9/8/26 COUNCIL MINUTES
City Manager Wier explained for clarification that storm drain system is completely separate from the sewer system. Ground water does not flow into the storm drain system. When the ground water rises, it gets into the sewer system.
CONTINUING BUSINESS
5. Short Term Rental Regulation Discussion
• Recommendation: Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion and direction to staff regarding the regulation of short-term rentals
City Manager Wier stated that as far as the housing stock is concerned, there are 981 single family units and 462 multi-family units. Currently staff have identified 53-54 short-term rentals within those numbers. There are 35 single-family and 18 multi-unit (duplex, quadplex) short term rentals. City Manager Wier stated that a couple of options for discussion would be TOT related services and/or regulations on short term rentals. There can also be a disclosure ordinance so staff can get the information from the short-term rental companies. Finance Director Leaver went over the research the Finance Department has done to find vacation rentals in the city limits. She explained that there are services that can get information from sites such as Airbnb and VRBO to find unregistered properties. This service can be anywhere from $4500 a year to $20k. Finance Director Leaver recommended the Council adopt an ordinance so staff can request addresses from VRBO and Airbnb and do the research themselves to see if the short-term rentals (STR) are registered. Council Member Shamblin asked how many STRs had on-site managers; Director Leaver stated staff does not have those numbers. Mayor Pro Tem Tinkler supports adopting an ordinance so City staff can do the work to find out which ones are unregistered. Council Member Altman felt that this is a waste of time and property owners should not be over regulated. Council Member Shamblin said the neighborhoods are disappearing as a lot of the houses in town are STRs. He would like for TOT to be evaluated. Council Member Greenough stated that the numbers are so low on how many STRs we have, it doesn’t make sense to spend money on this instead of other projects. He wants to see enforcement on licensing and insurance based on what we already have on file. He is in opposition to spending any more time on this subject. Mayor Wright asked what the trend is on vacation rentals; Director Leaver stated that the Planning Consultant looked at the last 5 years and it’s been an average of 10 per year, but it’s mostly for change in ownership, not new rentals.
The following members of the public addressed the Council:
Roger Gitlin: stated that STRs should have a 24-hour person on site or have someone available to solve any issues. Feels a vote on this item is premature and more information is needed.
Jody Mangum: there are a lot of empty homes on Pebble Beach that are second homes for people. She spoke about people being able to own their own homes instead of apartments.
Sam Strait: stated it is not an easy task to have a vacation rental. He stated that companies buy up properties to have as a vacation rental and there is always someone who is a point of contact for the property. He does not support moving forward on this as the amount of money to get is not as much as it will cost to move forward.
Mark Bower: stated that visitors to his rental bring money into the community and is not in support of limiting rentals.
Lori Collins: feels moving forward with this is a waste of taxpayer money. When you rent a STR, you already are charged for TOT. Does not support any regulations. 5 | P a g e
9/8/26 COUNCIL MINUTES
Bobbi Jo Bower: vacation rental owner and all contact information for vacation rentals can be found at City Hall with business license.
Lori Standring: spoke in opposition to the Council moving forward with this. She said as a vacation rental owner, they are not making a lot of money on the property and it supplements their income.
Mayor Pro Tem Tinkler stated that it is not the intention to disallow STRs, just to have regulations to address problems. She would recommend passing an ordinance. Supports a 5% cap on STRs.
Council Member Altman reminded the Council this is giving direction to staff, not voting on an ordinance. Spoke in opposition of staff taking any more time on this item. Council Member Shamblin supports creating an ordinance to get the addresses of all STRs. Mayor Wright observed that the Council was not in consensus to move forward with any of the options presented.
