Proclamation
of the
City of Crescent City
WHEREAS, the City of Crescent City recognizes that the lands known as the Americas have been occupied by Indigenous peoples since time immemorial; and WHEREAS, Indigenous Peoples' Day is a day to celebrate the Indigenous peoples who call California home and who persevered in the face of unimaginable challenges to shape California’s past, present and future; and
WHEREAS, peoples indigenous to California have survived the forces of systematic and legalized oppression, violence and discrimination, including a government funded effort to erase them from existence known as the “war of extermination,” the criminalization of their culture and language, the taking of their homelands, and the forced separation of families through legal slavery and forced enrollment in boarding schools; and WHEREAS, Crescent City was founded upon the ancestral homelands and villages of the Taa-laa-wa dee-ni', a place named “Taa-'at-dvn” long before it was incorporated as a city in 1854; and
WHEREAS, the 1850s were a particularly brutal period in Del Norte County as several organized attacks on Tolowa villages resulted in the deaths of hundreds of men, women, children, and elders, with the Yan'-daa-k'vt assault being the second largest massacre of Indigenous People on American soil; and
WHEREAS, acknowledging this brutal past as part of our collective history is an essential step toward healing and gaining a better understanding of our Indigenous community; and WHEREAS, southern Del Norte County is the ancestral home of the Yurok People, who constitute an integral part of both our region’s history and the current community that is Crescent City; and
WHEREAS, the City recognizes the value of the many contributions made to our community through Indigenous Peoples’ knowledge, labor, spirituality, technology, science, philosophy, arts and the deep cultural contribution that have substantially shaped the character of Crescent City; and
WHEREAS, the City of Crescent City promotes the closing of the equity gap for Indigenous Peoples through policies and practices that reflect the experiences of Indigenous Peoples, ensuring greater access and opportunity, and honoring our nation’s Indigenous history and contributions; and
WHEREAS, three years ago, the City invited representatives from the Tolowa Dee-ni' Nation, the Elk Valley Rancheria, and the Tolowa Nation to serve on a Taa-laa-wa Cultural Committee to consult and advise on certain City projects, particularly those related to the Beachfront Park Master Plan; and
WHEREAS, the Taa-laa-wa Cultural Committee has worked tirelessly with City staff and consultants to create the Tolowa Cultural Trail, an interpretive walk where Tolowa history and culture are shared by the Tolowa People along a rebuilt coastal pathway in Beachfront Park.
NOW, THEREFORE, BE IT PROCLAIMED that the City Council of the City of Crescent City recognizes Monday, October 12, 2026 as Indigenous Peoples’ Day; and BE IT FURTHER PROCLAIMED that the City of Crescent City shall continue its efforts to partner with the Taa-laa-wa dee-ni' to promote the prosperity and well-being of the local Indigenous community; and
BE IT FURTHER PROCLAIMED that Indigenous Peoples’ Day shall be used to reflect upon the ongoing struggles of Indigenous People on this land, and to celebrate the thriving culture and value that Indigenous Peoples add to our City; and
BE IT FURTHER PROCLAIMED that the City Council of the City of Crescent City encourages other businesses, organizations, and public institutions to recognize Indigenous Peoples’ Day.

REPORTS AND PRESENTATIONS
• Battery Point Project Update
City Manager Wier reported to the Council the history behind the project that will be outlined in this update. Jason Hobson with Synergy and Douglas Russell with Vertex were present via Zoom to give an update on the project. Council Member Shamblin asked if finishing buildings B & C will also include landscaping; Mr. Hobson stated that yes, it will be around A & C. Further stating that as much landscaping that can be done will be completed at that time. Council Member Greenough stated he drove by the worksite today and noticed the work crew was busy removing the wood paneling and asked how long the weatherization project will take; Mr. Russell stated that work starts next week and is expected to take three weeks. He explained the weatherization process and that the goal is November 1st to have all of the pieces come together. City Manager Wier asked Mr. Russell if building A & C will be weatherized by November? Mr. Russell answered in the affirmative and stated the plan is to work on the interior during the winter. Council Member Greenough asked if there is a contingency plan in place in case the weather is not appropriate for construction; Mr. Russell stated that the things planned are able to be done in inclement weather.

COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2026-27 BUDGET OF THE CITY OF CRESCENT CITY
City Manager Wier reported to the Council the issues that the Battery Point project has had and that this Task Order will reflect changes to the project. Council Member Greenough asked how much of the structure has to be redone; City Manager Wier stated the damage is extensive and all of the buildings will need to be reinspected on site. Mr. Hobson stated that the work itself will be inspected by an Industrial Hygienist. All of the materials that have been damaged by the weather will be replaced. City Manager Wier outlined the Task Order charges in detail. Council Member Shamblin asked how this is revenue neutral; City Manager Wier stated that the City will receive $260k in revenue, the City will then pay BPR $82k for the labor associated with the project, further stating there has been an increase in labor and expenses. Part of the reason for that is Building Inspector Dan Minges is a retired annuitant and his time is limited (Dec. 31). It is expected to be cost neutral.
Doug Dye: stated it was caused by incompetence, gross negligence and totally avoidable; stated City Manager Wier was responsible.

