CITY COUNCIL AGENDA REPORT
TO: MAYOR PRO TEM WRIGHT AND MEMBERS OF THE CITY COUNCIL FROM: ERIC WIER, CITY MANAGER
BY: MARTHA D. RICE, CITY ATTORNEY
DATE: JUNE 2, 2025
SUBJECT: BUDGET AMENDMENT FOR CODE ENFORCEMENT LEGAL
SERVICES
______________________________________________________________________
RECOMMENDATION
• Approve and adopt Resolution No. 2025-20, A Resolution of the City Council of the City of Crescent City Amending the Fiscal Year 2024-25 Budget for the City of Crescent City
• Approve and authorize the City Manager to sign Amendment No. 4 to the Legal Services Agreement with Civica Law Group
BACKGROUND
The City entered into a contract with Civica Law Group in 2023 for code enforcement / nuisance abatement legal services. The City has been working with Civica Law Group’s managing partner Matthew Silver since 2013. Nuisance abatement using the Health & Safety Code receivership process is time-consuming and labor-intensive work. Mr. Silver and his team have become experts in the field. Civica Law Group is currently representing the City in the final stages of the receivership for 200 A Street (former A Street health clinic) and an abandoned residence on W Essex, a newly filed receivership for an occupied residence Margie Street, a potential receivership for another occupied residence, and a building permit dispute that has turned into a lawsuit (city attorney has a conflict of interest due to the location of the subject property).
ITEM ANALYSIS
The contract with Civica Law Group provides an annual budget of $60,000, unless otherwise authorized and amended by the City Council. The current budget and contract under Amendment No. 3 authorize $105,000 for FY 24-25. We are ten months into the fiscal year, and we have exhausted that budget. After discussing the work to be done in the last two months of FY 24-25 with Lauren Brown of Civica Law Group, staff recommend
CODE ENFORCEMENT BUDGET
JUNE 2, 2025
2 authorizing an additional $30,000 to cover services through June 30. This change will require an amendment to the contract and a budget adjustment.
Additionally, staff recommend authorizing $111,000 for FY 25-26. This amount is included in the current draft budget. Again, this dollar amount was achieved after consultation with Civica Law Group upon considering the code enforcement / receivership workload requested by the City for FY 25-26.
FISCAL ANALYSIS
The budget amendment increases expenses in the General Fund by $30,000 for FY 2024-25. The proposed budget of $111,000 for FY 25-26 is included in the draft FY 25- 26 budget. The City will seek recovery of expenses from the parties responsible.
STRATEGIC PLAN ANALYSIS
This item is consistent with the following strategic plan goals:
• Goal 1: Support Quality Services, Community Safety, and Health to Enhance the Quality of Life and Experience of Our Resident and Visitors

SUBJECT: LIST OF PROPOSED LOCAL STREET PROJECTS FOR THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 (SB1)
______________________________________________________________________
RECOMMENDATION
• Adopt Resolution No. 2025-17, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CRESCENT CITY ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2025-26 TO BE FUNDED BY SB1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017
BACKGROUND
On April 28, 2017, Governor Brown signed Senate Bill 1 which is known as the Road Repair and Accountability Act of 2017. The purpose of the bill is to address basic road maintenance, rehabilitation and critical safety needs on the state highway system and local streets. Funds are derived from increases in per gallon fuel excise taxes, increases in diesel fuel sales taxes and increases in vehicle registration fees. In November 2017, the State Controller started depositing various portions of the new funding to the newly created Road Maintenance and Rehabilitation Account (RMRA). The funds are apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code (SHC) Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and road systems.
According to the most recent estimates provided by the California Transportation Commission (CTC) in January 2025, the City of Crescent City will receive $176,626 in RMRA funds during the fiscal year 2025-26. Prior to receiving an apportionment of RMRA funds from the State Controller in a fiscal year, each City and County must submit to the California Transportation Commission a list of projects to be funded with the Local Streets and Roads Funding. All projects proposed to use RMRA funding must also be included in the approved City budget. The approved project list for FY 2025-26 must be adopted by Resolution and submitted to the CTC by July 1, 2025.
FY 25/26 RMRA Project List SB 1
` June 2, 2025
2 ITEM ANALYSIS
Staff recommends dedicating the money received each year to design future projects or to use as an additional funding source for construction projects. Typically, the total amount received is insufficient as a sole funding source to perform major maintenance and repairs but is sufficient for project designs or to augment otherwise funded construction projects
The following carry-over design projects are proposed for listing on the SB1 List for FY 2025-2026:
1. Front Street Storm Drain and Roadway Rehabilitation Project Design
2. 2
nd Street S-curve Design
3. K Street Drainage Improvement and Roadway Rehabilitation Project
4. A Street Construction Project
5. Pebble Beach Design Project
6. Front Street Construction Project
The following new construction projects are proposed for listing on the SB1 List for FY 2025-2026:
1. H Street from Front Street to 5
th Street Design
2. 3rd Street from F Street to L Street Design
3. Northcrest Drive Construction Project
In addition, a portion of the RMRA funds (approximately 17%) are required to be passed through to the County based on the Pelican Bay annexation agreement, under which certain population-based revenues including gas taxes are shared with the County.
FISCAL ANALYSIS
The FY 25-26 budget, currently being developed, will include the FY 25-26 RMRA funds and approved projects. The approval of the attached list does not have any direct impact on the budget. Approving the project list simply informs the State of the City’s proposed projects and does not commit the City to spending any particular amount. In addition, the project list may be updated if the City’s priorities change. City staff time for design may be reimbursable.