NEW BUSINESS
6. CCPD Axon Dashcam Automated License Plate Readers
• Recommendation: Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Approve the Police Department’s use of Axon Automated License Plate Readers; provide additional direction regarding retention of ALPR data Chief Griffin explained the difference between these automated license plate readers and the Flock cameras. This item is to see what the public’s interest is in the retention period for the information obtained by the ALPR. The national database for this includes stolen vehicles, kidnapping, serial killers, and any crime associated with the plate. There is a very strict rule to be able to search the system (ALPR location history) and can only be done by Chief Griffin and probable cause must be outlined specifically for the search. City Manager Wier asked for clarification that if an officer is driving around and a license plate that has been entered into NCIC that it would automatically notify the officer; Chief Griffin explained that yes, there is an alert and what the crime has been connected to the license plate. The officer would then call dispatch to confirm the plate. Chief Griffin suggested a retention period of 0-10 days. City Manager Wier further explained the difference between Axon and Flock is that with Axon, data belongs to CCPD.
For Flock cameras, the data is sent to Flock. Council Member Greenough asked what the retention was before; Chief Griffin stated he set it back to 0, however, initially it was 365 as a factory preset. Council Member Greenough asked why he didn’t just go ahead and set it to 7-10 days; Chief Griffin stated the reason was because he wanted to hear what the community wanted as well as the Council. Council Member Greenough stated he agrees with Chief Griffin’s recommendation to have a 7-day retention period. Mayor Pro Tem Tinkler stated that this is not a new thing and supports the service as it is a good tool for law enforcement. She supports the 7-day retention period; commented that this aligns with the recommendation of the ACLU. Mayor Pro Tem Tinkler asked if the sharing of information includes sharing information with ICE; Chief Griffin stated that no, they are not authorized to work with ICE by state law. Council Member Shamblin stated the 7-day retention is a good balance between privacy and safety. Mayor Wright agrees with 7-day retention. Council Member Altman asked if the 10-year contract includes this; Chief Griffin answered in the affirmative.
The following members of the public addressed the Council:
Heather Taggart: believes this supports accountability. 6 | P a g e
9/8/26 COUNCIL MINUTES
Jake Borja: Supports a 0-day retention period, asked when the retention was changed from 365 to 0 and stated Axon cameras can be tracked by Axon Hunter (bluetooth sniffers).
Sam Strait: asked what if someone buys a car that was used in the commission of a crime and they drive it back to their location and the plate is picked up on the ALPR. Does not support surveillance of individuals.
David Garcia: stated in this time of innovated technology, he spoke in support of this service.
Further stated that this is an effective tool for law enforcement.
Lori Collins: against Flock cameras and data collection.
Jody Mangum: spoke about wanting to see the children of the community protected from trafficking; and about an AI data center.
On a motion by Council Member Tinkler, seconded by Council Member Greenough, and carried unanimously on a 5-0 polled vote, the City Council of the City of Crescent City approved the Police Department’s use of Axon Automated License Plate Readers; provided additional direction regarding retention of ALPR data to 7 days.

Council Member Shamblin asked what is the square footage of the cabins? City Manager Wier stated they are approximately 500 sq. ft. Mayor Pro Tem Tinkler asked if the furnishings would be included in this budget; Director Yeager answered in the affirmative, with the exception of the consumables (linens, dinnerware, cookware, etc). The existing apartment will need a lot of updating.
The following member of the public addressed the Council:
Sam Strait: spoke about the City wanting to have an ordinance to restrict STRs and now the City is adding STRs to the RV Park. Stated that a private owner of a vacation rental does not have access to funding for upgrades.
Mayor Wright asked how long the City has owned the RV Park; City Manager Wier stated it was transferred to the City as part of a state lands grant in 1976. 7 | P a g e

SUBJECT: AMENDMENT 2 TO TASK ORDER 1 FOR PLAN REVIEW SERVICES ______________________________________________________________________
RECOMMENDATION
• Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Approve and authorize the City Manager to sign Task Order 1 Amendment 2 to the Professional Services Agreement with BPR Consulting Group LLC for Plan Review Support Services
• Approve and adopt Resolution No. 2026-61, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2026-27 BUDGET OF THE CITY OF CRESCENT CITY
BACKGROUND
The City currently has one part-time and one full-time building inspector. Dan Minges, our retired annuitant who is currently performing building inspection and plan review services for the City, runs out of service time on December 31, 2026. The 162-unit Battery Point housing project remains on-going and is projected with construction scheduled to last through 2027. The plan review for the Battery Point project exceeded staff’s capacity and expertise to review such a large and complex building project. Thus, a request for proposals for plan review support services was released on December 11, 2023 and proposals were received on January 5, 2024. Seven proposals were submitted and evaluated by staff (PW Director, Building Inspector, and Engineering Project Managers).