Sam Strait: stated that this project is a fiasco and not well received in the community. Questioned where the people are coming from that have these housing needs.
Council Member Greenough asked about the discrepancy in the numbers as mentioned by Ms.
Mangum. City Manager Wier explained that the Task Order shows two pieces for the compensation; item 1 being for the re-plan check for BPR as they get 70% of the plan check. Item 2 is for the increased valuation for buildings A and C. BPR’s share of these two items is the $82k.
Council Member Greenough asked about the transit funds and bus stops and if there have been any issues with funding by the State; Mr. Hobson stated that the criteria has been met for the funding and all requirements for funding have been adhered to. City Manager Wier clarified for 4 | P a g e

the community that this is not a City project; it is a project by a private developer on private land.
City Manager Wier asked Housing Authority Executive Director Miller to explain the need for housing. Director Miller stated that the overwhelming amount of people that need this housing are local and have been here a long time. City Manager Wier asked if vouchers are going unused because we don’t have the appropriate amount of housing; Director Miller answered in the affirmative; vouchers are being lost because of the lack of housing. This project will fulfill those needs and allow those vouchers to be used. City Manager Wier reiterated that this is not a City project is a private company with their own funding on privately owned property.
On a motion by Council Member Shamblin, seconded by Council Member Greenough, and carried on a 4-0 polled vote with Mayor Pro Tem Tinkler being absent, the City Council of the City of Crescent City approved and authorized the City Manager to sign Task Order 1 Amendment 2 to the Professional Services Agreement with BPR Consulting Group LLC for Plan Review Support Services and approved and adopted Resolution No. 2026-61, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2026-27 BUDGET OF THE CITY OF CRESCENT CITY.

City Manager Wier explained that this bill came to the Council in between Council meetings from Del Norte Local Transportation Executive Director Tamera Leighton. The Bill is an attempt to help rural communities in regard to critical transportation projects and the CEQA review involved in such projects. Currently, the evaluation has to do with miles traveled and in rural communities, the long distances we have to travel and the limited transit opportunities, puts us at a disadvantage. This Bill is to have rural communities evaluated differently. City Attorney Rice stated that the Bill would require the department to publish guidance on their website and to come up with the finer points on how this would work. The idea is to give rural communities more flexibility on the mitigation of the vehicle miles traveled CEQA analysis. Council Member Shamblin stated that there is a movement to have bills tailored to the rural areas.

FROM: ERIC WIER, CITY MANAGER
BY: MARTHA D. RICE, CITY ATTORNEY
DATE: OCTOBER 5, 2026
SUBJECT: CALPERS DISABILITY RETIREMENT DETERMINATION DELEGATION ______________________________________________________________________
RECOMMENDATION
• Approve and adopt Resolution No. 2026-62, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CRESCENT CITY DELEGATING AUTHORITY UNDER GOVERNMENT CODE SECTION 21173 TO THE CITY MANAGER TO
MAKE CERTAIN DISABILITY DETERMINATIONS
BACKGROUND
The City of Crescent City is a contracting agency with California Public Employees’ Retirement System (CalPERS), which provides retirement benefits to City employees, including disability and industrial disability retirement. CalPERS retirement benefits and processes are heavily regulated in the Government Code and state regulations. When a CalPERS safety member (police or fire) applies for industrial disability retirement benefits, the City is required to determine whether the employee is “disabled” and whether such disability is “industrial” within the meaning of the Public Employee’s Retirement Law. By statute this is the responsibility of the governing board, i.e., the City Council. The law does, however, allow the City Council to delegate this responsibility to any subordinate official or position.
ANALYSIS
The analysis of whether a particular employee is disabled and whether that disability is “industrial” is a fact specific inquiry that involves review and knowledge of the employee’s job requirements, medical evaluations, including health history. The resolution presented this evening would delegate the authority to make these determinations to the City Manager. It is the opinion of staff that the City Manager is in the best position to make this decision on behalf of the City. The City Manager will consult with other City staff and insurance carrier representatives (as necessary) regarding the specific facts of each case. The City has had very few safety member industrial disability retirements over the years. However, delegating this authority to the City Manager would streamline the process.

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: LINDA LEAVER, FINANCE DIRECTOR
DATE: OCTOBER 5, 2026
SUBJECT: BUDGET-TO-ACTUAL SUMMARY AS OF AUGUST 31, 2026 ______________________________________________________________________
RECOMMENDATION
• Receive and file budget-to-actual summary of the City’s major operating funds for Fiscal Year 2026-27 as of August 31, 2026
BACKGROUND
In order to provide timely information to the City Council and to the public, the City’s Finance Department has prepared the attached budget-to-actual reports. These reports provide a summary as of August 31, 2026 of the fiscal year-to-date revenues and expenses of the City’s major operating funds: General Fund, Housing Authority Fund, RV Park Fund, Sewer Fund and Water Fund.
ITEM ANALYSIS
Finance Department staff is currently working to close the books for FY 2025-26, which ended June 30, 2026. During this process, many of the revenues and invoices received in July and August are accrued back to the prior fiscal year, resulting in July and August activity for the current year appearing very low. The data in the attached reports may change as the year-end process is finalized. Final results for FY 2025-26 will be presented to the Council later this year.
As of August 31, 2026, we are 17% through the fiscal year, with 83% of the year remaining. If revenues were received and expenditures made evenly throughout the year, there would be 83% of each budget line remaining. However, revenues and expenditures are not even throughout the year for many reasons. Many revenues are not received evenly throughout the year (particularly tax revenues and grant reimbursements), most expenses are not recorded until the invoice is received in the following month, and budgets may include large projects that have not yet been completed. In addition, the BUDGET TO ACTUAL SUMMARY AS OF AUGUST 31, 2026
OCTOBER 5, 2026
2 Finance Department is currently working on closing the books for the fiscal year just ended, resulting in current year activity appearing low.
This report summarizes the actual revenues and expenditures for the year to date; additional information is provided in the budget-to-actual reports attached. • General Fund
General Fund revenues show that 97% of the budgeted amount is yet to be received. This is dependent on the timing of when certain revenues are received.
For example, most taxes, third party billings, and grant reimbursements are recorded quarterly. In addition, many revenues received in July and August 2026 are accrued back to Fiscal Year 2025-26. General Fund actual expenditures show that 87% of the budgeted amount is yet to be expended. For comparison, as of August last year, revenues were 98% remaining and expenditures were 89% remaining.
• Housing Authority Fund
The Housing Authority is funded by monthly disbursements from the federal government. At this point, actual revenues show 84% remaining to be received and actual expenditures have remaining amounts of 84%. For comparison, as of August last year, revenues were 84% remaining and expenditures were 84% remaining.
• RV Park Fund
Revenues collected by the Recreational Vehicle Park (RV Park) show 62% of operating revenues are remaining to be collected. RV Park revenues are highly seasonal, and most rental revenues are typically received in the summer months.
Operating expenses in the RV Park show 84% of the budget left to be expended.
For comparison, as of August last year, operating revenues were 66% remaining and operating expenses were 85% remaining.
• Sewer Fund
The Sewer Fund earns revenue primarily from charges to the users of its services.
Actual revenues show 86% of the total operating revenue budget remaining to be collected. Operational expenses (not including debt service or capital improvements) show 88% of the budget remaining to be expended. For comparison, as of August last year, operating revenues were 84% remaining and operating expenses were 90% remaining.
• Water Fund
The Water Fund earns revenue primarily from charges for service. Actual revenues show 84% of the budget remaining to be collected and 82% of budgeted operational expenses (not including capital improvements) remaining to be BUDGET TO ACTUAL SUMMARY AS OF AUGUST 31, 2026