______________________________________________________________________
RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Allow the public to voice comments, concerns and ask questions regarding the Military Equipment Use Policy 2024 Annual Report and/or the City’s Military Equipment Use Policy
BACKGROUND
Assembly Bill 481 (AB 481), codified at Government Code sections 7070 through 7075 requires a law enforcement agency (LEA) to obtain approval from the applicable governing body, via adoption of a “military equipment” use policy (the Policy) by ordinance (the Ordinance), prior to the LEA funding, acquiring, or using military equipment. The term “military equipment” includes a variety of law enforcement tools (including less than lethal weapons) that are a component of overall best practices for law enforcement agencies throughout the country. Items deemed to be “military equipment” include, but are not limited to, unmanned aerial or ground vehicles, armored vehicles, command and control vehicles, pepper balls, less lethal shotguns, less lethal 40mm projectile launchers, long range acoustic devices, and flashbangs. Many of these tools are vital to protecting the safety of citizens and officers as they provide peace officers with the ability to safely resolve volatile situations which otherwise might rise to the level of a lethal force encounter.
AB 481 also requires an annual report (based on the previous calendar year) detailing the use, costs, and inventory of each type of military equipment listed in the policy as well as the result of any audits and a summary of complaints concerning the military equipment. After submission of the report, the City is required to hold one well-publicized public meeting where the public is invited to ask questions concerning the policy.

CITY COUNCIL AGENDA REPORT
TO: MAYOR PRO TEM WRIGHT AND MEMBERS OF THE CITY COUNCIL FROM: ERIC WIER, CITY MANAGER
BY: RICHARD GRIFFIN, CHIEF OF POLICE
DATE: JUNE 2, 2025
SUBJECT: RENEWED AXON AGREEMENT
______________________________________________________________________
RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Direct staff to select either Contract Option 1 (for 18 positions) or Contract Option 2 (for 15 positions) and authorize City Manager’s signature on AXON contract
BACKGROUND
In June of 2021, the Council approved a contract with AXON for body cameras, tasers, and evidence storage. That contract is set to expire during this next fiscal year. The reason for switching to the AXON body cameras was due to several issues with the body camera system that the police department had at the time, the Motorola brand (Watchguard) body camera system. The body camera system had issues with the mounting system, battery life, and evidence storage. The Motorola body cameras routinely came unattached from the officer’s outer carry vests during minor struggles with suspects, which resulted in the incident not being recorded and evidence being lost. The Motorola body cameras also had poor battery life and therefore did not make it through an entire 12-hour shift, which resulted in further incidents not being recorded by the officer. The evidence management system of the Motorola body cameras was also insufficient, as it required the officers to make physical downloads of their incidents to DVD’s and then submit them to the District Attorney for review. In most cases that also required our Records Clerk to spend time reviewing each video and then making further copies when requested by the District Attorney’s Office or by members of the public.
Based upon several needs, officer safety, transparency, and liability, a review of several different body camera systems was conducted by Chief Griffin and CCPD staff. CCPD City Council Agenda Report
CCPD AXON agreement
June 2, 2025
2 staff came out of the process with AXON being the number one choice for a new body camera and evidence management system. The contract for the new system was for five years and included technology upgrades for body cameras at two and half year intervals.
The contract included upgraded TASER 7’s for the Officers, as well as technology that allows for live monitoring of critical events. The evidence management system of the AXON body cameras also allowed the District Attorney to have their own login and to be able to review and download videos at any time, increasing our transparency. The contract also came with a virtual reality training program that allows CCPD Officers to train at any time on de-escalation techniques by going through scenarios that are updated and maintained by AXON.
The different body camera programs and CCPD staff opinions were presented to the Measure S committee during several meetings, with the overall recommendation being to sign a five-year contract with AXON for the new body camera system, the TASER upgrades, and the technology upgrades.
Since the contract with AXON started, there have been no reported issues with the systems. Records sharing has been streamlined, camera mounting is no longer an issue for losing evidence footage, and the new body cameras have several built-in activation features that activate recording during critical incidents if the officer is not able to. Staff is recommending continuing with a new AXON contract. If we were to switch to another provider, there would be a data migration cost to factor, although that is unknown at this time.
ANALYSIS
Based on the initial contract coming to an end this next fiscal year, along with an increased need for body cameras, staff have been working with AXON representatives to present a new contract to the City Council for review. There are two options available for the new contract:
Option #1 includes 18 total positions, with an additional license for records staff, which would include two Reserve Officers and a Community Service Officer. As discussed at the FY 25-26 budget workshop, staff is evaluating the addition of a part-time Community Service Officer which will be brought back to the Council for approval at a later date. Staff is also working on developing a Reserve Officer program (unpaid volunteers), which will be brought to the Council for approval.
Authorizing this contract option would allow the CSO and Reserve positions to be filled when ready.
Option #2 includes 15 officer positions in the contract, with one license for records.
Current Police Department staffing is for 15 full-time sworn staff (one Chief, four Sergeants, and 10 Officers / Recruits).
City Council Agenda Report
CCPD AXON agreement
June 2, 2025
3 FINANCIAL IMPACT
Option #1 (18 total positions):
The total contract price for the AXON agreement is $299,151.80. The contract will be split over a five-year period as follows:
Year 1 $60,570.17
Year 2 $59,645.46
Year 3 $59,645.46
Year 4 $59,645.46
Year 5 $59,645.25
Option #2 (15 total positions):
The total contract price for the AXON agreement would be $55,038.59 less over five years than option 1, with a total price of $244,113.21. The contract will be split over a five-year period as follows:
Year 1 $49,562.49
Year 2 $48,637.78
Year 3 $48,637.78
Year 4 $48,637.78
Year 5 $48,637.38
The final payment of the existing contract will be voided when a new contract is put into place. Another benefit of this new contract will be to have all the existing body camera and taser contracts under one contract, instead of two, as it is currently.
The first payment of this new contract will be made in FY 25-26. This contract is paid for by Measure S and was approved by the Measure S Oversight Committee. The recommended Measure S budget for FY 25-26 is $63,250. This amount would fully cover either Option 1 or Option 2.
STRATEGIC PLAN ANALYSIS
Attempting to acquire grant funding through these sources meets the goals and objectives of Goal 1 “Support quality services and community safety to enhance the lives of our citizens and visitors”, Subsection C. “Empower and utilize Police, Fire, and Public Works departments to make Crescent City one of the safest cities in the United States”