BPR Consulting Group was selected as the firm that would best fit the City’s needs.
On February 20, 2024 the City Council approved a Professional Services Agreement with BPR Consulting Group, LLC. Task Order #1 for plan review of the Battery Point housing project was fully executed on February 26, 2024. Task Order #1 required that BPR review the building structural, plumbing, mechanical, electrical, fire, energy efficiency and green building standards, ADA, health and safety. BPR completed the initial plan review according to Task Order 1 on time and on budget by June 26, 2024. Compensation for TO1 was based on BPR’s fee included in the PSA, with a not to exceed limit of PLAN REVIEW SERVICES TO1 A2
September 21, 2026
2 $153,460.00. This is 70% of the plan check fees received by the City, per the terms of the professional services agreement.
The Battery Point construction project broke ground in spring 2024. As the project has progressed, several design changes have required additional plan reviews beyond the scope covered in the 70% fee. To continue the plan review process through BPR and utilize their resources for project management, Council approved Amendment No. 1 November 3, 2025. The scope of Amendment No. 1 includes the following:
1) Additional plan check services for structural elements changed after the initial plan review.
2) Review of Request for Information (RFI) to make sure all RFIs have been properly documented and resolved.
3) Review of the plan set change log to verify review, acceptance and inspection of all proposed changes to the project plans.
Item #1 covers all structural, mechanical, or functionality changes that need engineering or code approval by the City prior to implementation. Items #2 and #3 assist the City with the project management of the project in terms of record keeping, track of RFIs between the developers/designers and subcontractors, RFI responses, project bulletins, and verification of submittal approvals. There is also a necessary component to make sure all changes are consistent with prior approvals. This thorough record keeping is necessary for the issuance of Certificates of Occupancy upon project completion. The support provided by Amendment #1 is anticipated to run continuously until project completion.
The additional work required for Amendment 1 of Task Order 1 is estimated not to exceed $40,000.00 for services provided for the Battery Point project. The future fees to be billed by BPR are based on the hourly rates established in their PSA, meaning they will be working on the re-review and management duties on an hourly basis. It is expected the additional plan check costs will be approximately $20,000 (which will be billed to the project developer) and the construction management will be approximately $20,000 to be paid utilizing the Permit Fees received.
ITEM ANALYSIS
Since the initial plan set approval for each of the three buildings, there have been several changes to the building plans. The largest of these changes was the moisture damage incurred by the modular units in Building A, which is the 41-unit senior housing building with all 40 units available for HUD assistance. These 41 units consist of 30 one-bedroom units and 11 two-bedroom units. The building plan drawings for these modular units was previously approved by California Department of Housing and Community Development (HCD). The inspection of these modular units while under construction was performed by representatives of HCD. The remainder of the building systems, including the building envelope, roofing, common areas, the structural foundations, stairwells, concrete elevator towers, and on-site installation of the modular units are the responsibility of the City’s building inspection department. The City had BPR perform the plan review and approval for all three of the main buildings.
PLAN REVIEW SERVICES TO1 A2
September 21, 2026
3 Due to the extensive moisture damage to Building A, each modular unit will need to be largely dismantled to remove and remediate the contents. As these units are reconstructed, they will need to undergo building inspections. Because these units are now installed on site, they are no longer eligible for HCD plan review and inspection. The City will need to have BPR review the plan set for both the HCD modulars along with performing a re-review of the overall structure to confirm that the combined plan set is complete and meets all California building code and structural requirements. Once the plans are approved, the City will perform field inspections on the reconstruction of these modulars along with the City’s original obligation of inspecting the buildings structural components and building envelope. The burden of the review of the HCD plan set, the re-review of the remaining Building A structure, and the additional inspection including these modulars will be paid for by the developer with increased plan check and building permit fees.