SUBJECT: COUNTY SERVICE AREA BUDGET ADJUSTMENT FOR THE ROY LIFT
STATION GENERATOR REPLACEMENT
______________________________________________________________________
RECOMMENDATION
• Approve and adopt Resolution No. 2026-63, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2026-27 BUDGET OF THE CITY OF CRESCENT CITY
BACKGROUND
As a result of the relatively flat terrain in and around Crescent City, a large number of lift stations are required to transport City and County wastewater to the wastewater treatment plant (WWTP). Of the twenty-one lift stations feeding the WWTP, six are owned by the City and fourteen are owned by County Service Area No. 1. The Oregon lift station serves both jurisdictions and maintenance expenses are split 18%/82% between the City/CSA.
Pursuant to an agreement with County Services AREA No. 1, the City maintains the CSA’s lift stations as well as the City’s lift stations.
When there is a power outage, the lift stations are supplied with power through generators. Many of the lift stations rely on portable generator power, which the City supplies during localized or widespread power outages. A few of the lift stations do have on-site generators available. The CSA is acquiring and installing generators at their lift stations as funding allows.
ITEM ANALYSIS
The lift station located at Roy Avenue and Humboldt Road does have a permanent generator which has exceeded its intended life expectancy. As the low point to the Bertch Ocean View area, this lift station is essential for a large portion of the County sewer system. The generator at this lift station recently had a catastrophic failure. The City has had to place one of the portable generators at this location during the most recent localized power outage. The County recently purchased a generator with grant funding and would like it to be installed at the Roy lift station. The City received an all-inclusive
CSA LIFT STATION REPAIRS BUDGET ADJUSTMENT
OCTOBER 5, 2026
2 bid from Northridge Electric to install the generator supplied by the CSA for a cost of $38,082.
FISCAL ANALYSIS
City staff is requesting a budget adjustment to increase the Sewer Fund revenue and expense budget in equal amounts to cover the revenue generated by billing the CSA and the expense of the Northridge contract in the amount of $38,082 for installation of a generator at the Roy lift station. All costs associated with the repair and maintenance of CSA sewer lift stations, including the amount requested above, is reimbursed by the County. Any expenses for miscellaneous materials or public works staff time associated with this project will also be billed to the CSA.

• Approve and Authorize the City Manager to sign an Agreement with the Crescent City – Del Norte Chamber of Commerce for the operation of the City's Visitor Center and related economic development, tourism promotion, and community support services.
BACKGROUND
The City of Crescent City has historically partnered with the Crescent City-Del Norte County Chamber of Commerce to provide visitor information services, promote tourism, support local businesses, and assist with economic development initiatives that benefit the community. As part of this partnership, the City provides financial support and allows the Chamber to occupy City-owned facilities rent-free in exchange for services that would otherwise need to be provided directly by City staff or through contracted services.
The Chamber serves as the primary visitor information center for the community, welcoming thousands of visitors annually and providing information regarding local attractions, lodging, dining, recreation opportunities, events, and community resources.
The organization also serves as a resource for existing businesses, entrepreneurs, residents, and potential investors seeking information about the community.
To ensure accountability and establish clear expectations regarding the City's investment, staff have negotiated an agreement outlining the services to be provided by the Chamber, the funds and resources to be contributed by the City, and the public benefits received by the City.

COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2026-27 BUDGET
BACKGROUND
Over the years, the City of Crescent City / Fred Endert Pool has partnered with the Crescent City Swim Club to purchase equipment that benefits both parties. The City purchased the last set of lane lines in 2021, and they need replacement. The lane lines are used by the City for daily lap swims and the Swim Club uses them for practice and meets.
ITEM ANALYSIS
In the Fiscal Year 2026-27 budget, Measure S authorized $3,750.00 to purchase lane lines. Pool staff and the Swim Club board researched and received 3 quotes for 6 lanes lines, EZ-tensioners and a new reel. The most affordable quote is from Lincoln Aquatics SCP for $10,663.77.
The Crescent City Swim Club received a grant from the Wild Rivers Community Foundation for $5,000 and together with their own funding, are providing the City with $6,913.77 in funding to purchase lane lines. The remaining $3,750 will be paid from the Measure S funds already budgeted.
The Crescent City Swim Club will start organizing regional swim meets at the Fred Endert Pool once the new scoreboard is installed, which is planned for early November. These lane lines will be a much needed addition to providing safe and professional lane lines for the events. We believe that in the future, swim meets will bring in visitors from out of town which in turn supports our local economy. In addition, the pool will use these lane lines for daily lap swims.
FISCAL ANALYSIS
A budget adjustment is required to approve receiving and expending the funds from the Swim Club for this purchase.
STRATEGIC PLAN ANALYSIS
This action is consistent with Strategic Plan Goal 1: Support quality services, community safety, and health to enhance the quality of life and experience of our residents and visitors; as well as Goal 2: Promote a thriving economy.

BACKGROUND
The City of Crescent City published a Notice Inviting Sealed Bids for Video Inspection of Sewer Lines and Manholes dated June 18, 2022, with a bid ending date of July 18, 2022.
The scope of work included the inspection of sewer lines and manholes within the City of Crescent City. The goal of the project was to clean/inspect/assess the condition of the City’s 93,883 linear feet of sewer lines and 286 manholes. This information was essential for proper asset management which includes planning and prioritizing capital improvement projects (CIP) for the sewer collection system. This project was completed by National Plant Services in September of 2023.
Since the implementation of stricter effluent standards under the Wastewater Treatment Plant’s new NPDES permit, the facility has experienced effluent limitation exceedances during heavy periods of precipitation caused by inflow and infiltration (I&I). The California Regional Water Quality Control Board (CRWQCB) tied 86 effluent violations to mandatory minimum penalties totaling $258,000. In lieu of assessing these penalties, the RWQCB has agreed to allow us to spend the equivalent amount on a compliance project. This is due to our status as a small rural community with financial hardships.
Order R1-2026-0058 SETTLEMENT AGREEMENT
OCTOBER 05, 2026
2 ITEM ANALYSIS
To take advantage of the option to complete a compliance project in lieu of paying penalties, the City must approve the settlement agreement with the RWQCB. The settlement agreement (Order R1-2026-0058) is attached to this staff report. Staff is requesting Council’s approval to enter into this settlement agreement.
To reach this settlement agreement, the City of Crescent City, labeled as Discharger within the agreement, had to submit and obtain approval from North Coast Regional Board staff for a sewer system repair project meeting the required improvement objectives while spending at least the full $258,000 of the accrued administrative civil fines.
The approved compliance project includes repairing several defects indemnified in the 2023 sewer collection system evaluation. The proposed repair is to use a trenchless rehabilitation method called “Cured In Place Pipe” (CIPP). CIPP is a way to repair damaged underground pipes without the expense of major excavation. A resin-saturated liner is inserted into the existing pipe, utilizing the existing access at a manhole, expanded with air, or steam, and then cured to form a brand-new pipe inside the old one. Utilizing this technology we can implement “spot repairs” which would be installing a very short liner at a specific location to repair a single defect or if the entire pipe has been compromised a “block repair” can be completed in which the full length of pipe between manholes could be lined.
The proposed repair locations are as follows:
Project Base Bid Locations
A-Street S-Curve:
1) One spot CIPP repair on A Street, between 2nd and 3rd Street 2) One spot CIPP repair on 2nd Street, between A and B Street Harding Area
1) A CIPP block repair On Oregon Street from Harding Ave North 300 Lineal Feet & South 300 lineal feet.
2) Six spot CIPP repairs on Oregon Street between Grant Ave and E. Coolidge Ave 3) Four spot CIPP repairs on Harding Street between California St. and Marshall St. 4) One spot CIPP repair on Harding Street between California St. and Marshall St.
The following additional locations could be added to satisfy expenditure of an amount equal to the mandatory minimum penalties ($258,000):

3 Tetrapod
1) A CIPP block repair from Hwy 101, 100 Lineal feet East (North of Chevron South)

The engineer’s estimate for the base bid for this project, including 10% contingency, is $300,000, which meets the financial obligation of the City under the Settlement Agreement.
The project will be bid with additive bid items for additional sewer lines needing repair.
RWQCB staff have approved this list of possible locations as well.
Staff will return to the Council requesting City Manager authorization for the contract award of the sewer line repair contract to the lowest responsible bidder.
FISCAL ANALYSIS
The sewer funds required to complete this sewer line improvement project are currently in the Fiscal 2026-2027 budget approved by the City Council in anticipation of completing this compliance project.