CITY COUNCIL AGENDA REPORT

DATE: JUNE 2, 2025
SUBJECT: WWTP BIOLOGICAL SURVEY BUDGET ADJUSTMENT

RECOMMENDATION
• Hear staff report
• Technical questions from Council
• Receive public comment
• Further Council discussion
• Approve and adopt Resolution No. 2025-21, A Resolution of the City Council of the City of Crescent City Amending the Fiscal Year 2024-25 Budget of the City of Crescent City.
BACKGROUND
The North Coast Regional Water Quality Control Board (RWQCB) issued Order No. R1- 2017-0002 which was adopted on February 2, 2017. This Order permits the City of Crescent City to discharge 1.86 million gallons per day (mgd) of treated wastewater into the Pacific Ocean. This permit expired on March 31, 2022. The City and the RWQCB executed permit renewal Order No. R1-2023-0039, which was adopted on December 12, 2023 and became effective on February 1, 2024. As a requirement of this new Order, the City is to complete a Biological Survey of the ocean outfall to evaluate any potential impacts of the permitted discharge.
ITEM ANALYSIS
The work plan defines two study areas, one near the Wastewater Treatment Plant (WWTP) outfall and a second at Preston Island chosen for its similarity of prevailing waves, rocky shore habitat, and elevation of intertidal coastal zones. Each site will contain 5 plots to document the presence of invertebrates (such as mussels, barnacles, sea stars, snails, etc.) and vegetation (such as rockweeds, algae, surf grass, etc.) as well as objectionable features (such as floating particulates, grease, oil, discoloration, or degradation of indigenous biota). Each of the photo plots will be a standardized size and

2 location to enable comparison between the spring and fall samplings and to be comparable to historical data.
The timing of the project as proposed will include site mapping, transect and plot layout, and surveys in May 2025 and repeated in October 2025. A final report will be submitted to the RWQCB in January 2026.
Due to limited contractor availability, Galea Biological Consulting (GBC) was contracted as a single source procurement as there were no competing consultants found or available. GBC has presented a proposal which meets the work plan methods, requirements, and timing. Due to the time being of essence, the City Manager has already countersigned the Professional Services Agreement with GBC and work has already commenced.
FISCAL ANALYSIS
The cost proposal is itemized in the table below…
Proposal $12,656.25
Contingency (15%) $2,343.75
Total $15,000.00
Since this expense was not foreseen or budgeted, city staff is requesting that the City Council approve a resolution amending the sewer budget to cover the above expense.
The project duration will extend across two fiscal years with approximately half of the work being completed in FY24/25 and the other half in FY25/26. Due to timing, this project is not included in the proposed FY25/26 budget that will be considered for adoption on June 16, 2025. However, the remaining unspent funds will be part of the “roll over” budget request typically taken for Council consideration in September.