For the overall project including the three primary buildings, a reassessment of the valuation of the project is occurring. The City and the developer have agreed to an increased valuation for Buildings A and C beyond incorporating the modular units in Building A.
A new valuation for Building B is pending but is not currently included in this budget adjustment. Building B will be considered on hold from further inspections until the reassessment of its valuation is completed.
FISCAL ANALYSIS
The City initially engaged BPR for the Battery Point project based on the valuation of the plan check fees charged by the City. Task Order #1 for the review of the building plans for the 162-unit Battery Point project compensation of $153,460.00 was based on the project valuation estimated at $55,683,413.
With the overall project having an increased valuation both the building permit fees and the plan check fees need to be increased. The new fees to be received total $ 260,724.
These fees will be placed in the general fund building inspection account as equal amounts revenue and expenses to cover both the City incurred additional building inspection expenses as well as the BPR Task Order 1 Amendment 2 costs.
The BPR Task Order 1 Amendment 2 accounts for the increased valuation to cover changes to the original plan set as well as the inclusion of the HCD modulars. The master agreement with BPR sets their plan check costs at 70% of the plan check fees received by the City for each project being reviewed. At 70% of $117,579 plan check fees being received through this valuation recalculation, Amendment 2 to Task Order 1, BPR will receive $82,305.
Any future major changes to the project will undergo additional plan review, with additional plan check fees being charged to the developer to cover these additional reviews.
The chart below also lists the fees for the re-review of the Building A plan set. This specific fee includes the re-review of the original City’s scope regarding the building’s structure and envelope. The BPR scope therefore will be budgeted to include the increase of PLAN REVIEW SERVICES TO1 A2

• Authorize the City Manager to sign a purchase order with Dell Technologies for the purchase of two servers for the Water system in the amount of $83,045
BACKGROUND
In the Summer of 2019, the City undertook a project to update water SCADA (Supervisory Control and Data Acquisition). The SCADA system automates control and records telemetry for the City’s water system. Among the items included in the update were new servers capable of running SCADA and supporting software. The average lifecycle of a server is commonly five years. The current servers are approaching the seven-year mark.
The City has maintained manufacturer support and hardware replacement coverage through a service contract, which can be extended only until April 2027. By that time, the servers will be nearing eight years old and will likely no longer qualify for renewal of service coverage.
ITEM ANALYSIS
The most recent quote for two servers to meet specifications is $83,044.34. This is part of a project to update server hardware and SCADA software. Server costs have risen substantially in the last twelve months and are forecasted to continue to increase over the next two years. This is primarily driven by hardware shortages and supply chain delays as manufacturers are focusing on A.I. initiatives. A server ordered to custom Water System SCADA Server Purchase
September 21, 2026
2 specifications would typically be delivered within thirty days of ordering, turnaround time is currently at about four months.
The two servers would be ordered and shipped direct to the City’s integrator (Technical Systems Inc.) for configuration, software installation, and conversion, then shipped to the City for installation on the water system by City staff.
Staff are requesting Council approval of this purchase as it is over the City Manager’s purchasing authority.
FISCAL ANALYSIS
Anticipating this system need and expected cost increases, the approved FY2026 / 2027 budget includes $135,000 for this server replacement project. It appears the Water Fund has adequate budget for both this server purchase and the associated integration and installation costs required to incorporate the new hardware into the existing water SCADA system. No additional budget is requested at this time.

• Approve a letter requesting Governor Newsom’s signature on AB 2059 (Wilson): California Environmental Quality Act: transportation impacts: vehicle miles traveled: mitigation
BACKGROUND
On September 15, 2026, Executive Director Mike Woodman of the Nevada County Transportation Commission reached out to the Del Norte Transportation Commission to urge the Governor to support for 2059.
ITEM ANALYSIS
AB 2059 would make highway capacity projects that are either for a demonstrated “evacuation need” or “safety need” under CEQA to have a less than significant VMT impact in the rural counties not contained in a Metropolitan Statistical Area (MSA) as established by the United States Office of Management and Budget.