3. On August 26, 2025, the Assistant Executive Officer of the North Coast Water Board issued Administrative Civil Liability Complaint (Complaint) No. R1-2025- 0034 to the Discharger. The Complaint originally proposed the imposition of $228,000 in mandatory minimum penalties (MMPs) pursuant to Water Code section 13385, subdivisions (h) and (i), for seventy-six (76) effluent limitation violations between January 1, 2024, and August 1, 2025, as identified in the initial Exhibit A. That version of the Complaint alleged fifty-three (53) Enterococci violations, twenty-one (21) Total Coliform violations, three (3) Ammonia, Total (as N) violations, one (1) Settleable Solids violation, and one (1) Chlorine, Total Residual violation.
4. Subsequent to the issuance of the Complaint, the Discharger accrued additional effluent limitation violations, thereby expanding the scope of the non-compliance period through March 23, 2026. Accordingly, Exhibit A has been updated to reflect a cumulative total of eighty-nine (89) effluent limitation violations. The current, updated violations include fifty-four (54) Enterococci violations, twenty-eight (28) Total Coliform violations, three (3) Ammonia, Total (as N) violations, three (3) Order No. R1-2026-0058
Stipulated Administrative Civil Liability Order
City of Crescent City Wastewater Treatment Facility
Settleable Solids violations, and one (1) Chlorine, Total Residual violation. Of these cumulative violations, eighty-six (86) are subject to MMPs, resulting in a revised total proposed administrative civil liability assessment of $258,000.
Updated Exhibit A is attached hereto and is incorporated herein by this reference.
5. Pursuant to Water Code section 13385, subdivision (h), the North Coast Water Board shall assess a $3,000 MMP for each serious violation. A “serious violation” means any waste discharge that violates the effluent limitations contained in the applicable WDRs for a Group II pollutant by 20 percent or more or for a Group I pollutant by 40 percent or more.
6. Pursuant to Water Code section, 13385 subdivision (i), the North Coast Water Board shall assess a $3,000 MMP for each violation whenever a discharger violates a WDR effluent limitation four or more times in period of six consecutive months (except that the requirement to assess the MMP shall not be applicable to the first three violations).
7. This Stipulated Order resolves eighty-nine (89) effluent limitation violations, eightysix (86) of which are subject to MMPs pursuant to Water Code section 13385, subdivisions (h) and (i), as identified in Exhibit A. The total proposed administrative civil liability amount is $258,000.
8. Pursuant to Water Code section 13385, subdivision (k)(1), in lieu of assessing all or a portion of MMPs, the North Coast Water Board may require a Publicly Owned Treatment Works (POTW) serving a small community to spend an equivalent amount on completion of a compliance project (CP) proposed by the POTW if the North Coast Water Board finds each of the following:
a. The CP is designed to correct the violations within five years; b. The CP is in accordance with the State Water Resource Control Board’s (State Water Board) 2024 Water Quality Enforcement Policy (Enforcement Policy); and
c. The POTW has prepared a financing plan to complete the CP.
9. Water Code section 13385, subdivision (k)(2), defines POTW serving a small community for the purposes of administrative civil liability imposed for MMPs, as a POTW “serving a population of 20,000 persons or fewer, or a rural county, with a financial hardship...”
10. A CP is “a project designed to address the problems related to the violation and bring the discharger back into compliance in a timely manner.” (Enforcement Policy, page 38.)
Order No. R1-2026-0058

City of Crescent City Wastewater Treatment Facility
11. As described in the Enforcement Policy, rural county means a county classified by the Economic Research Service (ERS), United States Department of Agriculture (USDA), with a rural-urban continuum code of four through nine. (Enforcement Policy, page 33.)
12. The Enforcement Policy further describes financial hardship as a community served by the POTW that satisfies one of the following conditions: (1) the median household income (MHI) for the community is less than 80 percent of the California MHI; (2) the community has an unemployment rate of 10 percent or greater; or (3) twenty percent of the population is below the poverty level. (Enforcement Policy, page 33.)
13. The Discharger is a POTW serving a small community because the Discharger’s Facility serves a population that lies completely within Del Norte County; a rural county with a rural-urban continuum code of seven according to USDA ERS 2023 Rural-Urban Continuum Codes. The Discharger’s Facility also serves a community with a financial hardship because, based on U.S. Census Bureau 2019-2023 American Community Survey 5-Year Estimates, the Facility’s service area MHI of $53,600 is less than 80 percent of California’s MHI. 80 percent of California’s MHI is $76,416.80.
14. North Coast Water Board staff have determined that the Discharger meets the requirements set forth in Water Code section 13385, subdivision (k), and the Enforcement Policy to be recognized as a POTW serving a small community with a financial hardship. This determination makes the Discharger eligible to complete a CP in lieu of paying all or a portion of the MMPs.
15. To resolve the alleged violations set forth in Exhibit A, by consent and without further administrative proceedings, the Parties have agreed to the imposition of an administrative civil liability amount of $258,000 against the Discharger.
16. The Parties have engaged in confidential settlement negotiations and agree to settle the matter by presenting this Stipulated Order to the North Coast Water Board, or its delegate, for adoption as an order by settlement, pursuant to Water Code section 13323 and Government Code section 11415.60.
17. The Prosecution Team has determined that resolution of the alleged violations is fair and reasonable and fulfills its enforcement objectives, that no further action is warranted concerning the alleged violations except as provided in this Stipulated Order, and that this Stipulated Order is in the public’s best interest.
Section III: Stipulations
The foregoing Recitals are incorporated herein, and the Parties stipulate to the following:
Order No. R1-2026-0058
Stipulated Administrative Civil Liability Order
City of Crescent City Wastewater Treatment Facility
18. Jurisdiction: The Parties agree that the North Coast Water Board has subject matter jurisdiction over the matters alleged in this action and personal jurisdiction of the Parties to this Stipulated Order.
19. Administrative Civil Liability: The Discharger hereby agrees to the imposition of an administrative civil liability of $258,000 to resolve the violations alleged herein.
In accordance with the Enforcement Policy and Water Code section 13385, subdivision (k), the Parties agree that the entire liability associated with the violations contained in Exhibit A will be suspended pending completion of a CP as detailed in paragraph 20 below and in the attached CP Proposal (Exhibit B), which is incorporated herein by reference.
20. CP Description: The Discharger proposes to fund and construct a series of infrastructure improvements to achieve compliance with NPDES permit effluent limitations and prevent future exceedances during periods of high flows. The Discharger believes that the source of the effluent limitation exceedances is elevated wet-weather flows at the Facility caused by inflow and infiltration (I/I) into the sanitary sewer collection system. The CP consists of localized collection system infrastructure repairs: installing 13 cured-in-place pipe (CIPP) patches and 600 linear feet of CIPP block repairs to rehabilitate approximately 4,500 linear feet of sewer collection lines across the A-Street S-Curve and Harding subdivisions.
These collection system improvements are intended to mitigate I/I, thereby reducing wet weather peak flows and enabling the treatment facility to maintain full tertiary treatment operations. The CP will be completed no later than December 31, 2027, at a total estimated cost of $300,300. The complete CP description, project milestones, budget, and reporting schedule are contained in Exhibit B, which is incorporated herein by reference.
21. CP Milestone Requirements: The Discharger agrees that this Stipulated Order includes the Milestone Requirements set forth in Table 3 below. The Discharger agrees that credit towards the suspended liability amount upon completion of any Milestone Requirement is contingent on the North Coast Water Board’s or its delegate’s adoption of this Stipulated Order. The implementation schedule for completion of the CP and current completion status for milestones are set forth below:

