deferred to Director Vosburg. Executive Director Vosburg addressed Council Member Shamblin’s question; she stated that they analyze what the return to investment is annually and compare it against several other counties. It was 4 years ago when it went out to bid and they continue to work with Lynnette Braillard with LuLish. Director Vosburg spoke about her own background in marketing. Director Vosburg spoke in detail about what the Agreement will outline between the City and the Crescent City - Del Norte Chamber of Commerce. 9. Settlement Agreement and Stipulation for Entry of Administrative Civil Liability Order with the California Regional Water Quality Control Board • Recommendation: Hear staff report
• Technical questions from the Council
• Receive public comment
• Further Council discussion
• Authorize the City Manager to sign order R1-2026-0058 Settlement Agreement for entry of administrative liability order
City Manager Wier explained that since the implementation of stricter effluent standards under the Wastewater Treatment Plant’s new NPDES permit, the facility has experienced effluent limitation exceedances during heavy periods of precipitation caused by inflow and infiltration (I&I).
The Regional Water Quality Control Board (RWQCB) tied 86 effluent violations to mandatory minimum penalties totaling $258,000. In lieu of assessing these penalties, the RWQCB has agreed to allow us to spend the equivalent amount on a compliance project. The compliance project is a proposed repair to use a trenchless rehabilitation method called “Cured in Place Pipe” (CIPP). This allows for repair without excavation. City Manager Wier explained the process for the CIPP. Council Member Shamblin asked if this will help reduce the inflow of storm water; City Manager Wier stated it will help but will not eliminate all of the infiltration and inflow issues in the collection system.
Jody Mangum: stated that I&I has always been a problem; she further stated there has been less rain than in the past.
Sam Strait; spoke about money being spent on the pipes for stormwater, however, there are several multi-family units being built.
Cate Classen: asked how tourism affects the functionality of the WWTP.
Tom Beers: spoke about reversing the flow and building an additional WWTP.
Council Member Shamblin stated that his first question was about capacity when he served on the Planning Commission. Further stated there have been multiple reports that answer the capacity question and that the WWTP does have the capacity. City Manager Wier explained further that the problem is the ground water. The MBR can meet the new water quality. A good example was the 4th of July, the WWTP handled that capacity with an increase in people in the community using water and sewer. It doesn’t matter if we hook another person up to the system, it’s the wet weather events that are creating the problem, not the connections.
On a motion by Council Member Altman, seconded by Mayor Pro Tem Tinkler, and carried on a 5-0 polled vote, the City Council of the City of Crescent City authorized the City Manager to sign order R1-2026-0058 Settlement Agreement for entry of administrative liability order.

On a motion by Mayor Pro Tem Tinkler, seconded by Council Member Shamblin, and carried on a 5-0 polled vote, the City Council of the City of Crescent City approved and adopted Resolution No. 2026-66, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CRESCENT CITY APPROVING AMENDMENT NO. 1 TO THE EMPLOYMENT AGREEMENT WITH CITY ATTORNEY MARTHA RICE.
CITY COUNCIL ITEMS
➢ Reports, Concerns, Referrals, Council travel and training reports – Council Member Greenough: spoke about the training he received at the recent League of California Cities Annual Conference.
Mayor Pro Tem Tinkler: echoed the training sessions she took along with Council Member Greenough. She appreciated seeing those stepping up to serve their communities were of the younger generation and it encouraged her. She took advantage of networking and learned there were a lot of common concerns bigger cities experience along with Crescent City.
Council Member Shamblin: asked about lower rates for low income and seniors; would like a better explanation of why it is being said we cannot do that when other public utilities do it. City Attorney Rice stated that we cannot offer separate rates from within the sewer or water funds, they would need to be subsidized by the general fund or grants; rates cannot discriminate between age or income level. Council Member Shamblin asked for grant funding to be sought after; City Manager Wier agreed it can be discussed further, however, the water/sewer rates need to be equitable.