The Bill attempts to address the unique reality rural communities face with longer travel times and few transit options challenges by addressing the way vehicle miles traveled (VMT) mitigation is applied to transportation projects in rural counties. As stated in the draft letter of support, proponents of the bill claim it will help advance projects that address safety deficiencies, system preservation needs, and emergency evacuation objectives without being burdened by mitigation requirements that can consume scarce transportation dollars and delay urgently needed improvements.
The request is to provide a letter urging Governor Newsom to sign AB 2059. The Governor has until September 30th to sign the legislation and submitting a letter from the jurisdictions that the legislation covers would help to express the benefits that this bill would have for our rural communities.

RE: AB 2059 (Wilson): California Environmental Quality Act: transportation impacts: vehicle miles traveled: mitigation
REQUEST FOR SIGNATURE
Dear Governor Newsom:
On behalf of the City Council of the City of Crescent City, I write to respectfully request your signature on AB 2059 by Assemblymember Lori Wilson which takes a practical and targeted approach to addressing the way vehicle miles traveled (VMT) mitigation is applied to transportation projects in rural counties.
AB 2059 would presume that transportation projects primarily located within California's 21 most rural counties have a less than significant impact under the VMT metric, while making clear that projects adding general purpose lanes to the state highway system would not qualify for that presumption unless there is a demonstrated safety or evacuation need. The bill reflects a balanced compromise reached with the Legislature and your Administration, and it passed both houses of the Legislature unanimously and without opposition.
For Del Norte County, these changes are both reasonable and necessary. Rural communities face unique transportation realities: longer travel distances, fewer alternative routes, limited transit availability, challenging terrain, and heightened emergency evacuation concerns. In this context, investments in the state highway system are often essential to maintaining safe and reliable mobility, yet the current VMT mitigation framework can impose costs that are disproportionate, unpredictable, and disconnected from what is feasible or effective on the ground.
AB 2059 helps restore balance. It recognizes that rural transportation agencies must be able to advance projects that address safety deficiencies, system preservation needs, and emergency evacuation objectives without being burdened by mitigation requirements that can consume scarce transportation dollars and delay urgently needed improvements.
The City Council of the City of Crescent City especially appreciates that the bill continues to acknowledge the importance of demonstrated safety and evacuation need. In Nevada County, wildfire risk and emergency response considerations are not theoretical. CEQA should not stand in the way of projects needed to protect life and improve the resilience of the transportation network.
For these reasons, the City Council of the City of Crescent City respectfully requests your signature on AB 2059. If you have any questions, please contact Chris Lee, at [email protected] or (916) 444-3770.
Sincerely,
Isaiah Wright

CHAPTER
An act to add Section 21081.4 to the Public Resources Code, relating to environmental quality.
legislative counsel’s digest
AB 2059, Wilson. California Environmental Quality Act:
transportation impacts: vehicle miles traveled: mitigation.
The California Environmental Quality Act (CEQA) requires a lead agency, as defined, to prepare, or cause to be prepared, and certify the completion of an environmental impact report on a project that it proposes to carry out or approve that may have a significant effect on the environment or to adopt a negative declaration if it finds that the project will not have that effect.
CEQA also requires a lead agency to prepare a mitigated negative declaration for a project that may have a significant effect on the environment if revisions in the project would avoid or mitigate that effect and there is no substantial evidence that the project, as revised, would have a significant effect on the environment.
CEQA requires the Office of Land Use and Climate Innovation to prepare, develop, and transmit to the Secretary of the Natural Resources Agency for certification and adoption proposed revisions to the CEQA implementation guidelines to establish criteria for determining the significance of transportation impacts of projects within transit priority areas, and requires the criteria to promote the reduction of greenhouse gas emissions, the development of multimodal transportation networks, and a diversity of land uses.
CEQA requires the office to recommend potential metrics, including, among other metrics, vehicle miles traveled, to measure these transportation impacts.
