component of overall best practices for law enforcement agencies throughout the country. Items deemed to be “military equipment” include, but are not limited to, unmanned aerial or ground vehicles, armored vehicles, command and control vehicles, pepper balls, less lethal shotguns, less lethal 40mm projectile launchers, long range acoustic devices, and flashbangs. Many of these tools are vital to protecting the safety of citizens and officers as they provide peace officers with the ability to safely resolve volatile situations which otherwise might rise to the level of a lethal force encounter.
11 MILITARY EQUIPMENT ANNUAL REPORT
MAY 19, 2025
2 A military equipment use policy must address the following matters for each type of military equipment:
(1) description, quantity, capabilities, lifespan, and manufacturer product descriptions;
(2) the purposes and authorized uses for each type of military equipment; (3) fiscal impact including the initial costs of obtaining the equipment and annual costs of maintenance;
(4) the legal and procedural rules that govern each authorized use; and (5) the training, including any course required by POST, that must be completed before an officer may use each specific type of military equipment.
The policy must also detail the mechanisms to ensure compliance with the policy, including which persons or entities have oversight authority, and, if applicable, what legally enforceable sanctions are put in place for violations of the policy. The policy must also provide procedures by which members of the public may register complaints or concerns or submit questions about the use of each specific type of military equipment, and how the department will ensure that each complaint, concern, or question receives a timely response.
AB 481 also requires an annual report (based on the previous calendar year) detailing the use, costs, and inventory of each type of military equipment listed in the policy as well as the result of any audits and a summary of complaints concerning the military equipment. After submission of the report, the City is required to hold one well-publicized public meeting where the public is invited to ask questions concerning the policy.
Prior to re-authorizing the policy, the City Council must determine that the identified military equipment was used in compliance with the policy.
ITEM ANALYSIS
The Military Equipment Use Policy 2024 Annual report is attached hereto. The specific equipment identified in the policy was only utilized for training purposes in calendar year 2024. As of the close of the calendar year, the drone had not been purchased. The changes proposed to the policy are to add 3 rifles and purchase 3 additional pepper ball guns. The ordinance will serve as the Council’s approval of the policy, which is necessary to be able to use or purchase the equipment described in the policy.

CITY COUNCIL AGENDA REPORT
TO: MAYOR ALTMAN AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
DATE: MAY 19, 2025
SUBJECT: LETTER OF SUPPORT FOR LEGISLATIVE EFFORTS TO PROTECT
THE NORTH FORK SMITH RIVER
______________________________________________________________________
RECOMMENDATION
• Hear a presentation from Grant Werschkull of the Smith River Alliance • Technical questions from the Council
• Receive public comment
• Further Council discussion
• Authorize the Mayor to sign a letter of support for legislative efforts to protect the North Fork Smith River
BACKGROUND
From the National Wild and Scenic Rivers System website (https://www.rivers.gov/river/smith-north-fork) :
• There are 13 miles of the North Fork Smith River in Oregon. Designated as wild and scenic in 1988, the two wild sections extend from the headwaters to Horse Creek and from Baldface Creek to the Oregon/California state line. The portion between Horse Creek and Baldface Creek is classified as scenic. • The North Fork of the Smith River is a relatively low-gradient river, dropping approximately 1,800 feet from an elevation of 2,900 feet in its headwaters in the 12 SMITH RIVER LETTER OF SUPPORT
MAY 19, 2025
2 Kalmiopsis Wilderness to 1,100 feet at the Oregon/California border. The North Fork flows south from the flank of Chetco Peak in the Kalmiopsis Wilderness to its confluence with the Smith River in California, creating one of the best protected river systems in the National Wild & Scenic Rivers System. • The North Fork of the Smith River's fishery, typical of Pacific coastal systems, is dominated by trout and salmon. Winter steelhead and sea-run cutthroat trout are the predominant anadromous species on the North Fork. Some populations of coho, Chinook (both fall and spring run), and summer steelhead are found in the lower reaches of the river, primarily in California. The North Fork provides seven miles of near-pristine steelhead spawning and rearing habitat and is a significant source of the high-quality water on which the anadromous fishery of the Smith River depends.
• The primary recreational attractions in the watershed are the Kalmiopsis Wilderness, Sourdough Camp, and several trails. Sourdough Camp offers excellent dispersed car camping and is located south of the Kalmiopsis Wilderness at the confluence of Bald Face Creek and the North Fork. Sourdough Camp is undeveloped, but there are existing traditionally used sites which should be used to concentrate camping impacts.
• The scenic quality in the river corridor is a result of a combination of the color, geology, water, and vegetation features. Factors contributing to site-specific scenic diversity include large rocks, deep pools, exposed outcrops of peridotite (or serpentinite), a variety of soil types and colors, a variety of plant life (including old growth Douglas-fir), anadromous fisheries, wildlife, and emerald-colored water. • The North Fork Smith River is known for its outstanding water quality and for its ability to clear quickly following storms. Low turbidity and lack of pollutants contribute to the river's excellent habitat and high fisheries value.
ITEM ANALYSIS
Grant Werschkull, Executive Director of Smith River Alliance will give a presentation on his request for this letter of support.
The City has supported legislative efforts in the past that were aimed at protecting the North Fork Smith River, including US Senate Bill 1538, The Smith River National Recreation Area Expansion Act and US House Resolution 980, The Southwestern Oregon Watershed and Salmon Protection Act.

Dear Senators Merkley and Wyden:
The purpose of this letter is to confirm the City’s long-standing support for protection of the headwaters of the North Fork Smith River from the devastating impacts of strip mining and to appreciate your outstanding leadership in advancing related legislation.
As background, the City of Crescent City is one of the largest water purveyors in the bioregion.
Clean drinking water is extremely important to the City, our community, and our visitors. For more than a decade, the City has advocated for the protection of the headwaters of the North Fork Smith River in Oregon. At every opportunity, the City has supported both the Smith River National Recreation Area Expansion Act and the Southwestern Oregon Watershed and Salmon Protection Act (SOWSPA), which has been integrated into Senator Wyden’s ORE Act. The City has also supported other State of Oregon’s measures to protect the North Fork’s headwaters.
The City is grateful for your continued leadership on this critical issue. Protecting the headwaters of the North Fork Smith River and adjacent rivers and streams from the devastating and unacceptable impacts of strip mining is a top priority. This is America’s Wild Rivers Coast and as you’ve heard from across our communities, the health of our rivers and streams is critical to our local economies and our identity. Thank you for your efforts and please know that the City of Crescent City will continue to work with you and our community partners until headwaters protection is secured.