City Manager Wier went over the recruitment and selection process for the position of Fire Chief.
The interviewing team selected Mr. Lance Selph to fill that position. He further reported to the Council and Board Mr. Selph’s background, training, and personality traits that made him a great fit for the Department. Regarding the Employment Agreement, the section entitled Excess Duty Coverage Compensation, City Manager Wier reported one change was being requested. In recognition of the Fire Chief’s sacrifice and service, the compensation for each 12-hour day shift as primary duty officer will increase from $175 to $200 for shifts in excess of 7 shifts in any given calendar week. The Agreement further states that the Fire Chief will only provide additional primary duty officer coverage beyond 7 shifts per week when there are no volunteers available to fill the shift.
Council Member Altman asked since we have a new Fire Chief, will Interim Chief Gillespie be retiring; City Manager Wier explained that not only will Chief Gillespie help with the transition, it is also his intention to stay on as extra help. Chief Gillespie addressed the Council and Board outlining his interactions with Mr. Selph and how he agrees that Mr. Selph’s experience, training, and personality are a good fit for the Department.

SUBJECT: ACCEPTANCE OF INSURANCE REIMBURSEMENT FOR POLICE
DEPARTMENT VEHICLE
______________________________________________________________________
RECOMMENDATION
• Accept an insurance reimbursement from Golden State Risk Management Authority (GSRMA) in the amount of $47,137.00 related to the total loss of a Crescent City Police Department Chevrolet Tahoe
• Approve and adopt Resolution No. 2026-68, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2026-27 BUDGET
BACKGROUND
The Crescent City Police Department experienced the loss of a patrol Chevrolet Tahoe following a vehicle collision that resulted in the unit being deemed a total loss. The incident was processed through the City’s insurance carrier, Golden State Risk Management Authority (GSRMA). After review, GSRMA approved a reimbursement claim.
ANALYSIS
GSRMA completed a market value analysis of the vehicle based on make and model, age, mileage, equipment, location, and condition. The estimated value, based on comparable vehicles for sale, is $47,137. The insurance settlement will be $46,137 (market value less the City’s deductible). Acceptance of these funds will allow the Police Department to begin the process of replacing the vehicle, which is essential for maintaining adequate patrol operations and ensuring timely response capabilities.
A budget adjustment is required to receive and appropriate the reimbursement amount within the current fiscal year.

CITY COUNCIL AGENDA REPORT
TO: MAYOR WRIGHT AND MEMBERS OF THE CITY COUNCIL
FROM: ERIC WIER, CITY MANAGER
BY: DAVID YEAGER, PUBLIC WORKS DIRECTOR
JAMES QUEEN, ENGINEERING PROJECT MANAGER
DATE: OCTOBER 19, 2026
SUBJECT: TASK ORDER #25 FOR FY 26-27 PLANNING SERVICES

RECOMMENDATION
• Hear staff report

BACKGROUND
As part of the City’s strategic planning workshop in 2019, Council directed staff to move forward with contract planning services to provide basic planning support and technical expertise. The City signed a Professional Services Agreement on February 19, 2019 with SHN Consulting Engineers & Geologists, Inc. Pursuant to that agreement, SHN provided engineering and planning services to the City for the next three years.
Over the course of those three years, SHN performed tasks covering general inquiries, Business Licenses, Sign Permits, Building Permits, Use Permits (including Cannabis Use Permits), and special projects as requested. In anticipation of the contract expiration, the City Council directed City staff to issue a new request for qualifications on February 15, 2022 for City-wide planning and engineering related services. Qualifications were received from 12 engineering, planning, architectural, environmental, and professional services firms. SHN was selected to provide engineering and planning services to the City on an as-needed basis. SHN signed the five-year Agreement for Professional Services on May 30, 2022.
ITEM ANALYSIS
The City continues to require the services of an engineering and planning firm to handle general inquiries, business licenses, sign permits, building permits, and special use