This bill would require the Department of Transportation, in consultation with specified entities, to, on or before December 31, 2030, develop guidance on vehicle-miles-travel mitigation measures for transportation projects in nonmetropolitan counties, as provided. The bill would require the department to publish the guidance on its internet website and add the guidance as an addendum to the Transportation Analysis Framework and the Transportation Analysis under CEQA. The bill would specify that 94 AB 2059 — 2 —
a transportation project for which the lead agency has issued a notice of preparation for the project’s environmental impact report on or before December 31, 2031 is presumed to have a less than significant transportation impact as determined by the
vehicle-miles-traveled metric if at least 70% of the project lies within one or more nonmetropolitan counties. Because the bill would impose additional duties on a lead agency in its analysis of significant transportation impacts, this bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.
The people of the State of California do enact as follows:
SECTION 1. Section 21081.4 is added to the Public Resources Code, to read:
21081.4. (a) For purposes of this section, the following definitions apply:
(1) “Demonstrated evacuation need” means a project that is specifically identified as necessary to provide evacuation capacity for the affected area in an adopted local hazard mitigation plan, general plan safety element, local emergency operations plan, or other local or regional emergency evacuation plan approved by a city, county, or regional planning agency through a public process. (2) “Demonstrated safety need” means a project for which the lead agency demonstrates, through documented collision, injury, or fatality data specific to the project location, or through a risk-based or systemic safety analysis consistent with state and federal guidance, that the proposed project includes safety countermeasures that are necessary to reduce the number and severity of injuries or the number of fatalities, including reducing specific risks to vulnerable road users.
(3) “Nonmetropolitan county” means a nonmetropolitan county designated by the Methodology for Determining Rural Status of Project Site for 2025 Applications issued by the California Tax Credit Allocation Committee on January 1, 2025.
94 — 3 — AB 2059
(4) “Transportation project” means a project undertaken by a public agency that consists of the planning, design, construction, reconstruction, rehabilitation, improvement, expansion, or operation of a highway, road, bridge, transit facility, rail facility, bicycle or pedestrian facility, or other public transportation infrastructure.
(b) (1) The Department of Transportation, in consultation with the Office of Land Use and Climate Innovation and the SB 743 Implementation Working Group Rural VMT Action Subcommittee, shall, on or before December 31, 2030, develop guidance on vehicle-miles-travel mitigation measures for transportation projects in nonmetropolitan counties. The guidance shall include all of the following:
(A) Case studies exemplifying the range of costs of
vehicle-miles-travel mitigation measures for transportation projects in nonmetropolitan counties compared to the costs in metropolitan counties.
(B) A review of direct and indirect vehicle-miles-travel mitigation measures and examples of direct and indirect vehicle-miles-travel mitigation measures that have been used for transportation projects in nonmetropolitan counties.
(C) Identification of barriers to implementing
vehicle-miles-travel mitigation measures for transportation projects in nonmetropolitan counties.
(D) Recommendations for processes for lead agencies and project developers to identify and implement appropriate vehicle-miles-travel mitigation measures for transportation projects in nonmetropolitan areas, including recommendations for processes of consultation with stakeholders, coordination with local jurisdiction and regional transportation planning organizations, and engaging with the community, as appropriate.
(E) Recommendations for appropriate vehicle-miles-travel significance thresholds for transportation projects in
nonmetropolitan areas that do not add general purpose lanes to the state highway system unless there is a demonstrated safety or evacuation need for the project.
(2) The Department of Transportation shall publish the guidance on its internet website. The guidance shall also be added as an addendum to the Transportation Analysis Framework and the Transportation Analysis under CEQA.
94 AB 2059 — 4 —
(c) (1) A transportation project is presumed to have a less than significant transportation impact as determined by the
vehicle-miles-traveled metric developed pursuant to Section 21099 if at least 70 percent of the project lies within one or more nonmetropolitan counties.
(2) Paragraph (1) does not apply to a transportation project that adds one or more general purpose lanes to the state highway system unless there is a demonstrated safety or evacuation need for the project.
(3) The presumption pursuant to paragraph (1) shall only apply to an eligible project for which the lead agency issues a notice of preparation for the project’s environmental impact report on or before December 31, 2031.
SEC. 2. No reimbursement is required by this act pursuant to Section 6 of Article XIIIB of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.