22. Representations and Agreements Regarding the CP:
a. As a material condition of the North Coast Water Board’s acceptance of this Stipulated Order, the Discharger agrees that it will use the suspended liability to implement the CP, in its entirety and in accordance with the schedule in Table 3.
b. The Discharger agrees that the North Coast Water Board has the right to require a third-party audit, at the Discharger’s expense, of the funds expended to implement the CP, and that the Discharger bears ultimate responsibility for meeting all deadlines specified in this Stipulated Order.
23. Certification of CP Completion: The Discharger must submit a written Certification of CP Completion to the designated North Coast Water Board contact identified in Section III, paragraph 31 below, by the due date in Table 3. A responsible official for the Discharger must submit a Certification of CP Completion, signed under penalty of perjury, that includes the following:
Order No. R1-2026-0058
Stipulated Administrative Civil Liability Order
City of Crescent City Wastewater Treatment Facility
a. Certified statement that the Discharger completed the CP in accordance with the terms of this Stipulated Order.
b. Certification documenting expenditures to implement the CP. Expenditures may include external payments to outside vendors and other costs directly associated with completing the CP, including the work undertaken to complete and submit the Certification of CP Completion. In preparing the certification, the Discharger may rely upon normal organizational project tracking systems that capture employee time and external payments to outside vendors, such as environmental and information technology contractors or consultants. The Discharger must provide photographs, invoices, receipts, certifications, and other materials reasonably necessary for the North Coast Water Board to evaluate CP completion and verify the costs incurred.
c. Confirmation that the Discharger followed all applicable environmental laws and regulations in implementing the CP, including the CEQA, California Water Code, and the federal Clean Water Act.
The Discharger shall provide North Coast Water Board staff with any additional information reasonably necessary to verify the Discharger’s CP expenditures and completion.
24. Publicity Associated with the CP: Should the Discharger or its agents or subcontractors publicize one or more elements of the CP, they shall state in a prominent manner that the project is undertaken as part of a settlement of a North Coast Water Board enforcement action against the Discharger.
25. Progress Reports and Inspection Authority: The Discharger agrees to submit to the North Coast Water Board progress reports in implementing the CP as described in Exhibit B. The Discharger agrees that North Coast Water Board staff has permission to observe and inspect the CP at any time during normal business hours without notice.
26. North Coast Water Board Acceptance of Completed CP: Upon the Discharger’s satisfaction of its obligations under this Stipulated Order, completion of the CP, and any audits, the Executive Officer will issue a “Satisfaction of Order.” The Satisfaction of Order shall terminate any further obligations of the Discharger under this Stipulated Order and permanently suspend the remaining penalty amount.
27. Time Extension for the CP: The Executive Officer (or her/his designee) may extend the deadlines contained in this Stipulated Order if the Discharger demonstrates delays from unforeseeable contingencies, provided that the Discharger continues to undertake all appropriate measures to meet its deadlines.
Order No. R1-2026-0058
Stipulated Administrative Civil Liability Order
City of Crescent City Wastewater Treatment Facility
Once discovered that a deadline extension is needed, the Discharger shall make any deadline extension request in writing at least 30 days prior to the applicable deadline if feasible. Under no circumstances may the completion of the CP extend past five (5) years from the effective date of this Stipulated Order. Any approval of an extension by the Executive Officer must be in writing expressly referencing this Stipulated Order. Under no circumstances may the completion of the CP extend past five (5) years from the effective date of this Stipulated Order.
28. Failure to Expend All Suspended Funds or Complete the Approved CP: If (1) the CP is not fully implemented by December 31, 2027 (CP Completion Date) and no extension is granted by the Executive Officer (or her/his designee) within the 5- year statutory period, or (2) the Discharger is unable to demonstrate to the reasonable satisfaction of the Executive Officer that the entire suspended liability amount was spent on the completed CP by the CP Completion Date, or (3) there has been a material failure to satisfy a project milestone, North Coast Water Board staff shall issue a “Notice of Violation” to the Discharger. As a consequence, the Discharger shall be liable to pay the entire suspended liability amount, less any amount that has been permanently suspended or excused based on the timely and successful completion of any interim project milestone that has an identifiable and stand-alone environmental benefit. Unless the North Coast Water Board or its delegate determines otherwise, the Discharger shall not be entitled to any credit, offset, or reimbursement from the North Coast Water Board for expenditures made on the CP prior to the Notice of Violation’s issuance date. The amount of the suspended liability owed shall be determined via a written, stipulated agreement between the Parties or, if the Parties cannot reach an agreement on the amount owed, via a “Motion for Payment of Suspended Liability” before the North Coast Water Board or its delegate. Within 30 days of the North Coast Water Board’s or its delegate’s determination of the suspended liability assessed, the Discharger shall pay the amount owed to the “State Water Pollution Cleanup and Abatement Account.” Within 30 days of the North Coast Water Board’s or its delegate’s determination of the suspended liability amount assessed for the Discharger to pay, the Discharger shall submit payment consistent with the payment method described below. Payment of the assessed amount shall satisfy the Discharger’s obligation to implement the CP.
a. The Discharger shall submit payment of the entire Suspended Liability, less any amount that has been permanently suspended or excused based on the timely and successful completion of any interim project milestone that has an identifiable and stand-alone environmental benefit, within 30 days of the North Coast Water Board’s or its delegate’s determination that the Discharger failed to demonstrate that the entire Suspended Liability was spent to complete the CP. The check must be made payable to the State Water Pollution Cleanup and Abatement Account, reference Order R1- 2026-0058, and mailed to:

33. Matters Addressed by Stipulation: Upon adoption by the North Coast Water Board or its delegate, this Stipulated Order represents a final and binding resolution and settlement of the alleged violations as of the effective date of this Stipulated Order. The provisions of this paragraph are expressly conditioned on the completion of the CP as specified herein.
34. No Waiver of Right to Enforce: The failure of the Prosecution Team or North Coast Water Board to enforce any provision of this Stipulated Order shall in no way be deemed a waiver of such provision, or in any way affect the validity of this Stipulated Order.
The failure of the Prosecution Team or North Coast Water Board to enforce any such provision shall not preclude it from later enforcing the same or any other provision of this Stipulated Order. No oral advice, guidance, suggestions or comments by employees or officials of any Party regarding matters covered under this Stipulated Order shall be construed to relieve any Party regarding matters covered in this Stipulated Order. The North Coast Water Board reserves all rights to take additional enforcement actions, including without limitation, the issuance of administrative civil liability complaints or orders for violations other than those addressed by this Stipulated Order.
35. Attorney’s Fees and Costs: Except as otherwise provided herein, each Party shall bear all attorneys’ fees and costs incurred by each Party in connection with the matters set forth herein.
36. Public Notice: The Discharger understands that this Stipulated Order must be posted for a 30-day public review and comment period prior to consideration by the North Coast Water Board or its delegate. If significant new information is received that reasonably affects the propriety of presenting this Stipulated Order to the North Coast Water Board, or its delegate, for adoption, the Prosecution Team may unilaterally declare this Stipulated Order void and decide not to present it to the North Coast Water Board or its delegate. The Discharger agrees that it may not rescind or otherwise withdraw its approval of this Stipulated Order once signed.
37. Addressing Objections Raised During Public Comment Period: The Parties agree that the procedure contemplated for the North Coast Water Board’s or its delegate’s adoption of the Order, and public review of this Stipulated Order is lawful and adequate. The Parties understand that the North Coast Water Board, or its delegate, have the authority to require a public hearing on this Stipulated Order.
In the event procedural objections are raised or the North Coast Water Board requires a public hearing prior to the Order becoming effective, the Parties agree to meet and confer concerning any such objections and may agree to revise or adjust the procedure and/or this Stipulated Order as necessary or advisable under the circumstances.

38. Interpretation: This Stipulated Order shall be construed as if the Parties prepared it jointly. Any uncertainty or ambiguity shall not be interpreted against any one Party. The Parties are represented by counsel in this matter.
39. If Order Does Not Take Effect: In the event that the Order does not take effect because the North Coast Water Board or its delegate does not approve it, or the State Water Board or a court vacates it in whole or in part, the Parties acknowledge this matter may proceed to a contested evidentiary hearing before the North Coast Water Board to determine whether to assess administrative civil liability for the underlying alleged violation(s), unless the Parties agree otherwise.
The Parties agree that all oral and written statements and agreements made during settlement discussions are confidential and will not be admissible as evidence in the hearing. The Parties agree to waive any and all objections based on settlement communications in this matter, including, but not limited to the following:
a. Objections related to prejudice or bias of any of the North Coast Water Board members or their advisors and any other objections that are premised in whole or in part on the fact that the North Coast Water Board members or their advisors were exposed to some of the material facts and the Parties’ settlement positions as a consequence of reviewing the Stipulated Order, and therefore may have formed impressions or conclusions prior to any contested evidentiary hearing on the violations alleged in this matter; or b. Laches or delay or other equitable defenses based on the time period for administrative or judicial review to the extent this period has been extended by these settlement proceedings.
40. Waiver of Hearing: The Discharger has been informed of the rights Water Code section 13323, subdivision (b), provides, and hereby waives its right to a hearing before the North Coast Water Board prior to the Order’s adoption. However, the Discharger may appear at any North Coast Water Board hearing where approval of this settlement is discussed. If the settlement is not adopted and the matter proceeds to the North Coast Water Board or State Water Board for a hearing, the Discharger does not waive its right to an adjudicatory hearing before any order other than this Stipulated Order is imposed.
41. Waiver of Right to Petition or Appeal: The Discharger hereby waives its right to petition the North Coast Water Board’s adoption of the Order for review by the State Water Board, and further waives its rights, if any, to appeal the same to a California Superior Court and/or any California appellate level court.