HOUSING AUTHORITY BOARD AGENDA REPORT
TO: CHAIR WRIGHT AND MEMBERS OF THE BOARD
FROM: ERIC WIER, CITY MANAGER
BY: MEGAN MILLER, HOUSING DIRECTOR
DATE: OCTOBER 19, 2026
SUBJECT: 2027 UTILITY ALLOWANCE SCHEDULES FOR HCV PROGRAM ______________________________________________________________________
RECOMMENDATION
• Approve and authorize the 2027 utility allowance schedules for the Housing Choice Voucher program.
BACKGROUND
Under the HCV program, the total tenant payment of rent includes both shelter and the costs for reasonable amounts of utilities which are not supplied by the owner. The amount that a public housing authority (PHA) determines necessary to cover the tenant’s reasonable utility costs is called the utility allowance. Separate schedules are maintained for single family detached (house) rental units and apartment/townhouse/duplex units.
The utility allowance schedule is based on the typical cost of utilities and services paid by energy-conservative households that occupy housing of similar size and type in the same locality. The objective is to establish allowances based on actual rates and average consumption estimates and should provide participating families with an allowance that is adequate to cover expected average utility costs and other services over a 12-month period. Non-essential utilities, such as telephone and cable, are not included.
ANALYSIS
The utility allowance schedules are reviewed annually. The review was performed by Nelrod, a company specializing in rate and consumption analysis. Their analysis revealed the following changes:
• ELECTRICITY: Baseline energy rates decreased by 11% from the values represented in last year’s schedules, while the monthly charges increased by 74%.
The bi-annual California Climate Credit changed from $259 to $111 which is reflected under the “other electric” values.
• BOTTLE GAS/PROPANE: The cost for propane decreased by 2% from the values represented in the previous year’s schedules. For the proposed 2027 schedules, the average fuel rate between suppliers Blue Star Gas and Suburban Propane calculates at $5.43 per gallon.
• KEROSENE: The cost for kerosene increased by 21% from the values represented in the previous year’s schedules and calculates at $5.39/gallon. • WATER/SEWER: Water monthly fixed rates increased 56%, and monthly usage charges decreased by 14%. Sewer monthly charges increased by 36%. • GARBAGE: The cost for garbage increased by 2% from the values represented in the previous year’s schedules. The rate for garbage and recycling collection (64 gallons per month) calculates at $55.11.
Implementation of the revised utility allowance schedules will go into effect immediately for all new admissions and for any participant families moving from one unit to another.
They will otherwise become effective at the time of each participant family’s annual recertification in 2027.
FISCAL IMPACT
Families leasing a unit with a gross rent at or below the payment standard may see a slight increase to their portion of rent where applicable allowances have decreased, and a slight decrease to their portion of rent where applicable allowances have increased.
Families leasing a unit where the gross rent exceeds the payment standard will see no impact. Most families in the CCHA program live in apartments where the property owner pays most of the utilities, and the families pay only electricity. For families who pay water and sewer bills (approximately 64 families currently), some of them may see a decrease in their required portion of the rent payment due to the increase in utility bills.

HOUSING AUTHORITY BOARD AGENDA REPORT
TO: CHAIR WRIGHT AND MEMBERS OF THE BOARD
FROM: ERIC WIER, CITY MANAGER
BY: MEGAN MILLER, HOUSING DIRECTOR
DATE: OCTOBER 19, 2026
SUBJECT: PUBLIC HEARING ON REVISION OF ADMINISTRATIVE PLAN FOR
HOTMA IMPLEMENTATION
____________________________________________________________________
RECOMMENDATION
• Open the public hearing
o Hear staff report
o Technical questions for staff
o Receive public comment
• Close the public hearing
• Further Board discussion
• Approve and adopt Resolution No. HA2026-02, A RESOLUTION OF THE BOARD OF
DIRECTORS OF THE CRESCENT CITY HOUSING AUTHORITY AMENDING THE
ADMINISTRATIVE PLAN FOR THE HOUSING CHOICE VOUCHER PROGRAM
BACKGROUND
The Housing Opportunity Through Modernization Act of 2016 (“HOTMA”) introduced significant reforms to the Housing Choice Voucher (“HCV”) program. HUD’s final rule, published in 2023 and fully effective as of January 1, 2027, updates income calculations, eligibility standards, and several administrative processes. The intent is to streamline operations, reduce administrative burden, and ensure fairer and more consistent subsidy determinations across Public Housing Authorities.
ANALYSIS
To ensure full compliance with HOTMA, CCHA’s Administrative Plan must be updated. The revisions, summarized in the attached document, affect income calculations, asset policies, eligibility standards, and ongoing program administration. Revision of the Administrative Plan is considered a significant program amendment and therefore requires a public hearing and adoption by Board resolution. The Housing Advisory Commission has reviewed and approved the proposed changes. All program participants have been notified of the upcoming changes and provided an opportunity to review and comment on Administrative Plan revisions. The entire plan, with all proposed revisions, is available on the City’s website under the Housing Authority Department page.
Attachment 1 summarizes revisions by chapter. While language throughout the Administrative Plan has been updated to correspond with language in current HUD publications and provide clarification, the emphasis of this report will be on the key discretionary HOTMA-related policies impacting families.
FISCAL IMPACT
None.

SUBJECT: POSITION CONTROL ADJUSTMENT – POLICE RECRUIT AND PARTTIME BUILDING INSPECTOR ______________________________________________________________________
RECOMMENDATION
• Hear staff report

• Further Council discussion
• Approve and adopt Resolution No. 2026-69, A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF CRESCENT CITY AMENDING THE FISCAL YEAR 2026-27 POSITION CONTROL OF THE CITY OF CRESCENT CITY
BACKGROUND
Police Recruit
The current position control authorizes 10 FTEs (full-time equivalents) in the category of Officer or Recruit. The Crescent City Police Department (CCPD) currently has 8 active Officers, one Recruit in the academy, and one Officer on leave pending a disability retirement.
Building Inspector
The City currently has one full-time and one part-time Building Inspector. The part-time position is currently being filled by a CalPERS retired annuitant to assist the City with the current surge in building permit inspections, particularly the additional workload generated by the 162-unit Battery Point housing project. Construction of this project is expected to continue through 2027. However, CalPERS retired annuitants may only work a limited number of hours per fiscal year and only in specific roles. The appointment for the current retired annuitant, Mr. Minges, ends on December 31, 2026, and CalPERS has indicated it will not approve an extension.
Position Control Amendment
October 19, 2026
2 ITEM ANALYSIS
Police Recruit
The CCPD has one officer who has been on extended leave pending disability retirement.
The City is working with CalPERS on this matter, and the position will not technically be vacant until CalPERS makes a final determination. Staff does not know how long this will take, but we expect the decision sometime in the next several months. In the meantime, the department is operating short-staffed.
In order to fill the upcoming vacancy, the Chief would like to hire another recruit to send to the next academy. The recruit would be hired in December to start training and learning department policies, and then the academy begins in January 2027.
Since we do not have an exact date the pending disability retirement will be decided, there is a possibility the new recruit would need to be hired prior to the other officer’s official separation. If we wait until we have the decision from CalPERS, it is likely we will not have enough time to fill the recruit position (including background checks, etc.) prior to the academy beginning.
There was a recruitment in May of this year, which resulted in one recruit being hired who is now in the academy. The City maintains an eligibility list from the prior recruitment, which is valid for 12 months. An eligible candidate from this list could be selected without having to start another recruitment.
In order to accomplish this, staff is requesting an increase in the authorized FTEs in the Officer / Recruit category of 0.58 FTE. This will cover any potential overlap of the new recruit and the officer pending retirement. In the next budget cycle, the total FTEs would be reduced to the usual number (10).
Building Inspector
In June of 2026 the City hired Josh Clark to fill the full-time Building Inspector position. In addition to the full-time position, a part-time retired annuitant position was authorized for extra help. However, the retired annuitant position can only be authorized for up to 960 hours per fiscal year and only in certain circumstances (interim position while being recruited or extra help, and only for a limited amount of time). The current retired annuitant is authorized through December 31, 2026.
To give Mr. Clark the support he will need to keep up with the Battery Point project in addition to other City and Housing Authority inspections, staff is recommending that a part-time Building Inspector / Code Enforcement Officer be hired during continuation of the construction of the Battery Point project. This position would be anticipated to work approximately 26-28 hours per week.
In order to fill this position, the position control will need to be increased by 0.73 FTE.
Position Control Amendment
October 19, 2026
3 FISCAL ANALYSIS
Neither of these proposed changes requires a budget amendment. The police staffing budget is sufficient to cover the additional recruit position due to vacancies. The building inspection position will be paid for out of the permit fees from the Battery Point project, for which the budget adjustment was already approved at the September 21, 2026 Council meeting by Resolution No. 2026-61.
STRATEGIC PLAN ASSESSMENT
This report is consistent with Strategic Plan Goal 3 to recruit and retain highly qualified employees.