No oral advice, guidance, suggestions, or comments from North Coast Water Board employees or officials regarding submissions or notices shall be construed to relieve the Discharger of its obligation to obtain any final written approval this Stipulated Order requires.
44. Modification: The Parties shall not modify this Stipulated order by oral representation made before or after its execution. All modifications must be in writing, expressly referencing this Stipulated Order, signed by all Parties, and approved by the North Coast Water Board or its delegate.
45. No Admission of Liability/ No Waiver of Defenses: In settling this matter, the Discharger does not admit to liability, admit to the truth of the findings or allegations made by the Prosecution Team, or admit to any of the findings in this Stipulated Order or Exhibit A, or admit to any violations of the Clean Water Act, the Water Code, any Regional or State Water Board order, or any other federal, state or local laws or ordinances, but recognizes that this Stipulated Order may be used as evidence of a prior enforcement action consistent with Water Code sections 13327 and 13385, subdivision (e), and the State Water Board’s Water Quality Enforcement Policy, which is available at:
https://www.waterboards.ca.gov/water_issues/programs/enforcement/docs/2024/2 024-enforcement-policy.pdf. By entering into this Stipulated Order, Discharger does not waive any defenses or arguments related to any new enforcement action that may be brought by the North Coast Water Board, including any brought under its discretionary enforcement authority reserved herein.

Subject: Proposed Compliance Project to Address Mandatory Minimum Penalties Incurred from January 1, 2024 through March 23, 2026 (City of Crescent City Wastewater Treatment Facility, WDID 1A84006ODN; NPDES Permit No. CA0022576) Dear Mr. Herman,
The City of Crescent City (City) is planning to repair various sewer lines within the community to address $258,000 in Mandatory Minimum Penalties (MMPs) assessed by the North Coast Regional Water Quality Control Board for violations of Order No. R 1-2025-0034. These violations were associated with effluent limit exceedances that occurred between January 1, 2024, and August 1, 2025, under Waste Discharge Requirements (WDR) Order No.
R 1-2023-0039.
The City's Wastewater Treatment Plant (WWTP) serves a small disadvantaged community as defined in the State Water Resources Control Board's Water Quality Enforcement Policy (2017).
As a result, the City is eligible and requesting to apply the entire penalty amount toward a Compliance Project designed to correct the underlying causes of the violations.
Background:
Chronic violations including exceedances of chlorine, total residual chlorine, settleable solids, ammonia (as N), enterococci, and total coliform occurred during high-rainfall periods when influent flows exceeded the WWTP's ability to process 100 percent of the flow through the Membrane BioReactor (MBR) tertiary treatment system, which is limited to 1.1 million gallons per day (MGD). On days when flows surpassed this capacity, excess flow was necessarily diverted to the Rotating Biological Contactor (RBC) system, which does not provide tertiary treatment and therefore cannot meet the new effluent limits.
On June 6, 2025, the North Coast Regional Water Quality Control Board issued Time Schedule Order No. R 1-2025-0015, granting temporary exceptions to the enterococci and total coliform limits during periods when facility flows exceed 1.1 MGD. Under this order, the WWTP is allowed to meet the effluent limits of the previous WDR (R 1-2017-0002) until April 1, 2030, unless a permanent solution is implemented sooner.
The City is concurrently pursuing a State Water Resources Control Board forgivable loan to fund a comprehensive WWTP upgrade that would increase the tertiary treatment ability and ensure compliance with WDR Order No. R1-2023-0039. Assuming full funding and no delays, construction is anticipated to be completed by October 2035.

Because the timeline and cost of the required permanent corrective actions exceed what can be accomplished under an MMP project, the City proposes a more limited, targeted project to repair selected sewer collection mains. The goal is to reduce inflow and infiltration (l&I) during storm events, thereby enabling the VvWTP to maintain 100 percent tertiary treatment more frequently and reducing the risk of future effluent violations.
Project Description:
In 2023, the City conducted a comprehensive condition assessment of the collection system, evaluating all sewer lines and manholes within the city using PACP grading. The assessment identified locations with broken, damaged, or deteriorated sewer lines that contribute to excessive l&I. The City proposes to rehabilitate sewer lines rated PACP Grade 4 or 5 by installing cured-in-place pipe (CIPP) liners at sites where fractures or breaks are present. In areas where pipes are collapsed, offset, obstructed, or shattered, more extensive open-trench replacement will be required.
CIPP installation involves inserting a resin-saturated liner into the existing pipe from the nearest manhole using a trenchless method. The liner is inflated to match the pipe shape and then cured in place, creating a new, seamless, structurally sound pipe within the old one. Prior to installation, the existing pipe will be cleaned of roots, debris, sediment, or fats/oils/grease (FOG) and dried.
Where lateral connections exist, the liner will cover the connection, after which a new opening will be cut and a short lateral liner installed to create a watertight joint. This process provides both structural rehabilitation and a sealed barrier against intrusion.
The proposed repairs will rehabilitate approximately 4,500 linear feet of sewer collection lines that convey flow to the City's VvWTP.

Project Benefits:
In 2024, the \NWTP recorded a minimum dry-weather influent flow of 0.77 MGD. Between January 1 and March 30, 2025, the average daily wet-weather flow increased to 2.316 MGD, with daily flows ranging from 1.257 to 5.337 MGD. Assuming the increase in influent during wet-weather conditions is attributable to inflow and infiltration (1&1), repairing approximately 1.7 percent of the system's total linear footage is conservatively expected to reduce infiltration by an estimated 26,000 gallons per day.
Project Estimate:
The table below presents the preliminary cost estimate for the proposed project. Final costs will depend on contractor bids to be received at a later date. The project is scalable: additional repair locations may be added to meet the Water Board's requirements for MMP offset funding, or the scope may be reduced to remain within available resources.
